A regular meeting of the City Council of the City of E1 Segundo, California, was held in the Council Chamber of the City Hall of said City on the above date, having -been called to order at 7:00 P. M. by George Love, Mayor. ROLL CALL. Councilmen Present: Gerow, Hesser,,Peterson, Selby and Mayor Love. Councilmen Absent: None. Other Officers Present: Clyde Woodworth - City Attorney. J. A. Cummings - Captain of Police. J. B. Catalano - Building Inspector. W. A.-Elsterman - Office Engineer. Victor D. McCarthy- City Clerk, READING,OF MINUTES OF PREVIOUS MEETING. The minutes of the regular meeting held on the 22nd day of April, 1942, were read. No errors or omissions appearing, it was moved by Councilman Selby, seconded by Councilman Gerow, the minutes be approved as recorded. Carried. WRITTEN COMMUNICATIONS. The following communications, which were read to the Council, were disposed of in the manner indicated, following reference to each hereinafter: RAILROAD COMMISSION OF THE STATE OF CALIFORNIA, dated April 22nd, 1942, urging extreme vigilance on the part of law enforcement officers to prevent acts of sabotage against the property and traffic of railway - lines in the State of California. Ordered filed. R. T. HUTCHINS, dated April 28th, 1942, requesting an additional four weeks leave of absence, without pay. Moved by Councilman Selby, seconded by Councilman Peterson, that R. T. Hutchins, City Engineer, be and he is hereby granted an additional leave of absence, not to exceed four weeks, beginning May 4th, 1942. . Absent: Councilmen None, FEDERAL: WORKS AGENCY, REGIONAL ENGINEER, dated April 23rd, 1942, subject "Docket Cal. 4 -295, Water Mains, L1 Segundo, California ", informing that the City's application for Federal aid in the construction of certain water mains within the City of E1 Segundo, as described in the.docket numbered as above, has been disapproved, due to the fact that Federal Works Agency has only limited funds available and that a high pressure water main will be provided for fire-fighting protection,for 11 Segundo aircraft factories. Ordered filed. LOCAL DEF'ENSE"COUNCIL OF THE CITY,OF EL SEGUNDO, dated April 24th, 1942, requesting the City Council to instruct the Fire Chief of the City of El Segundo to deny all applications which may be made for permits to sell fireworks within said City during the Year 1942. On motion of Councilman Selby, seconded by Councilman Peterson, which carried unanimously, the communication was ordered received and placed on file -in the,offiee of the _ City Clerk and the Council indicated that it.coneurred in the findings of the Defense Council. 4- 8 MARFAY DEYELOPME.NT INC., dated April 28th, 1942, requesting the Council consent to the installation of a cesspool on Lot 6, Tract 12391, within the City of E1 Segundo, so as to provide sewage disposal facilities for the dwelling house erected on said lot, inasmuch as the building is below the level of the sewer facilities installed in Sierra Street. By general consent the matter was'laid over for one week-for further consideration and action. SPECIAL ORDER OF BUSINESS. The hour of 7:15 o'clock P. M. at this meeting having heretofore been fixed as the time and place for hearing on-the petition to close to public use and travel, under the provisions of Section 9 of the "Sabotage Prevention Act" of the State of California, a certain public alley in a portion of Block 12, within the City of E1 Segundo, which abuts Lots19 nn:: li inclusive, and Lots 12 to 17 inclusive in said Block, and said hour having arrived., the Mayor announced the fact and that the Council would proceed-with the hearing. The City Clerk thereupon reported that notices of the time and place of the hearing had been duly published as required by law and that an affidavit of such publication is on file in his office. He reported also alley had been received The Mayor then asked if any person or persons present desined to make oral objection to the closing of said alley. No person appearing to do so or indicating a desire so to do, it was moved by Councilman Hesser, seconded by Councilman Selby, that the following.resolution be adopted: that no written protests against the closing of said by ,him. yWREAS, in conformity-with Section 9 of the "Sabotage Prevention Act'!' of the State of California (Statutes 1941, Chapter 184, page 1240) Standard Oil Company of California, a Corporation, filed a petition with this City Council, which said petition is dated the 31st day of March, 1942, and was presented to this City Council on the lot day of April, 1942, seeking