A regular meeting of the City Council of the City of E1 Segundo, California, was held in the Council Chamber of the City Hall of said City on the above date, having been called to order at 7:00 P. M. by George Love, Layor. ROLL CALL. Councilmen Present: Peterson, Selby and Mayor Love. Councilmen Absent: Hesser and Skelley. RE-DING OF MINUTES OF PREVIOUS 1=72ING. The minutes of the regular meeting held-on the 19th day of April, 1944, having been read and no errors or omissions appearing, it was moved by Councilman Selby, seconded by Councilman Peterson, the minutes of said meeting be approved as recorded. Carried. At this point, by general consent, the regular order of business was sus- pended and the matter cf considering bids received this date for the purchase of tax deeded real property offered for sale by the City was taken up. The Clerk announced that he had received and has in his rossession two bids for the purchase of tax deeded real property offered for sale by the City of E1 Segundo, which he then presented to the Council. Moved.by Councilman Selby, seconded by Councilman Peterson, that the Council proceed to open, examine and publicly declare all bids presented this date for the purchase of tax deeded real property offered for sale by the City of E1 Segundo. Carried. The Council thereupon proceeded to open, examine and publicly declare said bids, which said bids were found by said Council to be as follows, to -wit: Bid of Bearl McAllister, on regular form provided therefor, as follows: Under Notice No. 5 of Intention to Sell City of E1 Segundo Owned Real Property- Lot 6, Block 44, El Segundo - - - - - - - - - - - - - - - - 0125.00 Said bid was accompanied by cash deposit in the sum of $31.25. Following consideration of said bids, it was moved by Councilman Peterson, seconded by Councilman Hsser, that the bid of Bearl McAllister, presented this Council this date, bidding the sum of $125.00 for Lot'6, Block 44, E1 Segundo, _ under Notice No. 5 of Intention to Sell City of E1 Segundo Owned Real Property, be and the same is hereby rejected. Moved by Councilman Hesser, seconded by Councilman Selby, that Resolution No. 719, entitled: RESOLUTION OF 11-1E CITY COUNCIL OF THE CITY OF EL SEGU'NDO, CALIFORNIA, ACCEPTING THE CASH BID OF ROBERT F. FALCONER FOR CERTAIN CITY O'..'NED REAL PROPERTY, which was read, be adopted. Carried by the following vote: Ayes: Councilmen Hesser, Peterson, Selby and Mayor Love. Noes: Councilmen done. Absent; Councilman Skelley. Special City Attorney John F. Bender then presented the Council a Quitclaim Deed, executed by 1,1azie McDonald Milford, dated April 21, 1944, respecting Lot 25 in Block 12, E1 Segundo, which he recommended the Council accept and order recorded. It was thereupon moved by Councilman Selby, seconded by Councilman Peterson, the following resolution be adopted: RESOLVED, that that certain Quitclaim Deed, dated April 21, 1944, executed by Mazie McDonald Milford, presented to this Council for -its consideration, and conveying to the City of E1 Segundo, a municipal corporation, that certain parcel of real property situated in the City of E1 Segundo, County of Los Angeles, State of California, described as follows: Lot 25 in Block 12, of E1 Segundo, in the City of El Segundo, County of Los Angeles, State of California, as per map recorded in Book 18, Page 69 of Naps, in the office of the County Recorder of said County, be and the same is hereby accepted by and on behalf of the City of E1 Segundo; and BE IT FURTHER RESOLVED, that the City Clerk be and he is hereby authorized and directed to record said instrument in the office of the County Recorder of Los Angeles County, California. The .hour of 7:15 o'clock P.. M. at this meeting having heretofore been fixed as.the time and place for the reception of bids for drilling, casing and completing a water well for the City of E1 Segundo, the Mayor announced the arrival of the hour of 7:14 P. M. and asked if there were any person or persons present who desired to file bids for said work. The hour of 7:15 o'clock P. M. having arrived and all bids being in, the Mayor announced the hour for receiving bids for drilling, casing and completing a water well for the City of E1 Segundo, as ad4ertised for, closed. Q 1 •ii which said rates shall be mentioned in said notice inviting bids as contemplated in said Labor Code; and BE IT FURTHER RESOLVED, that upon receipt of said notice inviting bids, the City Clerk shall and he is hereby authorized and instructed to publish the same in time, form and manner as required by law, bids under such notice being hereby invited; and BE IT FURTHER RESOL7ED, that said City Clerk shall also furnish a memorandum of said notice to Southwest Builder and Contractor according to the usual practice in such matters. Weigand, 139 Richmond Street, E1 