A regular meeting of the City Council of the-City of El Segundo, California, vas-held-in the Council Chamber of the City Hall of said City on the above date, having been called to order at 7:00 o'clock P. M. by William R. Selby, Mayor. ROLL CALL. 4 Councilmen Present: Baker, Peterson, Swanson, Thompson and Mayor Selby. Councilmen Absent: None. READING OF MINMS OF PREVIOUS MEETING. The minutes of the regular meeting held on the 14th day of July, 1948, having been read, and no errors.or omissions having been noted, it was moved by Councilman Peterson, Sevonded by Councilman Thompson, the minutes of said meeting be approved as recorded. Written communications, received from the persons, firma or corporations hereinafter named, were read to the Council and were disposed of in the manner indicated, following reference to each hereinafter: CX RLSS F. NEAL, for M & M douse Moving Co., dated July 20; 1948, being sapliation for permission to move a one story frame building through the City of El Segundo. The City Clerk stated that all requisite fees and deposits had been paid and made, whereupon it was moved by Councilman Peterson, seconded by Councilman Baker, the following resolution be adopted: RESOLVED, that G. Neal be and he is hereby granted a permit to move.a one story frame building through the City of El Segundo, along the following route, to -wit: West on Imperial Highway from Aviation Boulevard, to Sepulveda Boulevard; south on Sepulveda Boulevard to Roaecrans Avenue: West on Rosecrans Avenue to Highland Avenue; E1 Porto;. said permit being granted subject to the following conditions, to -wit: 1. That said building shall be moved on rollers, or other equipment satisfactory to the Street Superintendent of the City of E1 Segundo. -1- S 229 2. That the Police Department of the City of a1 Segundo shell be notified at least thirty minutes in advance of the start of such removal operations, so that police escort may be provided therefor, if necessary. 4. That such removal and all operations related thereto shall be prosecuted and completed to the satis- faction of the Street Department and of the Police Department of the City of E1 Segundo. CITY PLANNING COMMSSION, dated July 21, 1948, with which was trans- mitted copy of Resolution 10. 33 of said Commission, granting a variance to Frank S. Martin and Bernice L. Martin for the erection of a single - family dwelling on the westerly 69 feet of Lot 7, Tract 2580. Ordered filed. At thiq time, City Clerk McCarthy announced he had in his possession, in the same condition as when received, one bid for the purchase of tat deeded property under Notice No. 9M. Moved by Councilman Baker, seconded by Councilman Peterson, the Comm 1 proceeq too open, examine and publicly declare said bid. Carried. The Council thereupon proceeded to open, examine and publicly declare said bid, which said bid was found by said Council-to be as follows, to -wit: Bid of Willard J. Skelley, as real estate broker for Lynn A. Upahaw, on regglar form provided therefor, as follows: Lot 8, Block 3, El Segundo - - - - - - - - - - - - - - - $850.00. Said bid was accompanied by check of L. A. Upshaw, drawn on E1 Segundo Branch, Security- First,National Bank i., amount of $163.00, and $50.00 cash. After consideration of said bid, it was moved by Councilman Baker, seconded by Councilman Thompson, that Resolution No. 944, entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL MMUNDO, CALIFORNIA, ACCEPTING THE CASE BID OF WIZARD J. SKE= FOR CERTAIN CITY OWNED TAX DEEDED PROPER?Y, which was read, be adopted. Said motion carried and said Resolution was adopted by the following vote: Peterson, Ayes: Councilmen Baker( Swanson, Thompson and Mayor Selby. Noes: Councilmen None. Absent: Councilmen None. STATE CONTROLLER, STATE OF CALIFORNIA, dated July 16, 1948, transmitting therewith certain farms and instructions respecting Annual Street Report to said State Controller, and requesting that the City Council designate an -2- S 2330 official of the Ctty-of -El Segundo, who will be responsible for the making out and filing of said report, and advise the State Controller the name and official title of such officer. Moved by Councilman Baker, seconded by Councilman-Thompson, that said report, together with accompanying letter and instruction sheets, be referred to the City Attorney for his study and report to this Council at its next regular meeting. Carried. The hour of 7.15 o'clock P. M. having arrived, the Mayor stated that this was the time and place for the hearing on the application of Emanuel Jensen for rezoning or reclassification from Zone R -1 to Zone R -3 of certain property lying easterly of Center Street and Northerly of Walnut Avenue, in the City of El Segundo, more particularly described as the Northerly 250 feet of the Southerly 375 feet of Lot 16, C. C. Hunt Sub - division and the Northerly 250 feet of the Southerly 375 feet of a portion of Lot 1, C. C. Hunt Subdivision, also known as Lots 31 through 90, Tract 