A regular meeting of the City Council of the City of E1 Segundo, California, was held in the Council Chamber of the City Hall of•said City on the above date, having been called to order at 7:00 o'clock P. M. by ldilliam R. Selby, Mayor.. ROLL CALL. Councilmen Present: Baker, Peterson, Skelley, Thompson and Mayor Selby. Councilmen Absent: None. READING OF MINUTES OF PREVIOUS MEETING. The minutes of the regular meeting held on the 16th day of October, 1946, having been read and no errors or omissions having been noted, it was moved by Councilman Skelley, seconded by Councilman Baker, the minutes of said meeting be approved as recorded. WRITT124 COI4�UNICATIONS . 11ritten communications, received from the persons, firms or corporations hereinafter named, were read to the Council and were disposed of in the manner indicated, following reference to each, as follows: MRS. FRANK B. CHAMBERLAIN, dated October 23, 1946,.requesting permission to park a trailer in the rear of 223 West Maple Avenue, El Segundo. The Building Inspector had endorsed thereon his recommendation that the permit applied for be granted, whereupon it was moved by Councilman Skelley, seconded by Councilman Baker, the following resolution be adopted: RESOLVED, that the application_of Mrs,Frank B, Chamberlain, dated October 23, 1946, for a permit to maintain a house trailer on the property located at 223 West Maple Avenue, E1 Segundo, be received and placed on file in the office of the City Clerk for the purposes of identification and reference; AND, BE IT FURTHER RESOLVED, that in view of the recommendation of the Building Inspector, that the City Council._ hereby grants a temporary permit, revocable at any time by the said Council upon fifteen days written notice to the permittee, to,keep and maintain a house trailer on the property herein- above described; said permit being subject to the provisions of Ordinance No. 223 of the City of.El Segundo and ordinances supplementary thereto or amendatory thereof; provided, further, that this permit shall automatically lapse and become void, unless sooner revoked, upon the 23rd day of January, 1947, by limitation. CULTON, dated October 23, 1946, requesting that his application, filed with this Council October 16, 1946, for a permit to keep a trailer in the rear of 211 Richmond Street, which request had been denied at a previous, meeting of this Council, be given additional consideration. Several members of the Council expressed themselves as being opposed to the use of trailers in the business district of the City and stated that they .01 R 4�3 had not changed their minds in this regard since the previous meeting of the Council, after which it was moved by Councilman Baker, seconded by Councilman Peterson, that the request of Guy H. Culton, filed with this Council this date, requesting a permit to maintain and use a house trailer in the rear of 211 Richmond Street, El Segundo, be denied. Carried. ERNEST L DeROUCHIE, dated October 23, 1946, making a reapplication for permission to park a trailer in the rear of his business at 228 Vfest ,rand Avenue, E1 Segundo. On motion of Councilman Skelley, seconded by Councilman Peterson, which carried unanimously, the request was denied. 17. De Rouchie then arose and asked the Council how much time would be allowed to move the trailers, permits for which had been denied at this meeting. After a general discussion, the consensus of the Council was that the trailers should be moved not later than thirty days from this date, i. e. by November 23rd, at midnight, such view being arrived at under the special and peculiar circumstances relating to the particular trailers herein involved and not to be construed as a precedent in any sense. Cif 1 -HLES CRA1P, dated October 21, 1946, suggesting that all lands . west of Hillcrest Street and between Imperial-Highway and Palm Avenue, be declared a possible oil zone, and if that is not a reasonable request, that these properties be-not zoned at all. In his communication he stated that the land has been held in prospect for oil development for many years; that there is a, feeling that activity in this regard may be under- taken in the not distant future; that the property owners should not be deprived of the opportunity, as-no one would be harmed by ihe'undertaking. By general consent the communication was ordered filed in the office of the City Clerk with other data, for the information of the Council when it gives further consideration to the adoption of .a planning or zoning ordinance for the City of EL Segundo. ROY 0. GILBERT, M. D., County Health Officer, dated October 14, 1946, advising that a copy of the annual report of L9s Angeles County Health Department for the fiscal Year 1944 -45 is being forwarded the City under separate cover, and expressing gratification at the cooperation given his Department by officials -representing, the cities within the jurisdictional area of the several health districts of Los Angeles County. Ordered filed. CITY OF LOS AN MES, dated October 21,.1946, titled:,"-Pile No. AC- 36466 - Hyperion Activated Sludge Plant ", with which was transmitted a' copy of a report made to the Board of Public Works of the City of Los Angeles on October 16, 1946`, setting Forth the