September 30th, 1942.
A regular meeting of the City Council of the City of E1 Segundo, California,
was held in the Council Chamber of the City Hall of said City, on the above date,
having been called to order at 7:00 P. M. by the City Clerk, the Mayor being
absent.
ROLL CALL,
Councilmen Present: Gerow, Hesser, Peterson and Selby.
Councilmen Absent: Love.
Other Officers Present:
Clyde Woodworth - City Attorney.
R. T. Hutchins - City Engineer.
J. B. Catalano - Building Inspector.
Victor D. McCarthy - City Clerk,
Councilman Hesser was unanimously chosen Mayor pro -tem and he immediately
assumed the duties of the Mayor.
WRITTEN COMMUNICATIONS.
The following communications, which were read to the Council, were disposed
of in the manner indicated, following reference to each hereinafter:
JOE RANDALL, dated September 26th, 1942, thanking the Council for leave
of absence heretofore granted him and advising he has terminated his employment
with the City. Ordered filed.
FRANK J. BANDUCCI, 954 Hillcrest Street, dated September-25th- 1942,
requesting a permit to keep two horses on said premises. Moved by Councilman
Selby, seconded by Councilman Gerow, the following resolution be adopted:
RESOLVED, that Frank J. Banducci, be and he is hereby
granted a temporary, revocable permit, under the provisions
of Ordinance No. 255 of the City of E1 Segundo, to keep two
horses at 954 Hillcrest Street, within said City; said permit
shall be revocable at the pleasure of the City Council, without
cause, without notice and without liability, and is further
subject to the provision that during all of the time this permit
is being exercised, said premises must be kept in a clean con-
dition and not in any manner to constitute a nuisance; said permit
is further conditioned upon the permittee approving a copy of
the same in writing, agreeing to its terms and conditions, and
that said approved copy shall be thereupon filed in the office of
the City Clerk.
The foregoing resolution was adopted by the following vote:
Ayes: Councilmen Gerow, Peterson, Selby and Mayor pro -tem Reeser.
Noes: Councilmen None.
Absent: Mayor Love.
.LOCAL DEFENSE COUNCIL OF THE CITY OF EL SEGUNDO, dated September 30th,
1942, making certain suggestions and recommendations with respect to the
payment of the expenses of a representative of the Local Defense Council
at the State-Council of Defense conference, to be held at Fresno, California,
September 28th and 29th, 1942; for equipping a certain municipally owned
water tank truck as a piece of auxiliary fire apparatus and suggesting the
procurement of other supplies and equipment essential to the proper
functioning of E1 Segundo Defense Corps.
Moved by Councilman Selby, seconded by Councilman Peterson, the
following resolution be adopted:

RESOLVED, that that certain communication from E1 Segundo
Defense Council, dated'September 30th, 1942, making certain
suggestions and recommendations in connection with the activities
of said Council , be received and placed on file in the office
of the City Clerk for the purposes of identification and reference;
that this Council act on the respective recommendations and
suggestions therein contained, as follows, to -wit:
As to Item 1. The reimbursement to Peter E. Binder for
his actual and necessary expenditure v in connection with his
attendance at the September 28th to 29th conference of the
California State Council of Defense, at Fresno, California, is
approved and authorized, upon'the filing of a proper demand there-
for, which shall be audited and approved in the usual manner
before payment.
Item 2. That the conversion of the Park Department water
tank truck into a piece of auxiliary fire apparatus by the addition
thereto of a mixing tank and pump, be approved and authorized; that
in addition thereto one 50- foot length of hose for use on said
equipment be purchased, and that application'be made for ration
order for the purchase of the necessary tires and tubes for said
vehicle, and that such tires and tubes be purchased upon receipt
of such order, and at a cost of not to exceed $150.00.
Item 3. That the recommendation for the purchase of-
harts and equipment to construct ultra high frequency radio
receivers and transmitters is approved, and authority to purchase
the same at a cost of not to exceed $250.00-is hereby granted.
Item 4. That the printing of circulars, entitled: "Home
Preparedness" is hereby approved and authorized at a cost of
not to exceed $25.00; and
Item 5. That the purchase of apparel for the use of
aircraft warning service personnel is recommended'in the last
paragraph of said letter is approved and authorized, at a cost
of not to.exceed $85.00.

