An adjourned regular meeting of the City Council of the City of E1 Segundo, California, was held in the Council Chamber of the City Hall of said City on the above date, beginning at the hour of 4:15 o'clock P. M., having been called to order by the City Clerk, the Mayor being absent. Councilman Love was unanimously_chosba.Mayor pro tem and he immediately assumed the duties of the Mayor. ROLL CALL. Councilmen Present: Gerow, Hesser, Selby and Mayor Pro Tom Love. Councilmen Absent: Binder. Other Officers Present: Victor D. McCarthy - City Clerk. Clyde Woodworth - City Attorney. By general consent the regular order of business was dispensed with. The City Clerk.reported that the returns of the General Municipal Election held on Tuesday, the 14th day of April, 1942,.in the City of.Z1 Segundo, California, were then, and had been, in his possession in the envelopes containing them, in the same condition as when received, and that he had also received and °.had ready to present to the Council seven (7) absent voters' ballots. Said Clerk then presented said returns and said absent voters' ballots to the.City Council at this time at this meeting. It was thereupon moved by Councilman Gerow, seconded by Councilman Selby, that the City Council proceed forthwith to canvass said returns and said absent voters' ballots. The.said motion was carried and adopted by the following vote:. Ayes: Councilmen Gerow, Hesser, Selby and Love. Noes: Councilmen None. Absent: Councilman Binder. . Said motion having carried, the City Council then proceeded forthwith to publicly examine and canvass the said returns and the said absent voters' ballots, all as provided-by law, and upon the completion of said canvass by said Council, it was moved by Councilman Selby, seconded by Councilman Gerow, that the following resolution be adopted: WHEREAS, there was held and conducted in the City of E1 Segundo, County of Los Angeles, State of California, on Tuesday, the 14th day of April,.1942, a General Municipal Election of the.qualified electors of said City, under, pursuant to and as required by, the provisions of the laws of the State of California, relating to cities of the sixth class, for the purpose of electing the following officers of said City, to -wit: Two members' of the City Council of said City for the full term of four (4) years; AND,•WHEREAS, it appears that noticp of said election was duly and legally given; that there were seven (7) voting precincts established within the said City for holding said election, consisting in all instances of the regular election precincts established for holding general State and County elections, as establised by.the Board of Supervisors of Los - Angeles County, California; that election officers were appointed and election supplies furnished; and that in all .respects said election was held and conducted and the votes cast thereat received and canvassed and the returns thereof made and declared in time, form and manner as required by the provisions of the laws of the State of California relating to cities of the sixth class and. pursuant -to all laws of said-State and of.said City in such case -made and provided; AND, WHEREAS, the City Council of the.said City of E1 Segundo, met at the Council Chamber.of the said Council in the City Hall of said City on Tuesday, the 21st day.of April, 1942, as provided by law, beginning at the hour of 4:15 o'clock p. m. of the said day, to canvass the returns of said election and said absent voters' ballots, and declare the results thereof, whereupon the said Council found that the number of votes cast; the names.of the persons voted for; the office to fill which each person was voted for; the results of said election; and the other matters required by law, to be as hereinafter stated; NOW, THEREFORE, THE CITY COUNCIL OF THE. CITY OF EL SEGUNDO, CALIFORNIA, DOES HEREBY RESOLVE, DECLARE AND DETERMINE AS FOLLOWS: That said General Municipal Election was held and conducted in said City of E1 Segundo; California,, on Tuesday,.the 14th day_ of April, 1942, in time, form and manner as required by law; That there were seven (7) voting precincts established within the said City for the purpose of holding said election, consisting in all instances of the regular voting precincts established by the Board of Supervisors of Los Angeles County, California, for the holding of general State and County elections, as follows: Voting Precinct "A" comprising State and County Precinct, E1 Segundo City Precinct No. 1, the polling place of which was in the dwelling house located at 835 Loma Vista Street, in said city; Voting Precinct "B" comprising State and County Precinct, E1 Segundo City Precinct No. 2, the polling place of which was in the dwelling house located at 515 W. Walnut Avenue, in said city; Voting Precinct "C" comprising State and County Precinct, E1 Segundo City Precinct No. 3, the polling place of which was in the dwelling house located at 506 Arena Street, in said City; Voting Precinct "D" comprising State and County Precinct, E1 Segundo.City Precinct No..4, the polling place of which was in the Council Chamber of the City Hall, 203 Richmond Street, in said city; Voting Precinct "E" comprising State and County Precinct, E1 Segundo City Precinct No. 5, the polling place, of which was in the dwelling house located at 426 Whiting Street, in said City; Voting Precinct "F" comprising State and County Precinct, E1 Segundo City Preclnct.No. 6, the polling place.of,which was in the dwelling house located at 403 Whiting Street, in said city; Voting Precinct "G" comprising State'and County Precinct, E1 Segundo City Precinct No. 7, the polling place of which was in the dwelling house located at 822 Main Street, in said city. :IT Q 81 That the whole number of votes (Ballots) cast in said City of E1 Segundo at said election was 898 votes (ballots); and That the whole number of absentee votes (Ballots) cast was seven (7) votes (Ballots), making a total of 905 votes (Ballots) in all cast at said election;' That the names of the persons voted for; the office to fill which each person was voted for; the number of votes given at each precinct to each of such persons; and the total number of votes given in the City to each of such persons, are as follows: For Member of the City Council of the City of E1 Segundo, California, for the full term