CC RESOLUTION 86' R3 RESOLUTION N0, a- A HESOLUTIOE OIL` THE BOARD Or TRUSTEE'S OF THE CITY OF EL SEGUNDO, CALIFORNIA, ORDERING THE, IMPROVEMENT OF A CERTAIN PORTION OF BAYONNE STREET AND OF A CERTAIN PORTION OF BONITA VISTA AVENUE, 71THIITT TH:' SAID CITY, AS CONT 1d e T ,Z IN RESOLUTION OF II1IT -1T 1011 NO. 85; DECLARING TH7 `TORY OR IMPROMENT TO BE OF MORE THAN LOCAL OR ORDINARY PUBLIC BENEFIT; THAT THE COST OF SAID WORY OR IM- PROVh:NT SHALL BE ASSESSED UPON A DISTRICT; AND DETERMINING THAT BONDS SHALL BE ISSUED TO REPR_`3 MT TH,: COST THiRr ,'OF. WHERFAS, the Board of Trustees of the City of El Segundo, California, has heretofore duly passed and adopted its resolution of Intention No. 85, declaring the intention of the said Board to order the work hereinafter referred to to be done; AND, 11MMIS , notice of the passage of said Reso- lution and of the matters therein contained and of the said proposed improvement has been duly given as required by law; AND, VHERo'AS, no protests or objections against the said work or improvement, or against the extent of the district proposed to be assessed to pay the costs and expenses there- of, or against the proposed grade to which the said work shall be constructed, have been made, either in writing or otherwise; AND, WF ERFAS, said Board of Trustees has now acquir- ed jurisdiction to order the said work or improvement to be made; NOW, THrREFORE, the Board of Trustees of the City of El Segundo, California, do resolve, declare and determine as follows: SECTION 1. That the Street work or improvement men- 1- tioned and described in Resolution of Intention No. 85, of the Board of Trustees of the City of El Segundo, Califor- nia, passed and adopted on the 13th day of February, 1925, is required by the public interest and convenience; and the said Board of Trustees of the City of El Segundo, Cali- fornia, hereby orders to be done, the said work or improve- ment upon a certain portion of Bayonne Street, between the northerly line of Palm Avenue and the southerly curb line of Maple Avenue, and upon a certain portion of Bonita Vista Avenue, between the northerly curb line of VJalnut Avenue and the southerly line of Collingwood Street, within the said City; all as the same is contemplated, set forth and fully described in said Resolution of Intention No. 85, which is on file in the office of the City Clerk of the said City of El Segundo, and which is hereby referred to for a description of said work, and hereby by this reference made a part hereof for the purposes of said description. SECTION 2. That the contemplated work or improve- ment hereinabove mentioned is in the opinion of the said Board of Trustees of more than local or ordinary public benefit, and the expenses of the said work or improvement are made charghable upon the district hereinafter described, and tho said Board of Trustees hereby declares said district to be the district benefited by the said work or improvement and to be assessed to pay the costs and expenses thereof. The said district is described as follows; to wit: All that real property in the said City of E1 Segundo, County of Los Angeles, State of California, included within the exterior boundary line of the said district as the same is shovn upon the "Map of ]District to be assessed for the im- provement of a Portion of Bonita Vista Avenue and Bayonne i Street, City of El Segundo ", designated as "Plat No. M25122 ", indicating the exterior boundary line of such district, which said plat, duly and regularly approved by the said Board of Trustees is on file in the office of the City Engineer of 2- the said City and is hereby expressly referred to and by this reference made a part hereof; excepting therefrom all public streets, roads, alleys, avenues, places and highways. Reference is hereby expressly made to the said plat for the particular description of the said district. SECTION 3. That the City Engineer of said City is hereby directed to make a diagram of the property affected or benefited by the proposed work or improvement, as de- scribed in said Resolution of Intention No. 85, and to be assessed to pay the expenses thereof. Such diagram shall show each separate lot, piece or parcel of land, the area in square feet of each of such lots, pieces or parcels of land and the relative location of the same to the work pro- posed to be done, all within the limits of the said assess- ment district. SECTION 4. That the said Board of Trustees hereby determines that serial bonds to represent unpaid assessments and bear interest at the rate of seven per cent (7foo) per annum will be issued hereunder in the manner provided by the Improvement Bond Act of 1915, the last instalment of which bonds shall mature nine years from the second day of July next succeeding ten months from their date. SECTION 5. That except as herein and in said Re- solution of Intention No. 85 provided, the proceedings for the aforesaid improvement shall be had and taken under that certain act of the Legislature of the State of California, commonly known, designated and referred to as the "Improve- ment Act of 1911 ", and under all acts amendatory thereof. SECTION 6. The City Clerk of said City is hereby directed to post conspicuously for five days on or near the Council Chamber door, of the Board of Trustees, in the manner and form required by law, a notice with the specifications inviting sealed proposals or bids for doing said work. Said City Clerk is hereby further directed to 3- publish twice in The E1 Segundo Herald, a weekly newspaper printed, published and circulated in said City of E1 Segundo, California, and hereby designated for the purpose of said publication, in the manner and form required by law, a notice of said work, inviting sealed proposals or bids for doing said work and referring to the specifications posted or on file. Said notice shall require that each proposal or bid be accompanied by either a certified check or a bond, as prescribed by law, and for an amount not less than ten per cent (10%) of the aggregate of the proposal or bid, payable to the said City of E1 Segundo, California. SECTION 7. The City Clerk shall certify to the passage and adoption of this resolution; shall enter the same in the Book of resolutions of said City of E1 Segundo, and shall make a minute of the adoption thereof, in the records of the Board of Trustees of said City, in the minutes of the meeting at which the same is passed and adopted.