its order closing to public use and travel that certain public alley in the City of E1 Segundo, County of Los Angeles,, State of California, in Block -12 of the said City, running in a Northerly and Southerly direction, whieh.abuts Lots 9.to 11 inclusive, and Lots 12 to 17 inclusive,,in said block, all as delineated upon said company's Print No. SB 29356, accompanying said petition; and WHEREAS; said petition was again presented to this City Council on the 15th day of April,•1942, at its regular:meeting held on said date, and in accordance with Section 9 of said "Sabotage Prevention Act ", this City Council set Wednesday, the 29th day of April, 1942, beginning at the hour of 7:15 o'clock p. ml of said-day, as the- date for the heaving of such petition, and ordered the publication of the notice of the filing of such petition and the hearing date in a newspaper having general circulation in the City of E1 Segundo,-County of Los Angeles, State of California, and further ordered that such publication should be made at least seven (7) days prior to.said 29th day of April, 1942; and wFzRF�IS, in accordance with said order such notice was published 4n the E1 Segundo Hetald, on Thursday, the 16th day of April, 1942; and WHEREAS, an opportunity has been given for any person present to be heard, and no protest against the closing of said public alley having been made or filed after a Still and coMlete hearing, it is hereby determined that the public safety and the safety of the property of petitioner, Standard 011 Company of California, requires that the said public alley within the City of E1 Segundo, County of Los Angeles, State of California, be closed to public use and travel; Q 99 NOW, THEREFORE, BE IT RESOLVED, and it is hereby ordered by the City Council of the City of E1 Segundo, California: First: That the said petition of Standard Oil Company of California, is proper, valid and authorized by Section 9 of'the "Sabotage Prevention Act"; that the contents or such petition are true and correct and in accordance with, and by reason of, the powers given it by Section 9 of the "Sabotage Prevention Act" this City Council hereby orders the closing of said public alley, which is that certain public alley within the City of El Segundo, County of Los Angeles, State . of California, running in a Northerly and Southerly direction, which abuts Lots 9 to 11 inclusive, and Lots 12 to 17 inclu- sive, in said block, all as delineated upon said company's Print No. SB 29356, accompanying said petition, - to public use and travel for the duration of the present war. Second: That Standard Oil Company of California shall erect and maintain barriers across said public alley at the northerly and southerly ends thereof, and place and maintain on•each barrier devices sufficient to advise anyone approach- ing of the presence of the barrier, and that such portion of said public alley is closed to public use and travel. A suitable gate or gates may be erected by the said petitioner in such barrier or barriers, which may be kept closed and locked by the petitioner, except when such gate or gates shall be opened for the ingress and egress of the officers, agents, employees and property of said Standard 011 Company of Calif- ornia, and of the United States'Governmeut.- Petitioner shall prepare and post the notice required by Section 9 of said act on each of said barriers. Third: That the officers, agents, employees and property of Standard Oil Company of California, and of the United States Government, shall be permitted and are hereby authorized to pass, travel over and use the closed portion of said public alley for the duration of the present'war, and no other person, persons or property are to be allowed to travel or pass over the closed portion of the said alley. In order to facilitate such use and travel petitioner is hereby authorized to alter or change the closed portion of the said public alley or its improvements, provided, however, that petitioner shall agree to restore such public alley and its improvements within six months after the end of the present war to a condition as determined by the City Engineer of the City of E1 Segundo, California, to be at least equal to that obtaining at the present time. Fourth: That the said petition of Standard-Oil Company of California, above referred to, which is now on file in the office of the City Clerk of said. City in the City Hall thereof and open to public inspection, is hereby referred to.and by this reference expressly incorporated in-this resolution and made & part hereof as