1963 DEC 30 CC MINX E1 Segundo, California December 30, 1963 An adjourned regular meeting of the City Council of the City bf E1 Segundo, California, was held in the Council Chamber of the City Hall of said City on- the -above date. The Clerk reported that a copy of Notice of Adjournment had been posted as required by law, and affidavit of posting was on file. Prior to calling the meeting to order, those present joined in pledging allegiance to the Flag of the United States of America, following which an invocation was given by Council- man Robert W. Frederick. 1641 The meeting was then called to order by Wilburn E. Baker, Mayor, the hour being 7:00 o'clock p.m. ROLL CALL Councilmen Present: Frederick, Kimport, Swanson, Tandy and Mayor Baker; Councilmen Absent: None. READING OF MINUTES OF PREVIOUS MEETING The minutes of the regular meeting of the City Council of the City of El Segundo, California; held December 23, 1963, having been read and no error or omission having been noted, it was , moved by Councilman Kimport,, seconded by Councilman Frederick, the minutes of said meeting be approved as recorded. Motion carried. WRITTEN COMMUNICATIONS The following written communications were received from persons, firms or corporations hereinafter named, and read to the Council. They were disposed of in the following manner.. 1. MRS. CHARLOTTE MOUSEL, SECRETARY, EL SEGUNDO YOUTH BASEBALL COUNCIL, INC., requesting permission to have a banner hung across Main Street during the week of official baseball registration, and that the City assume care and maintenance of the banner in the future. Moved by Councilman Swanson, seconded by Councilman Frederick, the request be granted, subject to checking with the Director of Public Works for height clearance. Motion carried. 2. WILLIAM EMMENS, PRESIDENT, LEAGUE OF CALIFORNIA CITIES, LOS ANGELES COUNTY DIVISION, sending Christmas and New Year Greetings to the Mayor and members of the City Council. Ordered filed. ORAL COMMUNICATIONS None. REPORTS OF OFFICERS AND SPECIAL COMMITTEES None UNFINISHED BUSINESS 1. The matter of apartment license tax fees was considered at this time. Councilman Tandy reported that the Tax Committee had met with the City Attorney to discuss the matter. It was pointed out that the license fee as outlines, is for the purpose of obtaining revenue. When considering these licenses, they were considered in the light of the cost to the City for services rendered. When apartment house fees were established, this was taken into consideration and the minimum number of apartments set. -1- - X 1642 Councilman Tandy further stated the license fee is based upon the physical number of units - the number of units indicate the size of the business, and whether the owner occupies one of the units is not a factor, nor is the percentage of occupancy. The return to the City from taxes on apartment houses, as compared to those from single dwellings, is not in proportion to the cost to the City for the extra police, fire protection, trash collection, etc. , imposed by the extra families occupying apartments. Therefore, the Committee came to the conclusion that the license fee is proper. It was then moved by Councilman Tandy, seconded by Council- man Kimport, that the opinion of the City Attorney as presented to the Council at its regular meeting held December 23, 1963, be ratified and confirmed. Carried by the following vote: Ayes: Councilmen Kimport, Swanson, Tandy and Mayor Baker; Noes: Councilman Frederick; Absent: Councilmen None. 2. The City Attorney read the title of the ordinas_ce amending Ordinance No. 594 and the Uniform Building Code, entitled: AN ORDINANCE OF THE CITY OF EL SEGUNDO, CALIFORNIA, AMENDING ORDINANCE NO. 594 OF SAID CITY AND THE "UNIFORM BUILDING CODE, 1961 EDITION, VOLUME I," THEREIN ADOPTED, BY AMENDING PARAGRAPH 4 OF SUBSECTION (C) OF SECTION 503 OF SAID CODE, AS AMENDED. Upon motion duly made and unanimously carried, the further reading of Ordinance No. 614 was waived. Following motion by Councilman Frederick, seconded by Council- man Swanson, Ordinance No; 614 was adopted by the following vote: Ayes: Councilmen Frederick, Kimport, Swanson, Tandy and Mayor Baker; Noes: Councilmen None; Absent: Councilmen None.
