April 20, 1948.
An adjourned regular meeting of the City Council of the City
of El Segundo, California, was held in the Council Chamber of the
City Hall of said City on the above date, having been called to
order at 1 :00 o'clock P. M. by William R. Selby. Mayor.
ROLL CALL.
Councilmen Present: Baker, Peterson, Thompson and Mayor Selby.
Councilmen Absent: Skelley.
READING OF MINUTES OF PREVIOUS MEETING.
The minutes of the regular meeting held on the 14th day of
April, 1948. having been read, and no error or omission having
been noted, it was moved by Councilman Baker, seconded by Council-
man Peterson, the minutes of said meeting be approved as recorded.
Carried.
Moved by Councilman Peterson, seconded by Councilman Baker,
the regular order of business be dispensed with. Carried.
The City Clerk reported that the returns of the General
Municipal Election held on Tuesday, the 13th day of April, 1948
in the City of E1 Segundo, California, were then, and had been,
in his possession in the envelopes containing them, in the same
condition as when received. Said Clerk then presented said
returns to the City Council at this time at this meeting.
It was thereupon moved by Councilman Thompson, seconded by
Councilman Peterson,that the City Council proceed forthwith to
canvass said returns of the regular General Municipal Election
held in the City of E1 Segundo, California, on Tuesday, the 13th
day of April. 1948. The said motion was carried and adopted by
the following vote:
Ayes: Councilmen Baker, Peterson, Thompson and Mayor Selby.
Noes: Councilmen None.
Absent: Councilman Skelley.
Said motion having carried, the City Council then proceeded
forthwith to publicly examine and canvass said returns, all as
provided by law.
Upon the completion of said canvass by said Council, it was
moved by Councilman Baker, seconded by Councilman Thompson, that
the following resolution be adopted:
"WHEREAS, there was held and conducted in the
City of E1 Segundo, County of Los Angeles, State of
California, on Tuesday, the 13th day of April, 1948,
a regular general municipal election of the qualified
voters of said city, under, pursuant to, and as re-
quired by the provisions of the laws of the State of
California relating to cities of the sixth class, for
the purpose of electing the following officers of said
city, to -wit:
Three members of the City Council of said city for
the full term of four (4) years;
A City Clerk of said city for the full term of four
(4) years; and
A City Treasurer of said city for the full term of
four (4) years;
AND, WHEREAS, it appears that notice of said election
was duly and legally given; that there were nine (9)
voting precincts established within the said city for
holding said election, consisting of the regular voting
precincts established by the 3oard of Supervisors of
Los Angeles County, California, for the holding of
general State and County elections; that election
officers were appointed and election supplies furnished;
and that in all respects said election was held and con-
ducted and the votes cast thereat received and canvassed
and the returns made and declared in time, form and
manner as required by the provisions of the laws of the
State of California relating to cities of the sixth class
and pursuant to all laws of said State and of said City
in such case made and provided;
AND, WHEREAS, the City Council of the said City of
E1 Segundo met in the Council Chamber of said City Council
in the City Hall of said city in said city on Tuesday,
the 20th day of April, 1948. as provided by law, beginning
at the hour of one o'clock p. m. of the said day, to can-
vass the returns of said regular general municipal
election and declared the results thereof, whereupon said
Council found that the number of votes cast; the names
of the persons voted for; the office to fill which each
person was voted for; the results of said election; and
the other hatters required to be determined by law; to
be as hereinafter stated : -
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EL SEGUNDO,
CALIFORNIA, DOES HEREBY RESOLVE, DECLARE, FIND-AND DETERMINE
AS FOLLOWS:
First: That said regular general municipal election
was held-an conducted in said City of E1 Segundo, California,
on Tuesday the 13th day of April, 1948, in time, form and
manner as required by law;
Second: That there were nine (9) voting precints
establis i`�i- ' within the said city for the purpose of holding
said election, consisting of the regular voting precincts
established by the Board of Supervisors of Los Angeles
County, California, for holding of general State and
County elections, as follows:
Voting Precint No. 1 consisting of E1 Segundo
City Precinct No. 1, the polling place of which
was in the residence, 841 Loma Vista Street, in
said city;
Voting Precinct No. 2 consisting of E1 Segundo
City Precinct No.*2, the polling place of which
,was in the residence, 837 Virginia Street, in
said city;
Voting Precinct No. 3 consisting of E1 Segundo
City Precinct No. 3, the polling place of which
was in the residence, 1227 East Mariposa Avenue,
in said city;
Voting Precinct No. 4 consisting of El Segundo City
Precinct No. 4, the polling place of-which was in the
Council Chamber of the City Hall, 203 Richmond Street,
in said city;
Voting Precinct No. 5 consisting of E1 Segundo City
Precinct No. 5, the polling place of which was in the
residence, 407 Concord Street, in said city;
Voting Precinct No. 6 consisting of E1 Segundo City
Precinct No. 6, the polling place of which was in the
residence, 508 Loma Vista Street, in said city;
Voting Precinct No. 7 consisting of E1 Segundo City
Precinct No. 7, the polling place of which was in the
Recreation Hall, 220 West Palm Avenue, in said city;
Voting Precinct No. 8 consisting of E1 Segundo City
Precinct No. 8, the polling place of which was in the
Woman's Club House Building, Southwest corner Standard
Street and Mariposa Avenue, in said city; and
Voting Precinct No. 9 consisting of E1 Segundo City
Precinct No. 9, the-polling place of which was in the
residence, 409 E. Maple Avenue, in said city.
Third: That (a) the whole number of votes cast in said City
of E1 Segundo at said election; (b) the names of the persons voted
for; (c) the office to fill which -each person was voted for; (d)
the number of votes given at each precinct to each person; and
(e) the number of votes given in said city to each person; are as
hereinafter set forth in this resolution;
Fourth: That the whole number of votes (ballots) cast in
said city at said regular general municipal election was 1637 votes
(ballots).
Fifth: (A) For member of the City Council of the City of
El Segundo, for the full term of four years, the following persons
respectively received the number of votes hereinafter indicated
and tabulated, and the respective total votes hereinafter set forth
and tabulated in the respective columns appearing under their
respective names, to -wit:

