July 16, 1956 An adjourned regular meeting of the City Council of the City of E1 Segundo, California, was held in the Council Chamber of the City Hall of said City on the above date, having been called to order by Kenneth R. Bonfield, Mayor, the hour being 7:00 otclock P. M. ROLL CALL Councilmen Present: Frederick, Gordon and Mayor Bonfield; Councilmen Absent: Baker and Xeschuk. READING OF MINUTES OF PREVIOUS MEETING The minutes of the regular meeting held July 9, 1956, having been read and no errors or omissions having been noted, it was moved by Councilman Gordon, seconded by Councilman Frederick, the minutes of said meeting be ap- proved as recorded. Carried. WRITTEN COMMUNICATIONS Written communications, received from the persons, firm or cdrpora- tions, hereinafter named, were read to the Council and were disposed of in the manner indicated, following reference to each hereinafter: PLANNING COMMISSION, dated duly 13, 1956, transmitting therewith, copy of its Resolution No. 274 recommending proposed amendment to Ordinance No. 434 (the Zoning Ordinance), which would have the effect of deleting cer- tain uses from the C-M zone and adding same to the M -1 zone; and PLANNING COMMISSION, dated July 13, 1956, transmitting therewith, copy of its Resolution No. 271 recommending proposed amendment to Ordinance No. 434 (the Zoning Ordinance), pertaining to height of walls, fences or hedges on corner lots. Moved by'Councilman Gordon, seconded by Councilman Frederick, the following resolution be adopted: Carried. RESOLVED, that the communications from the City Planning Commission, each dated July 13, 1956, together with copies of said Commission's Resolutions Nos. 274 and 274 recommending amendments to Ordinance No. 434 (The Comprehensive Zoning Ordinance) of the City of El Segundo, said Resolution No. 274 which would have the effect of deleting certain uses from the C M zone and adding same to the M-1 zone, and said Resolution No. 271, pertaining to the height of walls, fences or hedges on corner lots, be received and ordered placed on file in the office of the City Clerk; and BE IT FURTHER RESOLVED, that the City Council does hereby not the matter of the proposed amendments to Ordinance No. 434 (The Comprehensive Zoning Ordinance) of the City of E1 Segundo, referred to in said Resolutions Nos. 274 and 271 of the City Planning Commission, for public hearing before this Council, to be held in the Council Chamber of the City Hall of the City of El Segundo, in said City, on Monday, the 20th day of August, 1956, beginning at the hour of 7:00 otclock P.M.;'and that the City Clerk be and she is hereby authorized and instructed to give notice of said hearing in time, form and manner as con- templated by law. -1- 1 • UT 1 M PLANNING COMMISSION, dated July 10, 1956, transmitting therewith, copy of its Resolution No. 269 granting a variance to Fred E. and Virginia M. Anderwort to allow subdivision on the southerly 80 feet of Lot 1, Block 9, Tract 1685, under certain conditions as not forth in said resolution. the comiunication was ordered filed pending expiration of appeal date. DEPARTMENT OF ALCOHOLIC BEVERdGE CONTROL, dated July 11, 1956, being copy of an application for transfer of an On Sale Beer license at Hill Billy Haven, 292 North Sepulveda Boulevard, E1 Segundo. Ordered filed. WEST BASIN MUNICIPAL WATIR DISTRICT, dated July 12,•1956, acknowledg- ing receipt of copy of r®solution adopted by the"City Council of the City of E1 Segundo at its meeting of June 11, 1956, requesting consideration of a pro- gram so that the West Basin Water District might obtain a larger water supply from the Metropolitan Water District, and advising that the City /s request has been forwarded to the Board of Directors of said Metropolitan Water District. Ordered filed. HORTON P. SMITH, CAPTAIN, CALIFORNIA NATIONAL GUARD, dated l,3 July, 1956, advising said organisation is sponsoring a circus to be held at the Manhattan Beach Armory, 4 August, 1956, for the purpose of raising funds for athletic and recreational facilities. By general consent, the communication was ordered filed and the City Clerk was requested to transmit a copy to the press for its use. ROLLAND E. HOWELL, 124 West Walnut Avenue, El Segundo, dated July 12, 1956, alleging that his home at the above address