15115, and which property the Planning Commission, by its Resolution No. 30, had heretofore recommended be changed from Zone R -1 to Zone R -2. The City Clerk was then asked if the required notices of this hearing had been given, whereupon the City Clerk advised that said required notices had been given and that affidavits showing the fact of the giving of such notices were on file in the records relating to this matter. Such affidavits were thereupon ordered made a pert of the records in this proceeding. Mayor Selby then announced that the Council would hear first from those persons in favor of granting the application of said Emanuel Jensen for zone change or reclassification of certain property as hereinbefore not forth. The following persons then testified in favor of such zone change: Mr. Bernard Lawler: I understand the recommendation of the Planning Commission was that the change be granted to R -2, whereas the original application was for R -3. I am appearing on behalf of Emanuel Jensen and Alma Jensen, the owners and subdividers of the property in question. We still think R -3 should be granted on the north side of Acacia, but the Planning Commission has recommended that it be zoned as R -2. We will not insist too strongly on this, but would prefer the north side as R -3 since it does abut on commercial property and would be isolated from other property zoned as R -2 on the south side. As I said before, we are not going to urge the point too strongly and would abide by R -2, but would prefer the R -3. Mayor Selby then inquired if anyone also desired to give testimony in favor of the change. Mayor Selby: Since there are none, I will now ask those who are against the change of zone to give their testimony. George Satska, 1216 E. Walnut Avenue: Do I understand correctly the Commission has recommended it be changed to R -2? Mayor Selby informed Mr. gatska that as far as this Council is concerned, the original request was from R -1 to R -3; that,the Council has the Planning Commission's report recommending it be changed to an R -2 Instead of an R -3 zone. Mayor Selby again inquired if anyone present desired to give testimony in opposition to the requested change; and he also inquired of the City Clerk -3- S If any written protests had been filed, to which the City Clerk replied in the- negative. Mr. age- Katska: I would object to the R -3. We have started to build ova° homae, and that is one reason we are building there, it was zoned -as R -1. Of course I realized zone might be changed, but did not expect an R -3. I feel it would have a tendency to devalue our property if it is changed to R -3. Mayor Selby- I gather you are just objecting to R -3, or both? Mr. Katska: I would not object to R -2. B. R. Howland, 1220 E. Walnut Avenue: I have no objection to R -2, but I would not like to see the R -3. Mr. H. A. Brightly, 1208 E. Walnut Avenue: I object to both the R -2 and R -3. I lived in Los Angeles in an R -2 zone, it is not a good place to raise families. I came to El Segundo because it was a home town and bought property because it was in an R -1 Zone, and I think it should be kept as originally set up when you zoned. What are you going to do if every person who has over an acre of ground asks for a zone change? There is undeveloped property to the east of us and if you grant this change, you are going to have to grant it to others. I think you should take this into consideration. Mayor Selby again inquired if there was anyone else opposed to the change. Mr. C. M. Cramlett, 1214 E. Palm Avenue: I am building a home at 1212 E. Walnut Avenue, and I am opposed to the change. (As Mr. Cramlet came in late to the hearing, he inquired what had been the outcome of the meetings of the Planning Commission. Mr. Selby explained that the Commission had recommended a change to R -2). I object to both, would rather it stay as R -1. I-am just across the street, on the south side of Walnut and I feel that it would make a lot nicerneighborhood if it were single units all the way through. I think it is going to be one of the nicest sections in El Segundo. There is still a lot of R -3 property that is undeveloped, I don't think we are over - crowded yet. There is not a shortage of space, although there may be a shortage of homea. Mrs. James S. White: I live at 877 California Street. I am opposed to change of zone for two reasons, one being a purely personal one. I feel my investment in any property suffers from change in zone. The other is a community or civic reason. I have done a little investigation, of course not like a whole survey of southern California, but I have looked into who is buying duplexes and triplexes. Most of them are owned by people who do not even live in part of them, they are speculators. We would probably have transient population living in those units and I do not feel it would be to the best interests of our town. Mrs. Donald Kidd, 1300 East Walnut Avenue: We are practically ready to move in to our new, home at 1300 