progress in the completion of the new sewer treatment plant and submarine outfall at Hyperion. By -eneral consent the communication was ordered filed and the City Clerk requested tof ?rnish copy thereof to each member of the Council, one to the City Attorney and one to the City Engineer. DETCHTLH, HOYT, PIN _'S & INALSH, dated 17th October 1946, captioned: "RE: Sale of oil well known as Elsie No. 9 -1, and assignment of city permit for same ", enclosing therewith certain documents therein enumerated, bearing upon the sale and assignment of the oil well hereinbefore referred,to, to S. Block & Son b7'r Jack Frombach and /or Esther Leona Frombach, co- partners, owners of said well. The communication and accompanying documents had been referred to the City Attorney for examination and approval, and that officer having.. informed the Council that in his judgment all papers are in good order and are sufficient to effect'the transfer if it'is the Council's pleasure, it was moved by Councilman Skelley, seconded by Councilman Thompson, the following resolution be adopted: R'45! RESOLVED, that the communication from Dechter, Hoyt, Pines & Walsh, dated 17th October 1.946, enclosing transfer and assignment documents, with reference�to the transfer of Elsie No. 9 -1 oil well from Jack Frombach and Esther Leona Frombach, copartners, to S. Block & Son, subject to the approval of the City Council, be received and filed in the office of the City Clerk, open to public inspection, and that said aommunication, and its accompanying documents, so on file, be and the same are hereby referred to and by this reference incorporated herein and made a part hereof; AND, BE IT RESOLVED FURTHER, the City Attorney having approved as to form the various documents, that the City Council does hereby approve and consent to the assignment of the permit for said Elsie No. 9 -1 well, all as set forth in said assignment document, effective as of this date, October 23, 1946. Carried. StPECIAL ORDER O $USIN%SS. The hour of 7:15 o'clock P. M. at this meeting having heretofore been fixed as the time and place for receiving bids for.the sale of one 1940 Indian Motorcycle, now owned by the City of E1 Segundo; and also for furnishing the City of El Segundo with three centrifugal water pumps, the Mayor annbunced the hour of 7:14 o'clock P. M.. and stated that if any person or persons present desired to file bids for the purchase of one 1940 Indian Motorcycle, now owned by the City, or for furnishing the City of E1 Segundo with three centrifugal water pumps, they should do so immediately. The hour of 7:15 o'clock P. M. having arrived and all bids being in, the Mayor declared the time for receiving bids, closed.., It was thereupon moved by Councilman Peterson, seconded by Councilman Baker, that the Council first proceed to open, examine and publicly declare all bids received this date for the sale by the City of El Segundo of one 1940 Indian Motorcycle, now owned by said City, and thereafter to consider all bids received this date for furnishing the City of E1 Segundo with three centrifugal water pumps. Carried. The City Clerk announced that four bids-had been-received-for the Purchase of the 1940 Indian Motorcycle now owned by the City of,El_Segundo. The Council thereupon proceeded to_ open,__. examine. and- publicly declare said bids, i�rhich said bids were found by said Council to be as follows, to -wit: Bia of B. B. James, 145 Richmond Street, El Segimdo, bidding the sum of 1141.50. Said bid was accompanied by cash deposit in the sum of $15:00. Bid of J. A. Christian, 122 Penn S.treet,'El Segundo,. dated October 23, 1946, bidding the sum of $125.00. Said bid was accompanied by cash deposit in the size of $15.00. Bid of William C..Brown, 433 Concord Street, El Segundo, dated 21 Oct. 1946, bidding the sum of A251.00. Said bid was accompanied by Money Order No. 438673, payable to City of El Segundo, in the sum of $25.10. 'Bid of R. H•. Dietrich-, dated October 16,-1946,-bidding the sum' of 3340.00. Said bid was accompanied by cash deposit in the sum of $34.00. Following the opening, examination and declaration of said bids, it was moved by Councilman Thompson, seconded by Councilman Baker, the Y following resolution be adopted: - RESOLVED, that all bids received this date for the used 1940 Indian Motorcycle, Motor No. DD 0754 B, advertised for sale by the City of El Segundo, under the notice dated the 7th day of October, 1946, be rejected, with the exception of the bid of R. H. Dietrich, and that the City Council hereby accepts the bid of said R. H. Dietrich in the sum of $340.00 for said motorcycle, as is, and does hereby authorize the Mayor and /or the Cit;T Clerk to execute and deliver the necessary instrument of conveyance in the premises in due course upon receipt of the balance of the sale price; AIM) BE IT FURTHER RESOLVED, that the City Clerk be and he is hereby authorized and instructed to return the deposits of all unsuccessful bidders. IF R-46 Following the.opening and declaring of said bids, it was moved by Council- man Peterson, seconded by Councilman Baker, that all bids received this date for furnishing the City of EL Segundo three centrifugal water pumps, be taken under advisement until the next regular