RESOLUTION NO. 310
A RESOLUTION OF THE CITY COMCIL OF TEE
CITY OF SL BEGUND09 CALIFORNIA, AWARDING
TO CONSOLIDATED ROCK PRODUCTS CO. OF LOS
ANGELES, CALIFORNIA, TEE CONTRACT FOR
G SAID CITY WITH PORTLAND CEMENT
WHEREAS, the City Council of the City of E1 Segundo,
Califo mia, has heretofore in the manner provided by law, duly
and regularly advertised for bids for furnishing said City
with Portland Cement (Common), Sand and Crushed Rook, for
certain oonstrw tion work in said City;
AND, WHEREAS, at the time for opening and consider-
ing all of said bids, to -wit, the hour of 7 :15 o'clock P. M.
on the 12th day of December, 1934, said Council did publicly
open, examine and declare all bids received;
AND, WHEREAS, at said hour said Council did take
all of said bids under advisement until the hour of 4:30
o'clock P. M. on tba 17th day of December, 1934, said time
being an adjourned regular meeting of said Council;
AND, WHEREAS, said last mentioned hour has now
arrived and said Council has reached its decision in the said
matter;
NOW, THEREFORE, the City Council of the City of
Bl Segundo, California, does resolve, declare and determine
as follows:
SECTION 1. That the bid of Consolidated Rook
Products Co., of Los Angeles, Califo mia, dated December 11,
1934, which said Council determines to be as follows, to -wit:
Approx. 545 Tons Washed Concrete Sand

975 Tons #3 Crushed Rook
at $2.10 per ton .... $20047.50

at 104 each.
Bid on remelt is void unless accepted within
fifteen (15) days from bid date.
The price quoted on cement is based on delivery
of one carload lot, (640 nooks) within 48 hours, direct
from mill.
Bid on rock and sand is void unless accepted
within sixty (60) days from bid date.
The Califomia Retail Sales Tax is not included
in prices. If applicable the tax is to be added to
this bid. The tax will be computed upon the amount
actually paid for the material.
We have signed the applicable Cods of Fair Com-
petition for the material quoted on and are abiding,
and will oontinne to abide by the provisions tbareof.
TEEMS: All invoices for rook and sand are due
and payable on the 25th day of the following month
after date of invoice, subject to a dieoount of 200
per ton provided account is paid in full on or before
that date; otherwise BET.
TEEMS: All invoices for cement are due and
payable on the 10th day of the following month after
date of invoice, subject to a discount of 2jj per sack
provided account is paid in full on or before that
date; otherwise NET.
Should we be awarded this business, we will give
you the beat of service ana materials,-
be, and the same is hereby accepted, which said bid is now
on file in the office of the City Clark of said City, and
which said bid so on file is hereby expressly referred to
and by this reference incorporated herein and made a part
hereof.
All of the above materials are to be in accordance
with Specifications No. 7 of the City of E1 Segundo, and are
to be delivered f. o. b. job site on Arizona Drive (Sepulveda
Boulevard) within said City.
The City Council reserves the right to, within
reasonable limits, order more or less of the materials bid
upon at ouch unit prices.

That the contractor's attention has been called
to the provisions of Chapter 1037 and Chapter 1039 of the
Statutes and amendments of 1933, adopted by the 1933 session
of the Legislature of the State of California (which said
laws are also xespeotively known as Acts 8775 and 8779 of
Deering's General Laws of California, and the contractor
so far as it is legally required so to do, must observe
and abide by the provisions of said laws.
SECTION 2. That all bids received for said
materials, with the exception of the bid of said Consolidated
Rook Products Co., be and the same are hereby rejected, and
the City Clerk is hereby authorised to return the checks of
all unsuccessful bidders.
SECTION 3. That the City Clerk shall prepare
copies of this resolution after the passage and adoption
thereof, and shall affix to such copies at the end thereof,
after the Clerk's Certificate, forms for the approval of
the successful bidder, and on the part of the said City,
and such copies of this resolution, so approved and accepted
by the successful bidder and by and on behalf of said City,
shall constitute the contract for furnishing to said City
the respective items of materials bid upon, pursuant to
the award hereinabove made, and the Mayor of the City of
31 Segundo is hereby authorized, on behalf of said City,
to affix the approval and acceptame of said City to such
contract, and said City Clerk is hereby authorized and
instructed to attest the same on behalf of said City,
and to affix the seal of eel City thereto .
SECTION 4. That the City Clerk shall certify to
the passage and adoption of this resolution; shall omse
the original Of the same to be entered in the book of

resolutions of said City, and shall make a minute of the
passage and adoption thereof in the records of the pro-
ceedings of the City Council of said City in the minutes
of the meeting at which the same is passed and adopted.
Passed, approved and adopted this 17th day of
December, A. D., 1934.

number of members of the City Council of the said City is
five; that the foregoing resolution, being Resolution No.
3100 was duly passed and adopted by the City Council of the
City of E1 Segundo, approved snd signed by the Mayor of
said City and attested by the City Clerk of said City, all
at an adjourned regular meeting of the said Council held
on the 17th day of December, A. D., 1934, and that the
same was so passed and adopted by the following vote:
Ayes: Councilmen Heseer, Love and Selby;
Noes: Councilmen Binder;
Absent:Councilman Gerow.

The undersigned, the successful bidder referred
to in the foregoing resolution of award, hereby accepts and
approves the award made to the undersigned in said resolu-
tion, end does hereby agree to furnish those certain materials
covered by said award in a first class condition as contem-
plated in said award, and at the prices speoified therein.

In consideration of the furnishing of those
certain materials, by Consolidated Rook Products Co, to the
City of E1 Segundo, California, as contemplated under the
award made to said bidder in the foregoing resolution, the
City of E1 Segundo, California, agrees to pay to sold bidder
for such materials the prices specified in said resolution
of award at the time contemplated therein, and in said
bidder's proposal therefor on file.
