1994 MAY 17 CC MIN-7MINUTES OF THE REGULAR MEETING OF THE EL SEGUNDO CITY COUNCIL May 17, 1994 - 7:00 P.M. CALL TO ORDER Mayor Jacobson at 7:10 P.M. INVOCATION - Rev. John Svendsen, First Baptist Church PLEDGE OF ALLEGIANCE - Councilwoman Friedkin PRESENTATIONS 1. Proclamation declaring the month of May as Drought- Proofing Month. Mayor ProTem Weston presented a Proclamation declaring the month of May as Drought - Proofing Month to Mr. Ed Little of W BMW D, Mr Little gave a brief presentation on the water reclamation plant. 2. Proclamation proclaiming June 3, 1994 as Law Enforcement Re- cords and Support Personnel Day. Councilman Robbins presented a Proclamation to Fern Ruiz proclaiming June 3, 1994 as Law Enforcement Records and Support Personnel Day. 3. Proclamation designating June 11, 1994 as Volunteer Recognition Day in El Segundo and inviting its volunteers to a picnic in their honor to celebrate "Saturday in the Park" from 11:30 am to 3:00 pm on that day at Chevron Park. Ron Swanson, 629 California Street; spoke on behalf of R.O.A.D. and suggested if the City was going to fund by matching funds, they begin this on next years budget to facilitate R.O.A.D. tracking their fund raising. 2. Ruth Bixler, 733 W. Pine Ave: spoke representing the Woman's Club, and invited everyone to attend the Memorial Service at 10 A.M. at the El Segundo High School on Memorial Day. 3. Roger Barrel 225 1/2 Whiting St.: spoke on concerns with the con- struction on Grand Ave, pot holes and resulting vibration of residents buildings. Mayor jacobson stated he will ask Public Works to look into this.. 4. Joe Vitori, 124 W. Oak: commended the Council on their action taken at Budget Meeting. 5. Liz Garnholtz, resident; spoke regarding a problem with the Sepulveda tunnel widening project and traffic. 6. Discussion and possible action of Ordinance 1215 which enables the City to give transient occupancy tax credits - Willard Krick. Mr. Krick, 1414 E. Mariposa; spoke regarding the referendum petition on Ordinance 1215 that was submitted, and urges Council to respond. 7. Barbara Briney, representing PAVE; gave Council a progress report on the formation and actions of PAVE. 8. Susan Williams Gerra, introduced herself as the District Man- ager Representative for the Gas Company. 9. Nancy Wernick 515 Loma Vista: spoke on the progress of SB 1654, and discussed the amendments that are being submitted. She stated that the next stop would be the Senate Floor. 10 Jerry Saunders, CDC; spoke regarding the Sepulveda Tunnel 1 1 Frank Wong, spoke regarding the Joint use Agreement. City Attorney Lee Dolley announced from Close session the following proceed- ings have been initiated: City of El Segundo vs Stephen S. Rocco dba Big Brother, complaint for preliminary and permanent injunction and for collection of busi- ness tax and penalties; City of El Segundo vs Salvatore John Rocco, Jr. dba Bitch Skateboards, complaint for preliminary and permanent injunction and for collection of business tax and penalties. SPECIAL ORDERS OF BUSINESS 1. Public hearing on Environmental Assessment EA -338, Historical Preservation HP 94 -1, and consideration of adoption of a resolution approving the designation of the Urho Saari Swim Stadium (aka Plunge) at 219 W. Mariposa Avenue as a designated cultural resource. Mayor Jacobson stated that this is the time and place hereto fixed for a public hearing on Environmental Assessment EA -388, Historical Preservation HP 94 -1 2 and consideration of adoption of a Resolution approving the designation of the Urho Saari Swim Stadium (aka Plunge) at 219 W. Mariposa Avenue as a designated cultural resource. He asked if proper notice of the public hearing was done in a timely manner and if any written communication had been received regarding this public hearing? Clerk Mortesen responded that public hearing notice was done by the Plan- ning and Building Safety Department, and no written communications had been received regarding this matter. MOTION PASSED BY UNANIMOUS VOICE VOTE 5/0 City Attorney Lee Dolley read the following: RESOLUTION NO. 3866 A RESOLUTION OF THE CRY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA FOR APPROVAL OF ENVIRONMENTAL ASSESSMENT EA- 338 AND HISTORIC PRESERVATION HP 94 -1 DESIGNATING THE URHO SAARI SWIM