meeting of this Council, and that during the interim they be referred to the Superintendent of the Water Depart- ment of said City for checking and report to this Council at its next regular meeting. Carried. The'City.Clerk then reported to the_Council that he had in his possession, in the same condition as when received, one bid for tax deeded real property heretofore advertised for sale by the City of El Segundo. Moved by Councilman Baker, seconded by Councilman Skelley, that the Council proceed to open, examine and publicly declare said bid. Carried. The Council thereupon proceeded to open, examine and publicly declare said bid, which said bid was found by said Council to be as follows, to -wit: Bid of Marcus Siprut, on regular form provided therefor, as follows: Lot 25, Block 12, E1 Segundo - - - - - - - - - - - - - - - $700.00. Following consideration pf said bid, it was moved by Councilman Peterson, seconded by Councilman Thompson, that Resolution No. 656, entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SE ^UNDO, CALIFORNIA, ACCEPT'IN`G THE CASH BID OF MARCUS SIPRUT AND ELEONORE SIPRUT FOR CERTAIN CITY aIT ED REAL PROPERTY, which was read, be adopted. Said resolution was adopted by the following vote: Ayes: Councilmen Baker, Peterson, Skelley, Thompson and Mayor Selby.. Noes: Councilmen None. Absent: Councilmen None. ORAL COMtiUNICATIONS. None. REPORTS OF STANDING COMMITTEES. None. REPORTS OF OFFICERS AND SPECIAL COMMITTEES. The City Clerk reported that an infestation of silver fish in the City Hall is dau-iaging supplies and records; that he had obtained a price from a pest control firm for eradicating the same and felt the matter should be given prompt attention. 1"Oved by Councilman Skelley, seconded by Councilman Baker, that the City Clerk be authorized to cause the City Hall building to be treated for the eradication of silver fish, at a cost of not to exceed '72.00, plus • California State Sales Tax, if any. Carried by the following vote: Ayes: Councilmen Baker, Peterson, Skelley, Thompson and Mayor Selby. Noes: Councilmen None. Absent: Councilmen None. .� City Attorney Woodworth reported that his associate in that certain court action brought against the City of EL Segundo by Carl S. Dalton and 0. K. Gibbons, et al, had learned from the Attorney representing the plaintiffs that the matter would be continued, but that the exact time is unknown. City Attorney Woodworth reported receipt.of a communication From the Railroad Commission of the State of California, titled: "Investigation of 1as Utility Schedules, Rules, Regulations and Contracts, Relating to Sale of Surplus Natural Gas ",'concerning its reopening of hearing in Case No. 4591, which said 'hearing will be commenced in San Francisco December 4, 1946 and in Los Angeles December 11, 1946, and he thereafter handed the City Clerk for filing the letter he had received from said Commission,-dated October 22, 1946, together with the Commission's Notice of Adjourned Hearings. City Attorney Woodworth reported that in connection with the con- demnation action brought by the City of Los Angeles and involving the City of E1 Segundo, in which case he was authorized by the City Council of the City of El Segundo to appear as the City's Attorney, he had talked to-Mr. Arthur William Green, Deputy City Attorney-for Plaintiff in said action No. 520183 at 10:15 o'clock this a.m. and told him that the City'would deliver quitclaim deed for a dismissal. lr. Green stated he would review his files and advise whether such procedure would be acceptable, and that he had promised to write Mr. 'Joodworth a letter on the subject. In the meantime, pending receipt of such letter, no default will be taken and the City will have additional time within which to demur, answer or otherwise plead to the Plaintiff 's complaint on file. Mr. ?,,00dworth further stated he had heard nothing further subsequent to said conversation. nNFINISHED BUSINESS. In the matter of the application of Frank S. Chamberlain, filed with this Council October 16, 1946, and taken under advisement until this date, the City Clerk read to the Council the report and recommendation of the Building Inspector respecting said application, which recommended that the permit prayed for be denied; whereupon it was moved by Councilman Peterson, seconded by Councilman Skelley, that the application of Frank B. Chamberlain, filed with this Council October 16, 1946, for a permit to park a house trailer in the rear of 223 blest Maple Avenue, be denied. Carried. The City Clerk, reporting with respect to the sale to Harry Burlin in May, 1945, of a junked motor, stated that investigation following the last meeting of the Council, discloses that the Division of Motor Vehicles of the State of California had been advised by letter dated November 10, 1944, that said motor had been junked. By general consent, therefore, the Council conceded no further action be taken and that the present owner of said junked motor, who desires to repair and use the same, make direct application to the Division of Motor Vehicles for its reregistration. The Chief of Police reported to the Council that the Police Department has an accw.ulation of six bicycles, the owners of which the.Department has not been