RESOLUTION No. 304
A RESOLUTION OF TIE CITY COUNCIL OF
THE CITY OF EL SEGUND09 CALIFORNIA,
AWARDING TO GRAHAM BROTHERS, INC., OF
LONG BEACH, CALIFORNIA, THE CONTRACT
FOR F'CRNISHING SAID CITY WITH CERTAIN
ITEMS OF CRUSHED ROCK.
WHEREAS, the City Council of the City of
El Segundo, California, has heretofore in the manner
provided by law, duly and regularly advertised for bids
for certain items of crashed rook to be furnished the
said City:
AND, WHEREAS, at the time fixed for opening
and considering all of said bids, to -wit, the hour of
7:00 o'clock P. M. on Wednesday, the 28th day of February,
1934, said Council did publicly open, examine and declare
all bids received, and said Council has reached its
decision in the said matter:
NOWO THEREFORE, the City Council of the City of
E1 Segundo, California, does hereby resolve, dealers aid
determine as follows:
SECTION 1. That the bid of Graham Brothers, Inc.,
of Ung Beach, Califo mia, dated February 28, 1934, which
said Council determines to be as follows, to -wit:

2. 3 Cr. rock 75 Tons 2.10 157.50
3. 4 Or. rook 75 Tons 2.25 168.75
The above prices do not include Sales Tax.
Invoices 4or rook and said are subject to a
discount of 20A per ton if the account is paid in
full on or before the 25th day of the month following
the date of invoice.

Prices are based on individual deliveries
of five (5) tons or more. For loads of lose than
five (5) tons there will be a cartage charge of
504 per ton for the differen oe between five (5)
tons and the amount actually delivered.
Time of delivery not less than three (3)
hours.
Enclosed is bidder's bond #1 in the amount
of $90.00, which amount is in excess of 5% of the
total of this bid.
We agree if this bid is accepted within 60
days from the date of opening to furnish all items
on this bid at the prices and terms and conditions
shown herein.",
be, and the same is hereby, accepted, which said bid is
now on file in the office of the City Clerk of said City,
and which said bid so on file is hereby expressly referred
to and by this reference incorporated herein and made a
part hereof.
Delivery is to be made F. 0. B. construction
site, E1 Segundo Avenue, westerly from Arizona Drive,
E1 Segundo, California.
The City reserves the right to order more or
less, within reasonable limits, of the respective quanti-
ties of rook above referred to at the unit prices above
set forth for such respective items.
Payment for said crashed rook will be made out
of the General Fund of said city, upon approval and accept -
anos of said rock, and upon receipt of proper demands
therefor to be audited in the usual manner.
SECTION 2. That all bids received for said
crashed rook are hereby rejected with the exception of
the bid of said Graham Brothers, Inc., and the City Clerk
is hereby authorized and instructed to return the checks
of all unsuccessful bidders.
SECTION 3. Said contractor does hereby agree
that its attention has been called to the provisions of

those two certain laws of the State of California,
adopted by the 1933 session of the Legislature of the
State of California, approved by the Governor of said State,
and vhioh are commonly known and referred to as "Assembly
Bill 2432" and "Assembly Bill 24000, and the contractor
in so far as he is legally required so to do must
observe and abide by the provisions of said laws.
Said contractor further states that it is a
member of the Blue Eagle Division of the National
Recovery Administration, and has signed the President's
Re- employment Agreement.
SECTION 4. That the City Clerk shall prepare
copies of this resolution, after the passage aril adoption
thereof, and shall affix to such copies at the end thereof,
after the Clerk's Certificate, foams for the approval of
the successful bidder and on the part of the said City,
and such copies of this resolution, as approved and accepted
by the successful bidder and by and on behalf of said City,
shall constitute the contract for furnishing to said City
the said crushed rock bid upon, pursuant to the award
hereinabove made, and the Mayor of the City of E1 Segundo
is hereby authorized on behalf of said City, to affix the
approval and acceptance of said City to such contract, and
said City Clerk is hereby authorized and instructed to
attest the same on behalf of said City and to affix the
seal of said City thereto.
SECTION 5. That the City Clerk shall certify
to the passage and adoption of this resolution; shall
cause the original of the sane to be entered in the book
of resolutions of the said City of E1 Segundo, and shall
make a minute of the passage and adoption thereof in the
minutes of the proceedings of the City Council of said
City of the meeting at which the same is passed and adopted.

number of members of the City Council of the said City is
five. that the foregoing resolution, being Resolution No.
304 , was duly passed and adopted by the City Council of
the City of E1 Segundo, approved and signed by the Mayor
of said City and attested by the City Clerk of said City,
all at a regular meeting of the said Council held on the
28th day of February, A. D., 1934, and that the same was
so passed and adopted by the following vote:
Ayes: Councilmen Gerow, Hesser, Love, Selby and Mayor Binder
