1978 OCT 17 CC MINX 48ZO MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO October 17, 1978 1 . CALL TO ORDER X 48 ZD The El Segundo City Council convened in regular session on Tuesday, October 17, 1978 at 7:00 o'clock p.m., in the Council Chamber of the El Segundo City Hall. 2. PLEDGE OF ALLEGIANCE Councilman William Bue led the salute to the Flag. 3. INVOCATION Delivered by Father Feodor Wilcock of St. Andrew's Catholic Church 4. ROLL CALL Present: Councilmen Benson, Bue, Nagel and Mayor pro tem Van Vranken Absent: Mayor Balmer 5. SPECIAL ORDER OF BUSINESS a. Hearing to consider proposed ordinance adopting the Uniform Fire Codes The Mayor pro tem announced that this was the time and place heretofore fixed for subject hearing. City Attorney Allen advised that this public hearing had been published to con- sider adoption of the Uniform Fire Code, 1976 Edition, and secondary codes, Volumes 1 throuth 16 of the National Fire Code, 1978 Edition, that after said publication it became apparent that the Building Department was in the process of amending Volume 6 of the National Fire Code. Proposed that this public hearing be cancelled, a new ordinance introduced which would adopt all the codes except Volume 6, that the ordinance heretofore introduced be received and filed, and that the form of notice for rescheduling the public hearing be approved. Mayor pro tem Van Vranken inquired if anyone present wished to present any testimony in regard to the Fire Codes. There being no response, the Mayor pro tem ordered the ordinance, heretofore introduced, filed. City Attorney Allen presented the following ordinance, entitled: AN ORDINANCE OF THE CITY OF EL SEGUNDO, CALIFORNIA, ADOPTING THE "UNIFORM FIRE CODE, 1976 EDITION," INCLUDING APPENDIXES A, B, C, D, E, F AND G; REPEALING IN ITS ENTIRETY CHAPTER 17.04 OF, AND ADDING CHAPTER 17.04 TO, THE "EL SEGUNDO MUNICIPAL CODE," WHICH CHAPTER RELATES TO THE FIRE CODE which title was read. Upon motion duly made and carried, further reading of said ordinance was waived. The City Attorney advised that the aforesaid ordinance would adopt by reference the 1978 Edition of the National Fire Code, Volumes I through 5 and 7 through 16. X -4821 Motion was made by Councilman Nagel, seconded by Councilman Bue, that three copies of said Uniform Fire Code 1976 Edition and three copies of the National Fire Code, Volumes I through 5 and 7 through 16 be placed on file in the office of the City Clerk. Motion carried. Thereafter, the ordinance, heretofore read by title, was introduced by Council- man Bue. Motion was made by Councilman Bue, seconded by Councilman Nagel, that a public hearing be scheduled for consideration of the aforesaid Fire Codes on November 21, 1978. Motion carried. Motion was made by Councilman Nagel, seconded by Councilman Bue, that the form of the Notice of Public Hearing, presented on this date, be approved and that said Notice be published twice in the El Segundo Herald as required by law. Motion carried. 6. ORAL COMMUNICATIONS -- None 7. REPORTS OF COMMITTEES a. Noise Abatement. Councilman Nagel reported that the Aircraft and Airport Noise Reduction Bill M7.773063 passed the House but failed in the Senate, for the reason that it would not be appropriate to replace the old airplanes at this time. Stated the Senate acted to reduce the airplane ticket tax by 2 %, but did not earmark the savings for any specific purpose. 8. CONSENT CALENDAR Councilman Benson asked that approval of the minutes of the October 3, 1978 meeting be removed for discussion. b. Motion was made by Councilman Nagel, seconded by Councilman Bue, that Warrant Numbers 61116 through 61259 on Demand Register Summary No. 8 and Expense Checks Nos.2044 through 2053 on Expense Check Register No. 6, in total amount of $874,351 .16, conforming to the Budget approved by Ordinance No. 959 be ratified and approved. Motion carried unanimously 9. CALL ITEMS FROM CONSENT CALENDAR a. Minutes of regular meeting of the City Council held October 3, 1978 Councilman Berson stated that Planning Commissioner Charland did not get mention in the minutes and he thought he had a lot to say regarding animal control in condominium developments. City Attorney Allen advised that if the Council wishes the minutes changed, it may request that the minutes be resubmitted with the changes or move to amend the minutes by making certain corrections or insertions. Thereafter, motion was made by Councilman Benson, seconded by Councilman Bue, that a summary of the remarks made by Pete Charland at the meeting held October 3, 1978 be inserted in said minutes. Motion carried. (Councilman Nagel abstaining) . 