was damaged because of flood- ing during the heavy rains in January; that he feels the flooding was caused through the fact that the City has insufficient storm drains, and he inquired whether or not the City would take responsibility for the damage. The Mayor inquired of the City Engineer if he had made a survey, of the premises and the City Engineer stated ht had done so; that there ads hair cracks in the plaster on the outside and in some spots the plaster is falling off; that while he will agree there is some damage to the outside of the hove, yet many things other than storm waters could cause this character of damage. The City Attorney stated the City could deny any liability in the matter and refer same to its insurance carrier for further handling,, follow- ing which it was moved by Councilman Frederick, mdaWded by Councilman Gordon, the following resolution be adopted: Carried. `911i�D'LVtb, -that in view of the report made to this Council at this meeting by the City Engineer` and the opinion rendered by the City Attorney with respect to the allsged'daaage ocaulftng to the premises of Mr. Rolland E. Howell at 124 West Walnut Avenue, d" to storm waters, the City of El Segundo hereby denies any liability with respect to such alleged damage and the matter is hereby referred to the City's insurance carrier for any further handling. ORAL COMMUNICATIONS At this time Mayor Bonfield explained that representatives of the Department of Water and Power of the City of Los Angeles had been requested to be present at this meeting to answer questions and give information with respect to the construction of a proposed steam generating plant to be known as the Scattergood Plant and which will be erected on property immediately adjacent to the westerly boundary of the City of El Segundo. -2- ylf 98'7 City Manager Sailors than introduced Air. Gordon Sias, one of the representatives of said Department of Grater and Power. Air. Sins explained to those present that due to,the tremendous growth of the City of Los Angeles and the surrounding area, not only in population but in construction of new igdustries, there is naturally a need for more electrical powers that inns- _ much as no water is available the City of Los Angpl.es is faced with the _ responsibility of furnishing power through generation of steam. He them introduced Mr. James D. Laughlin, Assistant Chief Electrical Engineer of the Department of Water and Power, and he requested Mr. Laughlin to present draw- ings and plans of the proposed construction. Mr. Laughlin thereupon presented an architect's design for the com-- plate plan which he explained would take a number of years to complete; that initially only the center ,plant will be built, which will be completed in 1958 and the second unit in 1959• He also presented preliminary plans, and follow- ing the presentation of the above the meeting was thrown open to questions by citit6hs present. A tape recording of questions propounded by members of the City Council and the citizens was taken which recording is on file in the office _'bf the City Clerk and open to public inspection. Councilman Meschuk appeared during the foregoing discussion, the hour being 7:22 o'clock P.K. and he immediately took his seat at the Council table. Councilman Baker appearing during the foregoing discussion, the hour being 7:30 o'clock P.M., and he immediately took his seat at the Council table. At the hour of 8 :30 o'clock P.M., the Mayor declared a recess to enable the interested citizens to closer inspect the plans above referred to, submitted by the Department of Water and Power. At the hour of 8 :40 o'clock P.K., the Council reconvened, the follow- ing members being present and answering roll call: Baker, Frederick, Gordon and Mayor Benfieldi absent, Meschuk. The Mayor then inquired if any other persons desired to address the Council. A gentleman in the audience who failed to, identify himself, inquired what action, if any, might be taken to stop the City of Los Angeles from con- tinuing with the proposed construction, and City Attorney Bush stated, in his opinion, nothing could be done at this time since the property upon which the construction will be placed is properly zoned by the City of Los Angeles and also said City has the right of eminent domain