Following the reading of the last before mentioned communication, Mr. L. O. -Ford who was present in the Council Chamber addressed the Council, stating that his particular property.. Hyperion ;Triequesting that a certain Quitclainf Deed which accompanied said communication be ex- ecuted by and on behalf of the City of E1 Segundo, and returned to said -Bureau,, in considerat3on'of which the City Attorney of'the City-of-Los Angeles will dismiss a certain Superior Court Case No. 520183, entitled " City of Los Angeles vs Edwin W. Pauley, et al. City Attorney Woodworth'and City Engineer Hutchins each commented upon the matter, after which, by general- conserit the Council took'the request under advisement until its next regular meeting•,�nd refer -red the same to the City Attorney and'the City Engineer of the City of El'Segundo for investigation and report. COUNTY OF LOS ANGELES, dated November 19, '1946, with reference to the execution of an agreement between the City of E. Segundo and the County of-Los Angeles, respecting medical and surgical- treatment and hospitalization to prisoners detained-by the City, who may require such treatment while"so detained. The City Attorney informed the Council he wished to check certain provisions of law on the subject•and -the Chief of Police had some questions relative to the contract, whereupon, by general consent the matter was taken under advisement until the next regular meeting-of :the Council and the City Attorney and the Chief of Police were aequested` to report thereon' at said next regular meeting of the Council. STANDARD OIL OONPANY OF CALIFORNIA, dated November 25,'1946, captioned City of El Segundo Sewer and Water Lines, Block 12, El Segundo, with which was transmitted a form of agreement between the said Company an the City of E1 Segundo, covering Right of Way for the'City?-s Sewer and Water Lines in a portion of block 12, E1 Segundo. Following discussion, it was moved by Councilman Peterson, seconded by Councilman Thompson that the following resolu- tion be adopted: RESOLVED, that the Agreement (Easement) ericlosed by-Standard'. Oil Company of California to this Council in its communication of November 25, 1946, and which has'been read in full to this Council at this meeting, be approved by this.Council for executioh, with the following exception, that the sixth paragraph on page two of said Form of Agreement, be corrected to read as follows: "Grantee hereby recognizes Grantor's title and interest in and to the land over which the aforesaid right of way is hereby granted and agrees•never`to assail or resist Grantor *s title or interest therein, provided however, that Grantee expressly reserves its right of eminent domain and its right to condemn said property as provided by law as' presently vested in said Grantee and as mayl be vested in said Grantee under such laRs.as amended." AND, BE IT FURTHER RESOLVED, that the Mayor of the City of El Segundo be and he is hereby authorized to execute the said agreement as so corrected -and the City-Clerk to attest the.same and affix.the. Official Seal of the City thereto and to make delivery thereof in due course. Absent: Councilmen None. ORAL COMMUNIUATIONS, Mr. Edward'.A. Pitts addressed the Council, stating that he represented Pauley.Brothers and requested that the Council -in the consideration of its proposed Zoning Ordinance give thought to reasonable provisions for the drilling of oil and /or gas wells within the City of El Segundo. He stated that he and his principals have no objections to zoning, they agree that improved residential property should be protected, that it is possible to drill oil wells, and when drilling.is completed, remove the derricks and landscape the drill sites so that they present no objectionable features. He felt,.however, that two acres, which figure he heard- .mentioned at -the last public meeting on zoning, is insufficient area upon which to,drill eight wells for the purpose of draining forty acres, and he urged that the two acre drill site limitation be seriously considered. City Clerk McCarthy informed the Council that Mr. Charles Cramp, residing at 732 West Imperial Highwet�►, had asked-him to request the City Council to grant him a permit to keep, not to exceed four.horses _.at his before mentioned premises, He stated that it,is possible for him to keep his corrals and the animals a distance of more than 150 feet from +any oPening.into any building which is used for human - habitation. Moved by Councilman Peterson, seconded by Councilman Thompson that the following resolution be adopted: RESOLVED, that Charles Cramp be and he.is hereby granted a temporary, revocable permit, under the provisions of Ordinance No. 255 of the City of E1 Segundo and the-Housing Act of the State.of California, to keep four horses at his _premises at 732- West.Imperial Highway, El Segundo. Said permit shall be revocable at the pleasure of the-City Council, without notice and'without liability and is further subject to the provisions that during all of the,time this permit is being exercised, said premises must be kept in a clean condition and not in any manner to constitute a nuisance, Said permit is further, con- ditioned upon,.the.permittee approving,a. copy of the same in writing, agreeing to its terms and conditions, and that said approved copy shall be thereupon filed in-the office of the City Clerk. The foregoing resolution was adopted by the following vote: Ayes: Councilman Baker, Peterson, Thompson and.Mayor Selby. Not Voting: Councilman Skelley. Absent: Councilmen None. City Engineer Hutchins informed the Council that•on Notvinber 22,1946 Peter E. Binder,.Chairman of Veterans' Affairs Committee of:the City, of El Segundo, had received a communication from Langdon W, Post, Director Region VI, Federal Public Housing Authority, requesting that.Chairman Binder and others interested in the Federal Housing problem, attend a meeting in the United States Post Office Building, Los Angeles, November 25, 1946,•to discuss the inability of Federal Public Housing Authority to meet its contractual obligations-with reference to providing expense assistance in connection with temporary housing for veterans, that he,attended said meeting, Chairman Binder and Director McCarthy being unable to attend, Mr. Hutchins represented the City of E1 Segundo thereat. Also in attendance at said meeting, Were _- _persons representing cities from Santa Barbara and Bakersfield to'San Diego and as far east as Coachella. R �t The group was advised that as of January 15,.1947,.no more money will b e available through-FPHA and that all communities in which housing projects are under way will have to defray the cost of one or possibly all of the following: Hot Water Heaters, Space Heaters,. Stoves and Ice Boxes. 