1952 APR 15 CC MINU 848 El Segundo, California April 15, 1952 An adjourned regular meeting of the City Council of the City of El Segundo, California, was held in the Council.Chamber of the City Hall of said City on the above date, having been called to order at 2 :00 o'clock P. M. by William R. Selby, Mayor. Councilmen Present: Councilmen Absent: ROLL CALL Gordon, Peterson, Swanson, Thompson and Mayor Selby; None. READING OF MINUTES OF PREVIOUS MEETINGS The minutes of the regular meeting held on the 9th day of April, 1952, having been read, and no errors or omissions having been noted, it was moved by Councilman Peterson, seconded by Councilman Gordon, the minutes of said meeting be approved as recorded. Carried. The minutes of the adjourned regular meeting held on the 10th day of April, 1952, having been read, and no errors or omissions having been noted, it was moved by Councilman Swanson, seconded by Councilman Thompson, the minutes of said meeting be approved as recorded. Carried. Moved by Councilman Peterson, seconded by Councilman Swanson, that the regular order of business be dispensed with. Carried. The City Clerk reported that the returns ,of the General Municipal Election held on Tuesday, the 8th day of April, 1952, in the City of E1 Segundo, California, were then, and had been, in her possession in the envelopes containing them, in the same condition as when received. Said Clerk then presented said returns to the City Council at this time at this meeting It was thereupon moved by Councilman Gordon, seconded by Councilman Thompson, that the City Council proceed forthwith to canvass said returns of the regular General Municipal Election held in the City of El Segundo, California, on Tuesday the 8th day of April, 1952. The said motion was carried and adopted by the following vote: Ayes: Councilmen Gordon, Mayor Selby; Noes: Councilmen None; Absent: Councilmen None. Peterson, Swanson, Thompson and Said motion having carried, the City Council then proceeded forthwith to publicly examine and canvass said returns, all as provided by law. Upon the completion of said canvass by said Council, it was moved by Councilman Peterson, seconded by Councilman Gordon, that the following resolution be adopted: 41EREAS, there was held and conducted in the City of El Segundo, County of Los Angeles, State of California, on Tuesday, the 8th day of April, 1952, a regular general municipal election of the qualified voters of said city under, pursuant to, and as required by the provisions of the laws of the State of California relating to cities of the sixth class, for the purpose of elect- ing the following officers of said city, to wit: t -1- U 849 Three members of the City Council of said city for the full term of four (4) years; A City Clerk of said city for the full term of four (4) years; and A City Treasurer of said city for the full term of four (4) years; AND, WHEREAS, it appears that notice of said election was duly and legally given; that there were thirteen (13) voting precincts established within the said city for hold- ing said election, consisting of the regular voting pre- cincts established by the Board of Supervisors of Los Angeles County, California, for the holding of general State and County elections; that election officers were appointed and election supplies furnished; and that in all respects said election was held and conducted and the votes cast thereat received and canvassed and the returns made and declared in time, form and manner as required by the provisions of the laws of the State of California relating to cities of the sixth class and pursuant to all laws of said State and of said City in such case made and provided; AND, WHEREAS, the City Council of the said City of E1 Segundo met in the Council Chamber of said City Council in the City Hall of said city in said city on Tuesday, the 15th day of April, 1952, as provided by law, beginning at the hour of 2:00 otclock P. M. of the said day, to canvass the returns of said regular general municipal election and declare the results thereof, whereupon said Council found that the number of votes cast; the names of the persons voted for; the office to fill which each person was voted for; the results of said election; and the other matters re- quired to be determined by law; to be as hereinafter stated: NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, DOES HEREBY RESOLVE, DECLARE, FIND AND DETERMINE AS FOLLOWS: First: That said regular general municipal election was held and conducted in said City of El Segundo, California, on Tuesday, the 8th day of April, 1952, in time, form and manner as required by law; Second: That there were thirteen (13) voting precincts established within the said city for the purpose of holding ` said election, consisting of the regular voting precincts established by the Board of Supervisors of Los Angeles County, California, for holding of general State and County elections, as follows: Voting Precinct No. 1 consisting of El Segundo City Precinct No. 1, the polling place of which was in the residence, 721 Virginia Street, in said city; Voting Precinct No. 2 consisting of E1 Segundo City Precinct No. 2, the polling place of which was in the residence, 203 W. Walnut Avenue, in said city; Voting Precinct No. 3 consisting of El Segundo City Precinct No. 3, the polling place of which was in the Elementary School Auditorium, 700 Center Street, in said city; -2- U S,5O Voting Precinct No. 4 consisting of E1 Segundo City Precinct No. 4, the polling place of which was in the residence, 444 Maryland Street, in said city; Voting Precinct No. 5 consisting of E1 Segundo City Precinct No. 5, the polling place of which was in the residence, 544 Virginia Street, in said city; Voting Precinct No. 6 consisting of El Segundo City Precinct No. 6, the polling place of which was in the