(1) That the said William R. Selby above named received
for member of the City Council of said City for the full term
of four years, a total of 1091 votes;
(2) That the said Willard J. Skelley above named received
for member of the City Council of said City for the full
term of four years, a total of 588 votes;
(3) That the said L. Rexford Thompson above named received
for member of the City Council of said City for the full term
of four years, a total of 1131 votes;
(4) That the said Dexter K. Benson above named received
for member of the City Council of said City for the full term
of four years, a total of 602 votes;
(5) That the said Walter W. Swanson above named received
for member of the City Council of said City for the full term
of four years, a total of 758 votes;
(6) That the said Thomas A. Bement above named received
for member of the City Council of said City for the full term
of four years, a total of 289 votes;
(7) That the said Hoyt Fleming above named received for
member of the City Council of said City for the full term of
four years, a total of 1 vote;
(8) That the said L. 0. Ford above named received for
member of the City Council of said City for the full term of
four years, a total of 1 vote;
(9) That the said Charles E. Kenney above named received
for member of the City Council of said City for the full
term of four years; a total of 1 vote.
SAID COUNCIL DOES THEREFORE HEREBY FURTHER RESOLVE, DECLARE,
FIND AND DETERMINE THAT AT SAID REGULAR GENERAL MUNICIPAL ELECTION:
(1) That L. Rexford Thompson is the candidate for the office
of member of the City Council of the City of E1 Segundo, California,
for the full term of four (4) years, who received the highest
number of votes for said office, and that therefore said L. Rexford
Thompson was elected and is hereby declared elected to the office
of member of the City Council of the City of El Segundo, California,
for the full term of four (4) years;
(2) That William R. Selby is the candidate for the office of
member of the City Council of the City of E1 Segundo, California,
for the full term of four (4) years, who received the second
highest number of votes for said office and that therefore said
William R. Selby was elected and is hereby declared elected to
the office of member of the City Council of the City of E1 Segundo,
California, for the full term of four (4) years;
(3) That Walter W. Swanson is the candidate for the office
of member of the City Council of the City of E1 Segundo, California,
for the full term of four years, who received the third highest
number of votes for said office and that therefore said Walter
W. Swanson was elected and is hereby declared elected to the
office of member of the City Council of the City of E1 Segundo,
California, for the full term of four (4) years.
(B) For City Clerk of the City of E1 Segundo, for the full
term of four years, the following persons respectively received
the number of votes hereinafter indicated and tabulated, and the
respective total votes hereinafter set forth and tabulated in
the respective columns appearing under their respective names,
to -wit:

