The City Attorney then read the title of said ordinance, entitled: AN ORDINANCE OF THE CITY OF EL SEGUNDO, CALIFORNIA, AMENDING ORDINANCE NO. 594 OF SAID CITY AND THE "UNIFORM BUILDING CODE, 1961 EDITION, VOLUME 1" THEREIN ADOPTED, BY AMENDING PARAGRAPH 4 OF SUBSECTION (C) OF SECTION 503 OF SAID CODE, AS AMENDED., which was read. Thereafter, Councilman Swanson introduced said ordinance. 2. As requested at the last regular Council meeting, he presented a report on the question raised by Mr. William Lawson as to whether the owner of a four -unit apartment building, one unit of which is occupied by the owner, would be required to pay a business license fee on the apartment in which he is living; that an investigation into the background of the Code provision relating to the business license tax showed that full allowance for such provision was made; that the license is based upon the physical number of units - the number of units indicate the size of the business and as the size of the business increases the license fee also increases; whether owner - occupied or in the event it is unoccupied is a factor not taken into consideration through a literal interpretation of the ordinance; that it was his opinion that one must pay a business license fee on an apartment in which he is living because it is a fee based upon the physical dimension of the business and is not a fee based upon occupancy. The Council not concurring in a majority vote, the matter was referred to Committee for further study and recommendation at the next Council meeting. UNFINISHED BUSINESS 1.
