CC RESOLUTION 99RESOLUTION NO. 99 A RESOLUTION OF THE BOARD CF TRUSTEES OF THE CITY OF EL BEGUNDO, CALIFORNIA, PROVID- ING FOR THE ISSUANCE OF STREET IMPROVEMENT BONDS FOR THE .NORK OR IMPROVEMENT OF PORTIONS OF VIRGINIA STREET, WHITING STREET, BONITA VISTA AVENUE, MAPLE AVENUE, MARIPOSA AVENUE AND PAIM AVENUE, WITHIN THE SAID CITY, AS PROV ID E.D FOR IN RESOLUT I DN OF INTENTION NO. 79, PASSED AND ADOPTED ON THE 7TH DAY OF NOVERBF.R, A. D., 1924, PRESCRIBING THE DENOMINATIONS OF SUCH BONDS AND OF THE INTEREST uOUPONS ATTACHED THERETO; AND DIRECTING DELIVE.,RY THEREOF. WHEREAS, the Board of Trustees of the City'of E1 Segundo, California, did on the 7th day of November, A. D., 1924, pass its Resolution of Intention No, 79, for the improvement of, and the establishment of grade on portions of Virginia Street, Whiting Street, Bonita Vista Avenue, Maple Avenue, Mariposa Avenue and Palm Avenue, within the said City, under and pursuant to the provisions of the Improvement Act of 1911, and the amendments thereto, reference to which said resolution of intention (which is now on file in the office of the City Clerk of said City and open to public inspection) is hereby expressly made for further particulars; AND, WHEREAS, thereafter all necessary resolu- tions, notices and other proceedings of said Board were duly and regularly adopted and taken in said matter; the contract for said work or improvement was duly awarded and thereafter duly completed to the satisfaction of the Superintendent of Streets of said City and of this Board; whereupon a warrant, diagram and assessment were made; 1- I..,,. recorded and delivered to the contractor in time, form and manner as required by said act; and the contractor having made due return thereon, and the same having been duly recorded; AND, WEMM.AS, on the 21st day of July, 1925, the Street Superintendent of said City made and filed with the clerk of this Board a complete list of all the assessments unpaid thereunder, showing the respective assessment or diagram numbers of such unpaid assessments; the lots or parcels of land described in each of such respective assessments, and the respective amounts of each such unpaid assessment; said list also showing the total or aggregate amount of such unpaid assessments to be the sum of Thirteen Thousand Nine Hundred Seventy -six and 77/lUO Dollars ($13,976.77), whereupon said clerk gave notice of the filing of said list, and fixed in said notice Friday the 7th day of August, 19259 at the hour of eight o'clock P, M, of said day as the time when in- terested persons might appear before the Board of Trustees In the Council Chamber of the City Hall of said City, and show cause why bonds should not be issued upon the security of the unpaid assessments shown on said list; said time being at a regular meeting of said Board held on said date, and no protests or objections having been made in the said matter; and there therefore being no such protests or objections to pass upon; and Assessments Nos. 47, 49, 50, 57, 59, 199; and 407 in the aggregate amount of One Hundred Fifty -six and 86/100 Dollars ( §156.88) having been paid after the filing of said unpaid assessment list, and prior to the said hearing on the 7th day of August, 1925; and the issuance of bonds in the said matter having been taken under advisement until the hour of 7:30 o'clock P, M. on Friday the 14th day of August, 1925; AND, WHEREAS, said hour of 7:30 o'clock P. That said bonds shall be issued in series; and the assessments remaining unpaid at the date hereof, as hereinabove determined by said Board of Trustees (City Council) of said city, together with interest thereon, shall remain and constitute a trust fund for the redemption and payment of said bonds and of the interest which may be due thereon, which unpaid assessments shall be payable in annual series corresponding in number to the number of series of bonds, and such proportion of each assessment coming due in any year, together with the annual interest thereon, shall in turn be payable in instalments as the general municipal taxes of the said City of E1 Segundo on real property are payable, and shall become delinquent at the same times and in the same proportionate amounts, and bear the same proportionate penalties after delinquency. That said bonds shall be signed by the Treasurer of said City of R1 Segundo, and oountersigned by the City Clerk thereof; who shall affix thereto the official seal 12- of said City; that the interest coupons affixed thereto shall be signed by the Treasurer of said City, or bear his engraved or lithographed signature, and that said bonds shall be substantially in the form set forth in said Improvement Bond kot of 1915. Dixon, of Long Beach, California, assignee of the Contractor, Vido %ovacevich, in full satisfaction of the balance due upon his assessment and warrant. SECTION 4. That the City Clerk of said City shall certify to the passage and adoption of this resolution; shall cause the same to be entered in the Book of Resolu- tions of said City, and shall make a minute of the adoption thereof in the records of the Board of Trustees of said City in the minutes of the meeting at whio h the name is passed and adopted.
