1945 NOV 07 CC MINR 66 E1 Segundo, California. November 7, 1945. A regular meeting of the City Council of the City of El Segundo,' California, was held in the Council Chamber',of the City Hall of said City, on the above date, having been called to order at 7:00 P. M. by' William R. Selby, Mayor. ROLL CALL. Councilmen Present: Peterson, Skelley, Thompson and Mayor Selby. Councilmen Absent: Hesser. At this time, the subject of bids on real estate and matters relating to tax deeded land liquidation program of the City of E1 Segundo was considered as the next order of business. Special City Attorney John F. Bender _suggeated :that-before- - considers -- tion of any of the bids taken under advisement at the last regular meeting, or any which might have been received for presentation at this meeting, that the Council consider establishing the new appraised prices of property advertised for sale under Notice No. 6 -M, which matter the Council has had under consideration for several weeks. Councilman Hesser appeared at this time, the hour being 7:03 o'clock P. M. and he immediately took his seat at the Council table. After considering the matter of the new appraisal values, it was moved by Councilman Skelley, seconded by Councilman Thompson, that the following resolution be adopted: RESOLVED, that this Council does hereby approve the new appraised values of all parcels of tax deeded real property offered for sale by the City of E1 Segundo under Notice No. 6 -M, as the same are set forth in that certain list entitled "Merchantable Title Lots All Advertised In Notice No. 6 -M ", under the column headed "New Appraised Value ", except as to Lots 51 and 62, Tract 2540, the approved appraised value of each of which is hereby fixed at y$400.00; AND, BE IT FURTHER RESOLVED, that a copy of said list, which is dated November 7, 1945, be placed on file in the office of the City Clerk of the City of El Segundo for identification and reference, and for the inspection of any person or persons desiring to inspect the same; AND, BE IT FURTHER RESOLVED, that there be added to said list, at the bottom thereof, the following statement, to -wit: "The City Council of the City of E1 Segundo reserves the right to reappraise the herein described properties and to fix new values thereon, whenever, in its discretion, circumstances justify a reappraisal ". Absent: Councilmen None. _ LA R' (5 7 z The Council thereupon proceeded to consider the bids on tax sale real property received.at its regular meeting held October 17th, 1945, which had been taken under advisement until this meeting and after such consideration, it was moved by Councilman Skelley, seconded by Councilman Thompson, that the bid of Vincent 0. Farrell, as Agent for Daisy J. Farmer, bidding the sum of $300.00 each for Lots 9 and 10, Block 11, and $250.00 for Lot 13, Block 11, all in E1 Segundo, be rejected, and the City Clerk directed to return to said bidder his bid deposit in amount of $250.00. Carried by the following vote: Ayes: Councilmen Hesser, Peterson, Skelley, Thompson and Mayor Selby. Noes: Councilmen None. Absent: Councilmen None. Moved by Councilman Skelley, seconded by Councilman Peterson, that the bid of Willard, N. At this point the City Clerk announced he had-in his possession, in the same condition as when received, five envelopes containing bids on tact deeded real property heretofore advertised for sale by the City of El Segundo. Moved by Councilman Peterson, seconded by Councilman Thompson, that the Council proceed to open, examine and publicly declare the bids received this date on tax deeded-real property advertised for sale by the City of E1 Segundo. Carried. The Council thereupon proceeded to and did open, examine and publicly declare said bids, which said bids were found to-be as follows, to -wit:: Bid of William A. Baughman, for Ace T. It was.thereafter moved by Councilman Peterson,.seconded by Councilman Hesser, that Resolution No. 782, entitled: RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, AUTHORIZING THE CITY A'ITORNZY AND SPECIAL CITY ATTORNEY TO CLEAR TITLE TO CITY OTWE= REAL PROPERTY THEREIN DESCRIBED, which was read, be adopted. Uarried by the following vote : Ayes: Councilmen Hesser, Peterson, Skelley, Thompson and Mayor Selby. Noes: Councilmen None. " Absent: Councilmen None. ' At this point Mr. Henry Claman addressed the Council relative to the new appraised values of tax deeded property heretofore - offered for sale by the City, as determined by this Council at this meeting. Mr. Claman expressed the belief that the new values are too high and not comparable to the asking prices _for adjoining properties. Mr. Vincent 0. Farrell and Bar. John Catalano also addressed the Council with reference to the same subject. Each member of the Council made comment'in response to-the remarks of the several speakers, indicating that the Council had made an honest, sincere attempt to appraise the said properties at what the members of the Council believed to to the true value thereof, which they felt was for the best interests of the City. The Council indicated that