CC RESOLUTION 280_L itDi RESOLUTION NO. 280 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, PRO- VIDING FOR THE RECEIVING OF SEALED BIDS FOR THE PERFORMANCE OF THE WORK AND THE FURNISHING OF THE MATERIALS NECESSARY FOR THE CONSTRUCTION OF TIE IMPROVEMENT REFERRED TO IN PLAET AND PROFILE NUMEER M- 330801 OF SAID CITY, DESIGNATED AS "PLAN AND PROFILE FOR THE IMPROVEMENT OF ARIZONA DRIVE IN THE CITY OF EL SEGUNDO* CAL. UNDER MUNICIPAL IMPROVEMENT DISTRICT ACT OF 1927 ", AND AUTHORIZING THE CITY CLERK OF SAID CITY TO PUBLISH A NOTICE INVITING SUCH SEALED BIDS. The City Council of the City of E1 Segundo, California, does resolve, declare and determine as follows: SECTION 1. That sealed bids or proposals be invited by the City Council of the City of E1 Segundo, Califo mia, on behalf of said City, and be reps ived' by said Council for the furnishing of all of the materials and for the parfonmance of all of the work required to construct and complete the work of grading, paving and improving of Arizona Drive (State Highway No. 60), within said City, as contemplated in the Plans and Specifications for said project hereinafter in this resolution referred to. SECTION 2. That such sealed bids or proposals shall be so submitted and received for the furnishing 1- Gk!'a',3 of the materials and for the perfo miance of the wo 3t referred to in the form of notice to bidders hereinafter in this resolution set forth, and shall be so submitted and received upon and subject to each and all of the various terms, conditions sad provisions of, and set forth in, said form of notice. SECTION 3. That the City Clerk of said City be, and he is hereby, authorized and instructed, to publish a notice inviting sealed proposals or bids for the furnishing of such materials and the perform- anoe of such work in substantially the following form, to -wi t: 2. iLb "y J "NOTICE TO BIDDERS ON STREET WORK NOTICE I3 HEREBY GIVEN that the City Council of the City of El Segundo, California, on behalf of said City, invites sealed bids or proposals for the furnishing of all of the materials and for the performance of all of the work required in order to construct and complete the improvement of Arizona Drive (State Highway No. 60), within said City, as contemplated in and under the Plans and Specifications for said project hereinafter referred to. All bids or proposals must be sealed and endorsed "Proposal for the Grading and Paving of Arizona Drive (State Highway No. 60),' and must be mailed or delivered so as to be in the possession of the City Clerk of said City, at his office in the City Hall of said City, located in said City, at or before the hour of 7:15 o'clock P. M. on Wed- nesday, the 6th day of September, 1933, at which said time and in the Council Chamber of the City Hall of said City, all bids or proposals received will be publicly opened, examined and declared by said City Council. The materials to be furnished and the work to be performed under this notice, and for which such bids or proposals are invited, are all of the materials and all of the work required in order to construct and complete the improvement of said Arizona Drive (State Highway No. 60), in the City of E1 Segundo, California, as contemplated in and under the following Plans and Specifications for said work, to-wit: (1) 'Plan and Profile No. M- 330801, Consisting of Ten Sheets, numbered One to Ten inclusive', and which said Plan is also designated as 'Plan and Profile for the Improvement of Arizona Drive in the City of E1 Segundo,Cal. 3- 161)Si under Municipal Improvement District Act of 1927: Said Plan and Profile No. M- 330801 was heretofore approved and adopted for said work or improvement, and same is now on file in the office of the City Engineer of said City, in the City Hall thereof, and is open to public inspection, and said Plan and Profile No. M- 330801 so on file is hereby referred to and by this reference expressly in- corpor ate& herein and made a part hereof. (2) "Standard Grading and Paving Specifications No. 2 of the City of El Segundo, California ". Said Specifications No. 2 were heretofore approved and adopted by the City Council of the City of El Segundo, Calilbnria, and same are now on file in the office of the City Clerk of said City in the City Hall thereof, and are open to public inspection, and said Specifications No. 2 so on file are hereby referred to and by this reference are hereby expressly incorporated herein and made a part hereof. No bid submitted shall be vd. thdrawn for any purpose whatsoever, after it has been deposited with the City Clerk. Copies of said Plans and Specifications may be obtained by any person desiring the some at either the office of the City Clerk or the office of the City Engineer, by depositing with the officer from whom the same are re- oeived, the sum of $5.00, which said deposit will be refunded to the person, firm or corporation depositing the same, upon the return of such copies in good order. All bids or proposals shall be submitted on the blank form of proposal provided by the City for that purpose, copies of ihich may