September 2nd, 1942. .A regular meeting.of the City Council of the City of E1 Segundo, California, was held in the Council Chamber of the City 'ball of said City on the above date, having been called to order at 7:00 P. .:., by the City Clerk, the mayor being absent. Councilman Hesser was unanimously appointed ''Mayor pro temp and thereupon assumed the duties of the 14ayor. ROLL CALL. Councilmen Present: Gerow, Peterson, Selby and :y.ayor pro ter. Hesser. Councilmen Absent: Love. Other Officers Present: Clyde 0 oodworth - City Attorney. R. T. Hutchins - City Engineer.. Victor D. McCarthy - City Clerk. READING OF KINUTES OF PREVIOUS MEETING. The minutes of the regular meeting held on the 26th day of riugust, 1942, having been read, without error or omission being noted, it was moved by Councilman Peterson, seconded by Councilman Gerow, the minutes be approved as read. Carried. ;.RITTE'N CO'LI:UNTICATIONS. The following communications, which were read to the Council, were disposed of in the manner indicated, following reference to each here- inafter: GEORGE LAIRD, Sunday School Superintendent of E1 Segundo Calvary Church, dated September 2nd, 1942, requesting a permit to use Grand Avenue Park for a Sunday School picnic September 12th, 1942, between the hours of 9 A. M.. and 5 P. M., at which event twenty -five or more persons will be present. Moved by Councilman Peterson, seconded by Councilman Gerow, that Calvary Church of E1 Segundo be and it is hereby granted permission to conduct a Sunday School picnic, to be attended by twenty -five or more persons, in Grand Avenue Park September .12th, 1942, between the hours of 9 A. 1'. and 5 P. 1,11. Carried. REV. RUTH BRIDENSTINE, Pastor, Four Square Gospel Church, dated September 2nd, 1942, requesting the use of the Grand Avenue Park, September 13th, 1942, between the hours of 12 o'clock noon and 5 o'clock P. TM.., for the purpose of conducting a Sunday School gathering. rti:oved by Councilman Gerow, seconded by Councilman Peterson, that Rev. Ruth Bridenstine be and she is hereby granted permission to conduct a Sunday School gathering, consisting of twenty -five or more persons, in the Grand avenue Park, September 13th, 1942, between the hours of 12 o'clock noon and 5 o'clock P. Carried. :yiEX PETROLEU?d CORPORATION, LTD., dated August 25th, 1942, advising that all requirements of the City of El Segundo with respect to its ab- andonment of its oil :Arell within the City of El Segundo, known as Elsie No. 5 well, have been complied with, and requesting that its special deposit of $500.00 be returned. The City Clerk, after reading said communication, advised the Council that he has in his possession a written report of J. B. Catalano, Building Inspector, stating that un- 1 17 Q t 21 satisfactory conditions which previously existed around the said well have been corrected and that the surface of the ground has been restored to approximately its,original state. It was thereupon moved by Council- man Peterson, seconded by Councilman Selby, that the.communication of Apex Petroleum Corporation, Ltd., dated August 25th, 1942, be received and placed on fiele in the office of the City Clerk, and that the written report of the Building Inspector.dated September 2nd, 1942, respecting the well named and known as Elsie No. 5, of Apex Petroleum Corporation, Ltd., is hereby approved and ordered attached to the before mentioned letter of Apex Petroleum Corporation, Ltd.; that the request of said Apex Petroleum Corporation, Ltd., be approved and the City Clerk be and he is hereby authorized and directed to prepare and present to this Council the necessary refund warrant. DOUGLAS AIRCRAFT COM?ANTY, INC., dated September.2nd, 1942, re- questing permission to .install an eight -inph water line in Lapham Street, between Imperial Highway and the southerly line of Douglas Avenue. After consideration, it was moved by Councilman Selby, seconded by Councilman Gerow, that Resolution No. 624, entitled: A RESCLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO GRANTING A T 00RkRY REVOCABLE PERMIT TO DOUGLAS AIRCRAFT COMPANY, INC., AND/OR DEFENSE PLANT CORPORATION TO INSTALL A CERTAIN PIPE -LINE AND APPURTENANCES IN A CERTAIN PORTION OF LAPHAM STREET WITHIN SAID CITY, which was read, be adopted. The motion carried and said resolution was adopted by.the following vote, to —wit: Ayes: Councilmen