STADIUM (aka PLUNGE) AS A DESIGNATED CULTURAL RESOURCE LOCATED AT 219 W. MARIPOSA AVENUE MOVED by Councilman Robbins SECONDED by Councilwoman Friedkin to approve Environmental Assessment EA -338, and to adopt Resolution No. 3866 approving the designation of the Urho Saari Swim Stadium (aka Plunge) at 219 W. An ordinance of the City Council of the City of El Segundo, Califor- nia, amending Chapter 10.52 (Special Speed Zones) of Title 10 (Vehicles and Traffic) of the El Segundo Municipal Code. City Attorney Lee Dolley read the following: ORDINANCE NO. 1222 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, AMENDING CHAPTER 10.52 (SPECIAL SPEED ZONES) OF TITLE 10 (VEHICLES AND TRAFFIC) OF THE EL SEGUNDO MUNICIPAL CODE. Councilman Robbins stated concerns with lowering the speed limit on the straight section of Continental to 30 MPH. Mayor ProTem Weston INTRODUCED ORDINANCE NO. 1222 with the wording clarification in section 10.52.020. C. UNFINISHED BUSINESS 1. Golf course and driving range operational review and authoriza- tion to proceed with appropriate actions. Estimated cost: $104,500. 3 Jack Wayt, Interim Director of Recreation and Parks gave a presentation on all the alternatives for solving the current problems with the driving range. 1) Lake filling with golf balls: MOVED by Councilman Switz SECONDED by Mayor ProTem Weston to fill the lake and cover it with sod. MOTION PASSED BY UNANIMOUS VOICE VOTE 5/0 2) Additional Parking: COUNCIL CONSENSUS to direct staff to proceed with developing parking alternatives with West Basin and implement a temporary shuttle service as part of the operation. MOVED by Councilman Switz SECONDED by Councilwomen Friedkin to discuss entering into negotiations with WBMWD during closed session. MOTION PASSED BY UNANIMOUS VOICE VOTE 5/0 3) Driving Range North and South sides: MOVED by Councilman Switz SECONDED by Councilwoman Friedkin to extend both North and South driving ranges fences and additional 20 feet in height at an approximate cost of $52,000; install netting at the ninth tee, 25 feet high by 100 feet long directing shots away from the range and patio area, approxi- mate cost $9,500; and plant fast growing Eucalyptus trees off the North /West corner of the range toward the ninth green, approximate cost $3,000. MOTION PASSED BY UNANIMOUS VOICE VOTE 5/0 4) Driving Range East end: COUNCIL CONSENSUS a) to erect a temporary fence on the Hughes Curb line (with cooperation from Hughes), approximate cost $50,000, or install 20 foot netting at the property line and use limited flight ball approximate cost $40,000. b) contact SCE and request raising the existing Hughes Service poles to allow for 40 -50 foot netting at the property line approximate cost $250,000 and continue to police the range. 2. Amendment to Management Agreement to maintain and oper- ate the El Segundo Golf Course and related facilities, concession agreement to facilitate the on -site sale of beer and wine. Jack Wayt gave a brief staff report. MOVED by Councilman Switz SECONDED by Councilwoman Friedkin to approve the amendment to Contract 2325 with Practice Tee, Management Agreement to maintain and operate the El Segundo Golf Course and related facilities, concession agreement to facilitate the ont -site sales of beer and wine. MOTION PASSED BY UNANIMOUS VOICE VOTE 5/0 RECESS 9:07 RECONVENE 9:20 ALL MEMBERS PRESENT 3. Presentation by City water rate consultant concerning issues affecting City's future water rate structure. Bill Ferry, Consultant, explained the procedure on the study. Council received and filed the report and basically agreed with the methodol- ogy for formulating the water rate structure. 