'!AaER IN AIID FOR THE SAID CITY, APD DITINING THE PO ".dERS AND DUTIES, AND PROVIDING FOR THE COIdPENSATION OF SAID OFFICER. The people of the City of E1 Segundo do ordain as follows; SECTION 1. The office of City Manager of the City of E1 Segundo, California, is hereby created and established. Any person appointed City Manag- er shall be a duly qualified and licensed Civil Engineer. The City Manager shall be appointed by the Board of Trustees of said City, and shall hold office during the pleasure of said Board, Said City Manager shall receive such compensation for his services as the Board of Trustees shall from time to time determine. SECTION 2. It shall be the duty of the City Manager, and he shall have power: 1. To see that the laws and ordinances of the City are enforced. 2. To exercise control over all of the de- partments of the City and direct the work of all appointive officers. -1- raf c� 1 3. To recommend to the Board of Trustees persons to be employed and the employees to be discharged. 4. To superintend the construction of all public work within the said City. 5. To approve or disapprove the requisi- tions for the purchase of any article or articles for the said City, by any department or officer before the purchase is made. 6. To attend all meetings of the Board of Trustees and to recommend to the said Board for adoption of such measures as he might deem nec- essary or expedient. 7. To keep the Board of Trustees fully ad- vised as to the financial conditions and needs of the City. 8. To perform such other duties as may be prescribed by ordinances or resolutions of the Board of Trustees. SEC�IUD 3. Any and all acts of the City Manager performed under this ordinance shall be subject to the approval and control of the Board of Trustees of the City of E1 Segundo, and the said Board shall have full power to correct and set aside any action taken by them under this ordinance whenever said Board shall deem it proper to do so; and provided further that the legal department of said City and the City Attorney are hereby excepted from the operation of this ordinance. SECTION 4. All officers and departments of the said City, excepting in this ordinance otherwise provided, are hereby declared to be subject to the control of the said City Nanager, and no officer, employee or department of said City shall incur any indebtedness on behalf of said City until a requisi- tion for the same shall have been first presented to the City I4anager and shall have received his approval. Any violation of this section shall ren- der any person so violating subject to immediate discharge from the employ of said City. SECTION 5. All ordinances or parts of ordinan- ces in conflict herewith are hereby repealed. SECTION 6. This ordinance shall take effect immediately upon its adoption." was, on the 26th day of September, 1922, filed with the City Clerk of said City by Frank J. K@ssels and others, and 1uTFMEAS; Thereafter and on the 5th day of October, 1922, the City Clerk attached to said petition his certifi- cate, showing the same to be insufficient according to the -2- laws of the State of California relating to initiative petitions so far as number of signatures was concerned; and WHEREAS: Thereafter within the time prescribed by law and on, to -wit, the 14th day of October, 1922, an additional paper, a duplicate of the original petition except as to the names signed, was filed with the City Clerk; and 7lHIIVZ : The said original petition and said additional paper or supplemental petition w" on the Pith day of October, 1922, presented to and submitted to the Board of Trustees of said City, together with the certifi- cate of the City Clerk as to its sufficiency attached there- to; and ?'FuuWAS: It appears from the final certificate of the City-Clerk attached to said petition and said addi- tional paper or supplemental petition attached to the same, that the said petition consisting of two sections, is signed by at least fifteen per cent of the qualified electors of said City; and WHEREAS: It further appears that said petition by its terms requires that said ordinance shall be either passed or adopted without alteration, or that the same be submitted forthwith to a vote of the people of the said City of El Segundo at a special election called for such purpose, as provided by law; and .HEREAS: The Board of Trustees deems that the public - nterest and convenience will be subservecl by the calling of a special election for the purpose of submitting the question of the adoption of said proposed ordinance _3__ to the electors of said city. NOW, THEREFORE, The Board of Trustees of the City of E1 Segundo, California, do resolve, declare and determine, as follows: SECTION 1. That there shall be held in the City of E1 Segundo, County of Los Angeles, fornia, on Wednesday, the 29th day of Dove: special municipal election for the purpose to the electors of said City, the question of said proposed ordinance by the electors and that said proposition upon the ballots said election shall be stated, as follows: State of Cali - nber, 1922, a of submitting of the adoption of said City, to be used at "Shall the ordinance submitted to the i.....i.....i Board of Trustees of the City of E1 Segundo by initiative petition on : YES the 17th day of October, 1922, entitled: 'An ordinance of the City of El Se- :.....:.....: gundo, California, creating the office of City Manager in and for the said NO City, and defining the powers and duties and providing for the compensa- tion of said officer', be adopted ? ", ••••••:.....: and notice of the time and place of holding said election is hereby given. SECTION 2. That the ballots to be used at said election shall be, both as to form and as to matters con- tained therein, such as may be required by law to be used thereat, and the City Clerk is hereby directed to mail to the qualified voters of said city in the manner and within the time required by law, sample ballots, in the form and containing the matter required by law to appear thereon, enclosing with each sample ballot mailed, a card stating the location of the precinct polling place of the elector to whom said sample ballot was