RESOLUTION NO. 249.
A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF EL SEGUNDO, CALIFORNIA,
ASCERTAINING, DECLARING AND DETERMINING
THE GENERAL PREVAILING RATES OF PER
DIEM WAGES AS CONTEMPLATED UNDER THE
PROVISIONS OF CHAPTER 397 OF THE STATUTES
OF 1931 OF THE STATE OF CALIFORNIA.
WHEREAS, the City Council of the City of
E1 Segundo, California, has heretofore adopted its
Resolution of Intention No. 243, declaring the intention
of said Council to order the improvement of certain por-
tions of Imperial Highway (formerly Collingwood Street)
within the City of E1 Segundo, and within the City of
Los Angeles, California, as set forth in said resolution,
which said resolution which is now on file in the office
of the City Clerk of the said City is hereby expressly
referred to and by this reference expressly incorporated
herein for all further particulars;
AND, 11MREAS, this Council has duly and re-
gularly held the public hearing, referred to in said
resolution, and has overruled all protests and objections
and has ordered the improvement referred to in said
resolution of intention to be made;
AND, WHEREAS, it now becomes necessary to
publish notice to bidders inviting sealed proposals or
bids for the doing of said improvement and the furnish-
ing of all materials and supplies necessary in the
execution thereof;
AND, WHEREAS, Chapter 397 of the Statutes of
1931 of the State of California relating to the payment

of wages on public wmrks became effective at midnight
on the 13th day of August, 1931, and therefore same is
now in effect;
AND, WHEREAS, the Board of Public Works of
the City of Los Angeles, California, has heretofore
officially established in a formal resolution adopted
by said Board on the 11th day of September, 1931, the
prevailing rates of per diem wages in the City of Los
Angeles for each craft or type of workman needed to
execute the contract for said work or improvement,
which said rates are the same as hereinafter ascertained
by this Council;
AND, YEEREAS, it is incumbent upon this
Council pursuant to the p m visions of said Chapter 397
to ascertain the prevailing rates of per diem wages in
said City of E1 Segundo for each craft or type of work-
man or mechanic needed to execute the contract for
said work or improvement:
NOYJ, THEREFORE, THE CITY COUNCIL OF THE CITY
OF EL SEGUNDO, CALIFORNIA, DOES HEREBY ASCERTAIN, RESMVE,
DECLARE, DETERMINE AND SPECIFY AS FOLLOWS:
SECTION 1. That the general prevailing rates
of per diem wages in the City of E1 Segundo, California,
for each craft or type of workman or mechanic needed to
execute the contract for said work or improvement, as
contemplated under said Resolution of Intention No. 243,
are as follows, to -wit:

SECTION 2. That the general prevailing
rates of per diem vreges in the City of Los Angeles,
California, as heretofore determined, specified and
declared by the Board of Public Works of said City of
Los Angeles, are the same as those hereinabove ascer-
tained, specified, determined end set forth in Section
1 of this resolution by this Council for said City of
E1 Segundo,
SECTION 3. That for legal holiday (except
Saturday afternoon) and overtime work the general rate
for each of the respective crafts or type of workmen
or mechanics needed to execute the said contract is
ascertained, determined, declared and specified by said
City Council to be one and one -half times the prevailing
rates of per diem wages hereinabove respectively speci-
fied and set forth in Section 1 hereof.
SECTION 4. That the rates of per diem wages
hereinabove set forth in Sections 1, P. and 3 of this
resolution contemplate in each instance a working day
of eight hours. Vlork on Saturday afternoon is treated
not as legal holiday or overtime work unless same falls
upon a calendar day the whole of which is declared a
legal holiday by law.
SECTION 5. That in view of the provisions
of Sections 1, 2, 3 and 4 of this resolution hereinabove
set forth, this Council hereby finds that the general
prevailing rates of per diem wages in the City of Los
Angeles and in the City of El Segundo are the same and
that therefore the same rates prevail in the locality
in which the said work or improvement referred to in
said Resolution of Intention No. 243 is to be performed,
notwithstanding the fact that a portion of said work and
a portion of the district to be assessed therefor lies

in the City of El Segundo and a portion of said work
and a portion of the district to be assessed therefor
lies within the City of Los Angeles, California.
SECTION 6. That the City Clerk shall certify
to the passage and adoption of this resolution; shall
cause the same to be entered in the Book of Resolutions
of said City and shall make a minute of the passage and
adoption thereof in the minutes of the meeting of the
said Council at which the same is passed and adopted.
Passed, approved and adopted this 10th day of
September, A. D., 1931.