Gerow, Peterson, Selby and Mayor pro tem Hesser. Noes: Councilmen None. Absent: Councilman Love. ORAL C01,811UNICATIONS. Special City Attorney John F. Bender addressed the Council stating that one of the duties of his employment as Special City Attorney is to advise the Council concerning the action it should take with respect to those parcels of land within the City of El Segundo which have been sold to the State for delinquent taxes, and he requested an instruction from the Council as to the action which should be taken respecting approximately fifty -eight parcels of real property regarding which the Council has here- tofore given nil instruction. He recommended that in order to protect the City's interests in unpaid special assessments against these parcels, that the City purchase, at this time, tax deeds at a cost of $15.00 per parcel, deferring until a later date any further action with respect thereto. It appearing frog, the discussions had that the Council is dubious about the actual value of these properties and the financial recovery the City.might make in evept of the purchase of tax deeds as recommended by Mr. Bender, action �n the matter was postponed to enable the Council to give the subject further. consideration. REPORTS OF ST.;NDMTG COI&ITTEES. Councilman Gerovr recommended the purchase of two hundred feet of garden hose for the Parks Department so that said Department might then loan a quantity of hose to the troops encamped within the City of E1 Segundo to enable them to properly irrigate the trees and shrubs recently planted around the barracks at Loma Vista Street and Acacia Avenue, Q: 21 -8 whereupon it was moved by Councilman Selby, seconded by Councilman Gerow, that the purchase of two hundred feet of garden hose be and the same is hereby authorized at a cost of not to exceed $30.00, plus California State Sales Tax. Carried by the following vote: Ayes: Councilmen Gerow, Peterson, Selby and Mayor pro tem Hesser. Noes: Councilmen None. Absent: Councilman Love. REPORTS OF OFFICERS AND SPECIAL COIZIITTEES. Street Superintendent Hutchins reported to the Council that on September 1st, 1942, an E1 Segundo resident stepped into a freshly painted crosswalk line at Palm Avenue and Main Street,.getting paint on her shoes and clothing, and he thereupon handed the City Clerk a Police Department Investigation report on the matter. Thereupon it was moved by Councilman Gerow, seconded by Councilman Selby, that the Police Department investigation report concerning an accident alleged to have occurred on or about September lst, 1942, at or about the hour of 9:10.A.n_., of said day, involving a pedestrian who slipped and fell on a crosswalk stripe, thereby damaging wearing apparel, be received and placed on file in the office of the City Clerk and said Clerk be directed to notify the City's insurance carrier of the alleged occurrence, nothing herein contained to be construed as an admission of liability in the premises on the part of the City of E1 Segundo. Carried. UNFINISHED BUSINESS. In the matter of awarding contracts for drilling a fresh water well for the City of E1 Segundo and furnishing the necessary materials therefor, Water Department Superintendent Hutchins reported that no response has been received in answer to his request for a priority rating. Therefore it was moved by Councilman Gerow, seconded by Councilman Selby, that bids received June 17th, 1942, for the drilling of a water well in and for the City of E1 Segundo, and for furnishing a pump, Mlotor and certain pipe and fittings as appurtenances to said water well, be taken under further consideration until the next regular meeting of this Council. Carried. In the matter of the proposed contract between the Southern California Telephone Company and the City of E1 Segundo for the installation of signaling devices in certain locations within the City of El Segundo, it was decided, after discussion, that sufficient investigation has not as yet been made, whereupon it was moved by Councilman Peterson, seconded by Councilman Gerow, that this matter be taken under further advisement. Carried. Regarding the request of the Treasury, Department 'Aar Savings Staff that the City of El Segundo adopt a voluntary Thar Savings Bond Purchase Plan for its employees, no member of the Council was prepared to report at this time. It was thereupon by general consent determined to continue the matter for one week. In the matter of a Deed of Easement covering a strip of land twelve feet (12') in width,* situated in the northeast quarter (NE/4)' cf Section. 