be obtained without charge from either the office of the City Engineer or the City Clerk of said City. 4- Bidders in bidding shall state the unit price for each item of the proposed work, in ink, or typewriting, and such price shall be stated both in words and figures. Each bid must be signed by the bidder with the fall name and both the business and residence (if any) address of such bidder appearing. In case any bid is filed by a firm or oo- partnership, the name and residence of each and every member of such firm or co- partnership shall be inserted, and in case any bid is submitted by or on be- half of a corporation, such bid shall be signed in the name of such corporation by some duly authorised officer, agent or representative thereof, who shall also subsorfbe his own name and title of his office, and if practicable the seal of such corporation shall be affixed. Bach bid must be accompanied by a certified or cashier's check, or by a bidder's bond in a am not less than ten per cent (10%) of the total amount of such bid, payable to the order of the City of &1 Segundo, California, and the check of the saooeseful bidder shall be forfeited to said City,unless such bidder shall within ten days after notice of award of contract has been given such bidder, enter into the required contract and furnish the necessary bonds for faithful perfomance and to secure laborers end materialmen. The cheoks of unsuooessfnl bidders will be returned to such respective bidders within three days after the award of the contract hereunder, or in case of the rejection of all bids, within three days after such rejection. A surety bond in the emu of not lose than E5% of the total contract price will be required for the faithful performance of the contract, and a surety bond in an amount not less than 50% of such total contract 5- YrA'CJ °$ 0 price will be required to secure laborers and materialmen. All such bonds shall be subject to the approval of the City Council as to sufficiency, and to the City Attorney of said City as to form. The contract to be executed hereunder shall be subject to the approval of the City Attorney as to form. The bidder to whom the contract hereunder is awarded, will be required within ten days after notice of award of contract given such bidder to execute the necessary contract, as specified in the proposal, in duplicate. In case of the failure of shah successful bidder to execute said contract within said ten day period, the proposal or bid of such bidder and the aoceptame thereof by said Council, shall be null and void, and the check or bond of each bidder shall be forfeited to said City as hereinabove stated, and the City Council shall be at liberty to make other contracts with other parties as said Council may see fit. After thesigning of the necessary contract and the approval of the required bonds, the check of the successful bidder will be returned forthwith. Full Penetration two- oourse Asphalt Macadam Pavement Item 5. 1131 lin. ft. of 18" Corrugated Iron Drainage Pipes Item 6. 3 Standard Headwalls Item 9. 8 Standard Catch - Basins, Complete with Grating and Frame 6• a�'iN Item 8. 39000 Barrels Heavy Fuel 011 applied on Shoulders Item 90 Extra Work It is expressly understood that the foregoing quantities are appxoxim ate only; that they are stated merely as a basis for the momparison of bids and the City Council does not expressly, or by implication, agree that the actual amount of' work will correspond therewith, but reserves the right to increase or decrease the amount of any class or portion of the work as may be deemed necessary by it, provided that the net increase or decrease is not more than 25 per cent. An increase or decrease in the quantity for any item shall not be regarded as a sufficient ground for as increase or decrease in the prices nor in the time allowed for the completion of the work except as provided in the contract. The Contractor's attention is directed to the private utilities (pipe lines, pole lines, eto., ) which will have to be relocated. The work of changing, alter- ing, or relocating any of these private utilities will be done by the ovner of said utilities aid the right is reserved to said ovaers of said private utilities and franchises, sad to the City of El Segundo, to enter upon the street or highway for the purpose of removing, alter- ing, or relocating said struotvres, vdaen made necessary by the construction work contemplated. The Contractor must at all tames prossoute the work of grading and paving to facilitate the removing, altering or relocating of any of these private utilities and will be expected, when directed by the City Engineer, to partially grade or partially fill any portion of the right -of -way, when such grading or filling will aid and facilitate the relocating of any of such utilities. 