residence, 510 W. Grand Avenue, in said city; Voting Precinct No. 7 consisting of E1 Segundo City Precinct No. 7, the polling place of which was in the High School Auditorium, 640 Main Street, in said city; Voting Precinct .No. 8 consisting of E1 Segundo City Precinct No. 8, the polling place of which was in the residence, 523 Eycalryptus Drive, in said city; Voting Precinct No. c, City Precinct No. 9, was in the residence, said city; consisting of El Segundo the polling place of which 929 Sheldon Street, in Voting Precinct No. 10 consisting of E1 Segundo City Precinct No. 10, the polling place of which was in the Council Chamber of City Hall, 203 - Richmond Street, in said city; Voting Precinct No. 11 consisting of El Segundo City Precinct No. 11, the polling place of which was-in the residence, 1227 E. Mariposa Avenue, in said city; Voting Precinct No. 12 consisting of E1 Segundo City Precinct No. 12, the polling place of which was in the residence, 624 W. Mariposa Avenue, in said city; and Voting Precinct No. 13 consisting of El Segundo City Precinct No. 13, the polling place of which was in the Elementary School Auditorium, Palm Avenue Entrance, in said city. Third: That (a) the whole number of ballots cast in said City of E1 Segundo at said election; (b) the whole number of absentee ballots cast at and for said election; (c) the names of the persons voted for; (d) the office to fill which each person was voted for; (e) the number of votes given at each precinct to each person; (f) the number of votes given in said city to each person; (g) the number of absentee votes given to each of such persons; and (h) the total number of votes given both in said city and in said absentee ballots to each of such persons; are as hereinafter set forth in this resolution. Fourth: That the whole number of ballots cast in said city at said regular general municipal election was 2175 ballots. -3- U 8 ) t. Fifth: That the whole number of absentee ballots cast at and for said election was 47 ballots. Selby above named received for member of the City Council of said City for the full term of four years, a total (including all votes cast in said City and all votes cast in said absentee ballots) of 1286 votes; (2) That the said Walter W. Swanson above named received for member of the City Council of said City for the full term of four years, a total (including all votes cast in said City and all votes cast in said absentee ballots) of 949 votes; (3) That the said Wilburn E. Baker above named received for j member of the City Council of said City for the full term of four years, a total (including all votes cast in said City and all votes cast in said absentee ballots) of 945 votes; (4) That the said D. T. Crooks above named received for member of the City Council of said City for the full term of four years, a total (including all votes cast in said City and all votes cast in said absentee ballots) of 383 votes; (5) That the said Robert H. Whipple above named received for member of the City Council of said City for the full term of four years, a total (including all votes cast in said City and all votes cast in said absentee ballots) of 1 vote. - SAID COUNCIL DOES THEREFORE HEREBY FURTHER RESOLVE, DECLARE, FIND AND DETERMINE THAT AT SAID REGULAR GENERAL MUNICIPAL ELECTION: (1) That William R. Selby is the candidate for the office of member of the City Council of the.City of El Segundo, California, for the full term of four (4) years, who received the highest number of votes for said office, and that therefore said William R. Selby was elected and is hereby declared elected to the office of member of the City Council of the City of E1 Segundo, California, for the full term of four (4) years;. (2) That Walter. W. Swanson is .the candidate for the office of member of the City Council of the City of E1 Segundo, California, for the full term of four (4) years, who received the second high- est number of votes for said office and that therefore said Walter W. Elsey is the candidate for the office of City Clerk of the City of El Segundo, California, for the full term of four (4) years, who received the highest number of votes for said office and that therefore said Neva M. Elsey was elected and is hereby declared elected to the office of the City Clerk of the City of El Segundo, California, for the full term of four (4) years. Selby was elected as a member of the City Council of the City of E1 Segundo, California, for the full term of four (4) years; (b) That-Walter W. Swanson was elected as a member of the City Council of the City of E1 Segundo, California, for the full term of four (4) years and U 8:) (c) That Wilburn E. Baker was elected as a member of the City Council of the City of E1 Segundo, California, for the full term of four (4) years; (d) That Neva M. Elsey was elected as City Clerk of the City of E1 Segundo, California, for the full term of four (4) years; and (e) That Ruth Hopp was elected as City Treasurer of the City of E1 Segundo, California, for the full term of four (4) years. (B) That the City Clerk shall impose the constitutional oath of office upon the said William R. Selby, Walter W. Swanson, and Wilburn E. Baker, as members of the City Council of said City for the full term of four (4) years; and upon the said Ruth Hopp as City Treasurer of said City for the full term of four (4) years; and have them subscribe thereto and file the same in the office of said City Clerk. That the City Clerk shall also take and subscribe the constitutional oath of office before some person authorized to take oaths and shall file the same in the office of said City Clerk, as required by law. (C) That thereupon each and all of said persons so elected to said respective offices shall be inducted into the said re- spective offices to which they have respectively been elected. The motion to