Following the reading of the before mentioned applications for employ- ment, Councilman Skelley stated that Assistant Street Superintendent Gunn has previously interviewed these gentlemen and is desirous of emDloyirg them in view of the fact that his Department is short- handed. Following discussion, it was moved by Councilman Skelley, seconded by Councilman Hesser, that the applications for employment of Fred L. Thompkins and Jr. L. Compton, presented tbiis Council this date, be received and placed on file in the office of the City Clerk for the purposes of identification and reference; and that the Street Superintendent of the City of El Segundo be authorized and directed to employ said persons on a temporary basis for such period of time as their services are actually necessary in his Department. Councilman Hesser, Commissioner of Public Safety, reported that he had been handed a communication by the Police Department of the City of E1 Segundo from the Communications Division of the Sheriff's Office of Los Angeles County, indicating that a Motorola transmitter, receiver and supply unit had been transferred to the Police Department of the City of El Segundo for use by said Department and that the same would be a valuable adjunct to the present equipment of the local Police Department in affording, additional protection to the community. Moved by Councilman Peterson, seconded by Councilman Hesser, that that certain letter from the Conarunications Division of the office of the Sheriff of the County of Los Angeles, dated October 30th, 1943, presented this Council this date by Public Safety Commissioner Hesser, referring to the transfer of right and title to the E1 Segundo Police Department of a Motorola transmitter, Teo. 3983; Receiver No. 1267 and Supply Unit No. 2658, be received and placed on file in the office of the City Clerk for the purposes of identification and reference, and that the equipment described therein be accepted on behalf of the City of El Segundo. Councilman Peterson, Commissioner of Public Works, reporting in connection with the matter of a complaint heretofore filed with this Council respecting a sewer pump pit on the West side of Center Street, between blariposa Avenue and Palm Avenue, stated that he had investigated the same, with City Engineer Hutchins, and that the situation has been corrected to the satisfaction of the complainant. He added that further improvements are contemplated, provided the City is able to purchase a fan for ventilating the pump pit referred to. REPORTS OF OFFICERS AND SPECIAL COMMITTEES. A letter, dated December 15th, 1943, from the Police Department of the City of El Segundo, reporting that Robert Dean Miller has heretofore been advised that his contract with the City as radio maintenance man will terminate as of December 29th, 1943, was presented and read to the Council and by general consent ordered filed. 1,Tritten renort of the Police Department of the City of E1 Segundo, dated December 15th, 1943, stating that Commercial Radio Eouipment Company has been advised that its services will no longer be needed to.mafe periodic freouency tests of the radio equipment of said Police Department, was presented any read to the Council and by general consent ordered filed. The City Clerk thereupon presented and read to the Council a letter from El Segundo War Council, dated December 14th, 1943, and to which was attached form of "Proposed Mutual Aid Plan for Los Angeles County ", referred to therein. MM ­,,r- The City Clerk further reported that the War Council had authorized the execution of the document by the Commander of the War Council and that same had been so executed subject to the approval of the City Council. It was thereupon moved by Councilman Selby, seconded by Councilman Peterson, that the following resolution be adopted: RESOLVED, that the communication from E1 Segundo War Council, dated December 14th, 1943, addressed to the Honorable City Council, City of E1 Segundo, Qnclosing a form of "?roposed Mutual Aid Plan for Los Angeles County ", be received and placed on file in the office of the City Clerk, together with a copy of the "Proposed Mutual Aid Plan for Los Angeles County" therein referred to; AND, BE IT FiRi-` R R":SCLVLD, that the City Council aDDroves -the said " ProDosed Mutual Aid Plan for Los Angeles County ", and does hereby approve, ratify and confirm the action of the War Council and of the Commander of said War Council in executing said Agreement on the part of the City of El Segundo., The foregoing resolution was adopted by the following vote: Ayes: Councilmen °esser, pAterson, Selby, Skelley and Mayor Love. The City Attorney at this time stated that he had been handed a copy of a certain Summons and Complaint served upon each member of the City Council and the City Engineer within the last few days, in connection with an action instituted by the