A regular meeting of the City Council of the City of E1 Segundo, California,
was held in the Council Chamber of the City Hall of said City on the above date,
having been called to order at 7:00 P. M. by George Love, 1,,ayor.

The minutes of the regular meeting held on the 3rd day of Tway, 1944, having
been read, without error or omission appearing, it was moved by Councilman Peterson,
seconded by Councilman Selby, the minutes of said meeting be approved as recorded.
Carried.
Councilman Hesser appeared at the meeting at this time, the hour being 7:03
o'clock P. T. =. and he immediately took his seat at the Council table.
At this point the City Clerk announced that he had in his possession, in the
same condition as when received, three bids on real property advertised for sale
by the City of E1 Segundo under published Notice No. 5 of Intention to Sell City
of E1 Segundo Owned Real Property and Inviting Bids or Offers Therefor.
T:ioved by Councilman Peterson, seconded by Councilman Skelley, that the
Council uroceed to open, examine and publicly declare all bids received this
date for the purchase of real property heretofore advertised for sale by the
City of El Segundo under published Notice No. 5 of Intention to Sell City of
E1 Segundo Owned Real Property and Inviting Bids or Offers Therefor. Carried.
The Council proceeded to open, examine and publicly declare said bids,
which bids were found by said Council to be as follows, to -wit:
Bid of Ben °.,. Tubbs, offering the sum of w165.00 cash for Lot 6, Block
44, E1 Segundo. Said bid was accompanied by Cashiers Check No. 156632, drawn
on Fifth & Spring Office of Security -First National Bank of Los Angeles,
payable to City Clerk, City of E1 Segundo, in the sum of 1165.00.
Bid of Bearl McAllister, on regular bid form, offering the sum of 1135.00
cash, for Lot 6, Block 44, E1 Segundo. Said bid was accompanied by deposit
in amount of w33.75 in currency.
Bid of George T. Lynch, for Emmett E. Stump and Frances V. Stump, on
regular form, offering the sum of 4125.00 cash for Lot 20, Block 7, E1 Segundo.
Said bid was accompanied by cash deposit in the sum of 150.00.

prayed for be granted and that the Park Superintendent be instructed to fill
the wading pool for casting practice on or b --fore May 201 1944, and to permit
said pool to remain filled through May 280 1944, so that the fly casting contest
may be held on.said date. Carried.

Grand Avenue Park for the annual picnic of E1 Segundo Pack No. 268 Cub Scouts,
Saturday, Lay 20, from 3:00 P. 1. to 7:00 P. M. for a group of approximately
150.
Loved by Councilman Selby, seconded by Councilman Skelley, that the permit
requested be granted and the Police Department of the City of El Segundo
directed to reserve the necessary= facilities. Carried.
PACIFIC ELECTRIC RAIU`,1AY COMPANY, dated May 109 1944, further referring
to the letter of the City Clerk of the City of El Segundo, dated April 7, 19449
with reference to the rerouting of motor coach service within the City of E1
Segundo, stating that the City's petition for such rerouting is denied and
setting forth numerous reasons therefor.
After consideration, it was moved by Councilman Skelley, seconded by
Councilman Hesser, the following resolution be adopted:
FUSOLVED, that the communication from Pacific Electric
Railway Company, dated Lay 10th, 1944, denying the request
recently made for the rerouting of a certain portion of the
Pacific Electric bus line serving the City of E1 Segundo be
received and placed on file in the office of the City Clerk;
AND, BE IT FURTi3✓R RESOLVED, that the City Clerk be and
he is hereby authorized and instructed to acknowledge receipt
of said communication and in so acknowledging such receipt,
to direct the attention of said Pacific electric Railway
Company to the fact that the J)resert routing, through the City '
of •E1 Segundo, of the busses which previously traversed the
Vista Del Ylar route, has been found to serve a large number
of patrons of the line in the City of El Segundo,,and that
such use has developed to such proportion that the City
Council would be opposed to any change back to the Vista Del
I4ar rout, ng and that, therefore, in the event that any such
change is contemplated in the future, the City of E1 Segundo
respectfully requests that it be advised of any such intention,
so that it may have ample opportunity to make protest against
any such proposed change.

