The Mayor stated the files would become a part of this hearing and then inquired if any written communications had been received, to which the Clerk replied that none had been received. Assistant Planner Cosin requested that this item be removed from the agenda, that there were matters which needed further action by the Planning Commission. The Mayor inquired if there were any objections t-) referring this matter back to the Planning Commission. Hearing none, he so ordered. b. Hearing on abatement of weeds, rubbish, refuse and dirt at three locations in accordance with Resolution No. 2949 The Mayor announced that this was the time and place heretofore fixed for consideration of all objections to the proposed removal of weeds, rubbish, refuse and dirt at various locations within the City of El Segundo in accordance with Resolution of Intention No. 2949, and inquired of the Clerk if proper notice of the hearing had been given. The Clerk replied that affidavits of posting and mailing the notices were in the City Clerk's file. The Mayor stated the files would become a part of this hearing. The Mayor then inquired if any written communications had been received, to which the Clerk replied that none had been received. Director of Public Works Glickman reported that none of the parcels listed on subject resolution had been cleaned satisfactorily and recom- mended that the lots be ordered cleaned by City crews. The Mayor inquired if anyone present wished to speak in this matter. There being no reply, motion was made and carried that the hearing be closed. Thereafter, motion was made by Councilman Nagel, seconded by Councilman Van Vranken, that the Street Superintendent be authorized to abate the nuisances by having the weeds, rubbish, refuse and dirt re- moved from the properties listed in Appendix 'A' of said Resolution No. 2949. MDtion carried by the following vote: Ayes: Councilmen Benson, Bue, Nagel, Van Vranken and Mayor Balmer Noes: Councilmen None Absent: Councilmen N.)ne C. Appeal of Sergeant L. M. Lunsford and Sergeant R. R. Green regard- ing interpretation -)f Administrative Code relating to salary increases The Mayor announced that the purpose of this matter was to consider the appeal by above employees from the determination of the City Manager that their salary levels on promotion to sergeant were correctly computed at the time of their promotion; that this determination was !eased upon a consideration of Section 1A6.090 of the E1 Segundo Administrative Code. The Mayor inquired if the appellants were present. Both officers responded. Mr. William SQhaeffer stated he represented both appellants and advised that the dispute was over the interpretation of whether the title Detective was a classification, that in his and the appellants' opinions this was a classification and, therefore, their salary increase upon pro- motion to the classification of Sergeant should have been based upon the salary they had been receiving as Detectives, not as Police Officers. Stated the difference amounted to approximately $100 per month. Councilman Nagel stated it had not been his intent, at the time the salary resolution was adopted, that special assignments be considered classifica- tions. City Manager Jones advised that Mr. Schaeffer's proposal w -)uld create inequity situations in the Police Department; that if special assiprn- ments were considered classifications, it would be necessary to Council Minute Nov. 6, 1979 hold promotional examinations for those positions and the practical experience derived by rotating the officers in and out of special assign- ments would no longer be received. Stated this interpretation would have an impact on both the Merit Ordinance and the Salary Resolution. Mr. Schaeffer asked that the Council find in the officers' favor by basing the percentage increase on the amount received by the officers at the time of their promotion. Each of the officers responded to Councilman Bue's direct questioning. Motion was made by Councilman Benson that the City Manager's recom- mendations be upheld. After further discussion, Councilman Nagel offered a substitute m -)tion, to take the matter under advisement until the first meeting in December. Councilman Van Vranken seconded the motion, which carried by the following vote: Ayes: Councilmen Bue, Nagel, Van Vranken and Mayor Balmer Noes: Councilman Benson Absent: Councilmen None 7. ORAL COMMUNICATIONS a. Mr. Wesley Bush, Manager of the El Segundo Chamber of Commerce stated a group of people are interested in building a break water off the E1 Segundo Beach. Announced that a meeting had been scheduled to dis- cuss the matter, at 2:00 o'clock p. m. , Tuesday, November 13, 1979, in the City Hall West Conference Room; invited all those interested to attend. 8. City Manager Jones 1) Amendment to Municipal Code relating to parking vehicles on City -owned or operated parking lots for purposes of selling Advised that the practice of placing vehicles on public parking lots for sale was creating policing problems and the Chief of Police had re- quested an ordinance be written so that the City could control the practice. City Attorney Allen presented an ordinance amending the Municipal Code, entitled: AN ORDINANCE OF THE CITY OF EL SEGUNDO, CALIFORNIA, ADDING SECTION 10. 29.065 TO THE EL SEGUNDO MUNICIPAL CODE WHICH SAID SECTION RELATES TO PARKING VEHICLES FOR SALE ON CITY -OWNED OR OPERATED PARK- ING LOTS which title was read. Upon motion duly made and carried, further reading of said ordinance was waived. Thereafter, said ordinance was introduced by Councilman Bue. 2) Fire and extended coverage insurance protection for City buildings Advised that Chubb Insurance Company was the most competitive in subject field of insurance and, therefore, the City's consultant had not solicited proposals. Stated the quotation from Chubb was for $8, 335 for renewal of the provisions currently in force, which is less than the premium rate for last year. Recommended the City remain with Chubb Insurance Company for the 1979 -80 policy year. Motion was made by Councilman Bue, seconded by Councilman Nagel, that the City Manager's recommendation be accepted and the City's property insurance be renewed with Chubb Insurance Company for one year, expiring November 20, 1980. Ordinance relating to signs for condominiums City Attorney Allen presented subject ordinance, entitled: ORDINANCE NO. 979 AN ORDINANCE OF THE CITY OF EL SEGUNDO, CALIFORNIA, AMENDING TITLE 20 (THE COMP- REHENSIVE ZONING ORDINANCE) OF THE EL SEGUNDO MUNICIPAL CODE BY AMENDING SECTION 20.24. 220 RELATING TO SIGNS FOR CONDOMINIUMS which title was read. Upon motion duly made and carried, further reading of said ordinance was waived. Thereafter, motion was made by Councilman Nagel, seconded by Councilman Van Vranken, that said ordinance be adopted. Councilman Nagel asked if something could be done to clean the grounds around the Scout House on Grand Avenue, that if the Scouts could not keep it up, then suggested the City forces do the work and charge the cost to the Scouts. Director of Recreation and Parks Ruis advised that City personnel were working with the Scouts regarding improvements. b. City Clerk Burrowes advised that the first meeting in January falls on a holiday, and therefore, recommended the Council meet on the day following - Wednesday, January 2, 1980. Motion was made by Councilman Van Vranken, seconded by Council- man Nagel, that the City Clerk's recommendation be accepted. Motion carried. c. The City Clerk further advised that it may be necessary to hold an additional meeting in January to handle Municipal Election matters. Asked the Council to tentatively reserve January 21 for this purpose. 15. ORAL COMMUNICATIONS - -- None 16. RECESS At the hour of 9 :00 o'clock p. m. , the Council recessed to an Executive Session in the Mayor's Office. At the hour of 9:35 o'clock p. m. the Council reconvened, all members being present and answering roll call. 17.