fully as though the same were herein set forth at length. The foregoing resolution was adopted-'by the following vote, to -.wit: 'Ayes: Councilmen Gerow, Hesser, Peterson, Selby and Mayor Love. ..Noes:' 'Councilmen None. - Absent: Councilmen None. • REPORTS OF STANDING COWITTESS. None: - REPORTS OF OFFICERS AND SPECIAL COMMITTEES. Acting Chief of Police Cummings advised the Council that on Sunday last, a group of State Militiamen appeared at the City of E1 Segundo pistol range for target work and confusion and dissatisfaction resulted, due to the fact that other persons who-had had previous permission to.use the range at said time were required .to. surrender the privilege to the militiamen. He further stated that the persons discommoded on this date had been organized and had been privileged to use the range Sunday forenoons over a long period of time and that he believed if the use of the range is to be granted the militiamen or other agencies-, that the new permittees should be willing to use afternoon hours. Anthony Ciampa, Commander of the Militiamen referred to, was present at the meeting, and stated that the use of the range by.his group on the forenoon of April 26th, was due to a misunderstanding, for which he expressed regret, and he advised that his organization will arrange to avail itself of the privilege of the local range at such hours as may mutually be agreed upon. He stated also that his organization desired to improve the range at its own cost and expense, whereupon,.by general consent, the matter of the use of the local pistol range and the improvements .thereto, be referred back to the committee heretofore appointed for that purpose, to -wit: Councilman Hesser and Captain Cummings and that this committee be authorized to use its own discretion in deciding upon the matters referred to. Councilman Peterson reported that he, Building Inspector Catalano, Office Engineer Elsterman and City Clerk IMcCarthy,:had investigated and con- sidered the matter of additional fire proof storage space for certain municipal records, and that as a.result thereof it has-been decided not to construct such additional space at this time, as the -City Clerk believed that by removing some obsolete records from his vault and rearranging the remainder, he could find space to accomodate the vital records which the Engineering Department desires to file for safe keeping. Acting Chief of Police Cummings, through the City Clerk, presented a letter received by him from the Division of Highways of the State of California, indicating that the Division of Highways has no objection to the placing of pedestrian cross walks on Sepulveda Boulevard, provided the Division standards are followed. It appearing that these standards are known to the Street Superintendent of the City of E1 Segundo and that the crosswalks will be constructed accordingly, as heretofore authorized by this Council, the communica- tion was ordered received and filed in the Ioffice of.the City.Clerk. The Acting Chief of Police, through the City Clerk, announced the appointments of Milford Howard., Herman F. Seller, and William: J. Kusack as Special Police Officers of the City of E1 Segundo and requested approval of said appointments. Moved by Councilman Selby, seconded by Councilman Hesser, that the appointments, by the Acting Chief of Police of the City of E1 Segundo, of Milford Howard, Herman F. Keller and William J. Susack, as Special Police Officers of said City, be and the same are hereby .ratified, approved and con- firmed. Carried. The City Clerk reported that Mr. Alderton, Field Representative of Federal Works Agency, Public Roads Administration, visited his office on .Monday, April 26th, 1942, and requested the City of E1 Segundo file a state- ment with the United,States Public Roads Administration,'720 Whelan Building, San Francisco, indicating whether it will or will not contribute,25% of the entire cost of improving the roadway of Imperial Highway, between Sepulveda Boulevard and Inglewood- Redondo Road. Following discussion, it was moved by Councilman Gerow, seconded by - Councilman Hesser, that the City Clerk be authorized to address an appropriate letter to the said Agency, advising it that the City of E1 Segundo has no funds available to use in any way in the improvement of Imperial Highway, between Sepulveda Boulevard and Inglewood- Redondo Road. Carried. 