4 4. Consideration of an ordinance amending Chapter 5.28 of the El Segundo Municipal Code regulating pool rooms and billiard rooms. Don Harrison, Assistant City Manager gave a brief staff report. Jeanne Yagley, 824 Maryland; stated she is concerned with the behavior of the customers not the addition of pool table. She also suggested extending the hours of pool tables after the close of the bar to facilitate more time between drinking and driving., Willard Krick, questioned if the existing establishment was covered by this and how was the 30% figure arrived at. Lottie Gillig, 1637 E. Palm Ave; requested clarification of the Ordinance and who it applies to, She also stated she agreed with the hours of operation. Council discussed many of the issues surrounding the pool play, hours, and operation. They also stated that if a guard was necessary they would like the means to require the establishment to provide one. City Attorney Lee Dolley stated the permit can be conditioned as determined by the Council. City Attorney Lee Dolley read the following: ORDINANCE 1223 AN ORDINANCE OF THE CITY OF EL SEGUNDO, CALIFORNIA, AMENDING CHAPTER 5.28 OF THE EL SEGUNDO MUNICIPAL CODE ENTITLED POOL ROOMS AND BILLIARD ROOMS, BY AMENDING SECTIONS 5.28.020 AND 528.080, DELETING SECTION 5.28.060 AND ADDING A NEW SECTION 5.28.015 Mayor ProTem Weston INTRODUCES ORDINANCE 1223, with the addition of "conditionally granted" to section 5.28.10 and "or further condition" to section 5.28.020. D. REPORTS OF COMMITTEES, BOARDS AND COMMISSIONS 1. Request for City Council to schedule interviews for applicants to the (1) Recreation & Parks Commission; (2) Senior Housing Corpora- tion Board of Directors; (3) Library Board of Trustees; and (4) the Planning Commission. COUNCIL CONSENSUS TO SCHEDULE: Recreation and Parks and Library Board for May 23, 1994 at 7:00 P.M. and Planning Commission and Senior Housing Board for June 13, 1994 at 7:00 P.M. Council also authorized the extension of the Senior Housing Board vacancy to 5 P.M. May 31, 1994. Mayor Jacobson stated that He and Mayor ProTem Weston will be working the Recreation and Parks Commission on the Golf Course dedication ceremonies. 5 2. Report from the Planning Commission recommending to the City Council that the Urho Saari Swim Stadium (aka Plunge) at 219 W. Mariposa Avenue be considered for designation as a state and federal historic site and that the interior of the building be pre- served, which would require an amendment to Chapter 20.52 of the Zoning Code. COUNCIL CONSENSUS that they are concerned with the interior preservation but do not wish to restrict any future repairs or maintenance by adhering to the State and Federal Historic quidelines. E. Warrant Numbers 211746-211964 on Demand Register Summary Number 23 in total amount of $968,322.22, and Wire Transfers in the amount of $151,530.71. 2. City Council meeting minutes of May 3, 1994. 3. Recreation and Parks Commission's recommendation for the Operating Manual of the El Segundo Golf Course. 4. Acceptance of improvements - lining of sewer lines. Specifications No. PW 92 -6 (final contract amount = $86,870). 5. Request for City Council to approve awarding Bid #9329, Fire Department Protective Clothing for Structural Firefighting, in the amount of $23,252.10 to All Star Fire Equipment, Inc., the only responsive bidder. 6. Review and analysis of various options available to insure the City of El Segundo against liability claims. Fiscal impact: $265,571 for FY 94/95 (budgeted). 7. Task Order No. 4 agreement between the City and Harris and Associates for professional engineering services to provide design, construction engineering and management, and geotechnical services for reconstruction of storm drain pump station Nos. 15 and 19 (hourly rates not to exceed a total services cost of $395,235). Discussion and possible action relating to ordinance allowing El Segundo to give transient occupancy tax credits to Summerfield Suites Hotel and the Citizens Referendum on that ordinance. ITEM NOT DISCUSSED Councilman Robbins stated that he would like the City Council to write a letter to Assembly Debra Bowan asking her to reconsider her position opposing much needed new prison construction. He asked that this item be agendized for the next regular Council Meeting. Councilman Switz - Stated he had received a response from Bowens office regarding the Brown Act and would like the Council to respond. City Attorney Lee Dolley volunteered to help Council write letters complaining about the Act. Mr. Dolley and Councilman Switz to work on this project. Mayor ProTem Weston 1. Discussion and possible action regarding Community Cable Advi- sory Committee makeup and duties. Requested that the Council investigate other cities policies regarding the formation of their Cable Boards, and for Council to possibly consider new regulations. Staff to return with a report.