E. Walnut Avenue. My husband is ill and was unable to come tonight. I have a letter of protest from him I would like to present to the Council. I agree with Mrs. White on both points. I do not feel there is any necessity for duplexes or triplexes. I feel there is plenty of property available for that use. A good many of us bought our property out there because it was zoned for single units. We have put a good deal of time and effort into our placaBout there, with the idea of making them a definite asset to E1 -4- 231 232 Segundo. K Segundo has always been a town of home owners. I feel people who own homes are more Interested in civic affai7 -s, more interested in schools, in who is running for office. I do not feel it would be of a great deal of advantage to the merchants, it is so close to Westchester district. Mayor° _ Selby -inquired if there was anyone also who wished to testify in opposition, if not, he would give those who testified in favor of the change a chance for rebuttal. Mr. Bernard Lawler: Mr. Mayor and gentlemen of the Council - In the first place I think we should reflect momentarily on basic purpose of zoning laws, they originated under police powers of city, to enable the governing body to plan for intelligent development of the City, to keep out undesirable industries and buildings and classifications, at least keep them segregated. In this particular instance we have a completely new area out there. It has been pointed out this land was originally zoned as R -1 and people relied thereon. A11 laws and rules or subject to change, particularly in this case. I believe I attended every meeting when the zoning ordinance was under consideration and I remember a great deal of objection was made to so much R -1 property and I believe I am correct in stating that representations were made that, as the town grew and the needs changed, a great deal of that property would be rezoned, but for protection of the town as a whole and to assure intelligent growth of the town, it was kept in the R -1 bracket. Now here we have a large tract of land, perhaps the largest in the City, available for home development, the largest single area available. It is true that some of these people have built on the south side of Walnut Avenue since the zoning law was first adopted. However, my client has not asked that any property facing on Walnut be changed, it is entirely limited to property on another street and none of the owners of property abutting on the property, the subject of this request, are objecting to the change. This change will be on a.new street, the closest lot will probably be some 180 feet away and will be entirely on different street and different-block. An objection has been made that duplexes are not desirable for the raising of children. I agree - I would not want to raise my family in duplexes, but that is up to the purchaser of the property. Mr. Jensen is the owner of the property and seeking to develop it. If someone wants to buy it, that is up to him. I do not think it is up to the Zoning Comni.ssion or the City Council to determine whether families shall live in duplexes. Neither do I think they should take into consideration the question of the values or the effect the change might have on property considerably removed from there. The purpose of zoning is for intelligent development, not to increase value of some properties. I think Mr. Jensen's contemplated development will increase values of all property in area. I do feel some people have in mind those very unsightly housing projects we saw during the war. That is not the type of development Mr. Jensen has in mind and I feel if Council decides to grant his application, his development will be an asset to the community. He owns that property, he is not seeking to change any property that adjoins or is even on the same street or upon property already built upon and I see no reason why Council should deny his request. We do feel R -3 should be granted on the north side, but will agree to accept Commission "s recommendations of R -2, but do feel that R -3 should be granted on property that immediately abuts cammiercial property. Mayor Selby inquired if anyone also desired the change. No such person arising, the Mayor then those opposed to the change, a chance for rebuttal. -5- to speak in favor of stated he would give S 23-3 The City Clerk amaiounc he had in his possession a letter of protest from D. S. Kidd, 1300 Fast Walnut Avenue, which letter he read to the Council and which said letter is as follows: "July 21, 1948. City Council E1 Segundo California Gentlemen: As I em unable to attend the hearing tonite because of illness, I wish to tender this letter in protest of a change in zoning from R -1 for the property under consideration. My objections are based on the an points which I presented to the planning commission at the public meetings. 1. I do not feel that there is any need for rezoning, as there is already plenty of multiple dwelling areas in E1 Segundo as yet undeveloped. 2. A change in zoning is unfair to the property owners who already own property in this general area, who have built homes there and who have spent considerable time, money and effort developing them. Multiple units will definitely lower the value of this adjacent property. 3. Multiple units with the additional numbers of people will benefit E1 Segundo merchants and business very slightly as the area is so much closer to the Westchester.area that these people will conduct their business there. 4. E1 Segundo has the reputation of being a hams - owning town. It is unique in never having had a very transient population but one which has been stable. Pbople who are transients have much less of a pride and an interest in civic affairs. For the above reasons as well as other presented by myself and others at the other public meetings I wish to protest against a change in zoning. D. S. Kidd 1300 East Walnut Avenue E1 Segundo." Following the reading of the above letter, the Mayor announced it would be filed with other documents respecting this hearing. Mrs. J. S. White: As a point of rebuttal on what was said by Mr. Lawler. I would like to point out the fact that the proximity to my location, for example, it is enough that it is comparable to the amount of Montage I have for my property. I would be that close to one of the multiple dwellings. It has been pointed out to me by more than 10 S" 23 4 one lo= company, in inquiring about possible loans on pieces of property, that is of interest to all people, whether they get a loan before they build or later, or wish to take out a loan for reammm of- investing or emergency,- with any sort of multiple dwelling zone as close as this one, we would not be able to get the same amount of loan on our piece of property as if the property were P-1. I have had this report from more than one loan company. I would have to offer that contradiction to Mr. Lawler`s statement that it does definitely effect us, even though R -1 dwellings have been built on Walnut facing us, when the other units would start, it would immediately effect the value of our property. Mr. H. A. Brightly- The gentleman spoke of protection. It is the protection of the unwanted buildings put one upon the other. If you did not have zoning, you could build a nice home and a factory could come in beside you. It is evident you do have to have zoning. I went into business, made iuvestmenta and I lived in Los Angeles and drove back-aad fox . E1 Segundo was a good town. I turned around and looked up a piece of property, checked with the office to see what it was zoned it was R -1. I took the gamble that it would change. So you go ahead and buy property - because a man owns a large piece of property, he is going to get all out of the zoning ordinance he can. You have a large portion of people that are home owners. I think the Wagon Wheel Forty - Niner is going to take hold, because people are interested in their town. I am trying to bring out something that is in the back of your mind, that you already know. I think the home owners should have some weight in the problem. We have the biggest investment; which is our limitation. I think if you gentlemen do give Mr. Jensen that, right across the street is another piece of property that you will have the same thing comae up. In getting out and working around houses where a tract of houses goes in, and multiple dwellings, you should see the For Sale signs go up. Mrs. Jerry Fisher. We have a home under construction at 1400 East Walnut. I know that the School Board spent quite a lot of money making a survey of how many children would be in that area, figuring one family per lot and if there are three families per lot, the school is not going to be large enough. The school is built at its maximum now. Mrs. James S. White- I do not know if this is permissible or not. My husband had an accident today and was unable to get here. He asked that I register his protest. Mayor Selby: If there is nothing further, we will draw the meeting to a close. Mr. Bernard Lawler- I would like to make one reply to the one about the school survey. Basically the schools are to serve the community and the Zoning Commission is not to serve the schools. I do not feel the Council should be controlled at arriving at its decision by the statement that the schools will be crowded. If more people come into the community it is going to be up to the School Board to provide facilities for those people and it is not up to the Zoning Commission or the Council to limit the population of the town so that the School Board will not have to build larger schools. I understand the school is going to ask for a zone change in this same area. Mayor Selby stated that inasmuch as those had been given another opportunity to speak, the afforded to,those opposed. -7- in favor of the zone change same opportunity would be Mrs. Kidd: Every single one of the prop" -owners on Walnut Avenue were present- -at-the meeting and