REPORTS OF STANDING COMMITTEES.
REPORTS OF OFFICERS AND-SPECIAL COMMITTEES.
The Chief of Police reported concerning an accident involving the
police car of the City of El Segundo, which occurred September 27th, 19429
at or about the hour of 7:15 P. M., at the corner of Grand Avenue and Center
Street.
Moved by Councilman Peterson, seconded by Councilman Selby, that the
Police Department Investigation Report; dated September 27th, 1942, written
by Officer Wood, with respect to an auto accident involving damage to
municipal property, presented this Council this date by the Chief of Police,
be filed with the City Clerk for the purposes of identification and reference;
that the matter be referred to the City Attorney for report to this Council
in due time and that the City Clerk be - instructed to notify the City's
insurance carrier respecting the matter.. • Carried.
The City Clerk reported that Los Angeles County Health Department
recommended it be authorized to enforce the provisions -of Ordinances Nos. 9 and
90 of the City of E1 Segundo, so as to clothe it with proper authority to
enforce the eradication of rats in certain localities within the City.
It was thereupon moved by Councilman Selby, seconded by Councilman
Peterson, that Los Angeles County Health Department, which by virtue of a contract,

acts in the capacity of Health Officer of the City of El Segundo, be requested
to enforce the provisions of Ordinances Nos. 9 and-90 of the City of El Segundo,
within said City, and the City Clerk is.directed to address a communication to
said Los Angeles County Health Department, advising it of this action by this
Council. Carried by the following vote:
Ayes: Councilmen Gerow, Peterson, Selby and Mayor pro -tam Hesser.
Noes: Councilmen None.
Absent: Mayor Love.
City Attorney Woodworth reported having prepared the applications for
the two crossings over the A. T. & S. F. Ry. Co.'s right of way as requested
by Douglas Aircraft Company, Inc., and asked permission of the Council to
file the same.
Moved by Councilman Selby, seconded by Councilman Peterson, that City
Attorney Woodworth be and he is hereby authorized to file, with the Railroad
Commission of the State of California, applications for two crossings over the
right of way of the A. T. & S. F. Railway Company in the City of E1 Segundo,
and that in view of the filing of said applications, he also be authorized to
notify said Commission that the original application for one crossing and
orders made pursuant thereto, will not be utilized. Carried by the following
vote:
Ayes: Councilmen.Gerow, Peterson, Selby and Mayor pro -tam Hesser.
Noes: Councilmen None,

The City Attorney reported that there had been referred to him a copy of
Summons and copy of a Complaint.in the matter of'United States of America vs.
1.6 acres of land within the City of E1 Segundo, in'the Federal Court, in and
for the Southern District of California, and that answer thereto should be
made within ten days following service of these papers upon the Mayor, which
date of service was September 25th, 1942.
It was thereupon moved by Councilman Selby, seconded by Councilman
Peterson, that the following resolution be adopted:
RESOLVED, that the City Attorney and the Special City
Attorney be and they are hereby authorized and instructed
to appear on behalf of the City of E1 Segundo, one of the
defendants in that certain action in the District Court of
the United States in and for the Southern District of Calif-
ornia Central Division, entitled:. "UNITED STATES OF AMERICA,
Plaintiff, vs. 1.6 ACRES OF LAND, MORE OR LESS SITUATE IN THE
CITY OF EL SEGUNDO, COUNTY OF LOS ANGELES, STATE OF CALIFORNIA:
CITY OF EL SEGUNDO, a municipal corporation; COUNTY OF LOS
ANGELES, a body politic and corporate; STATE OF CALIFORNIA,
a corporation sovereign, at a1., Defendants," and which said
action bears No. 2441 P H Civil in said District Court of the
United States; and
BE IT FURTHER RESOLVED,*that said City Attorney and said
Special City Attorney shall take such steps and file such
papers and pleadings and make such arguments and take such
action as in their opinion are best in order to preserve and
protect the interests of said City; and
EE IT FURTHER RESOLVED, that said City Attorney W
said Special City Attorney shall receive reasonable additional
compensation for their servi_-es to be rendered in connection
with said action, to be paid upon.proper demands therefor, to
be presented, audited and approved in the usual manner.

NEW BUSINESS.
Street Superintendept Hutchins advised the Council that to prevent
erosion and minimize street maintenance cost, a curb should be constructed
and sidewalk repaired on the North side of Mariposa Avenue, between Virginia
Street and Whiting Street. He submitted his estimates of the costs of
two methods of treatment, and explained that although the cost of the
installation of a cement concrete curb is $45'.00 more than the installation
of a plant mix rolled.gutter, the cement concrete would be more economical
in that maintenance.costs would be greatly reduced; whereupon it was moved
by Councilman Selby, seconded by Councilman Peterson, that the Street
Superintendent of the.City of E1 Segundo be and he is hereby authorized and
directed to construct a cement concrete curb in the North side of Mariposa
Avenue, between Whiting Street and Virginia Street, within the City of E1
Segundo and to repair,the plant mix sidewalk in the same locality, all at
a cost of not to exceed $220.000 ,Carried by the following vote:
