A regular meeting of the City Council of the City of El Segundo, California, was held in the Council Chamber of the.City Hall of said City on the above date, having been called to order at 7:00 P. The minutes of the regular meeting held on the.12th day of August, 1942, having been read and no errors or omissions appearing, it was moved by Councilman Selby, seconded by Councilman Peterson, the minutes be approved as recorded. Carried. WRITTEN CODiuMUNICATIONS. The following communications, which were read to the Council, were disposed of in the manner indicated, following reference to each hereinafter: JOHN F. BENDER, Special City Attorney, dated August 19th, 1942, captioned "Re= E1 Segundo Option Agreement.No. 43 ", and.transmitting therewith Los Angeles County Warrant No. S- 25161, dated August 12th, 19429 in amount $139.30; representing a refund on a City of E1 Segundo warrant issued for the purchase of various parcels of land included in Option Agreement No. 43, between the County of Los Angeles and the City of E1 Segundo, and explaining in detail the reasons for said refund. _ On motion of Councilman Selby, seconded by Councilman Peterson, which carried unanimously, the communication was ordered received.and placed on file in the office of the City Clerk for the purposes of identification and reference, and the accompanying warrant in amount of 4139.30 was ordered JdX i R' i zxfz R il I ±ftXKt±zXXKantxc a received and deposited °in the fund from which was drawn the amount of money used to purchase certain tax deeded properties from the County of Los Angeles. BYRAM, Tax Collector, County of Los Angeles, dated August 14th, 1942, making demand upon the City Council to provide funds for the payment of all delinquent assessments for all.'projects in the City of E1 Segundo under the Improvement Bond Act of 19159 for which current assessments have terminated but which have delinquent assessments for prior years still outstanding. Moved by Councilman Selby, seconded by Councilman Peterson, that said communication be received and filed. Carried unanimously. HARTFORD ACCIDENT AND INDEL'IdITY C0t2AIvY, dated August 13th, 1942, recuesting release from liability under certain bonds referred to in said "2 4 communication in favor of the City of El Segundo, with Sovereign Oil Corporation a$ principal, in view of the fact that Fidelity and Deposit Company of Maryland has executed and filed bonds covering the same oil wells of said Sovereign Oil Corporation. Moved by Councilman Hesser, seconded by Councilman Gerow, that the following resolution be adopted: RESOLVED, that Hartford Accident and Indemnity Company Bonds Nos. 1621063, 1630652, 1622758 and PO- 1622812, covering Sovereign Oil Corporation's El Segundo Community Well,No. 1, Community No. 2, Sovereign Elsie No. 2 and Sovereign Copinger No. l oil wells respectively, within the City of E1 Segundo, be and the same are hereby exonerated as to any liability accruing thereon subsequent to July 22nd, 1942.^ Carried by the following vote: Ayes: Councilmen Gerow, Hesser, Peterson, Selby and Mayor Love. LOS ANGELS COUNTY DIVISION, LEAGUE OF CALIFORNIA CITIES, dated August 15th, 1942, inviting attendance at its 131st regular monthly meeting at Hermosa Beach, August 27th, 1942. Moved by Councilman Selby, seconded by Councilman Hesser, that any member of the City Council desiring so to do, the City Engineer and the City Clerk be and they are hereby authorized to attend the regular monthly meeting of Los Angeles County Division, League of California Cities, to be held at Hermosa Beach, August 27th, 1942, and to file their demands for their actual and necessary expenses in connection therewith. PACIFIC 'COAST BUILDING OFFICIALS CONFERENCE, dated August 17th, 1942, recommending attendance of the Building Inspector of the City of E1 Segundo at the 20th Annual Convention of said Conference at Reno, Nevada, October 6th to 8th inclusive, 1942. Ordered filed. EL SEGUNDO LODGE NO. 5079 F. &, A. M., dated August 17th, 1942, complaining.with reference to the loss of a picture belonging to said organization which had been hanging in the City Hall Auditorium. By general consent the matter was referred to Councilman Hesser for investiga- tion and disposition of the complaint. None. None. ORAL COMMUNICATIONS. REPORTS OF STANDING COMMITTEES. REPORTS OF OFFICERS AND SPECIAL COMMITTEES. Councilman Gerow initiated discussion relative to amending the ordinance establishing fire districts within the City of E1 Segundo, so as to permit of the erection of frame buildings in the business district of the City of El Segundo northerly-of Franklin. Avenue. The desire of a property owner to-alter an existing brick building is the reason for - considering the ordinance amendment and Councilman Hesser stated that he had also been approached with respect to the same matter. By general consent the matter was taken under advisement until the interested property owner may find it convenient to appear before the Council in person, or transmit a letter setting forth his desires. Councilman Peterson reported that he and the City Engineer had reviewed the drainage situation at Maple Avenue and Bungalow Street, referred Q 205 to in a