10. WRITTEN COMMUNICATIONS -- None 11 . REPORTS OF OFFICERS a. Acting City Manager Weber -2- Council Minutes October 17, 1978 x482 - - - 1) Proposals for Liability Insurance X 48 Z2 Presented proposals for liability insurance coverage, the breakdown of which included four different options. Stated that insurance premiums reflect a savings from those of last year, that generally there has been a down turn of high insurance premiums. Recommended that Option III(A) in the proposal received from Cal - Surance, dated October 11, 1978, be accepted. Advised that this would provide $150,000 self- insured retention with No -Stop loss, with Admiral Insurance Company covering from $150,000 to $1,000,000 at an annual cost of $61,593.60 based on the payroll; Midland Insurance Company covering from $1,000,000 to $2,000,000 for an annual flat rate of $27,000 and an additional $1,000,000 coverage, not heretofore provided, by Midland Insurance Company from $2, 000, 000 to $3, 000, 000 for a flat rate of $13,000, bringing the total cost of this new policy to $101, 593.60. Stated that this proposal provided considerable cost savings to the city and recommended that the difference between the budgeted amount of $138,352 and the premium cost of $101,593.60 be placed in a Liability Reserve fund for payment of future losses. Motion was made by Councilman Benson, seconded by Councilman Bue, that the Acting City Manager's recommendations be accepted and approved. There being no comments, the Mayor pro tem ordered the report filed. b. Acting Director of Public Works Jack Allen 1) Easements for right -of -way for improvements of Nash Street and Mariposa Avenue Councilman Bue announced that due to possible conflict of interest, he would not participate in any discussion or action of the items being presented by the Public Works Director pertaining to easements for rights of way or for construction of a water vault. Presented six easement deeds consisting of seven parcels of land proposed to be dedicated to the City for public street purposes in connection with improve- ments of Nash Street between Imperial Highway and Mariposa Avenue, and Mariposa Avenue between Nash and Douglas Streets. Stated that the City Attorney had approved the easements as to form. Recommended acceptance of the deeds. On roll call, said motion carried and the aforesaid six deeds were accepted, by the following vote: Ayes: Councilmen Benson, Nagel and Mayor pro tem Van Vranken Noes: Councilmen None Absent: Mayor Balmer Not Voting: Councilman Bue 2) Easement for Water Vault at Hughes Aircraft Company, Imperial Highway Development Advised that there was lack of sufficient right of way for installation of a water vault for water service to subject development and, therefore, Hughes Aircraft Company granted the City an easement for domestic water service. Stated the City Attorney had approved the easement as to form. Recommended acceptance of the easement. Motion was made by Councilman Benson, seconded by Councilman Nagel, that the following resolution be adopted: -8- Council Minutes October 17, 1978 - X-AZa RESOLVED, that that certain Grant of Easement for a Domestic Water Service Vault, dated September 27, 1978, from Hughes Aircraft Company to the City of El Segundo, for the right to use as an easement to construct a domestic water service vault that certain parcel of land situated in the City of El Segundo, County of Los Angeles, State of California, described as follows: That portion of the northwest quarter of Section 7, Township 3, South, Range 14 West, in the Rancho Sausal Redondo, in the City of El Segundo, County of Los Angeles, State of