10 Q. 1 . The City Clerk reported further that Mr. Alderton, of the Federal Works Agency, Public Roads Administration, requested that the City inquire of the property owners who may be effected, whether or not they will dedicate, with- out cost,to the City of E1 Segundo or to the Federal Government, requisite, parcels of land for the opening of Mariposa Avenue, from Sepulveda Boulevard .easterly to a line which would correspond with a southerly prolongation of the westerly line of Northrop Street. This request was made by verbal communication with the City Clerk, who was advised that Northrop Street will be opened in a southerly direction from its present southerly terminus and that as opened, it will be fenced along its westerly line. The City Clerk stated he had informed Mr. Alderton that under date of March 19th, 19420 he had addressed a communication to the Federal Works. Agency at San Francisco, requesting certain important information, which he might impart to the property owners effected when he solicited street deeds from these parties, but that as yet not even an acknowledgment of receipt of the communication had been received from said Federal Works Agency; that before making any representations to property owners effected.he would like to have the facts set forth in writing so that no misunderstanding might result as between the Federal Works Agency, the City of El Segundo, or said property owners; that as to this Mr. Alderton demurred and suggested if the City cared to do so, it might request that the Mariposa Avenue opening project be withdrawn from further consideration. Upon hearing the report of the City Clerk in this connection, it was moved by Councilman Gerow, seconded by Councilman Hesser, that in.view of the foregoing report, that the City Clerk be and he is hereby authorized and instructed to forward an appropriate letter to-the Federal Works Agency, setting forth the circumstances under which the application of the City of E1 Segundo with reference to said matter was originally made, and further stating that there is no further desire.on the part of the City of E1 Segundo to proceed with the opening of Mariposa Avenue under the circumstances. Inglewood Mercantile Company, Inc. has completely Fulfilled its contract to furnish certain materials to the City of El Segundo for the construction of El Segundo Public Library Building and he requested permission to return the deposit check filed by said firm with its bid for-furnishing said materials. Moved by Councilman Selby, seconded by Councilman Gerow, that the City Clerk be and he is hereby authorized and directed to return to Inglewood Merchantile Company, Ind, -the deposit check of said firm now on file in his office, which was filed with the City at the time said Company bid upon eertain•materials to be furnished the Citp'of E1 Segundo in connection with the .construction of El-Segundo Public-Library Building. Carried. The City Attorney reported that he had prepared an ordinance with• respect to the regulation of fires on.the ocean beach within.the City of E1 Segundo, as heretofore requested by the •IInited States Army. Councilman Gerow thereupon introdueed'Ordinance No 2540 entitled: AN ORDINANCE OF THE CITY OF EL SEGUNDO, CALIFORNIA, REGULATING FIRES ON OR IMMEDIATELY ADJACENT TO THE OCEAN BEACH WITHIN SAID CITY,- which was read. i1w The City Attorney reported also that he had prepared and has delivered to the City Clerk three deeds covering - certain improvements and installations in Tracts Nos. 12812, 12887 and 12391,- within the City of El Segundo, which when executed by the persons whose execution thereof is necessary-, and delivered to and accepted by the City Council of the City of E1 Segundo,;_ will convey to said City all title and interest in and to all cement curbs, and sidewalks, street improvements, water lines and sanitary sewer lines in said tracts. The City Attorney reported receipt of information from a representative of Sovereign 011 Corporation that said Corporation expects.to have its substitute oil well drilling bonds executed not later than April 30th, 1942. The City Attorney reported also having received a communication from Mr. George Trucan, who allegedly is repponsible for damage to municipal property.by reason of the involvement of his automobile in a collision sometime ago, advising that Mr. Trucan is investigating to determine whether or not he has an insurance coverage with respect to property damage and that he-will communicate further with the City Attorney after this determina- tion is made. The City Clerk reported that he has obtained a price of $10.00 each for turn -out coats requested by the Fire Npartment of the City of El Segundo. UNFINISHED BUSINESS. None. PAYING BILLS.