communication recently received from Wright - Becker and Duntley, and that he concurs in the recommendation of the City Engineer that nothing be done with respect to the matter until after the effects of the neat rains are observed. The Chief of Police reported respecting a discussion had with Captain John E. Jardine of the United States Army assigned to the Office of Civilian Defense, respecting dim -out regulations in this area and he explained the instructions received and his action taken in the matter. Following the report of the Chief of Police respecting dim -out regulations,' it was moved by Councilman Hesser, seconded by Councilman Peterson, that all municipal officers and employees having control of City property, take all necessary steps to comply with the dim -out regulations set forth in Proclamation No. 10 of General John L. DeWitt, General Commanding, Western Defense Command. Carried. The City Attorney read to the Council a certain letter he had addressed to Hartford Accident and Indemnity Company respecting its Bonds Nos. 1621063, 16206529 1622758 and PO- 1622812, tbvering certain oil wells of Sovereign Oil Corporation within the City of E1 Segundo, and he inquired whether or not the transmittal of said letter would be satisfactory to the Council; %hereupon it was moved by Councilman Gerot, seconded by Councilman Hesser, that a copy of that certain letter written by Clyde Woodworth, City Attorney, dated August 20th, 19420 addressed to Hartford Accident and Indemnity Company, referring to certain bonds written by said Company covering the operations of Sovereign Oil Corporation, within the City of E1 Segundo, be placed on file in the office of the City Clerk for "the purposes of identification and reference, and that the City Attorney be authorized and directed to transmit the original of said letter to said Hartford Accident and Indemnity Company. Carried. In view of the foregoing, it was moved by Councilman Selby, seconded by Councilman Peterson, that the action of this Council heretofore taken at this meeting under the Order of Business "Written Communications ", respecting the release of Hartford Accident and Indemnity Company from liability under certain of its bonds in favor of the City of E1 Segundo covering Sovereign Oil Corporation, as requested in said Company's letter dated August 13th, 1942, be and the same is hereby rescinded. Carried. The City Attorney reported that Santa-Fe Land Improvement Company has drafted a new form of easement, granting the City of E1 Segundo the right to construct, maintain, operate and repair a certain storm drain across certain property of said Company adjacent to Imperial Highway and Inglewood- Redondo Road, which redraft does not contain the objectionable features set forth in the original form of easement heretofore presented this Council, and that if the Council is now desirous of accepting this easement, he approves it as to form. It was thereupon moved by Councilman Hesser, seconded by Councilman Selby, that that certain easement, made the 17th day of August, 1942, by Santa Fe Land Improvement Company, granting to the City of E1-Segundo the right to construct, maintain, operate and repair an underground drain pipe and reinforced concrete storm drain across certain real property owned by the Grantor, be and the same is hereby accepted on behalf of the City of E1 Segundo, and the City Clerk is hereby authorized and directed to cause the said Easement to be filed for record in the office of the County Recorder of-Los Angeles County, California. Moved by Councilman Peterson, seconded by Councilman Gerow, that Ordinance No. 258, entitled: Q 2)s AN ORDINANCE OF THE CITY OF EL SEGUNDO, CALIFORNIA, FIXING THE AMOU -NIT OF MONEY NECESSARY TO BE RAISED BY TAXATION UPON THE TAXABLE PROPERTY THEREIN AS A REVENUE TO CARRY ON THE VARIOUS DEPARnmTS (IN- CLUDING THE EL SEGUNDO PUBLIC LIBRARY) AND PAY THE BONDED INDEBTEDNESS OF SAID CITY FOR THE CURRENT FISCAL YEAR, 1942 -1943, which was introduced and read at a regular meeting of this Council held on the 12th day of August, 1942 and reread at this meeting, be adopted. The City Clerk reported that Master Pest Control Company has submitted a new contract for consideration of the Council, which he then read and explained to the Council. Thereupon it was moved by Councilman Gerow, seconded by Councilman Hesser, that the City of El Segundo enter into a contract with Master Pest Control Company for the extermination of rats in and around the municipal can dump, at a total cost of ;114.00, said sum to be paid in monthly installments of 49150 each, beginning with September, 1942. In the matter of executing the contract heretofore submitted by the Department of Public Works, Division of Highways of the State of California, respecting the improvement of Imperial Highway, between Sepulveda Boulevard and Anza Avenue, by said Division, action on which was deferred until the matter of the storm drain easement had'been cleared up, it was moved by Councilman Hesser, seconded by Councilman Peterson, that the following resolution be adopted: RESOLVED, that that certain form of Agreement, between the City of E1 Segundo and the State of California., Department