successful in finding and he inquired respecting disposal of same. The City Attorney recommended that the same procedure as formerly used be followed at this time, Mr. R. T. Hutchins expressed the desire to take his annual earned vacation between the dates October 28th and November 9th, 19462 and there- after be permitted to take one week's leave of absence, without pay. He stated it eras his intention to place all departments under his supervision in- control of Assistant City Engineer J. D. Locke, with the., exception of the Police Department, which Department will be in charge „of T. B DeBerry, Captain of Police. He suggested that Captain•DeBerry be given additional compensation for the period of his absence fror4 the..City. It was moved by Councilman .Thompson, seconded.,by Councilman Baker, that R. T. Hutchins be and he is hereby granted permission to take his earned annual vacation between the dates October 28th, 1946 and November 9th, 1946, and thereafter, beginning November 10th, 1246, to take one week.!s, leave of absence, without pay; that his appointment of J. D. Locke as supervisor of all departments presently under the supervision of Mr. Hutchins, with the exception of the Police Department for the period of his absence from the City, be ratified and approved;.that• his appointment of T. B. DeBerry as acting Chief of Police-during his said absence be likewise ratified and approved, and that.when this meeting adjourns, it adjourn until .the hour of 12:00 o'clock Noon, October 28th, 1946, at which time the matter of additional compensation for T. B. DeBerry while serving in the,gapagity of acting Chief of Police shall be given consideration.. Carried by the following vote: Ayes: Councilmen Baker, Peterson, Skelley, Thompson and Mayor Selby. The Water Superintendent reported that subject to the approval of the Council he had appointed Mrs. Peggy Sullivan as Departmental Clerk, Temporary, at the rate prescribed for such position--in.the salary resolution of the City of EL Segundo, effective on October 21st, 1946, and he.suggested that since her time would be divided between the Federal Housing Prodect, _ R 46 to be taken over by the City of El Segundo at its completion, and the Water Department, that her salary should be apportioned as follows: 50% to Federal Housing Project and 50 %_to_Water Department. After discussion, it was moved by Councilman• Baker, seconded by = -- Councilman Skelley, that the following resolution be adopted: RESOLVED, that the action of the water Superintendent in appointing Peggy Sullivan as Departmental Clerk, Temporary, effective October 21, 1946, at the rate prescribed in the salary resolution for such service, be and the same is hereby approved, ratified and confirmed; and BE IT FURTHER RESOLVED, that until the-further order of this Council, the compensation of the said employee shall be apportioned and charged as follows: 50% to Federal Housing Project and 50% to Water Department. Absent: Councilmen None. :eater Superintendent Hutchins reported that on November 1, 1946, Mr. Oakley Nayo will have been an employee of the City for one year on a daily basis, and that subject to the Council's approval he would like to place said employee on the monthly payroll as Water Service i,,an, at the salary fixed for said position in the salary resolution-of-the City of E1 Segundo. Moved by Councilman Peterson,'seconded by Councilman Thompson, that effective'Notrember 1, 1946, and until the further order of this Council, Mr. Oakley Mayo be designated Service Man in the Water Department, in accordance with the provisions of the current salary resolution of the'City of E1 Segundo. • Carried by the following vote: Ayes: Councilmen Baker, Peterson, Skelley, Thompson and Mayor Selby. Noes: Councilmen None. Absent: Councilmen None. In connection with the housing units being erected in E1 Segundo by the Federal Public Housing Authority, which units will be turned over to the City for operation when their construction by the Federal Government is completed, it was'felt that each housing unit should have two doors as a matter of safety for the-occupants instead of one door only as,present plans of the Federal Government permit; therefore, the City Engineer was instructed to obtain quotations for the installation of an additional door in each of said housing units and to report his findings to this Council. Water Superintendent Hutchins reported to the Council that in con- nection with the drilling of a new water well for the City of E1 Segundo, certain new pipe is needed; that he has prepared an estimate of the quantities and types of pipe which wili be needed; whereupon it was moved by Councilman Peterson, seconded by Councilman Baker., that the Superin- tendent of the Water Department be and he is hereby instructed to furnish the City Attorney all of the data necessary to permit said City Attorney to prepare a notice inviting bids for furnishing the City of El.Segundo Pipe of the type and in the quantity to be recommended by said •later R 46 Superintendent; that the City Attorney prepare such notice and furnish the same to the City Clerk, who is hereby authorized and directed to cause such notice to be published in time, form and manner provided by law.