they all registered their protests. Every single one of the people who face on Walnut was definitely against a change of zone, they-all felt it was against their better interests. Every one of them felt the property on Acacia was not sufficiently far away to hwm any effect on them Also one other thing - the fact that there is a good deal of other-propexrty- vacant across Center Street. The people who own that property are 3ving to zmit this decision and if granted, feel that it is going to give them a good basis for asking for the same thing. Do we all want that property as duplexes? Mr. Brightly brought out very briefly the fact that there is still a good-deal of other property-vacant across Center Street snd the people who own that property are going to watch the - decision very closely and if R -2 or R -3 is-granted, that is going to give them a good basis to ask for same thing. He asked if we wanted all of that property or even a small portion of it under that kind of zone, and that it is going to be hard to grant to one and turn others down. Mayor Selby stated that if there is nothing new to be brought up, he would close the hearing. Other members of the Council concurring, it was moved by Councilman Thompson, seconded by Councilman Peterson, that the Council take said matter under consideration, and its decision will be announced at a later date after it has had a chance to study the transcript of the proceedings heretofore at this meeting taken. Carried. WRITTEN COMMUNICATIONS - CONTINUED. WEST BASIN WATER ASSOCIATION, dated July 14, 1948, acknowledging receipt of check from the City of E1 Segundo in amount of $100.00, covering its membership dues in said Association for the 1948 -49 fiscal year. Ordered filed CITY PLANNING COMMISSION, dated July 16, 1948, re "Proposed Change of Zone from an R -3 use to a C -2 Use on the Commissions' Own Motion on that property west of Cedar Street, parallel to Imperial Highway for a depth of 150 feet and extending to the western boundaries of the City of E1 Segundo', together with a copy of said Commission's Resolution No. 31 di3approving such reclassification, and the complete file of said Commission with respect to said matter. It appearing that the City Council should now set the matter for public hearing, it was moved by Councilman Baker, seconded by Councilman Thompson, the following resolution be adopted: RESOLVED, that the matter of the proposed reclassification of properties fronting on the South side of Imperial west of Cedar Street to the western city limits, paralleling Imperial Highway to a depth of 150 feet from R -3 to C-2, which matter had been previously set on the Commission's own motion and hearings thereon held by said Commission, be set down for public hearing before this Council at the regular meeting of said Council to be held on.Wednesday, the 18th day of August, 1948, beginning at the hour of 7:3Q o'clock P. M. in the Council Chamber in the City Hall of the City of E1 Segundo in said City; AND, BE IT FiiRTHFs'R RESOLVED, that the City Clerk be and he is hereby authorized and instructed to give notice of said hearing in time, form and manner as required by law. PLANNING COM0IISSION, dated July 16, 1948, to which was attached copy of said Vommi-ssion's Resolution No. 32, disapproving the application of R. H. Dietrich for a change of zone from R -3 to C -2 for the northerly 85 feet of Lot 6, Block 106, El Segundo, also the Commission's complete file on the subject matter. Moved by Councilman Peterson, seconded by Councilman Swanson, the following resolution be adopted- RESOLVED, that the matter of the application of R. H. Dietrich for reclassification of the northerly 85 feet of Lot 6, Block 106, El Segundo, from Zone R -3 to Zone C -2 and the recommendations of the Planning Commission with reference thereto, be set down for public hearing before this Council at the regular meeting of said Council to be held on Wednesday, the 18th day of August, 1948, beginning at the hour of 7 -30 o'clock P. M. in the Council Chamber in the City Hall of the City of E1 Segundo, in said City; AND, BE IT FURTHM RESOLVED, that the City Clerk be and he is hereby authorized and instructed to give notice of said hearing in time, form and manner as required by law. ORAL COMMUNICATIONS. None. REPORTS OF STANDING COMMITTEES. Public Service Commissioner Thompson reported that Mr. Lyle Penn, an employee of the Parks Department of the City of E1 Segundo, had completed one year of service with said City; that the Parks Superintendent had reported to him that Mr. Penn's services were entirely satisfactory, and he recommended that Mr. Penn be classified as Laborer -let Class, commencing August let, 1948. It was thereupon moved by Councilman Peterson, seconded by Councilman Swanson, the following resolution be adopted: RESOLVED, that effective August lot, 1948, and until the further order of this Council, Lyle Penn, an employee in the Parks Department of the City of E1 Segundo, be classified as S 