An.adjourned regular meeting of the City Council of the City of El Segundo, California, was held in the Council Chamber of the City Hall of said City on the above date, having been called to order at 4:30 o!clock P. M. by George Love, Mayor. ROLL CALL. Councilmen Present: Peterson, Selby and Mayor Love. Councilmen Absent: Gerow and Hesser. Moved by Councilman Selby� seconded by Councilman Peterson, the regular order.of business be dispensed with. Carried. The City Clerk reported that the returns of the Special Municipal Election held on Tuesday, the 20th day of April, 1943, in the City of El Segundo, California, were then, and had been, in his-possession in the envelopes con- taining them, in the same condition as when received, and that he had also received and had ready to present to the Council three (3) absent voters' ballots. Said Clerk then presented said returns and said absent voters' ballots to the City Council at this time at this meeting. It was thereupon moved by Councilman Selby and seconded by Councilman Peterson, that the City Council proceed forthwith to canvass said returns and said absent voters' ballots. The said motion was carried and adopted by the following vote: Ayes: Councilmen Peterson, Selby and Mayor Love. Noes: Councilmen None. Absent: Councilmen Gerow and Hesser. Said motion having carried, the City Council then proceeded forthwith to publicly examine and canvass the said returns and the said absent voters' ballots, all as provided by law, and upon the completion of said canvass by said Council, it was moved by Councilman Selby and seconded by Councilman Peterson, that the following resolution be adopted: WHEREAS, there was held and conducted in the City of E1* Segundo, County of Los Angeles, -State of California, on Tuesday, the 20th day'of April, 1943, a Special Municipal Election of the oualified electors of said City, under, pursuant to and as required by, the provisions of the laws of the State of California, relating to cities of the sixth class, for the purpose of submitting to the qualified electors of said City the following question, proposition or measure, to -wit: "Shall the City of E1 Segundo fully participate in the State Employees' Retirement System of the State of California, making the employees of said City members of said system in and under the pro- visions of the State Employees' Retirement Act of said State, as amended, and levy and collect annually, as contemplated in said Act, a special tax sufficient to raise the amount estimated by said Council to be required to, provide sufficient revenue to meet the . obligation of said City to said retirement system ?" AND, WHEREAS, it appears that notice of said election was.duly and legally given; that there were three (3) consolidated voting precincts established within the said City for holding said special municipal election, to -zit: Consolidated Voting Precinct "A" was known as such and included all of the territory in the City of E1 Segundo, within the exterior boundaries of E1 Segundo City Precincts Nos. .1, 2 and 79 as now established by the Board of Supervisors of Los Angeles County, California, for state and county elections;: Consolidated Voting Precinct "B" was known as such and in- cluded all of the territory in the City of E1 Segundo, within the exterior boundaries of E1 Segundo City Precincts Nos. 4, 5 and 6, as now established by the Board of Supervisors of Los Angeles County, California, for state and county elections; Consolidated Voting Precinct "C" was known as such and in- cluded all of the territory in the City of E1 Segundo, within the exterior boundaries of E1 Segundo City Precincts Nos. 3 and 8, as now established by the Board of Supervisors of Los Angeles County, California, for state and county elections; AND, WHERE_ S9 it further appears that election officers were appointed and election supplies furnished; and that in all respects said election was held and conducted and the votes cast thereat . received and canvassed and the returns thereof made and declared in time, form and manner as required by the provisions of the laws of the State of California relating to cities of the sixth class, and pursuant to all laws of said State and of said City in such cases made and provided; AND, IATHEREAS, the City Council of the said City of El Segundo met at the Council Chamber of the said Council in the City Hall of said City on Tuesday, the 27th day of April, 1943, as provided by law, beginning at the hour of 4:30, o'clock p. m. of the said day, to canvass the returns of said election and said absent voters' ballots, and declare the results of said election; AND, Wh'MAS, said Council has now completed said canvass and has found the results of said election'to be as hereinafter set forth; NOW, THEREFORE', the. City Council of the City of El Segundo, California, does hereby resolve, declare, find,-determine and order as follows: First: That each vote indicated as voting "Yes" upon said question, proposition or measure was-by the City Council, and shall be, counted in favor of or for said question, proposition or measure; and that each vote indicated as voting "No" upon said question, - proposition or measure was by said Council, and shall be, counted as a vote not in favor of, or against said question, proposition or measure; Second: That the whole number of votes cast in said City at said election on said question, proposition or measure, hereinafter above stated was 658; and the number of votes given at each of said