FIND AND DETERMINE THAT AT SAID REGULAR GENERAL MUNICIPAL ELECTION:
Said Victor D. McCarthy is the candidate for the office of
City Clerk of the City of E1 Segundo, California, for the full
term of four (4.) years, who received the highest number of votes
for said office and that therefore said Victor D. McCarthy was
elected and is hereby declared elected to the office of the City
Clerk of the City of El Segundo, California, for the full term of
four (4) years.
(C) For City Treasurer of the City of El Segundo, for the
full term of four years, the following persons received the
number of votes hereinafter indicated and tabulated, and the
total votes hereinafter set forth and tabulated in the column

THAT SAID COUNCIL DOES THEREFORE HEREBY FURTHER RESOLVE, DECLARE,
FIND AND DETERMINE THAT AT SAID REGULAR GENERAL MUNICIPAL ELECTION:
That said Mints. Curtzwiler is the candidate for the office of
City Treasurer of the City of E1 Segundo, California, for the full
term of four (4) years, who received the highest number of votes
for said office and that therefore said Mints. Curtzwiler was elected
and is hereby declared elected to the office of City Treasurer of
the City of E1 Segundo, California, for the full term of four (4)
years.
AND SAID CITY COUNCIL DOES HEREBY FURTHER RESOLVE, DECLARE,
FIND AND DETERMINE that the City Clerk of said City shall enter on
the records of said City Council a statement of the results of said
election, showing:
(1) The whole number of votes cast in said City
of E1 Segundo;
(2) The total number of votes cast inclusive of
both the votes cast at the various precincts
and the votes cast in absentee voters' ballots;
(3) The names of the persons voted for;
(4) The office to fill which each person was voted for;
(5) The number of votes given at each precinct to each
of such persons for each of such offices;
(6) The total number of votes given in said City to
each of such persons for each of such offices;
(7) The total number of votes given in said City and
in absent voters' ballots to each of such persons
for each of such offices;
AND SAID CITY COUNCIL DOES HEREBY FURTHER RESOLVE, DECLARE,
DETERMINE AND DIRECT:
(A) That the City Clerk shall immediately make and
deliver to each of such persons so elected a
certificate of election signed by him and duly
authenticated, said certificates to certify re-
spectively as follows:
(a) That L. Rexford Thompson was elected as a
member of the City Council of the City of
E1 Segundo, California, for the full term
of four (4) years;
(b) That William R. Selby was elected as a member
of the City Council of the City of E1 Segundo,
California, for the full term of four (4)
years; and
(c) That Walter W. Swanson was elected as a member
of the City Council of the City of E1 Segundo,
California, for the full term of four (4) years;
(d) That Victor D. McCarthy was elected as City
Clerk of the City of El Segundo, California,
for the full term of four (4) years; and
(e) That Minta Curtzwiler was elected as City
Treasurer of the City of E1 Segundo, California,
for the full term of four (4) years.
(B) That the City Clerk shall also impose the constitutional
oath of office upon the said L. Rexford Thompson, William R. Selby
and Walter W. Swanson, as members of the City Council of said City
for the full term of four (4) years; and upon the said Minta Curtzwiler
as City Treasurer of said City, for the full term of four (4) years;
and have them subscribe thereto and file the same in the office of
said City Clerk. He-shall also take and subscribe the constitutional
oath of office before some person authorized to take oaths and shall
file the same in the office of said City Clerk, as required by law.
(C) That thereupon each and all of said persons so elected
to said respective offices shall be inducted into the said re-
spective offices to which they have respectively been elected."
The motion to adopt the foregoing resolution was carried
unanimously (and by the Mayor declared carried) by the vote shown in the
following certificate of the City Clerk, to -wit:

I, the undersigned, Victor D. McCarthy, City Clerk of the City of
E1 Segundo, California, do hereby certify that the foregoing resolution was
duly and regularly introduced and adopted by the City Council of said City
of E1 Segundo, California, at an adjourned regular meeting of the said
Council held on Tuesday, the 20th day of April, A. D., 1948, and that
the same was adopted by the following vote, to -wit:
Ayes: Councilmen Baker, Peterson, Thompson and Mayor Selby.
Noes: Councilmen None.
Absent: Councilman Skelley.
Not Voting: Councilmen None.
IN WITNESS WHEREOF, I have hereunto set my hand and affixed the
official seal of said City of El Segundo, California, this 20th day of

The City Clerk then reported that he had caused to be entered
on the records of the City Council of the City of E1 Segundo, California,
a statement of the result of said election, by filing the resolution
last hereinabove set forth in his office, and by entering said resolution
in full in the minutes of this meeting on the said records.
The City Clerk thereupon issued certificates of election to
Councilmen L. Rexford Thompson, William R. Selby and Walter W. Swanson,
and also upon Minta Curtzwiler, Treasurer elect, who immediately there-
upon took and subscribed to their respective constitutional oaths of
office and filed the same with the City Clerk; who thereupon announced
that he had taken and subscribed his constitutional oath of office
before an officer authorized by law to impose oaths, and that said
oaths of office were duly filed in his office.
The City Clerk thereupon announced that the Official Bond of the
City Clerk and the Official Bond of the City Treasurer had been duly
furnished and filed as provided by law.
Councilmen Elect'L. Rexford Thompson, William R. Selby and Walter
W. Swanson thereupon took their respective seats at the Council table
and the Council thus constituted thereupon consisted of the following
members, all of whom were present, to -wit:
Councilman Wilburn E. Baker,
Councilman Dave W. Peterson,
Councilman William R. Selby,
Councilman Walter W. Swanson,
Councilman L. Rexford Thompson.
The City Attorney thereupon advised the Council that it would be
in order for the City Council at this time to hold its organization meeting
and proceed to organize by choosing a Mayor. He thereupon presented to
the members of the Council elect the following "CONSENT AND WAIVER OF
NOTICE OF ORGANIZATION MEETING OF THE CITY COUNCIL OF THE CITY OF EL
SEGUNDO, CALIFORNIA, ", which was subscribed by each of the members of the
City Council as so constituted, and which was thereupon filed with the
City Clerk, to -wit:
"CONSENT AND WAIVER OF NOTICE OF ORGANIZATION
MEETING OF THE CITY COUNCIL OF THE CITY OF
EL SEGUNDO, CALIFORNIA.

KNOW ALL MEN BY THESE PRESENTS:
That we, the undersigned, constituting and being all of the
members of the City Council of the City of E1 Segundo, California,
as presently constituted, do hereby give our written consent to holding
of the organization meeting of the said Council following the regular,
general municipal election of April 13th, 1948, to be held in the
Council Chamber in the City Hail of said City, in said City, beginning
at this time, to -wit's the hour of 1:29 o'clock p. m. on Tuesday, the
20th day of April, 1948, for the purpose of organizing said Council by
choosing one of .its members as, and to act as, Mayor of said City,
and for the purpose of transacting any other business that may properly
come before said Council, and we hereby waive any and all notice of the
time and place of the holding of said meeting and do hereby consent and
agree that the same may be held at said place, beginning at said time,
upon said date, and for said purposes.

The City Council thereupon proceeded with the organization meeting
referred to in the foregoing Consent and Waiver of Notice, and upon pro-
ceedings duly and regularly taken, William R. Selby was chosen by said
Council as Mayor of said City to continue as such Mayor during the
pleasure of said Council and until its further order.
WRITTEN CO*= CATIONS.
The following communications, which were read to the Council, were
disposed of in the manner indicated, following reference to each herein-
after:
STATE BOARD OF EQUALIZATION, dated April 12. 1948, being notifica-
tion that Floyd Carr has made application for an "On Sale" beer license
at 3 @7 Richmond Street, E1 Segundo. Ordered filed.
MRS. H. L. GILLIG, dated 4 -19 -1948, being application for renewal of
permit to occupy, use and maintain a house trailer at 227 Concord Street,
E1 Segundo.
The Building Inspector having recommended the permit applied for
be granted, it was moved by Councilman Peterson, seconded by Councilman
Thompson, that Mrs. H. L. Gillig be and she is hereby granted a temporary,
revocable permit, in regular form, to occupy, use and maintain a house
trailer at 227 Concord Street, El Segundo, said permit to expire by
limitation June 30, 1948. Carried.