237 -Labor- er -lst Class; said employee to be compensated for his services rendered in-said capacity in accordance with the pro- visions --of the salary resolution of the Ctty of E1 Segundo. REPORTS OF OFFICERS AND SPECIAL COMMITTEES. City Clerk McCarthy read to the Council the written sport of Fire Chief Farrar, dated July 21, 1948, calling the Council's attention to the fact that due to illness, Mr. D. J. Langsdon, a member of ther Volunteer Fire Department, had resigned from said Department. The Fare Chief requested the Council's approval to the addition of the woad "Retired" to Mr. Langedon's badge, and also requested-that a letter of appreciation be sent Mr. Langsdon for the services he has rendered said Department. It was thereupon moved by Councilman Baker, seconded by Councilman Thompson, the following resolution be adopted: RESOLVED, that the resignation of D. J. Langsdon as a member of the Volunteer Department of El Segundo Fire Depart- ment be and the same is accepted as of this date; that his badge of office be obtained by the City Clerk for the purpose of having the word "Retired" affixed thereto, after which the said badge shall be returned to him; AND, BE IT FURTBER RESOLVED, that the City Clerk be requested to address a communication to Mr. Langsdon, appropriately expressing the City's thanks for public service well rendered. City Clerk McCarthy reported receipt from the Department of Public Works of the City of Los Angeles of Financial Progress Report No. 23, showing amount of monies expended in connection with construction of activated sludge plant at Hyperion, also showing balance in City of E1 Segundo funds, copies of which report he delivered to each the City Attorney and the City Engineer. City Clerk McCarthy reported that effective as of July 16, 1948, Charles L. McIlwain, Parks Superintendent, had been restored to the City's payroll. R. T. Hutchins, City Engineer, reported receipt of a letter from the Standard Oil Company of California, dated July 16, 1948, in which said Company stated its estimate of its demand for water in 1960 will be 6,625 acre feet. Moved by Councilman Baker, seconded by Councilman Thompson, that Ordinance No. 335, entitled: AN ORDINANCE OF THE CITY OF EL MUNDO, CALIFORNIA, AMENDING ORDINANCE NO. 276 OF SAID CITY, ENTITLED: AN aRDINANCE of THE CITY OF EL SEGUNDO, CALIFORNIA, GIVING AND GRANTING THE CONSENT OF SAID CITY TO THE INSTALLATION AND MAINTENANCE OF CERTAIN WATER SERVICE CONNECTIONS WITHIN SAID CITY OF EL SEGUNDO, BY THE DEPARTMENT OF WATER AND POWER OF THE CITY OF LOS ANGELES, IN AND ACROSS CERTAIN OF THE PUBLIC STREETS WITHIN SAID CITY OF EL SZGUNDO." City Engineer Hutchins informed the Council that storage space is needed by the Water, Police and Fire Departments for the storage of miscellaneous supplies and he recommended the construction of two cabinets for the Water Department and one larger cabinet for the combined use of the Police and Fire Departments. After discussion, it was moved by Councilman Baker, seconded by Councilman Peterson, the following.resolution be adopted: RESOLVED, that the construction of the following cabinets, to -wit: 1 - 33" x 36" z 27" 1 - 36" x 411" x 24" for use of the Water Department; and 1 - Five Dept. Locker, 8' 6" x 6' z 24 ", for the combined use of the Police and Fire Departments of the City of E1 Segundo, at a total cost of not to exceed $192.00, plus California State Sales Tax, be and the same is hereby authorized. Carried by the following vote: Ayes: Councilmen Baker, Peterson, Swanson, Thompson and Mayor Selby. Noes: Councilmen None. Absent: Councilmen None. Councilman Peterson informed the Council he anticipates taking his. vacation between the dates July 26th to August 21st, 1948, both dates inclusive, and he requested permission to leave the State of California and the United States of America during said period. City Attorney Woodworth recommended that a'form of Waiver of Notice of Special Meetings of the City Council be signed by any member of said Council who is on leave of absence or on vacation from his duties, The Council con- -12- S 240 curred in ftivn of the City Attorney, Who thereupon read to the said Council a form of such notice. Thereafter, it eras moved by Councilman Baker, seconded by Councilman Thompson, the-following resolution be adopted: RESOLVED, that Councilman Peterson be and he is hereby granted permission to absent himself from meetings of the City Council of the City of El Segundo which may be held between the dates July 26th and August 21st, 1948, both iaclusiva, and that during such time he is also granted permission to leave the State of California, and the United States of America; and BE IT FURTHER RESOLVED, that said Councilman be requested to sign and rile with the City Clerk a waiver of any notice of azw kind vhetsoever of any special meetings of the said City Council which may be called by the Mayor or any three members of said Council during the period of said leave hereinbefore granted.