under the circumstances the prices would remainiin effect during such time as the Council deems reasonable and if the remaining unsold properties do not move within such period, the Council may then consider a reappraisal thereof. READING OF MINUTES OF PREVIOUS MEETING. The minutes of the regular meeting held'on the 17th day of October, 1945, having been read and no errors or omissions appearing, -it was moved by Councilman Hesser, seconded by Councilman Skelley, the minutes of said meeting be approved as recorded. Carried. WRITTEN COMMUNICATIONS. .The following communications, received from the persons, firms or corporations hereinafter named, were read to the Council and disposed of in the manner indicated following reference to each hereinafter: JOHN VON FLUE, dated October 22, 1945; CHARLES YATHERS, dated October 18, 1945; EVERETT E. DALE, dated October 31, 1945; and, ROBERT W. PARKER, dated November 5, 1945; each being application for employment by the City of El Segundo. Ordered filed. E. L. STANFIELD, dated November 1, 1945, being application for permit to keep one horse at 514 East Maple Avenue, El Segundo.- The location and surroundings thereof having been investigated by the Building Inspector of the City of E1 Segundo,, that officer reported that there are -nine residences within less than 150 feet of the corral within which it is proposed to keep the animal referred to in Mr. Staniffield's letter, therefore the Council, by general consent, deferred action upon said application until its h6it regular meeting. ESTHER ROSELYN 3ZCKS, dated November 2, 1945, being application for permit to conduct a Child Care Center at 606 Eucalyptus Drive, El- Segundo. It- appearing that the Fire.-Chief and the representative of Los Angeles County Health Department have not had time since said application was re- ceived, to report thereon with reference to the'fire safety and sanitary conditions of the premises proposed to be used for such Child Care Center, all as required by Ordinance No. 270 of tbLe City of E1 Segundo, by general consent the application was taken under advisement until the next regular meeting of the Council to enable the said officers to report with reference to the matter. 4€ R :1 STATE BOARD OF EQUALIZATION, dated October 31, 1945, being notification that Beecher B. James, d.b.a. The Spinning Wheel, has made application for an "On Sale" beer license at 145 Richmond Street,' E1 Segundo. Mr. Peter E. Binder, who was present at the'meeting, addressed the Council, indicating his belief that a protest against the.granting of the license should be filed with the State Board of Equalization. It also came to the Council's attention that certain of the residents in the neighborhood of 145 Richmond Street; had circulated a petition in opposition to the granting of said license, which said petition is to be filed with said State Board of Equalization. The Council thereupon discussed the matter at some length, at the conclusion of which it was moved by Councilman Peterson, seconded by Councilman Skelley, that the following resolution be adopted: RESOLVED, that the notification of Alcoholic Beverage License Application, dated October 31, 1945, with reference to an "On Sale " beer license, applied for by Beecher B. James, d ,,b.a. The Spinning Wheel, at 145 Richmond Street, E1 Segundo, presented this Council this date, be received and placed on file in the office of the City Clerk for the purposes of identification and reference; AND, BE IT 1URTBER RESOLVED,' that the City Clerk be and he is.hereby instructed to address a communication 'to the said State Board of Equalization, on behalf of this Council, protesting and objecting to the granting of the license applied for as aforesaid, for reasons, among others, as follows, to -wit: from - 1. That said proposed location is. across the street /and within 75 feet of the only theatre in the City of E1 Segundo, which is attended by large numbers of minor children and that their observance, of the conduct of certain persons in and about and entering and leaving the establishment of the nature herein referred to, "is not uplifting, nor a good example of approved conduct of good citizens, and could, on occasions, be considered as contributing to juvenile delinquency., 2. That the proposed location of said business is opposite and within 75 feet'of the only mortuary in the City of E1 Segundo and the boisterous conduct of persons frequenting An *establishment of this nature and the noise from music boxes and otherwise created, will have a tendency to interrupt and interfere with the dignity and solemnity of funeral services conducted in said mortuary. •. x 3. That the applicant hereinbefore referred to, has previously conducted a similar establishment at 139 Richmond Street, E1 Segundo, under the fictitious name and style of "The Workingmen's Club ", and experience and complaints received concerning same, indicate that occasional disturbances created therein, the noises emdllating therefrom, and the loud and profane conversations of pattrans entering and leaving the premises, have disturbed