Attorney General of the State of California concerning the Hyperion Outfall Sewer. He explained the procedure which should be followed in the matter, following, which it was moved by Councilman Hesser, seconded by Councilman Skelley, that the following resolution be adopted: WHEREAS, there was served upon each of the members of the City Council of the City of E1 Segundo, and the City Engineer o° said City, on December 13th, 1943, as such officers, a copy of the Summons and Complaint in that certain action bearing No. 489890, in the Superior Court of the State of California, in and for the County of Los Angeles, entitled: "The People of the State of California, Plaintiff, vs. The City of Los Angeles, a Municipal Corporation; . . . . The City of E1 Segundo, a Municipal Corporation; George Love, Orest C. "lesser, 'Dave W. Peterson, Willard J. Skelley and William R. Hutchins, as City Engineer of the City of E1,Segundo; . . . . et al"; AND, IKIHIE:-tE'AS, the City of El Segundo and the various officers of said City above referred to are named as parties defendant in said action; N0101, THERFFOPW, BE IT RESOLVED by the City Council of the City of E1 Segundo, California, that the City Attorney be and he is hereby authorized and instructed to appear in said action for and on behalf of said City of E1 Segundo and for and on behalf of each and all of the officers above named, who are indicated as parties defendant in said action, and make defense of said action or, the Dart of said City and on the part of said respective officers; preparing and filing such pleadings and documents, making such arguments and taking such steps and proceedings as in his opinion may be necessary or advisable in the premises in order that the interests of said City and of said officers may be protected; bLA AND, BE IT FURTF�1ER RESOLVED, that said City Attorney be and he is hereby authorized to incur, on behalf of the said City, such reasonable, necessary expenses in connection with the making of said defense and in appearing in said action as may be required in order to properly conduct such defense; AND, BE IT FURTHER RESOLVED, that said City Attorney shall be entitled to receive and there shall be paid to him, upon presentation of a proper demand or demands therefor, to be presented, audited and approved in the usual manner, reasonable additional compensation for his services to be rendered in said action. SPECIAL ORDER OF BUSINESS. The hour of 7 :15 o'clock P. M. at this meeting, having heretofore been fixed as the time and place for receiving bids for.furnishing the City of El Segundo with such hydrated lime as said City may require during the calendar year 1944, the Mayor announced the hour of 7 :14 o'clock P. 14. and requested that if any person or persons present in the Council Chamber desired to file bids for said lime, they do so immediately. The hour of 7:15 o'clock P. M. having arrived, the Mayor announced the time for receiving bids for furnishing the City of E1 Segundo with such hydrated lime as said City may require during the calendar year 1944, closed. The City Clerk announced that one bid had been received. The City Clerk reported having in his possession, in the same condition as when received, a sealed envelope marked on the outside: "Bid on Real Property under Notice of Intention No. 3 -M11. It was thereupon moved by Councilman Selby, seconded by Councilman Skelley, the Council proceed to open, examine and publicly declare the bid received this date for the sale by the City of El Segundo of real property under Notice No. 3 -Y. Carried. The Council thereupon proceeded to open, examine and publicly declare said bid, which said bid was found by said Council to be as follows, to -wit: Bic. of Thelma Einstein and �a_^ry Einstein, on regular form, .bidding the sum-of q`355.0.0 cash for Lot 21, 1�loek 22, Ei Segundo. Said bid was accompanied by Certified Check No. E 1350, drawn upon the account of Coldwell, Hanker & Company, payable to City of E1 Segundo in the sum of X355.00. Said bid was also accompanied by a letter from Coldwell, Banker & Company, dated December 14, 1943, advising that said firm is acting as agent for Mr. and 1drs. Harry Einstein, and that upon final consummation of the sale, there is a selling commission of 417.75 due said Company. 