'It is believed that the State may assist California communities required to furnish these items to the extent of 90% of, the cost.to the Cities, but that the State will require reimbursement_of� such moneys as it may spend in that regard out of the rentals from such units.as the Federal- Government may permit the communities to collect and retain full rental. Further in connection with the local Federal Housing Project, City Engineer Hutchins reported he had been informed that several of the units will be ready for occupancy within a short'time. The City Clerk reported that pursuant to instruction of the Council given at its last regular meeting, he had written the State Employees' Retirement System for additional information concerning the proposed con- tract between the City of E1 Segundo and the Consulting Actuary of said State Employees; Retirement System, concerning certain investigations and valuations the Actuary is to make to determine the cost to the City of. E1 Segundo of amending -its current contract with said,'Syste-m., so as.to enable the employees of the City of E1 Segundo to participate in'the addi- tional retirement benefits granted by recent legislation Mending the Retirement Act. That in reply, he has received from t'he'State"anployees' Retirement System, form of contract which includes the Police- Department of the City of El Segundo, in the'invebtigation'and valuation'to be made. This form of contract being in conformance with the views'. of the Council on the subject, it was moved by Councilman Thompson, seconded by Councilman Peterson the following resolution be adopted: RESC1hVED, that a copy of that'certain Contract between rite City of E1 Segundo and the Firm of Coates .and Herfurth,, Consulting Actuaries, i►elating to arctuarial service to be performed for said City by said Actuaries (form F 113B -1 11 -46), be plaeed'on file in the office of the City Clerk arid that said form of Agreement as so on file, be and the same is hereby approved by the City Council of the City of El Segundo ;: AND, BE IT FURTYER RESCUED; that the Mayor of said City. -be and is hereby authorized 'to execute the said Agreement on behalf, of the City of El Segundo 'and the City Cl -erk to attest the same and, affix the official seal of the said'City thereto and make delivery of said Agreement in due course. Reporting with reference to the request of The Texas Company, filed with this Council - November 20, 1946, and taken under advisement until this meeting; the City Clerk stated that Acting Building Inspector Locke has --- approved as satisfactory, the abandonment of said Companyla'well.s -Nos. 1. 4, 5 and 6. Thereupon it - -was moved by Councilman Skelley, seconded by Councilman Baker that that certain communication from The.Texas Company, dated November 18, 1946, requesting termination of liability under bonds filed with the City for the satisfactory maintenance, operation and abandonment of certain Oil Wells within the City of E1 Segundo, be received and placed on.file in the office of the City Clerk of the City of E1 Segundo`and by this reference referred to and made a part of this Resolution , and that in view of a report of the Building Inspector that all mattteers in connection with the abandon- ment of wells No. 1, 4, 5 and 6 of said Company are in good order, this kA iCouncil does hereby resolve, declare and order that The Texas Company and its Surety, Maryland Casualty Company be, and they'are hereby exonerated from any'liability accraing thereon-subsequent-to midnight November 27, 1946, as to those certain oil wells bff=the- Texas Company, named and known as Security No. 1,- -Security No: 4, Security No. 5 and Security No. 6-Wells, and that the-City Clerk be'directed-to notify The Texas Company and the Maryland Casualty Company of this action. Absent: Councilmen None. -� The City Clerk reporting.with- reference to the request of the El Segundo Oil Company, filed with this Council November 20, 1946, that it be released from liability as to its El Segundo No. 4 Well, inasmuch as the same had been abandoned October 30, 1946; : Stated = - that �Acting.Building Inspector Locke had reported to him that said" well had'.beeri abandoned-in a satisfactory manner. It was thereupon moved by Councilman Thompsoa,_secohfled _ by Councilman Baker, that in view of the report to this Council that'El 'Segundo Oil Company has satisfactorily abandoned its oil-well in the City of El' 'Segundo, named and known as El Segundo No:•4, that -said Company-and its Surety; under bond No. 4613685 be and they are hereby exonerated as to any liability accruing thereon subsequent to midnight November 27, 1946, and that the'City Clerk.be directed to notify said E1 Segundo Oi�.Company, and its Surety,`Fidelity- and Deposit Company of Maryland, of this action taken by this Council. Gierlich,`City Engineer of thg City of Manhattan Beach, California, with reference to the City of El Segundo paying.one -half the cost of operation,charges of,a traffic control signal being ;erected at Sepulveda Boulevard and Rosecrans Avenue. Following discussion, it was moved by Councilman Baker, seconded by c:quncilman Thompson that the City Clerk be authorized and directed to notify the _City Clerk of .Manhattan Beach, that the City of E1 Segundo will pay one- half,,oi the costs of the operation of the traffic control signal presently being installed on the common boundary between,the City.of .EL.,Segundo and the City of' Manhattan Beach', at Sepil- veda Boulevard 'and Rosecrans Avenue, upon.receipt by the City of a Segundo of proper bills for such charges, which said bills shall be subject to audit in the usual manner. Carried by the following vote: Ayes: Councilmen Baker, Peterson, Skelley, Thompson and Mayor Selby Noes: Councilmen None. Absent: Councilmen None. Moved by Councilman Peterson, seconded by Councilman Baker that on recommendation.of the Street Superintendent, R. T. Hutchins, Sebastian Aimino, presently employed in the Street Department of the City of El Segundo, be classified as Laborer First Class, effective December 1,1946, and that thereafter said employee be compensated in accordance with the provisions of the Salary Resolution of the City.of El Segundo, as the same applies to_Laborers First Class, Carried-by the following vote: Ayes: Councilmen Baker, Peterson, Skelley, Thompson and Mayor, Selby.