the peace of the neighbor- hood and have seriously interferred with the sleep and comfort.of' nearby residents at late and unusual hours of the night and have annoyed some to the extent that the Police Dep4irtment of the City of E1 Segundo has, on occasions,-been called upon to preserve the peace and quiet disorders; _ Arm, BE IT FUFMIER RESOLVED, that the City Clerk of the City of E1 Segundo is further directed to advise said Board of Equaliza- tion that in event the said application is not denied summarily and a hearing with reference thereto is ordered, that the Council Chamber of the City Hall of the City of El Segundo and such of its facilities as may be needed and are available, are at the disposal of said Board of Equalization for such purpose, without charge. BOARD OF PUBLIC HEALTH OF THE STATE OF CALIFORNIA, dated October 16, 1945, transmitting therewith a quarantine order respecting the ocean, beach and shore waters of Santa Monica Bay, from 14th Street, Hermosa Beach, north to Seaside Terrace, Santa Monica. Ordered filed. In connection with the matter of the abatement of the Hyperion outfall sewer nuisance, with which the quarantine is concerned, the City Attorney at this time reported progress in the matter of consideration of procedure in connection with the suit brought by the Attorney General of the State of California against the cities of Los Angeles, E1 Segundo, et al. THE REGIONAL PLANNING COMMISSION OF THE COUNTY OF LOS ANGELES, dated October 16, 1945, transmitting therewith a copy of a section bf the Amended Master Plan oP Shoreline Development for the County of Los Angeles, as adopted by the Board of Supervisors, September 4, 1945, which includes the shoreline of the City of E1 Segundo. Ordered filed. MRS. KARL BAMIORE, dated October 23, 1945, transmitting therewith a petition signed by Karl J. Barmore and 25 others, protesting the erection of any church, civic or community building in the residential district. The communication was ordered filed and the City Clerk requested to inform Mrs. Barmore that the Council contemplates conferring with re- presentatives of the County Regional' Planning Commission in the near future, with the view of developing a comprehensive zoning plan for the City of E1 Segundo. ' RAILROAD COMMISSION OF THE STATE OF CALIFORNIA, dated October 26, 1945, being a notice of hearing in 72nd Supplemental Application No. 179849, in the matter of Pacific Electric Railway Company, a corporation, for an in lieu certificate of public convenience and necessity,.with reference to its Los Angeles- Redondo via Del Rey bus service,•scheduled for hearing in the City Hall of the City of E1 Segundo, Thursday,.November 8, 1945, at 10:00 A. M. The City Attorney in this connection reported that pursuant to the instructions,of the Council given at its last meeting, he had advised the Railroad Commission of the City's desire to be heard before any order is made in the premises, and that doubtless the hearing scheduled here for November 8th is the result of his said communication. He further stated that he had prepared a resolution for the. Council's considerat.ioA and adoption if it correctly sets forth the facts as he believed them to be when he'prepared said resolution. The City Clerk thereupon read the resolution, as prepared and presented by City Attorney Woodworth, after which it was moved by Councilman Skelley, seconded by Councilman Hesser, that the following resolution be adopted: WHEREAS, there is now pending before the Railroad Commission of the State of.California, an application by Pacific Electric Railway Company for permission to re -route certain of 'its Passenger Busses now serving the City of El Segundo, so that such busses, so re- routed, will no longer serve said City; and WHEREAS, a copy of said application has been served upon said City, and the City Council thereof has requested a hearing on said matter, which hearing will be held in the Council Chamber of the City Hall of said City on Thvadday the 8th day of November, 1945, beginning at the hour of 10 o'clock A. M. of said day; R ._73 NOW THEREFORE BE IT UNANIMOUSLY RESOLVED BY THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, AS FOLLOWS: First: That said City Council, on its own behalf and on behalf of the citizens of said City, does hereby most respectfully, earnestly and vigorously protest and object to the changes proposed in said application. Second: That some of the reasons and grounds for the said protest and objection are the following: A. That said change is not required in order to serve the public interest, convenience or necessity, but on the contrary would adversely affect such public interest, convenience and necessity. B. That said change would inconvenience large numbers of patrons who have come to depend upon the service which is currently being rendered by the busses which it is proposed to reroute. C. Such change would seriously interfere with the proper and efficient transportation of pupils to and from the public schools located within said city. D. Said change is proposed to be made at a time when the