permission to parade on I::ain Street, from Grand Avenue to Library Park and
to use said Park on Yay 30, 1944, in connection with its Iemorial Day services
and to be afforded an escort for the parade.
Moved by Councilman Peterson, seconded by Councilman.Hesser, that the
communication from E1 Segundo Post No. 38, American Legion, respecting its
I,:emorial Day parade and services be received and placed on file in the office
of the City Clerk for the purposes of identification and reference; that said
organization be and it is hereby granted permission to parade on Main Street,
bet-Teen Grand Avenue and the Library Park and to use Library Park in connection
with its Memorial Day services, Tuesday, May 30, 1944, and that the Police
Department of the City of E1 Segundo be requested to furnish a police motorcycle
escort for said parade if the furnishing thereof is convenient and practicable

VICTOR D. McCARTHY, dated May. 15, 1944, requesting representation from
the City Council at a general public meeting to be held in the Council Chamber
of the City Hall, 't-ednesday, May 31, 1944, at 7:45 P. M., for the purpose of
determining if the erection in El Segundo of a memorial to its citizens
participating in 'iorld ,ar II is a proper, patriotic and timely project and
if so, to organize for its accomplishment..
On motion of Councilman Peterson, seconded by Councilman Skelley, which
carried unanimously, ".,!ayor Love was chosen as the delegate of the City Council
of the City of El Segundo to represent said Body at a public meeting to be
held ".ednesday,;yay, 31, 1944, for the purpose of considering the erection in
E1 Segundo of a memorial to its citizens participating in World War II and
that Councilman Selby be appointed alternate in this connection to attend said
meeting and represent said City Council in event of the inability of the Mayor
so to do. Carried.

At this time, Yrs. Kinnie D. Burgner addressed the City Council with
reference to the balance payable to her deceased husband, Jacob S. Burgner,
as an employee of the City of E1 Segundo, including the amount of his accrued
vacation allowance.
The City Attorney suggested that Mrs. Burgner be sworn to testify and
the City Clerk adziaistered the oath.to her.
She thereupon proceeded to testify to the City Counc1l' upon auestions
propounded by the City Attorney as hereinafter set forth in the following
resolution, and at the conclusion of said testimony, it was moved by Councilman
Eesser, seconded by Councilman Skelley, resolution as follows be adopted:

has appeared before this Council at this meeting and after having been
duly sworn, has testified to this Council that the follw,.,ing facts are
true:
. First: That sl:e is the widow of said Jacob S. Burgner, deceased,
formerly employed by the City of yl Segundo.
Second: That said Jacob S. Burgner, deceased, left no estate which
it is necessary to probate through court and that therefore no adminis-
trator or executor will be appointed.
Third: That the unpaid balance of salary and accrued vacation
allowance, to which said Jacob S. Burgher vas entitled from said City
at the time of his death, constituted and was and is a part of the
community property of said Jacob S. Burgner and Yinnie D. Burgner.
Fourth: That as the surviving widow of said deceased she is
making claim against the City of El Segundo under the particular
and peculiar facts of the present case that she be raid the balance
of compensation due said Jacob S. Burgner, plus the amount of his
earned vacation allowance, same to"be pail to her as surviving widow
of said deceased and the person entitled to the community property
of said parties;

paid the said amount as the surviving widow of said deceased be and

to prepare and present to this Council for its consideration and
allowance at the nest regular meeting of this Council, the necessary
demand and warrant to enable the payment of the sums referred to
to be paid to said I::innie D. Burgner. Nothing herein contained
shall be construed as a precedent, as the Council finds that under
the particular and peculiar facts above set forth, the payment
hereby provided for should be made.

Dr. Loren D. Sims then addressed the Council relative to an easement over
the Northerly 3 feet of Lot 11, Block 21, E1 Segundo, heretofore on December
6th, 1939, granted him by this Council, to enable him to provide light and
air space as required by law in that certain two story brick building owned by
him on Lot 12, Block 21, which he proposes to reconstruct and convert into
living quarters.
In this connection the City Clerk reported that on May 11, 1944, he had
received from Dr. Sims a payment of w250.00 Being the consideration named by
the Council at the time it granted the easement referred to and, that said
payment was accepted conditioned upon its approval at this time by the City
Council, in view of the lapse of time beti,reen the granting of the easement
and the acceptance thereof by Dr. Sims.

resolution be adotted:

held on the 6th day of December, 1939, authorize the granting of
a certain easement to Dr. Loren D. Sims in consideration of the
sum of X250.00 to be paid the City of E1 Segundo as more fully
appears in the resolution of the City Council adopted on said last _
mentioned date, now of record at Page P -467, records of the minutes
of the nroceedin .cs of said Council, which said resolution is

