SPECIAL ORDERS OF BUSINESS 1. STATUS REPORT ON CITY'S HYPERION TEAM EFFORTS TO BRING ABOUT MODIFICATIONS TO PROPOSED PROJECTS AT HYPERION TREATMENT PLANT. City Manager Cano gave Council an update regarding the Hyperion Treatment Project. He stated Council had authorized the procurement of services of consultants, including outside legal assistance to review the procedures, practices and major concerns addressed by the Citizens of the community regarding the Hyperion Treatment Plant. Mr. Jim Anderson of the law firm of Brunick & Pyle and Mr. Ray Lewis, a consultant in waste water issues were hired to assist in this review. Additionally, Richard Miura, Planning Manager; Bellur Devaraj, City Engineer; Lynn Harris, Development Services Director, Lee Dolley, City Attorney and Don Harrison, Assistant to the City Manager were a part of the project team. These individuals developed strategies, evaluated possible mitigation measures, contracted agencies with jurisdiction and interest in the issues at the Hyperion Plant, and conducted research to support positions. Assistant to the City Manager, Don Harrison gave a presentation on the overhead projector listing the findings of the project team. The following were of concentration: A. Current construction activities at the Hyperion Waste Water Treatment Plant. B. Proposed construction of facilities which would require a Conditional Use Permit from the City. C. Odor nuisance conditions from the existing facility and the HERS facility. D. Future construction programs. Mr. Harrison stated there were specific areas that required mitigation measures or alternatives: 1) Mitigation of odor nuisance from the existing plant; 2) Mitigation or limitation or the amount of flow treated at Hyperion for ocean discharge; 3) Mitigation of the amount of construction needed at the Plant for the future; 4) Mitigation on the visual impacts of the Hyperion Plant upon operation at full secondary; and 5) Expansion of existing facilities. City Manager Cano informed Council that through the team's research, sufficient documentation presenting proposed short term mitigation measures which would reduce odors from the facility. The following mitigation measures would be sought: Enclosure of conveyor belts that transport sludge to the truck loading area; enclosure of the truck loading area; digester gas venting system operational control (1) Council Minutes December 12, 1989 or venting to scrubbers in a mobile unit; continued use of the after- burner as an odor control measure for the Carver - Greenfield system, and connection of the pressure relief valves to the odor control device and improved mixing of ferric chloride on the influent raw sewage lines to reduce hydrogen sulfides in the headworks. Manager Cano concluded the team had developed a procedure for the receipt and processing of odor complaints through the cooperation of the Police Department. Manager Cano recommended a closed session discussion regarding legal considerations in this matter. Mayor Jacobson suggested that the meeting be open to Public Communications. 1. Gerhardt Van Drie, 724 Pine stated that the affect of Hyperion on residents has never received due consideration and that the presentation presented tonight was not people oriented. He continued by saying that mitigation measures will help but should not be the primary focus. The City should create a people orientated analysis. 2. John Van Hook, Chairman of SEE urged Council to adjourn to Closed Session and take deliberate action. 3. Jim Ferguson, resident stated the presentation given did not consider economics and stated the City should address water conservation, should learn from experienced EPA staff, and requested that the Hyperion staff inform residents of agenda items for the next meeting of Hyperion and the EPA. At the hour of 7:30 p.m. Council adjourned to the Mayor's Office for Closed Session. GC 54956.9 (b) (City might have significant exposure to litigation). Between the hour of 8:50 p.m. and 9:05 p.m. Council recessed from Closed Session. At the hour of 9:18 p.m. Council reconvened in the Council Chambers with all members present and answering roll call. City Manager Cano stated that as a result of the time and effort spent on this project, staff is convinced that a public nuisance and health hazard exists in the City of El Segundo as it involves the Hyperion Treatment Plant affecting the quality of life of citizens and El Segundo. In light of this it is recommended that Council direct staff to proceed with 1) gather affidavits from citizens to establish the public nuisance and health hazards in a court of law; 2) to proceed to obtain an agreement with the City of Los Angeles on specific short term odor abatement and mitigation measures; 3) to direct staff to discuss with the EPA changes to the long term construction project to minimize or eliminate all environmental impacts on the citizens of El Segundo and 4) staff is requesting that all interested citizens participate in the continued Public Hearing on the Conditional Use Permit set for January 16th and to widely publicize this hearing. Mayor ProTem Dannen MOVED, Councilman Clutter SECONDED to proceed with the recommendations as stated by the City Manager. MOTION CARRIED BY UNANIMOUS VOICE VOTE. PUBLIC COMMUNICATIONS (City Business Only -5 minute limit) 1. John Van Hook, Chairman of SEE stated he and his organization were available for assistance in the next step regarding the Hyperion and thanked Council for their action. Patti Paynter, 920 Dune gave Council a report regarding a study she conducted sighting incidents of cancer in the City of El Segundo potentially link to the Hyperion Treatment Plant. 3. Jim Ferguson, resident, addressed Council regarding the potential health and respiratory diseases possibly created by Hyperion emission. 2. COMMITTEES, COMMISSIONS AND BOARDS 1. Vacancy to the Senior Citizens Housing Corporation Councilman Clutter MOVED, Mayor ProTem SECONDED to accept the single application that was received from the last recruitment. Councilman Anderson and Councilman West wanted the Senior Housing Board to have the opportunity to review the application before appointment. COUNCILMEMBERS REPORTS AND RECOMMENDATIONS -Mayor Pro Tem Dannen Mayor ProTem Dannen asked that the subject of Police Safety be considered and discussed on the next regular agenda rather than in a special workshop. City Manager Cano stated the subject of Police Safety could be agendized at the next regular City Council Meeting. City Manager Cano announced that the Hyperion's Meeting that was scheduled for December 13, 1989 will be rescheduled for January 10, 1990. ADJOURNMENT At the hour of 9:35 p.m. Council adjourned.
