CC RESOLUTION 67RESOLUTION NO. A RESOLUTION OF THE BOARD OF TRUSTEES OF THE CITY OF EL SEGUT'DO, CALIFORNIA, ORDERING THE IMPROVEMENT OF I,IAIN STREET, WITHIN THE SAID CITY, AS CORTMMLATED IN RESOLUTION OF INTENTION NO. 63 OF THE SAID BOARD; DECLARING THE WORK OR I11PROVEPMT TO BE OF MORE THAN LOCAL OR ORDINARY PUBLIC BENEFIT; THAT TFE COST OF SAID WORK OR IMPROVEIMT SHALL BE ASSESSED UPON A DISTRICT, AND DETERP,TIPSING THAT BONDS SHALL BE ISSUED TO REPRESENT THE COST THEREOF. WHEREAS the Board of Trustees of the City of E1 Begundo,California, has heretofore duly passed and adopted its Resolution of Intention No. 63, declaring the intention of the said Board to order the work hereinafter referred to to be done; And whereas notice of the passage of said resolution and of the matters therein contained, and of the said proposed improvement has been duly given and posted, as required by law; And whereas all protests and objections agairs t the said wark or improvement and against the extent of the district proposed to be assessed to pay the costs and expenses thereof have been duly considered, and overruled and denied heretofore by the Board; And whereas no protests or objections against the proposed grade to which the said work shall be con- structed have been made, either in writing or otherwise; 9 And whereas said Board of Trustees has now acquired jurisdiction to order the said work or improve- ment to be made; NOW, THEREFORE, the Board of Trustees of the City of E1 Segundo, California, do resolve, declare and determine as follows : SECTION ONE: That all of the street work or improvement mentioned and described in Resolution of Intention No. 63 of the Board of Trustees of the City of El Segundo, California, passed and adopted on the 18th day of September, A.D. 1923, is required by the public interest and convenience; and the said Board of Trustees of the City of E1 Segundo, California, hereby orders to be done the said work or improvement upon Main Street, within the said city, all as the same is contemplated, set forth and fully described in said Resolution of Intention No. 63, which is on file in the office of the city clerk of the said City of El Segundo, and which is hereby referred to for a descrip- tion of said work and hereby by this reference express- ly made a part hereof for the purpose of said descrip- tion. SECTION TWO: That the said contemplated work or improvement in the opinion of the said Board of Trustees of said City of E1 Segundo is of more than local or ordinary public benefit, and said Board of Trustees by and in the aforesaid Resolution of Inten- tion No. 63 made the expenses of the said work or improvement chargeable upon a district, which said P district is shown by a plat, designated as Plan No. M12396, on file in the office of the city engineer of the said City of E1 Segundo, California, to which said plat reference is hereby made for the colored boundary line showing the extent of the territory to be inoluded in the assessment district, and which said district is also described in general terms in the aforesaid Resolution of Intention No. 63, to which said plat and Resolution of Intention No. 63 reference is hereby wade for a more parthular description of said assessment district, and for all details with reference to the extent of said assessment district. SECTION TIiR'EB': That the City Engineer of said city is hereby directed to make a diagram of the property affected or benefited by the proposed work or improvement, as described in said Resolution of Intention, No. 63, and to be assessed to pay the ex- penses thereof. Such diagram shall show each separ- ate lot, piece or parcel of land, the area in square feet of each of such lots, pieces or parcels of land and the relative location of the same, and the work proposed to be done, all within the limits of the said assessment district. SECTION FOUR: That the said Board of Trustees hereby determines that serial bonds to represent unpaid assessments and bear interest at the rate of seven per cent (7 %) per annum will be issued hereunder in the manner provided by the "Improvement Bond Act of 1916 ", the last Instalment of which bonds shall mature nine years from W I' the second day of July next succeeding ten months from their date. SECTION FIVE: That except as herein and in said Resolution of Intention No. 63 provided, the proceedings for the aforesaid improvement shall be had and taken under that certain act of the legislature of the State of California commonly known, designated and referred to as the "Improvement Act of 1911" and under all acts amendatory thereof. SECTION SIX: The City Clerk of said city is hereby directed to post conspicuously for five days on or near the Council Chamber door of the Board of Trustees, in the manner and form required by law, a notice with the specifications inviting sealed pro- posals or bids for doing said work. Said City Clerk is hereby further directed to publish twice in the E1 Segundo Herald, a weekly newspaper printed, published and circulated in said City of E1 Segundo, California, and hereby designated for the purpose of said publication, in the manner and form required by law, a notice of said work, inviting sealed proposals or bids for doing said work and referring to the specifications posted or on file. Said notice shall require that each proposal or bid be accompanied by either a certified check or a bond, as prescribed by law, and for an amount not less than ten per cent (101%) of the aggregate of the proposal or bid, payable to the said City of El Segundo, California. V SECTION SEVEN: The City Clerk shall certify to the passage and adoption of this resolution, shall enter the same in the Book of Resolutions of the said City of E1 Segundo, and shall make a minute of the adoption thereof in the records of the Board of Trustees of said city in the minutes of the meeting at which the same is passed and adopted.