7, township 3 South, Range 14. "Jest,' S.3.B. - Y.,, within the City of E1 Segundo, and a bill of sale covering certain cast iron water rains located,in Section 7, which instruments were tendered the City of E1 Segundo by Santa Fe Land Improvement Company., in February 1941, th.- City Clerk retorted that said Santa Fe Land Improvement Company renuested return of the instruments to it in view of the fact that current developments make such return desirable at this time. Follow- ing discussion, it was moved by Councilman Selby, seconded by Councilman_ Gerow, that the following resolution be adopted: Q '1.9 WHEREAS, during the month of February, 1941, Santa Fe Land Improvement Company tendered the City of E1 Segundo a Deed of Easement covering a strip of land twelve feet (121) in width, situated in the northeast quarter (ti'E/4) of Section 7, Township 3 South, Range 14 West, S.B.B. & within the City of El Segundo, together with a bill of sale covering certain cast iron water mains in said section within the City of E1 Segundo; AND, VEEREAS, the City of El Segundo has not accepted said instruments or the rights intended to be conveyed thereby; AID, HEREAS, said Santa Fe Land Improvement Company has requested that said instruments be returned to it; AND, 'i=,IREAS, in view of the fact that circumstances now existing differ from those which existed at the time of the tender of said instruments; N01, THEREFORE, HE IT RESOLVED, that the City Clerk be and he is hereby authorized and directed to return to Santa Fe Land Improvement Company the instruments herein- before in this resolution referred to, together with a letter of transmittal stating that the City contemplates the probability of requesting similar concessions from said Company at some future date. Carried. In the :ratter of'awarding a contract for furnishing the City of El Segundo certain petroleum products as heretofore advertised for, pursuant to bids received August 26th, 1942, which said bids were taken under advisement untii - this hour at this meeting; the Council, ,by general consent, indicated its desire to proceed with the con - sideration of the bids received as aforesaid. The City Engineer thereupon submitted an analysis of bids received on petroleum products, which said analysis indicated ,Richfield Oil Company to be the lowest bidder, whereupon it was moved by Councilman. Selby, seconded by Councilman Peterson, that .Resolution No. 625, entitled: A RESOLUTION OF TE:E, CITY COUNCIL OF THE CITY OF EL SEGUNDO , CALIFORNIA, XATARDING TO RICHFIELD OIL CORPORATION THE CONTRACT FOR FURNISHING SAID CITY :`IT ITS PETROLEUM PRODUCTS REQUIR=NTS FOR THE PERIOD BE7VVEEN THE DATE OF CONTRACT AWARDED HEREUNDER AND V-]E 30TH DAY OF NNE, 19439 AT MIDNIGHT, .which was read, be adopted.. Carried by the following vote: Ayes: Councilmen Gerow, Peterson, Selby and Mayor pro tem Hesser. Noes: Councilmen_ None. Absent: Councilman Love. In the matter of the amendment of the Ordinance of the City of E1 ,Segundo fixing and establishing fire districts within the City of El Segundo so as to permit of the construction of frame buildings on Richmond Street between Grand Avenue and Franklin Avenue, it was moved by Councilman Selby, seconded by Councilman Peterson, that the City Engineer prepare and furnish the City Attorney e legal description of that portion of Fire District No. 2 which shall be eliminated from Fire District No. 2 of the City of E1 Segundo, as the same is fixed and established by Ordinance No. 221 and ordinances amendatory thereof or supplementary thereto, of the City of El Segundo, and the City Attorney be authorized and directed to prepare the necessary amendatory ordinance. Carried by all. M =--+.*I In the matter of the reconstruction of pedestrian walks in Library Park so as to minimize the cost of maintenance due to erosion in the rainy season of the decomposed granite walks now existent in said park, it was moved by Councilman Selby, seconded by Councilman Peterson, that the Street Superintendent of the City of E1 Segundo be and he is hereby authorized and directed to con- struct plant mix pedestrian walks throughout Library- Park at a cost of not to exceed $325.00.