adopt the foregoing resolution was carried unanimously (and by the Mayor declared carried) by the vote shown in the following certificate of the City Clerk, to wit: STATE OF CALIFORNIA, ) COUNTY OF LOS ANGELES, CITY OF EL SEGUNDO. ) I, the undersigned, Neva M. Elsey, City Clerk of the City of:E1 Segundo, California, do hereby certify that the fore- going resolution was duly and regularly introduced and adopted by the City Council of said City of E1 Segundo, California, at an adjourned regular meeting of the said Council held on Tuesday, the 15th day of April, 1952, and that the same was adopted by the following vote, to wit: Ayes:. Peterson, Swanson, Thompson and IN WITNESS WHEREOF, I have hereunto set my hand and af- fixed the official seal of said City of El Segundo, California, this 15th day of April, 1952. (SEAL) The City Clerk then reported that she had caused to be entered on the records of the City Council of the City of E1 Segundo, California, a statement of the result of said election, by filing the resolution last hereinabove set forth in her office, and by entering said resolution in full in the minutes of this meeting on the said records. -10- U 858 The City Clerk thereupon announced that she had in her possession the official band of Neva M. Elsey, as City Clerk, and the official bond of Ruth Hopp, as City Treasurer, which bonds had been approved as to form by the City Attorney. Thereafter, it was moved by Councilman Gordon, seconded by Council- man Thompson, the following resolution be adopted: WHEREAS, on the 15th day of April, 1952, Neva M. Elsey, City Clerk of the City of El Segundo, California, did duly and regularly, as required by law, execute, deliver and file the official bond of said City Clerk, dated the 15th day of April, 1952, with United States Fidelity and Guaranty Company, of Baltimore, Maryland, as surety, in the principal sum of $5,000.00 covering her term of office as City Clerk of the City of E1 Segundo, California, commencing on said 15th day of April, 1952; and WHEREAS, on the said 15th day of April, 1952, Ruth Hopp, City Treasurer of the City of E1 Segundo, California, did duly and regularly, as required by law, execute, deliver, and file the official bond of said City Treasurer, dated the 15th day of April, 1952, with United States Fidelity and Guaranty Company, of Baltimore, Maryland, as surety, in the principal sum of $100,000.00, covering her term of office as City Treasurer of said City of E1 Segundo, commencing on said 15th day of April, 1952; and WHEREAS, the City Attorney of said City has approved both of said bonds as to form; NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of El Segundo, California, does hereby approve and ac- cept the said above described bonds, and each of them, on the part of said Council and of said City, and does hereby order the bond of said City Clerk delivered into the custody of the Mayor of said City, and does hereby order the bond of said City Treasurer delivered into the custody of said City Clerk, all as provided by the law in such cases made and provided. On roll call, the foregoing resolution was adopted by the following vote: Ayes: Councilmen Gordon, Peterson, Swanson, Thompson and Mayor Selby; Noes: Councilmen None; Absent: Councilmen None. The City Clerk thereupon issued certificates of election to Councilmen William R. Selby, Walter W. Swanson and Wilburn E. Baker, and also to Ruth Hopp, Treasurer elect, who immediately thereupon took and subscribed to their respective constitutional oaths of office and filed the same with the City Clerk; who thereupon announced that she had taken and subscribed her constitutional oath of office before an officer authorized by law to impose oaths, and that said oaths of office were duly filed in her office. Councilmen Elect William R. Selby, Walter W. Swanson and Wilburn E. Baker thereupon took their respective seats at the Council table and the Council thus constituted thereupon consisted of the following members, all of whom were present, to wit: Councilman Wilburn E. Baker, Councilman George E. Gordon, Jr., Councilman Dave W. Peterson, Councilman William R. Selby, Councilman Walter W. Swanson. -11- The City Attorney thereupon advised the Council that it would be in order for the City Council at this time to hold its organiza- tion meeting and proceed to organize by choosing a Mayor. He there- upon presented to the members of the Council elect the following "CONSENT AND WAIVER OF NOTICE OF ORGANIZATION MEETING OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA ", which was subscribed by each of the members of the City Council as so constituted, and which was thereupon filed with the City Clerk, to wit: "CONSENT AND WAIVER OF NOTICE OF ORGANIZATION MEETING OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA. STATE OF CALIFORNIA, ) COUNTY OF LOS ANGELES, ) SS. CITY OF EL SEGUNDO. ) KNOW ALL MEN BY THESE PRESENTS: That we, the undersigned, constituting and being all of the members of the City Council of the City of E1 Segundo, California, as presently constituted, do hereby give our written consent to holding of the organization meeting of the said Council following the regular general municipal election of April g, 1952, to be held in the Council Chamber in the City Hall of said City, in said City, beginning at this time, to wit: the hour of 2:54 o'clock p.m. on Tuesday, the 15th day of April, 1952, for the purpose of organizing said Council by choosing one of its members as, and to act as, Mayor of said City, and for the purpose of transacting any other business that may properly come before said Council, and we hereby waive any and all notice of the time and place of the holding of said meeting and do hereby consent and agree that the same may be held at said place, beginning at said time, upon said date, and for said purposes.