7- I U 1�11fv The City Council reserves the right to reject any and all bids, and to take same under advisement for a reasonable time. The work is to commence immediately after the signing of the contract, unless the City Council shall, in writing, authorize a further delay, and is to be continued with regularity and diligence, except during unsuitable weather until its completion, and the entire work shall be completed wit A20 days after the signing of the contract, unless the City Council shall, in writing, designate some later date. Before the award of the contract, any bidder may be required to show to the satisfaction of the City Council that he has the necessary facilities, ability and financial resources to perform the work in a estis- factory manner sad within the time stipulated, and that he has had experience in constructing works of the same or a similar nature, aryl to give references which will enable the City Council to satisfy itself as to his qualifications for doing the work. NOTICE IS HEREBY FURTHER GIVEN that the City Council of said City has ascertained and determined, de- clared and specified the general prevailing rate of per diem wages for each craft or type of workman or mechanic needed to execute the contract for said work or improvement. Sundays and holidays - double the above rates. The per diem wages listed above are based on the customary 8 hour working dew and when less time is worked per day the amounts paid shall be the pro rata of the amounts listed above. The attention of all bidders is called to the provisions of Chapter Ro. 397 of the Statutes of 1931 of the State of California relating to the payment of wages on publio works. The attention of bidders is also called to the provisions of Seotion 653o of the Penal Code of the State of Califo mia, relating to hours of labor on publie works, which said section was amended by the Legislature of said state in 1931. 9- ) t "';l . The attention of bidders is also called to the provisions of those two certain laws adopted by the 1933 session of the Legislature of the state of California, which have been approved by the Governor of said State, and which are known and referred to as "Assembly Bill No. 2432" and 'Assembly Bill No. 24001, and the contractor, in so far as he is legally required so to do, must observe and abide by the provisions of said laws and a provision to this effect will be in- serted in the contract to be awarded hereunder. Bidders in bidding should acquaint themselves with the requirements of the laws and regulations of the United States of America, and of the State of CaUtomia, with reference to the use of materials or articles, materials and supplies produced, mined or manufaotured within the United States of America, and /or within the State of California, and the contractor so far as he is legally required so to do must observe the provisions of all such laws and regulations. The attention of all bidders is also called to the provisions of the 'Alien Non - Employment on Public Work Lot of 1931 ", Chapter 398 of the Statutes of 1931 of the State of California, relating to the employment of aliens upon public works. Reference is hereby made to the Construction Agreement, Bitumuls Pavement, dated the 11th day of August, 1931, on file in the office of the City Clerk of said City, in the City Hall thereof, and open to public inspection. All bidders are expected to make themselves familiar with the laws of the State of California, and the ordinances of the City of El Segundo, California, 10- Y&ioh refer to the employment of labor, or the letting or carrying out of the contract work or the furnishing of any articles, materials, or supplies hereunder, and to observe and comply therewith so far as such observa- tion and compliance is legally required, whether special attention is called to them herein, or in the proposal or specifications or plans hereinabove referred to or not. Each bidder is required to state in his bid the names of all persons interested with such bidder, and if no other person be so interested he shall distinctly state such fact, and shall also state that the bid is made without any connection with any other bidder making any bid for the above wo zk. Also that the bid is in all respects fair am d made without collusion or fraud, and that no person acting for or employed by the City of E1 Segundo is directly or indirectly interested therein or in the materials, supplies or work to which it relates, or in any portion of the profits thereof. Bidders are invited to be present at the opening of bids. Dated at E1 Segundo, California, this l day of August, A. That said Notice to Bidders on Street Work, hereinabove referred to, shall be published three times in the E1 Segundo Herald, a weekly newspaper of general circulation, printed, published and circulated within said City, and which is hereby designated for that purpose, such publications to appear in the issues of said paper of August 17th, August 24th and August 31st, of the year 1933. SECTION S. That the City Clerk shall certify to the passage and adoption of this resolution; shall cause the same to be entered in the book of resolutions of the said City, and shall make a minute of the passage and adoption thereof in the records of the City Council of said City in the minutes of the meeting at which the same is passed and adopted.