City,of Los Angeles is about to commence major construction operations on the new Hyperion Sewage Disposal plant, which immediately adjoins the Coast Highway to which it is proposed to reroute said busses. That the said portion of the Coast Highway affected by such change is narrow and the routing of busses through said section at a time when the same will be congested with large motor trucks and heavy construction traffic during a construction period whichit is estimated will consume more than a year, will create dangers and hazards to which the traveling public should not be subjected. That the running time of the busses through such construction traffic in the interests of safety must be so reduced as to eliminate most, if not all of the alleged saving in running time, which applicant refers to in said application and which applicant estimates at a possible six minutes. E._ That large numbers of employees of industrial plants located in said City would be disturbed in their trans- portation schedules to their great inconvenience and disadvantage. F. That the growth of the City and the area presently served by the busses has bean such as to require that all of the busses be maintained on their present routing. G. That the area to which and through which it is pro- posed to reroute said busses is only sparsely settled and the location of the proposed route would carry the rerouted busses directly by and in full view of the-spot where the outfall sewer is presently discharging into the Pacific'Oceant whereas the maintaining of the present routing would permit the busses to continue to operate through populous territory and completely by -pass the condition at Hyperion proper. ILM R'74 H. That no agreement or consent granted by the Board of Public Utilities of the City of Los Angeles to the present routing on condition that the former routing be restored at the end of the war should be binding or control in the present instance where matters definitely affecting the public convenience, necessity, health and welfare are concerned. I. That in the opinion of said Council experience of the operation since the change to the present routings and schedules has demonstrated that there is need for the continued operation on the present routing and in accordance with such present schedules far and beyond that which would be served were the application granted and the route changed, Second: That the City Clerk be and he is hereby authorized and instructed to present and file with said Commission, a certified copy of this resolution, as the protest and objection of the City Council and of the City of E1 Segundo in-the premises. Moved by Councilman Skelley, seconded by Councilman Peterson, that the following resolution be adopted: RESOLVED, that the City Attorney be and he-is hereby authorized and instructed to attend the hearing before the Railroad Commission-of the State of California, to be held in the Council Chamber in the City Hall in the City of E1 Segundo, on Thursday,,November-8, 1945, in connection with the application of Pacific Electric Railway to reroute certain of its busses, which presently serve the City of El Segundo; and BE IT FURTHER RESOLVED, that said City Attorney shall be entitled to receive and there shall be paid to him a reasonable additional compensation for his services to be rendered in making such attendance and representing said City of Z1 Segundo at said hearing. Councilman Hesser of the Public Safety Committee advised having received complaints concerning .a hedge paralleling the westerly.line of that certain alley which intersects the northerly line of Grand Avenue, between Loma Vista and Whiting Streets within the City of E1 Segundo, the complainants stating that by reason of its size and location the hedge obstructs the view of motorists entering Grand Avenue from said alley, thereby creating a hazard and should be trimmed to eliminate the danger. By general consent the matter was referred to Park Superintendent McIlwain for.' such treatment as is indicated upon investigation. Councilman Peterson of the Public Works Committee recommended that the City Engineer of the City of E1 Segundo be instructed to prepare plans and specifications for the improvement of E1 Segundo boulevard between Main_Street and Richmond Street, within the City of E1 Segundo, so that the same will match in width and type of improvement with the work now being prosecuted in E1 Seguncjo Boulevard easterly of Main Street... t _ Following discussion it was moved by Councilmen Peterson, seconded by Councilman Hesser, that -the City Engineer of the City of-ZlI Segundo,be and he is hereby authorized and directed to.prepare plans and specifications for the improvement of E1 Segundo Boulevard, between Main Street and Richmond Street, within the City of E1 Segundo, by resurfacing the.present pavement thereon, by grading and improving the shoulders thereof, and by the doing of such other work as is required to make the improvement comparable to the improvements at this time being constructed in said E1 Segundo Boulevard easterly of Main Street.
