CC RESOLUTION 334141 -4 RESOLUTION NO. 334. A RESOLUTION OF THE CITY COUNCIL OF TIE CITE OF EL SEGUNDO, CALIFORNIA, GRANTING TO STANDARD OIL COMPANY OF CALIFORNIA A CERTAIN REVOCABLE PERMIT FOR THE IN- STALLATION OF A CERTAIN PIPE LINE ACROSS SEPULVEDA BOULEVARD WITHIN SAID CITY. The City Council of the City of E1 Segundo, California, dose hereby resolve, declare and determine as follows: SECTION 1. That pursuant to its application dated February 7, 1936 therefor, Standard Oil Company of California is hereby granted, upon the terms and condi- tions hereinafter set forth, permission to excavate for, install and maintain a certain pipe line across Sepulveda Boulevard, within the City of E1 Segundo, California, at a point 40 feet South of and parallel with the South boundary line of El Segundo Avenue, as shown marked in red on the blue print designated as N- 10113 -B, prepared by the Engineering Department of said permitter and which is attached to said application, and which said application and blue print are on file in the office of the City Clerk of said City, hereby referred to and by this reference incorporated herein and made a part hereof. SECTION 2. That the pipe line, permission for which is herein granted, is described as follows, to -wit; One 4 inch line, f or the purpose of con- veying crude oil, to be installed in a 12 inch casing for the full width of the boulevard. 1- `��i o That this permission is granted upon the following terms and conditions, to -wit: First: This permit is revocable and may be revoked by the City Council of said City at any time upon thirty days' notice to the permittee, and upon revocation of such permission the said line must be removed by the permittee if so required in the order making such revocation. Second: The pipe line is to be installed and maintained at the sole cost and expense of the per - mittee and must be approximately 5 feet below the top of the present pavement for the full width of the boulevard. Third: 611 excavations or work must be pro- tected at all times so as to avoid injury or damage to persons or property in or upon said boulevard, or immediately adjacent thereto. Fourth: All installations must be made and the said line must be maintained at all times to the satisfaction of the Street Superintendent of said City. Fifth: That the permittee will promptly pay to the said City the full amount of any and all damage which may be occasioned to any public street or public property by reason of the installation, maintenance, use or failure of the said pipe line, or of any in- strumentality used in connection therewith, or which appertains thereto. Sixth: T',e City, through the City Council thereof, reserves the right to charge the grade of said boule- vard, and in case of any such change the permittee must conf orm to such changed grade without liability on the part of said City therefor. 2- I Seventh: That this permit is granted only in so far as the City of 'el Segundo is lawfully authorized to grant the same, and that in the event any further permission is required from the State of California or any division or department of said State, other than said City, the same must be pro- cured by the permittee in view of the fact that said Sepulveda Boulevard is a State highway of the State of California. !ighth: Open excavations must be confined to the shoulder areas only, and the portion under the pavement areas must be installed by means of a bore which will not disturb the present pavement or interfere with traffic. SECTION 3. That the City Clerk shall certify to the passage and adoption of this resolution; shall enter the same in the book of resolutions of the said City, and shall make a minute of the Passage and adoption thereof in the records of the proceedings of the City Council of said City in the minutes of the meeting at which the same is passed and adopted; and shall cause a certified copy thereof to be forwarded to said permittee, which said certified copy shall be and constitute the form of permit representing the permission herein granted.