mailed, but a failure on the -4- part of any elector to receive such sample ballot shall not be held to invalidate the election or affect in any manner the result thereof; and the City Clerk is hereby fur- ther instructed and directed and authorized to procure all supplies that may be necessary to properly and law- fully conduct said special municipal election. SECTION 3. That for the purpose of holding said special municipal election, there shall be two voting precincts within the said city, consisting of a consblida- tion of the regular voting precincts established for hold- ing general state and county elections, as follows: Voting Precinct "A" shall be known as such and shall include all of the territory in the City of El Se- gundo, California, within the exterior boundaries of E1 Segundo Precinct IYo. 1, as the same were fixed by the Board of Supervisors of the County of Los Angeles, California, on the 29th day of December, 1921, and now being of record in Book 78 -A of the minutes of the said Board of Supervisors, reference to the same being hereby expressly made for a more particular description of said precinct, and the said exterior boundaries forming the exterior boundaries of the territory included within said E1 Segundo Precinct No. 1 shall be and constitute, and the same are hereby designated as the exterior boundaries of said Voting Precinct 'W'. That the polling place in said Voting Precinct "A" shall be in the basement of the Methodist Church, on the northeast corner of Mariposa Avenue and Main Street, within the said city, and the Board of Election to conduct the said election in said Voting Precinct "A" shall be, and the same is hereby appointed as follows: -5- Inspector: Thomas Levi Tuck, Judges: Frederick Ii. Violet Thurston Consolidated Voting Precinct "B" shall be known as such and shall include all of the territory in the City of E1 Segundo, California, within the exterior boundaries of E1 Segundo City Precinct ito. 2 and E1 Segundo City Pre- cinct No. 3, as the same were fixed by the Board of Super- visors of the County of Los .Angeles, California, on the 29th day of December, 1921, and now being of Record in Book 78 -A of the minutes of the said Board of Supervisors, reference to the same being hereby expressly made for a more particu- lar description of said precincts, and the said exterior boundaries forming the exterior boundaries of the territory included within said E1 Segundo City Precincts Nos. 2 and 3 shall be and constitute, and the same are hereby designated as the exterior boundaries of said Consolidated Voting Pre- cinct "B ", said El Segundo City Precincts Uos. 2 and 3 being hereby consolidated for the purpose of holding said election. That the polling place in said Consolidated Voting Precinct "B" shall be in the Council Chamber of the City Hall of the City of E1 Segundo, California, at the northwest cor- ner of Franklin Avenue and Richmond Street, within said City, and the Board of Election to conduct the election in said Consolidated Voting Precinct "B" shall be, and the same is hereby appointed as follows: Inspectors Ivan U. Larsen Judges: Claud A. Manson John 0. Fitzgerald Clarks: Jilliam C. Grimes Mrs. Effie R. Magee :,:rs. Mary B. Rogers -6- (b�M YS All of the persons hereiabefore named are hereby ap- pointed as such officers respectively, and their compensa- tion is hereby fixed at the sum of Eight Dollars (?8.00) each for said election. Said proposition shall appear on the ballots to be used at said election in the words and figures as the same is set forth in Section 1 of this Resolution, and in addition to other matters required to be stated in said ballots, there shall appear thereon the following: "INSTRUCTION TO VOTERS: To vote on a question or proposition, stamp a cross (X) in the voting square after the word "YES" or after the word "NO"; all marks, except the cross (X) are for- bidden. 611 distinguishing marks or erasures are forbidden and make the ballot void. If you wrongly stamp, tear or deface this ballot, return it to the inspector of election and ob- tain another." SECTION 6. If an elector shall stamp a cross (X) after the printed word "YES ", his vote shall be counted in favor of the adoption of said ordinance, and if he shall stamp a cross (X) in the voting square after the printed word "NO ", his vote shall be counted against the adoption of the same. If a majority of the qualified electors vo- ting on said proposed ordinance shall vote in favor thereof, such ordinance shall thereupon become a valid and binding ordinance of the said City of El Segundo, and shall be considered as adopted upon the date that the vote is can- vassed and declared by the Board of Trustees of said City and as provided by law shall go into effect ten (10) days -7- thereafter. SECTION 7. That in all other respects, said special municipal election shall be conducted in the manner required by the resolutions and ordinances of the said City of E1 Segundo, relating to the elections and the laves of the State of California relating thereto, as far as the same may be applicable. SECTION 9. The City Clerk shall certify to the passage and adoption of this Resolution; shall enter the same in the Book of Resolutions of the City of E1 Segundo; shall make a minute of the passage and adoption thereof in the records of the Board of Trustees of said City in the minutes of the meeting at which the same is so passed and adopted; shall cause this Resolution to be published by three consecutive insertions before the date of said election in the E1 Segundo Herald, a weekly newspaper of general circulation, printed, published and circulated within the said City, which is hereby designated for that purpose; and he shall conspicuously post a printed copy of said Resolution at least one week next preceding the date of said election in three public places within the said City, to -wit, one copy thereof on the bulletin board near the main entrance to the City Hall in said City; one copy thereof on the bulletin board at the United States Post Office in said City; and one copy thereof on the bulletin board at the main entrance to the refinery of the Standard Oil Company in said City.