and can thus condemn property which it can shorn it needs for this purpose. The gentleman then inquired whether or not it might be of benefit to have a committee composed of representatives of the City Council, the Chamber of Commerce and other organizations of the City of E1 Segundo, meet in Los Angeles in an effort to persuade the City of Los Angeles to reconsider the location of its proposed steam plant since the gentleman making the inquiry felt there was other ground available which would not be contingent to resi- dential property. While it was the consensus of the City Council and other City offi- cials that no good,, wou,7.d be agcomplished through such a meeting, yet the Mayor stated the Council desired to cooperate in every manner possible, and,he re- quested City Manager Sailors to arrange such meeting. Mrs. Barbara Donner, residing at 357 Whiting Street, inquired whether or not something might be done to alleviate the dust condition caused by trucks hauling sand which travel Whiting Street. -3- 1 . 0 Z Councilman Gordon stated the sand was being hauled from property owned by him at H61 1T Avenue and Hillcrest Street; that the hauling opera- tions were under a contract and he explained that the sand was not being blown off the top of the tracks inasmuch as the sand'is wet, but was caused 'by sand which is picked up by'the tires of the tracks and then thrown onto the street from the tires. He explained that he anticipates making a subdi- vision of the property Sroia which the sand is being hauled and that the haul- ing operations would be completed by the middle of August. Several other persons in the audience complained of the same feature and also complained of the speed of the tracks, and inquired whether or not some other street might not be used. The-Mayor stated that the Police Department had been- instraated to watch the speed of these trucks and that a further effort would be made to cause the speed to be reduced, but no definite statement'wits•'gkdi as to the use of streets other than Whiting Street for such hauling.­-4- , I � � j -C) REPORTS OF OFFICERS AND SPECIAL CONNITTEES 4 The City Manager stated that with respect to Item 1p under his re- ports, he had been given an opinion by the City Attorney that it would not be necessary to formally advertise for bids on the asphaltic emulsions and that he would, therefore, obtain informal bids and present his recommendations to the Council at a later date. The -City Attorney presented Resolution No. 1637, requesting cancel- lation of taxes and assessments on property acquired by the City for the widen- ing of Maple Avenue. Moved by Councilman Baker, seconded by Councilman Frederick, that Resolution No. 1637, entitled: —` A RESOLUTION OF THM CITY COUNCIL OF THE CITY OF EL SBG%W, CALIFORNIA, REQVZ15TIN4 CANCEL- LATION OF TAKES AND ASSENTS ON CERTAIN PROPERTY ACQUIRED BY SAID CITY FOR PUBLIC STREET PUM=v NAMELY THE WIDENING OF MAPLE AVENUE., which was read, be adopted. On roll call, said motion carried and said resolution was adopted by the follow- ing vote: Ayes: Councilmen Baker, Frederick, Gordon and Mayor Bonfield; Noss: Councilmen None; Absent: Councilman Mesehuk. UNFINISHED BUSINESS The City Clerk read the title of Ordinance No. 490, entitled: AN ORDINANCE OF THE CITY OF EL SEGUNDO, CALI- FORNIA, AMENDING ORDINANCE NO. 429 (THE TRAFFIC ORDINANCE) (F SAID CITY IN VARIOUS PARTICULARS.• It was then moved by Councilman Fredertcky:secadded by Councilman - Baker, and unanimously carried by the following roll call, to wit: Ayes: Councilmen Baker, Frederick, Gordon and Mayor Bonfield; Noes: Councilmen None; Absent: Councilman Mesahuk, that the further reading of Ordinance No. 490 be waived. -4- yll 989 Moved by Councilman Baker, seconded by Councilman Frederick, that Ordinance No. 490, entitled: AN ORDINANCE OF THE CITY OF EL SEGUNDO, CALI- FORNIA, AMENDING ORDINANCE NO. 429 (THE TRAFFIC ORDINANCE) OF SAID CITY IN VARIOUS PARTICULARS., which was introduced and read at a regular meeting of the City Council held on the 9th day of July, 1956, and reread at this meeting, be adopted. On roll call, said motion carried and said ordinance was adopted by the following vote: Ayes: Councilmen Baker, Frederick, Gordon and Mayor Bonfield; Noes: Councilmen None; Absent: Councilman Meschuk.