California, as per map recorded in Book 66, page 5 of Record of Surveys, in the office of the County Recorder of said county, described as follows: BEGINNING at a point in the northerly line of said northwest quarter and distant easterly 1,279.62 feet from the northwest corner of Section 7; thence south 00 00' 40" east 40.00 feet to the true point of begin- ning of this description; thence from said true point of beginning, north 89° 59' 20" east 3.00 feet thence south 00 01' 10" east 11 .00 feet; thence 890 59' 20" west 6.00 feet; thence north 00 01' 10" west 11 .00 feet; thence north 89° 59' 20" east 3.00 feet to said true point of beginning. be and the same is hereby accepted for and on behalf of the City of El Segundo, California; and BE IT FURTHER RESOLVED, that the City Clerk be and she is hereby authorized and directed to cause said instrument to be filed for record in the office of the County Recorder of Los Angeles County, California. UNFINISHED BUSINESS Councilmen Benson, Nagel and Mayor pro tem Van Vranken Councilmen None Mayor Balmer Councilman Bue City Attorney Allen requested to meet in Executive Session after this meeting to discuss three matters of litigation and one personnel matter. a. Ordinance amending City Code regarding self - insurance for fleet taxicab operations entitled: AN ORDINANCE OF THE CITY OF EL SEGUNDO, CALIFORNIA, AMENDING SECTION 5.16.250 OF THE EL SEGUNDO MUNICIPAL CODE WHICH SAID SECTION RELATES TO INSURANCE FOR TAXICABS AND VEHICLES FOR HIRE which title was read. -9- Council Minutes October 17, 1978 Upon motion duly made and carried, further reading of said ordinance was waived. Thereafter, motion was made by Councilman Benson, seconded by Councilman Bue, that said ordinance be adopted. Councilman Nagel inquired about the requirements in the State Vehicle Code in regard to self - insurance for taxicab companies, that he thought it dangerous and not protective of the public interest to allow taxicab companies to be self - insured. Stated hd would like to see evidence that self - insurance under the law does provide adequate protection. Thereafter, offerred a sub- stitute motion, which was seconded by Councilman Bue, that this matter be deferred for further information. Motion carried by the following vote: Ayes: Councilmen Bue, Nagel, and Mayor pro tem Van Vranken Noes: Councilman Benson Absent: Mayor Balmer 13. NEW BUSINESS a. The Council concurred in changing the date for the first meeting in November to Monday, November 6 in lieu of Election Day, November 7th. 14. ORAL COMMUNICATIONS -- None 15. RECESS At the hour of 7:30 o'clock p.m., the Council recessed to the Mayor's office for an Executive Session. At the hour of 8:10 o'clock p.m., the Council reconvened, the following members being present and answering roll call: Councilmen Benson, Bue, Nagel and Mayor pro tem Van Vranken. At this time the Clerk introduced Mr. Leuzinger and members of the Centinela Valley Historical Society, who had come to the meeting to make a proposal to the Council. Mr. Leuzinger stated he was in town to handle some of the affairs of his aunt who owned the property at Aviation and El Segundo Boulevards, that the family would like to donate the house and furnishings to the City of El Segundo since it had been one of the first residences,having been built in 1906. The Mayor pro tem advised that no decision could be made at this time; asked Councilman Benson and Director of Recreation and Parks Ruis to investigate the possibilities of accepting this gift; and that a member of the staff or council would contact Mr. Leuzinger's representative in this regard. 16. ADJOURNMENT No other business appearing to come before the Council at this session, motion was made by Mayor pro tem Van Vranken, seconded by Councilman Nagel, and unanimously carried, that the meeting adjourn in memory of Mrs. Carol Ayers, a long time resident of the City, and further that the meeting adjourn until Monday November 6, 1978 at the hour of 7:00 o'clock p.m., in the Council Chamber of the City Hall of the City of El Segundo; the hour of adjournment of this meeting being 8 :25 o'clock p.m. APPROVED: K.
