CC RESOLUTION 427<. r V ) RESOLUTION 110. 427- 1 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIPOirIA, ESTABLISH - ING .2UL:'sS AIM REGULATIONS RELATING TO THE FILING _1ND GRANTING OF APPLICATIONS FOR T�XPORARY P R1,11TS TO INSTALL, LAY, REPAIR, MOVE OR ABANDON PIPE LINES IN THE PUBLIC STREETS AND PLACES OF SAID CITY. The City Council of the City of El Segundo, Cali- fornia, does resolve, declare and determine as follows: SECTION 1. That any person, firm, association or corporation desiring to install, lay, repair, remove, or abandon any pipe or pipe line for any purpose whatsoever In any of the public streets, avenues, roads, lanes, allays or highways or public places within said Oity, before install- ing, laying, repairing, removing or abandoning the same or making any excavation or doing any work in any of said public streets, etc., with reference thereto, must first obtain a written permit so to do from the City Council of said City, it such installation is, or is to be, a longitudinal installa- tion along such street, or from the Street Superintendent of said City if such installation is, or is to be, a lateral installation across such street. 1ny pipe or pipe line which is to be installed, or which has been installed, which is to occupy or which occupies a distance along the line of the street greater than the width of the street, shall be deemed a longitudinal installation within the meaning of this resolution, SECTION 20 That applications for all such in- stallations, laying, repair, or removal or abandonment must be made on forms furnished by said City and contain the in- formation called for therein. The City Council reserves the right to refuse to consider any application not so filed. 1- SECTION 3. The undersigned will comply with all laws of the State of California, and laws, rules and regulations of the Division of Highways of said State and of the City of ffi Segundo, relating to such lines, There is attached hereto a map or plat (in a scale not less than 100 feet to the inch), which fully and correctly indicates the location, extent and oharacter of the said pipe line_, and said map is hereby referred to and by this reference expressly incorporated herein and made a part hereof, 2- Applicant understands that certain terms and conditions may be imposed under and pursuant to which such permit may be granted, and does hereby state and represent for the purpose of inducing the granting of such permit, that each and all of such terms and conditions will be observed, met and performed with due diligence by the applicant in the event each permit be accepted by applicant. It is understood that any amount not required for making such repairs or restoration by said City will be refunded to the undersigned, and that the undersigned shalls and does hereby promise too pay any amount over and above the sum reasonably necess- ary in order to accomplish such repairs or restora- tion to the satisfaction of the Street Superintendent of said City. In the erossinp of streets Navin{-- permanent pavement in pl,.ce, all pipes, lines, etc., shall be placed in casin. 2. All casing containing pipes, linos, etc., in- stalled for the crossing of streets havin',; permanent pavement in plc:,ce shall be installed by hacking said casinL under the pavement. 5- J� 5 I ,. 3. The Street Superintendent shall in all cases determine whether or not the pavement involved is or is not permanent pavement. 4. All casing containing pipes, lines, etc., in- stalled for the crossing of streets having permanent pavement in place shall be of sufficient length so as to clear the paved portion of the street by at least four and one -half (4 1/2) feet excepting in the case of casing installed under Sepulveda Boulevard in which instance said casing, shall be of sufficient length so as to clear by at least one foot on each side, the roadway of aepalveda Boulevard between curbs. 5. All casing, ,jipes, lines, etc., shall be install- ed in such a manner and at such a depth under the surface of the street so as to provide a cover of at least tao (2) feet, except in the case of casing, pipes, lines, etc., installed under Sepulveda Boulevard where said casing, pines, lines, etc., shall be installed in such a manner and at such a depth under the surface of the Boulevard so as to provide a cover of at least three (3) feet. 6. here it is necessary, and allo�Rjed, for excavation across any street for the purpose of installing pipes, lines, etc., no more than one -half (1 /2) of the travelled way shall be barricaded or closed at one time, and in no case shall such excav -tion be left open for a lon er ,eriod than twenty -f oar (24) boars. 7. All excavations shall be proyerly protected a;t all times by barriers, lanterns, flares, sifgnu, flag- 6- <z r r men or other means providing° for the safety OT life and property. S. The backfillin� of all excavations shall be done in a workmanlike manner to the satisfaction of the Street 3ularintendent, and when said b,ckfill reaches in a trench less than three (3) feet in depth, a point six (6) inches from the natural „rade of the surface, said bwekfill shall be thoroughly flooded and poled. In trenches deeper than three (-�) feet the came shall be flooded and poled in t,co (`-') moot layers. 9. Upon the completion of the backfillin,- of any excavation in a public street, notification of such completion shall be given to the ;3trect Superintendent. 