respective consolidated voting precincts for and against such question, proposition or measure was as follows: Consolidated Voting Precint Number For YES Against NO A 244 9 B 272• 11 C 116 6 Third: That the.total number of votes given in said entire City at,said election for or in favor of said question, proposition or measure was 632 and the total nwnber of votes against the samd'was 26, and in the ballots furnished to absentee voters, hereinabove referred to, the question, proposition or measure hereinabove quoted received 3 votes for said auestion, proposition or measure and no votes against the same; Q 416 :0 Fourth: That at the said election, and as a result thereof, the said question, proposition or measure was approved by more than a majority of the electors of said City voting thereon; Fifth: That the City Clerk of said City shall enter on the records of said City Council a statement of the result of said election showing: (1) The whole number of votes cast in said City of E1 Segundo at said election; (2)' The number of votes cast by absentee voters; (3) The total number of votes cast inclusive of both the votes cast at the various precincts and the votes cast in absentee voters' ballots; (4) The question, proposition or measure voted upon; (5) The number of votes given at each precinct for and against such question, proposition or measure voted upon; (6) The number of votes given in said City for and against such question, proposition or measure voted upon; (7) The number of votes given in absent voters' ballots for and against such question, proposition or measure voted upon; (8) The total number of votes given in said City and in absent voters' ballots for and against such question, proposition or measure voted upon. The motion to adopt the foregoing resolution was carried unanimously (and by the Mayor declared carried) by the vote shown in the following certificate of the City Clerk, to -vrit: STATE OF CALIFORNIA ) COUNTY OF LOS ANGELES ) SS. D., 1943, and that the same was adopted by the following vote, to-wit: Hesser, Ayes: Councilmen /Peterson, Selby and Mayor Love, Noes: Councilmen None. Councilman Hesser appeared at the Council Chamber during the reading of the foregoing resolution, the hour being 4:46 o'clock p. m. and he immediately took his seat at the Council table. McCarthy, City Clerk of the City of E1 Segundo, California, duly elected, qualified and acting as such, pursuant to the requirements of law and the resolution of the City Council of the City of E1 Segundo, immediately hereinabove set forth, do hereby certify and state: --tea Q-�- 41i'7 (1) That the whole number of votes cast in said City of E1 Segundo at the Special Municipal Election held in said City on the 20th day of April, 1943, was 658 votes; (2) That the number of votes cast by absentee voters was 3 votes; (3) That the total number of votes cast inclusive of both the votes cast at the various precincts and the votes cast in absentee voters' ballots was 661 votes; (4) That the question, proposition or measure voted upon was: "Shall the City of E1 Segundo fully participate in the State Employees' Retirement System of the State of California, making the employees of said City members of said system in and under the pro- visions of the State Employees' retirement Act of said State, as amended, and levy and collect annually, as contemplated in said act, a special tax sufficient to raise the amount estimated by said Council to be required to provide sufficient revenue to meet the obligation of said City to said retirement system ?" The City Clerk at this time advised the Council that further procedure in connection with participation in the State Employees' Retirement System by the City of E1 Segundo necessitated advising the Board of Administration of the State Employees' Retirement System of'the City's intentions with respect to the matter and requesting said Board to forward the City certain documents. The City Clerk then read to the Council the letter he proposed trans - mitting.to said Board of Administration of the said State Employees' Retirement System pursuant to his foregoing statement, and enumerated the several documents required by the City in connection with its parti- cipation in said Retirement System, whereupon it was moved by Councilman Selby, seconded by Councilman Hesser, that the City Clerk transmit to the Board-of Administration of the State Employees' Retirement System at Sacramento, California, a commurfbation setting forth the present intention of the City of E1 Segundo with respect to participation in the State Employees' Retirement System and requesting said Board to forward the City of E1 Segundo all of the documents necessary to enable the City to effect participation in said System in the manner provided by law. Carried by the following vote: Ayes: Councilmen Hesser, Peterson, Selby and Mayor Love, Noes: Councilmen None. Absent: Councilman Gerow. City Attorney Woodworth then advised the Council that-he had received from Consolidated Rock Products Company a check in the sum of $11.12 in settlement of its indebtedness to the City of E1 Segundo by reason of repairs made by said City to public property heretofore damaged by one of the motor vehicles of said Company, which remittance and accompanying letter of transmittal he thereupon delivered to the City Clerk. No further business appearing to be transacted at this meeting, it was moved by Councilman Selby, seconded by Councilman Peterson, the meeting adjourn. Carried.
