1989 JAN 10 CC MINEL SEGUNDO CITY COUNCIL MEETING - MINUTES ADJOURNED REGULAR CITY COUNCIL MEETING-JANUARY 10, 1989- 7:OOPM CALL TO ORDER by Mayor Jacobson at 7:00 P.M. PLEDGE OF ALLEGIANCE led by Councilman Anderson ROLL CALL Councilman Anderson - present Councilman Clutter - present Councilman West - present Mayor ProTem Dannen - present Mayor Jacobson - present CLOSED SESSIONS Pursuant to the California Government Code a Closed Session will be held on the following matters: GC 54956.9(b) (City might have significant exposure to litigation) 1 matter At the hour of 7:05 p.m. Council adjourned to the Mayor's Office for a Closed Session. At the hour of 7:19 p.m. Council reconvened in the Council Chambers with all members present and answering roll call. Mayor Jacobson announced that no decisions were made in Closed Session. PUBLIC COMMUNICATIONS (City Business Only -5 min.limit) 1. Dennis Martin, 722 Indiana Ct. commented favorable on the airport sign initiated by Councilman Clutter. Discussion of the March 71 1989 Special Election in reference to recent Court Decisions. City Attorney Dolley stated that the recent Court Decision that dealt with Proposition 62 and citizens rights to referendum, declared it was an invalid delegation to the citizens of the taxing duties of the Council body. Council can vote by a four - fifths vote to continue with the Election or Council can enact the Ordinances with a three - fifths vote and pass the tax (or any taxes as long as they are not a "special tax ") as a legislative body. City Attorney Dolley stated that a "Special Tax" is for a special purpose such as PERS, a designated tax for a specific purpose. This tax still requires voter approval. Mayor ProTem Dannen MOVED that the Employee Confidential letter received from Burke , Williams and Sorenson with regard to this matter be made public, Councilman West SECONDED. MOTION CARRIED BY UNANIMOUS VOTE (1) Council Minutes January 10, 1989 Mayor ProTem Dannen invited citizens at home viewing to attend the meeting and share their views on this issue. 1. Larry Fine 427 Loma Vista was in favor of the election and the voter option to decide which tax is enforced. 2. Gary Schultz, 227 E. Oak expressed concern regarding the Council possibly enforcing taxes only on industry. Mr. Schultz was in favor of the election. Mayor ProTem Dannen stated that because this City is a general Law City, the right of referendum for citizens will not be upheld. However, if E1 Segundo was a Chartered City those rights would be in place. Mayor ProTem Dannen stated that it would take $20,000 to get an advisory statement only from the electorate regarding these taxation issues and would like the City of E1 Segundo to look toward becoming a Chartered City. As it stands the City will hold an election for advisory purposes from the electorate on March 7, 1989. Councilman West stated that he would like Council give definitive action in its measures toward raising revenue by starting from the beginning in deliberating revenue considerations. IT WAS THE CONSENSUS OF COUNCIL TO TAKE THIS ITEM OUT OF ORDER 3. The Griffith Report (a) Police Department (b) Fire Department Diane Arakaki, Representative of David Griffith and Associates gave a report and findings of the full cost in providing services for Police and Fire. An overhead presentation was given. Ms. Arakaki suggested the City recover $193,328 of the total $282,000 plus that is currently being subsidized. A recommendation for increasing the existing fees and bring them more in line with neighboring cities. Ms. Arakaki stated the Fire Department was estimated for the User Fee Services. Total cost for operating the Fire Department is $5.5 million. The department is currently subsidizing $2 million plus. Ms. Arakaki recommended recovering $281,695 a net increase of $193,267. Recommendations for full cost recovery of high rise inspections (fire prevention on an annual inspection basis) were also noted. Jerry Saunders. Continental Development asked what the percentage of the total cost was reflected as City wide costs. Council recessed at 8:05 PM and reconvened at 8:11 PM with all members answering roll call.