of Public Works, Division of Highways, presented this Council August 12th, 1942, be and the same is hereby approved; AND, BE IT FTJRT1_1ER RESOLVED, that the City of El Segundo enter into a contract with the State of California, Department of Public Works, Division of Highways, for the improvement of Imperial Highway from Sepulveda Boulevard to Anza Avenue, all as set forth in said form of contract, and that the iMayor of the City of E1 Segundo be and he is hereby authorized to execute said contract on behalf of the City of El Segundo and the City Clerk is authorized and directed to attest-the same, and to cause one copy of said contract to be placed on file in his office and six copies of said contract, together with a certified copy of this resolution, to be forwarded to said Division of Highways of the State of California. In connection with the request of United States Treasury Department that the City of :l Segundo adopt a'payroll deduction plan to enable employees of the City of E1 Segundo to purchase war savings bonds, it was decided, by general consent, to refer the matter to the Mayor, so that he might make arrangements for a discussion of the subject among the employees of the several departments of the City of E1 Segundo, representatives u of whom would advise the Council as to what method of war bond purchases would be most desirable and at the same time comply with the suggestions of the Treasury Department and conform in general with the plans for such purchases adopted by other municipalities. Councilman Hesser inquired what dispositior. is contemplated of the matter of installing alarm signals in the residences of certain firemen and defense council members, in accordande with the plan and contract heretofore submitted by Southern California Telephone Company. Discussion ensued, and it appearing that the matter is not entirely clear to all members of the Council, action was deferred until'a later date to permit of further consideration. The City Engineer reported no further word from the '-dar Production Board respecting the issuance of priority orders for the equipment and material necessary in connection with the drilling of a new water well for the City of El Segundo. It was, therefore, by general consent agreed that the City Engineer should send the priorities board a telegram, requesting immediate action in connection with this urgent matter. 4- 207 Ivoved by Councilman Gerow, seconded by Councilman Peterson, that bids received Tune 17th, 1942., for furnishing the City of .E1 Segundo certain pump, :rotor, pipe and fittings, be taken under further consideration for the period of one week. Carried. At this point the City Engineer _presented to the Council his written "Report of Proposed Vacation of Douglas Avenue, between Northrop Street and Lapham Street, within the City of E1 Segundo - August 19, 194211, which recites the amounts of money heretofore expended by the City of E1 Segundo in connection with the abandonment of Douglas Avenue, within the City of El Segundo, as the same formerly existed, and the anticipated costs of abandoning Douglas Avenue as it presently exists. Thereafter, by general consent, the City Engineer was authorized to transmit the original of said report to Douglas Aircraft Corporation and to file one copy thereof with the City Clerk. None. Moved by Councilman Selby,.seconded by Councilman Gerow, that Resolution No. 622, entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, FIXING TNT RATES OF TAXES LEVIED III AND FOR,SAID CITY, SUFFICIENT TO RAISE THE AMOUNT OF Y,01 Y FIXED BY THE SAID CITY COUNCIL IN ORDINANCE NO. 258 THEREOF, PASSED :AND ADOPTED ON THE 19TH DAY OF AUGUST, A. Moved by Councilman Hesser, seconded by Councilman Selby, the following resolution be adopted: RESOLVED, that a copy of that certain notice entitled "Notice No. One of Intention to Sell City of E1 Segundo Owned Real Property and Inviting Bids or Offers Therefor, " dated the 19th day of August, 1942, wherein notice of intention of the City of E1 Segundo to sell by quitclaim deed certain real properties situated in Tracts 1685, 25409 6968, 95499 100769 E1 Segundo, in said City of El Segundo, therein described, is given, and bids or offers on such properties are invited, as set forth in said notice, be immediately placed on fia.e in the office of the City Clerk of said City for the purposes of identification and reference; and BE IT FURTHER RESOLVED, that the City Council hereby approves the said form of notice and does hereby invite bids or offers for the real properties therein described, as therein contemplated; and BE IT FURTHER RESOLVED, that the City Clerk be and he.is hereby authorized and instructed to cause said notice to be published in the official newspaper of said City, to -wit: The E1 Segundo Herald, in the issues of said paper of August 27th, September 3rd, and September 10th, 1942; and BE IT FURTHER RESOLVED that'the said "Notice No. One of Intention to Sell City of E1 Segundo Owned Res.1 Property and Inviting Bids or Offers Therefor," which is on file as.aforesaid and open t& public inspection,, is hereby referred to and by this reference expressly incorporated herein and made a part hereof.