Segundo. Ordered filed. GEORGE KELLOGG, for Imperial Highway Association, being notice of meeting of said Association to be held Saturday, May 27th, 1944. Ordered filed. PIPER AIRCRAFT CORPORATION, dated April 26, 1944, offering to send the City, without charge, a booklet on airfields and the coming air age. By general consent the communication was ordered filed and the City Clerk directed to request that one of the free booklets be sent the City. DR. ARTHUR-H. DAHLEM, dated April 28, 1944, respecting the physical con- dition of J. C. Osborne and the desirability of his remaining away from work for a period of two or three months. Ordered filed. l-�AR DEPARTMENT, OFFICE OF DIVISION ENGINEER, dated 26 April 1944, to which voucher for 42.95 was attached covering rental of a certain piece of municipally owned real property covered by Lease No. W -04- 193 -eng -929, and directing that said voucher be signed by the proper official of the City of E1 Segundo and returned to the War Department for payment. Moved by Councilman Selby, seconded by Councilman Hesser, that the Mayor of the City of E1 Segundo be and he is hereby directed to execute, for and on behalf of the City of E1 Segundo, that certain voucher in amount of $2.95 for the rental of Lot 26, Block 44, E1 Segundo, by the War Department, Office of Division Engineer, for the period January 26, 1943 to March 31, 1944, and to cause the same to be transmitted to the proper office for payment. 'WEEDLER, City Clerk; City of Manhattan Beach, dated April 24, 194.4, advising th4t the City Council of that City had approved action of the Chamber of Commerce of the City of Manhattan Beach, protesting the practice of gill net fishing in coastal waters off the South Bay coast. After discussion, it was moved by Councilman Selby, seconded by Councilman Peterson, that the following resolution be adopted: Q �'7i2 The City Clerk announced that one bid had been received. It was thereupon moved by Councilman Selby, seconded by Councilman Hesser, that the Council proceed to open, examine and publicly declare the bid received this date for drilling, casing, and completing a water well for the City of E1 Segundo. Carried. The Council thereupon proceeded to open, examine and publicly declare the bid received this date for drilling, casing and completing a water well for the .;ity of E1 Segundo, which said bid was found by said Council to be as follows, to -wit: Bid of Roscoe Doss Company, on regular form provided therefor, bidding the sum of 410.20 per Lineal Foot of ',dell, measured from the surface of the ground to the bottom of the casing. Said bid wa -s accompanied by a letter from said Roscoe Noss Company, dated Pday 3, 1944, explaining said bid in further detail; also by a Certified Check, No. 62839, drawn on The Farmers and Merchants National Bank of Los Angeles, payable to City of El Segundo in amount of $'360.00. Following consideration of said bid, it was moved by Councilman Selby, seconded by Councilman Peterson, that Resolution No. 720, entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEG'UNDO, CALIFORNIA, AVIARDING TO ROSCOE 11OSS COMPANY TIT; CONTRACT FOR CONSTRUCTING AND COMPLETING °.AT'R :'.ELL NO. 9 IN AND FOR SAID CITY, which was read, be adopted. Carried by the following vote: Ayes: Councilmen Hesser, Peterson, Selby and Mayor Love. Noes: Councilmen None. .Absent: Councilman Skelley. At this point the Superintendent of the .Hater Department reported receipt of requisite priorities for the purchase of materials and equipment needed to drill and complete a certain fresh water well for the City of E1 Segundo and recommended that the Council authorize the advertising for bids-for such equip- ment. It was thereupon moved by Councilman Hesser, seconded by Councilman Selby, the follo -ing resolution be adopted: RESOLVED, that the Superintendent of the Water Department furnish the City Attorney with the necessary data for the pre- paration of a notice inviting bids for all labor, machinery, materials, equipment, tools, apparatus and supplies necessary for the complete installation of a deep well turbine pump assembly in proposed fresh water well No. 9 of the City of El Segundo; and BE IT FURThER RESOLVED, that upon receipt of such data that the City Attorney prepare and furnish to the City Clerk such notice inviting bids; and BE IT FURTHER R,SOLV.ED, that, in accordance with the requirements of the Tabor Code of the State of California, the City Council of the City of El Segundo hereby finds and determines that the prevailing rates of per diem wages in the City of El Segundo, for the various classifications of labor which will be required in the execution of said work are as follows, to -wit: Machinery Erector - - - $1:15 per hour Machinery Erector's Helper - - - 90¢ per hour Any classification not