THE JUDICIAL COUNCIL OF THE STATE OF CALIFORNIA, dated April 15,
1948, which was accompanied by a summary of the said Council's proposal
for the reorganization of courts with jurisdiction inferior to that of
the Superior Court and a questionnaire which the Council is requested
to complete, as an expression of its views on the matters covered
therein.
On motion of Councilman Baker, seconded by Councilman Thompson, which
carried unanimously, the communication and questionnaire received this
date from the Judicial Council of the State of California were referred
to the City Attorney for study and report to this Council at its
April 28th, 1948, meeting.
REPORTS OF OFFICERS AND SPECIAL COMMITTEES.
The City Clerk reported that on or about March 27, 1948, a motorist
had damaged a fire hydrant at the southwest corner of Imperial Highway
and Main Street, the cost of replacement being $137.08; that the
motorist's insurance carrier has submitted a form of release for
execution by the proper officers of the City of E1 Segundo, indicating
the insurance carrier's willingness to pay the claim when the properly
executed.-release is received by it.
The release having been approved as to form by City Attorney
Woodworth, it was moved by Councilman Peterson, seconded by Councilman
Baker, that that certain communication from Employers Mutual Liability
Insurance Company of Wisconsin, dated April 12, 1948, captioned:
"Re Walter S. Swain - E 42- 4698 ", presented this Council this date
by the City Clerk, be received and placed on file in the office of
the City Clerk and that the Mayor and the City Clerk are hereby
authorized to execute the said release, on behalf of the City of E1
Segundo, and the City Clerk is directed to make delivery thereof in
due course to the said insurance company. Carried by the following
vote:
Ayes: Councilmen Baker, Peterson, Swanson, Thompson and Mayor Selby.
Noes:' Councilmen None.
Absent: Councilmen None.
The City Clerk reported, that as a result of interchange of corres-
pondence between his office and the State Employees' Retirement System,
he is in receipt of a communication from said System, stating that
if the City wishes to amend its current contract so as to provide
benefits under said State Employees' Retirement System for the City
Attorney at his actual rate of compensation instead of on a reduced
basis, as at present, it will be necessary to order an actuarial survey
to determine the cost to the City of such amendment.
After an explanation of the matter and discussion, it was moved by
Councilman Peterson, seconded by Councilman Baker, that the City Clerk
be and he is hereby authorized and directed to advise the State Em-
ployees' Retirement System, in response to its letter dated April 13,
1948, initialed LCH and addressed to the City Clerk, that the City
Council is desirous of having the said System advise the City of El
Segundo the approximate cost of an actuarial survey for the purpose
of determining the cost to the City of E1 Segundo to enable the City
Attorney of said City to participate in full benefits under the State
Employees' Retirement System instead of his present limited participa-
tion. Carried by the following vote:
Ayes: Councilmen Baker, Peterson, Swanson, Thompson and Mayor Selby.
Noes: Councilmen None.

Mr. Joseph C. Powers at this point addressed the Council, stating that
he has been informed that it is not the intention of the City of Los Angeles
to reduce the grade of the sand hills westerly of the City of El Segundo
beyond the point now reached and that it is the desire of property owners
in portions of Tract No. 1685 within the City of E1 Segundo to have the
grade further lowered, so as to provide a full view of the beach and ocean.
After discussion, by general consent, the City Engineer was directed
to confer with the proper agency of the City of Los Angeles to determine
whether or not said City would be disposed to further lower the finished
grade of the sand hills lying between the westerly city limits of the City
of E1 Segundo and the Hyperion outfall sewer plant now in course of
construction along the beach.
No further business appearing to be transacted at this meeting, it
was moved by Councilman Thompson, seconded by Councilman Peterson, the
meeting adjourn. Carried.