10. Before comnencin� any work hereunder, reasonable notice shall be Siven the Street superintendent so as to permit a convenient inspection of such work as same progrresses, and all work must be performed to the satisfr.etion of the Street �uperintcndent„ and all materiels must be -),-.-).rov- ed by him. 11. fhe permittee shall promptly re�,air any and all leaks in such line or lines, and any deinatge to pub lic .�-roperty o; ary kind .rhich xa result from such leaks or otherv.ise, at perr.iittee's own cost anu expense, and to the satisfaction of the, street 3u )eTintendent. 12. The Street :)u,x:rintendent shall determine whether or not any line or lines is or arc to be instalied in excavations, or whether s -je are i o be , achea any for bored under tn.- surce6. 7- .fir. 13. Within thirty days after completion of any work of installation, tvo full, true end correct maps showing the lines and/or appur- tenanoes and the location thereof exactly as same have been installed, shall be filed with the City Clerk, who shall deliver one thereof to the Street Superintendent of said City. 14. The applicant at the time of making application for the permit hereinabove referred to shall deposit with the Street Superintendent of said City, the amount estimated by said Street Superintendent as the fair amount needed to pay the cost of repair by said City, or publio properties which may be disturbed or damaged by the installation, repair, removal or abandonment of any pipe line or appurtenance, or the work or acts involved in the making or doing thereof. It is understood that any amount not required for making such repairs or restoration by said City will be refunded to the applicant, and that the applicant shall promise to pay any amount over and above the sum reasonably necessary in order to accomplish such repairs or restoration to the satisfaction of the Street Superintendent of said City. S. The Street Superintendent shall determine whether or not any line or lines is or are to be insta Us& in exoavations, or whether same are to be jacked and/or bored under the street. 91 Within thirty days after completion of any work of installation, two full, true and correct maps showing the lines and/or appurtenances and the location thereof exactly as same have been install- ed, shall be filed with the City Clerk, who shall deliver one thereof to the Street Supezi ntendent of said City. 10. The applicant at the time of making application for the permit hereinabove referred to shall deposit with the Street Superintendent of said City, the amount estimated by said Street Super- intendent as the fair amount needed to pay the cost of repair by said City, of public properties which may be disturbed or damaged by the installa- tion, repair, removal, or abandonment of azV pipe line or appurtenance, or the work or acts in- volved in the making or doing thereof. It is understood that any amount not required for making such repairs or restoration by said City will be refunded to the applicant, and that the applicant shall promise to pay any amount over and above the sum reasonably necessary in 10- order to accomplish such repairs or restoration to the satisfaction of the Street Superintendent of said City." In case of any dispute arising as to the manner or method in which the work shall proceed, or as to the location thereof, or the materials to be used, the decision of the Street Superintendent shall be final and conclusive, subject only to appeal to the City Council, and its determination of the matter; provided, however, that nothing herein contained shall be construed as making the applicant or any person acting for or on behalf of applicant, as the agent or employee of said City. SECTION 6. That the City Council reserves the right to impose more or less stringent terms and conditions, and additional terms and conditions in connection with any particular application; and the Street Superintendent has likewise reserved and shall have power to make similar more or less stringent terms and conditions and additional terms and conditions in connection with lateral encroachments. SECTION 7. That nothing herein contained shall be construed as applying to the Water Department of said City, or installations made or to be made b- it, as said department will at all times function under the direction and to the satisfaction of the Water Superintendent and the Street Superintendent of said City. SECTION 8. That all permits issued hereunder shall be temporary only and shall be revocable at any time by the City Council of said City without notice, without cause and without liability, and must be accepted by the respective permittees accordingly. SECTION 9. That the permits herein referred to relate to those needed from the City of E1 Segundo only, 11- and any other permit or permits or authority which may be necessary under the law must be obtained by the respective permittees in addition to the permission referred to hereunder. SECTION 10. That the City Clerk shall certify to the passage and adoption of this resolution; shall cause the same to be entered in the book of resolutions of said City and shall make a minute of the passage and adoption thereof in the records of the proceedings of the City Council of said City in the minutes of the meeting at which the same is passed and adopted.