AND, 1:.HE.EAS, due to intervening circumstances, the tender
to the City of ill Segundo of the sum of $250.00 was not made
until May 11th, 1944;

felt that before accepting said amount for said easement the
matter should again be presented to the City Council;
AND, :=RZPS, this Council has considered all of the
facts and circumstances relating to said matter and has heard
the testimony of said Dr. Sims as to his' reasons for failure
to make such tender prior to this time and is satisfied with
such reasons;

and he is hereby authorized to accept the said sum of 49,50.00
on behalf of the City for the easement as contemplated in said
resolution of December 6th, 1939, and that the easement as there-

The Chief of Police, through the City Clerk, reported the appointment of
Richard 71Tilliam Abert as a Police Officer of the City of El Segundo, and
his em -bloyment, as of tay 9, 1944, as a Police Officer -2nd Class of said
City and requested approval of such appointment and employment.
Loved by Councilman Selby, seconded by Councilman Hesser, that the
appointment by the Chief of Police of the City of E1 Segundo of Richard
?:illiam Abert as a Police Officer of said City'be and the same is hereby
ratified, confirmed and approved, and that the employment of said
Richard +illiam Abert as a Police Officer -2nd Class of the City of El
Segundo, effective may 9, 1944, is also hereby ratified, confirmed and'
approved. Said employee shall be compensated for his services rendered
as such Police Officer -2nd Class in accordance with the provisions of
Resolution No. 635 (the salary resolution) and resolutions amendatory
thereof or supplementary thereto. Carried by the follo-rzing vote:

Building Inspector Catalano reported that pursuant to request of Councilman
Skelley he had made an inspection of the El Segundo directional sign located
at the Southwest corner of Imperial High. =ay and Sepulveda Boulevard, and had
informed the City Clerk with respect to the conditions as he had found them so
that the City Clerk might obtain an estimate-of the cost of making essential
repairs in order to relight said signe
The City Clerk thereupon reported that the information concerning said sign
ana the rcouest for an estimate of its repairs had come to him only this date
and due to the fact that the Company hhich installed and formerly serviced the
sign has gone out of business, as have other neon sign servicing agencies in
this vicinity, he was unable to- obtain the desired estimate for presentation
at this meeting, but :could be prepared to report thereon to the Council at its
next meeting.
The City Attorney advised the Council that he has prepared for consideration
and study by the Council a rough draft of a resolution ma'_.ing provisions for the
appointment of members of the City Council as Commissioners in charge of the
immediate supervision of various departments, functions and activities of the
City and he thereupon delivered one copy thereof to each member of the Council
and to the City Clerk.
The City Attorney also reported having written the Los Angeles County
Health Officer with respect to renewal of the City's contract with the County
of Los Angeles for the performance of the functions of Health Officer in and
for said City; which said contract will expire July 1, 1944.
The City Attorney reported that the case of the People of the State of
California vs. the City of Los Angeles, City of Ll Segundo, et al, with respect
to'the abatement of the Los Angeles sewer problem has been set for trial
June 7th, 1944, and that he ,rill report further to the Council respecting the
matter.
The City Clerk renorted receipt from the Department of Finance of the
State of California of a fora of Application and Agreement for allocation of
State aid to Local Agencies for Civilian Defense purposes, the same being No.
545, and pertaining to reimbursement for communication service expenditures in
connection with Civilian Defense for the period June 1, 1943 to and including
June 30, 1944.
The form of agreement was examined by the City Attorney, who explained
its purport and certain of its conditions, after which it was moved by
Councilman Peterson, seconded by Councilman Skelley, that the following
resolution be adopted:

said form of Application and Agreement and does hereby authorize,
designate, empower and name the Layor of said City to sign said
application_ and agreement on behalf of,said City in quadruplicate

plated in said communication.
Third: That the amount of said aid requested is the sum
of w622.40 under said Application and Agreement.
Fourth: That said Council does-hereby certify that funds
eoual to or in excess of the said amount so reauested from the
State, have been made available for expenditure by said City
for the purposes for which said aid is requested, from a source
or sources other than the State Treasury or any fund of any
agency which is a part of the Executive Department of the State
Government; that the funds requested by said City in said
Application and Agreement have been Matched by funds from other
sources, and that monies received from the State Treasury; or
any fund of any agency which is a part of the Executive Department
of the State Government have not been and will not be used as
matching funds.
Fifth: That the City Clerk is hereby authorized and in-
structed to prepare and forward such number of certified copies
of this resolution as may be required in order that the said
Application and Agreement, in quadruplicate; may be forwarded
as soon as conveniently possible to the Department of Finance
of the State of California, for approval and for the signature
of the Director of Finance of the said State of California.