7 (� 602 Following the opening, examination amd declaration of said bid, it was • moved by Councilman Peterson, seconded by Councilman Hesser, that the bid received this date from Thelma Einstein and Harry Einstein for Lot 21, Block 22, E1 Segundo, be taken under advisement until the next regular meeting-of. this Council. Miss•Loshorcy, representing Special City Attorney John F. Bender, presented to-the-Council a certain Quitclaim Deed, conveying to the City. of E1 Se-undo certain properties more particularly described in said instrument, which Quitclaim Deed rras purchased in lieu of fo -reclosure proceedinvs and which deed Mr. Bender recommended the Council accept.. It was thereupon moved by Councilman-Hesser, seconded by Councilman Skelley, the following resolution be adopted: RESCL.IED, that that certain Quitclaim Deed, presented this Council for its consideration and quitclaiming to the City of E1 Segundo, a municipal corporation, those certain parcels of real property, situated in the City of E1 Segundo, County of Los Angeles, State of California, described as The South 92 feet of the North 187 feet-of Lot 4 in Block 96 and the South 46 feet of Lot 5 in 31ock 96, of El Segundo, County of Los Angeles, State of California,•as per map recorded in-Book 20, Pages 22 and 23 of leaps, in the office of the County Recorder of said County, executed by J. C. Burke and "Lena Mae Burke, husband and wife, dated the 30th day of November, 1943, be an,i the same is hereby accepted on behalf of the City of El Segundo; and BE IT FGRT R R SOLv'ED, that the City Clerk be and he is hereby authorized and directed to record said instrument in the office of the County Recorder of Los Angeles County, California. The City Clerk advised of the necessity of transferring money from the General Fund of the City of El Segundo to the Library Fund of said City, thereupon it was moved by Councilman•Selby, seconded by Councilman Skelley, that the sum of $2500.00 be transferred from the General Fund of the City of El Segundo to the Library Fund of said City, and that the City Clerk and the City Treasurer be authorized and directed to effect such transfer and to make appropriate entries thereof in their respective books of record. Edward 11.• Loftus ad^ressed the Council at this time, stating that yesterday he had mailed a letter to the City Council, advising that he is <`- ettin, topetther a community oil lease in Tract 1685 in the City of El Se undo; that a copy of the form of lease he is using and a copy of Sup:)lemertal Order No. 4 to Petroleum Administrative Order No. 11 had been attacl-.ed to said letter, which said letter also requested the City to join in the execution of the lease as respects the real property owned by said City in 'Tract i ,,o. 1685. He stated further that the City Clerk had informed Q 603- him that his letter has not been received by the City and he then requested permission to and did present the matter orally to the Council. Mr. Paul Ritter, associated with Mr. Loftus, also addressed the Council on the Same subject. The City Attorney propounded several questions with reference to the matter, which questions were answered by Messrs. Loftus and Ritter, and at the conclusion of the discussions it was moved by Councilman Selby, seconded by Councilman Peterson_, that the matter of leasing municipally owned property located in Tract No. 1685 for oil drilling purposes, as proposed by EdTr-ard Y. Loftus this date, be taken under consideration and the said matter referred to the City Attorney for his further report to this Council. Carried by the following vote: Ayes: Councilmen Hesser, Peterson, Selby, Skelley and Mayor Love. Does: Councilmen None. Absent: Councilmen None. At this time Councilman Peterson stated that after consideration he felt that the Council should reconsider its previous action taken at this meetin, whereby the bid of Thelma Einstein and ;carry Einstein for Lot 21, Block 22 had been taken under advisement until the next regular meeting of the Council. navinf� voted in favor of said motion to take said bid under advisement, he thereupon moved that the City Council proceed to immediately reconsider the previous action in so taking said bid under advisement.' Bender, Special City Attorney, reported to the Council in connection with the proposed leasing of Lot 12, Block 13, Tract 1685 to the United States Government for military purposes; that I�_r. Bender had consulted with the Attorneys for the Government in the said matter and had ascertained that said Attorneys would be willing to dismiss a vending condemnation suit if the City will lease the land as requested by the Government in its communication dated September 27th, 1943, fiJ_ea z ith this Council Ccto�er 6th, 1943, and Tr-ould also be willing to pass e lease containin a clause permitting the City to lease for oil drilling purposes rrovided that the surface operations did not interfere -ith military installations or requirements. yhe City rttorney stated he had also discussed the matter with I:r. Q. 604 It was thereupon moved by Councilman Selby, seconded by Councilman Peterson, that the Snecial City Attorney be authorized to advise the Government Attorneys that, i' the clause referred to permittinC the City to lease sai!' nronerty for oil drilling purposes is included, the City would be willing to execute a lease to the Government and that "4r. Bender and the City Attorney work out the details and submit the form of lease required to this Council.