includdd hereinabove - - 900 per hour Q RESOLVED, that this Council does hereby disapprove the practice of gill net fishing in the waters of the Pacific Ocean in the South Bay area westerly of the Cities of Redondo Beach, Hermosa Beach, Manhattan Beach, El Porto and Playa del Aey and does respectfully request that the Division of Fish and'Game of the State of California deny any permit or authority to any commercial or other interests to prosecute such fishing operations in such waters; AND, BE IT FURTHER RESOLVED, that the City Clerk be and he is hereby authorized and directed to forward a certified copy of this resolution to said Division of Fish and Game of the State of California for its information in the premises. In response to the Mayor's invitation to anyone present who desired to address the Council to do so, Mr. Walter Swanson arose and informed the Council that by reason of certain sand removal operations, which are being prosecuted on property owned by the City of Los Angeles immediately west of the City Limits of El Segundo and North of Grand Avenue, the sand surface had been disturbed and vegetation and sand crust had been effected to such an extent that the encroachment of sand upon private property in the City of E1 Segundo had been greatly accelerated, particularly in the neighborhood of Lots 1 to 14 inclusive in Block 50 and that these properties were threatened with destruction from the encroachment of said sand. He further stated that he felt the sand could be removed from the base of the present encroachment to the advantage of all concerned, whereas continued disturbance of the sand on the top of the hill would naturally lead to further encroachment. He stated further that it was a matter of grave concern to the citizens and taxpayers of the City whose properties are adjacent to the areas effected and felt that some action should be taken by the City of E1 Segundo with reference to this menace. Discussion was then had, in which it was brought out that the properties effected were in many instances improved properties, upon which the owners are paying considerable taxes to the City of E1 Segundo and that if these premises were destroyed, the City of E1 Segundo would lose the tax revenues therefrom, as well as the loss which would be suffered by the owners by the destruction of their properties. Having due regards to the necessitibs'of the situation, it was moved by Councilman Selby, seconded by Councilman Hesser, the following resolution be adopted: RESOLVED, that the City Clerk of the City of E1 Segundo, California, address a communication to the Honorable City Council of the City of Los Angeles, California, and to the Board of Eduqation of the City of Los Angeles,.calling the specific attention of the said respective bodies to the con - ditions relating to sand encroachment complained of and herein - above mentioned and request that both of said bodies give immediate consideration to the problem presented and soliciting the cooperation of said bodies in the solution of said problem. Said Clerk to also request that said bodies inform this Council as soon as possible respecting such corrective measures as they may find it proper to employ in order to abate this menace to property in the City of E1 Segundo. The City Clerk reported to the Council that Los Angeles County Health Department has never been authorized to enforce the provisions of Ordinances Nos. 205 and 206 of the City of E1 Segundo, which ordinances regulate the keeping of livestock and swine within said City, whereupon it was moved by Councilman Selby, seconded by Councilman Hesser, that Los Angeles County Health Department be requested and authorized to enforce the provisions of Ordinances Nos. 205 and 206 of the City of E1 Segundo,'in addition to enforcing other ordinances of this City heretofore authorized by this Council, all as provided in that certain contract between the County of Los Angeles and the City of E1 Segundo, respecting the performance of the duties of Health Officer of the City of El Segundo by said Los Angeles County Health Department. Carried by the following vote: Ayes: Councilmen Hesser, Peterson, Selby and Mayor Love. Hoes: Councilmen None. Absent: Councilman Skelley. The City Clerk reported that some of the pottery tableware in the banquet hall in the City Hall needs replacement, as breakage and damages have occurred during the seven years the equipment has been inise, whereupon it vas moved by Councilman Peterson, seconded by Councilman Selby, that the City Clerk be authorized to expend not to exceed $50.00 to make necessary replacements in the pottery tableware required for use in the banquet hall in the City Hall. The City Engineer advised the Council that he has prepared and has ready for transmittal to the District Engineer of the Department of Public Works of the State of California, Project Statement providing for the allocation and expenditure on Streets of Major Importance within the City of E1 Sef -undo of the 1/40 per gallon tax on motor vehicle fuel for the ensuing fiscal year. After consideration of same, it was moved by Councilman Hesser, seconded by Councilman Petorson, the follotsin- resolution be adopted: EESOL V: D, that' Project Statement No. ST.U- 44 -1•, dated May 3, 1944, containing an estimate of the cost of general maintenance of Streets of Major Importance within the City of E1 Segundo, for the fiscal year 1944 -45, addressed to the Director of Public ?Yorks, Sacramento, California, pre- pared and submitted to this Council this date by the City Engineer of the City of E1 Segundo, be and the same is hereby approved, and. the City Engineer is hereby authorized and directed to cause the same to be forwarded to the Director of Public ""orks of the State of California, at Sacramento, California, through the Office of the District Engineer at Los Angeles, California; and BE IT FU=R RESOLVED, that one copy of said Project Statement be placed on file in the office of the City Clerk of the City of E1 Segundo for the purposes of identification and reference. The City.Attorney at this time announced that the plaintiff in the case of the People of the State of California vs. the City of Los Angeles, et al, (the Hyperion Nuisance Case) had requested the Clerk of the Court to designate a date for the trial of said action. The City attorney stated that this was merely a memorandum for setting the case -and that we would not be notified of the actual date determined for the trial until later. - Fie stated this was merely a progress report. Q 71-6 The City Attorney reported to the Council that pursuant to its instructions given at the previous meeting, he had written a letter to Douglas Aircraft Company, a copy of which had been filed with the City Clerk, indicating the City's reasons for not granting other than temporary revocable permits to applicants for special uses in public streets. He read a copy of the said communication to the Council for its information in the premises and stated that any person interested could examine the copy or file in the Clerk's office. The City Attorney at this time then stated that Councilman Skelley, in company with Park Superintendent McIlwaine, had consulted with him with reference to a proposed ordinance providing certain rules and regulations with reference to the use of parkways and public parks in the City of E1 Segundo; that as a result of that conference he had prepared a rough draft of a.form of ordinance relating to such matters for the Council's consideration and study. He thereupon delivered to the members of the Council and to the City Clerk copies of said proposed form of ordinance and also an extra copy for Mr. McIlwaine, the Park Superintendent. After discussion, the Council stated that the matter would receive consideration from it and the Attorney would be advised in due time respecting the Council's *wishes in the matter. The City Attorney then presented to the Council a form'of 'ordinance dealing with the subject of standards for electrical appliances in the City. He stated this ordinance was substantially in form as approved'by the legal department of the League of California Cities, and that the same had the approval of the Building Inspector of the City of E1 Segundo. The City Clerk then read to the Council the said ordinance in full and announced that there was now on file in his office three full and complete copies of the "Code of Standards for Electrical Materials, Devices and Appliances in the City of E1 Segundo", printed as a code in book form and that the same were open to public inspection. Councilman Selby thereupon introduced said Ordinance, being Ordinance No. 277, entitled: AN ORDINANCE OF THE CITY OF EL SEGUNDO, CALIFORNIA, REGULATING THE SALE OR DISPOSAL OF ELECTRICAL MATERIALS, DEVICES AND APPLIANCES, which, as aforesaid, had.been read in full by the City Clerk tb the Council at this meeting. The City Attorney then presented to the Council a fotm of ordinance adopting a uniform electrical code in and for the City of E1 Segundo and also adopting the National'Electrical Code, which ordinance'he'state.d had the approval of the Building Inspector of the City of E1 Segundo. The City Clerk then read to the Council the said ordinance ir_ full and announced that there was now on file in his office three full and complete conies of each of "Uniform Electrical Code Published by the Pacific Coast Electrical Bureau 1941 Edition "*and "1940 National Electrical Code (NBFU Pamphlet No. 70, with Supplement to September 10 1942) ", each printed as a code in book form, and that all of these codes are open to public inspection.