of four years, the following persons received the number of votes herein- after set forth in the respective precincts hereinafter indicated and the respective total votes set opposite their respective names to -wit: TOTAL NAMES OF PERSONS P R E C I N C T S VOA VOTED FOR: A: B: C: D: E: F: G• Orest 0. L. Munger above named, received for Member of the City Council of said City, a total (including all votes cast in said City and all votes cast ih said absentee voters' ballots) of 369 votes; That said Dave W. Peterson is the candidate for the office of Member of the City Council of the City of E1 Segundo, California,. for the full term of four (4) years, who received the highest number of votes for said office and that therefore _ said Dave W. Peterson was elected and is hereby declared elected to the office of Member of the City Council of the City of E1 Segundo, California, for the full term of four (4) years; and Second: That Orest 0. Hesser is the candidate for the office of Member of the City Council of the City of E1.Segundo, . California, for the full term of four (4) years, who received the second highest number of votes for said office and that therefore said Orest 0. Reeser was elected and; is hereby declared elected to the office of.Member of the City Council of the City of E1 Segundo, California, for the full term of four (4) years; and SAID CITY COUNCIL DOES HEREBY FURTHER RESOLVE, DECLARE AND DETERMINE that the City Clerk of said City shall enter on the records of said City Council a statement of the result of said. election, showing: , (1) The,whole number of votes cast in said.Gity of El Segundo; (2) The number of votes cast by absentee voters;. (3) The total number of votes cast inclusive of both the votes cast at.the various precincts and -the votes cast in absentee voters' ballots; (4) The names of-persons voted for; (5) The office to fill which each person was voted for; (6) The number of votes given at each precinct to each of such persons for each of such offices; t • • (7) The total number of votes given in said City Of E1 Segundo to each of such persons for each of such offices; (8) The number of votes given in absent voters'' ballots to each of such persons for each of such offices; and (9) The total number of votes given in said City and in absent voters* ballots to each'of such persons for each of such offices; AND SAID CITY COUNCIL'DOES HEREBY FURTHER RESOLVE, DECLARE, DETERMINE AND DIRECT: ' (A) That the City Clerk shall immediately make and deliver to each of such persons so elected a certificate of election signed by him and duly authenticated, said certificates to certify respectively as follows: .(a) That Dave W. Peterson was elected as a member of the City Council of the City of EZ Segundo, California, for the full term of four (4) years;. and (b) That Orest 0. Rosser was elected as a member of the City Council of the City of E1 Segundo, California, for the 'full term of four (4) years. (B) That the City Clerk shall also impose the constitutional oath.of office upon the said Dave W. Peterson and Orest 0. Rosser, as members of the City Council of said City, and have them subscribe thereto, and file the same -in his office. (0) That thereupon each of said persons so elected to said respective offices shall be inducted into the said respective offices to which they have respectively been elected. The motion to adopt.the foregoing resolution was carried unanimously (and by the'Mayor pro tea declared carried) by the vote shown in the following certificate of the City Clerk, to -wit: STATE OF CALIFORNIA ) COUNTY OF LOS ANGELES) SS. MCCARTHY, City Clerk of the City of E1 Segundo, California, do hereby certify that the foregoing resolution was duly and legally introduced and adopted by the City Council of said City of E1 Segundo, California, at a meeting of the said Council held on Tuesday, the 21st day of April, A. D., 1942, and that the same was adopted by the following vote, to -wit: Ayes: Councilmen Gerow, Rosser, Selby and Mayor pro tern Love. Noes:' Councilmen None. Absent: 'Councilman Binder. City Clerk of the C egu , (SEAL) California. t � The City Clerk then delivered a Certificate of Election to and imposed the Constitutional Oath of Office upon Dave W. Peterson and Orest 0. Rosser, Councilmen elect, and each subscribed to said oath,.and announced that he had taken and subscribed his con - stitutional oath of office before an officer authorized by law to impose oaths and had filed the same in the office of the City Clerk. At this time Dave W. Peterson and Orest O. Rosser assumed their respective offices and took their seats at the Council table, and the Council as thus constituted, consisted of Councilmen Dave W. Peterson, Orest 0. Rosser, John A. Gerow, George Love and William R. Selby, all of whom were present. The City Attorney thereupon advised the Council that it would be in order for the City Council at this time to hold its organiza- tion meeting and proceed to organize by choosing a Mayor. He there- upon presented to the members of the Council elect the following: "Consent and Waiver of Notice of Organization Meeting of the City Council of the City of E1 Segundo, California ", which was subscribed by all of the members of the City Council as so constituted, and which was thereupon filed with the City Clerk, to -wit: "Consent and Waiver of Notice of .Organization Meeting of the City Council of the City of E1 Segundo, California. "STATE OF CALIFORNIA ) COUNTY OF LOS ANGELES) SS. CITY OF EL SEGUNDO ) "KNOW ALL MEN BY THESE PRESENTS: That we, the under- signed, constituting and being all of the members of the City Council of the City of El Segundo, California, as presently constituted, do hereby give our written consent to the holding of the organization meeting of the said Council following the regular general municipal election of April 14, 1942, to be held in the Council Chamber in the City Hall of said City, in said City, beginning at this time, to wit: the hour of 4:55 o'clock P. m. on Tuesday, the 21st day of April, 1942, for the purpose of organizing said Council by choosing one of its members as, and to act as, Mayor of said City, and for the purpose of transacting any other business that may properly come before said Council, and we hereby waive any and all notice of the time and place of the holding of said meeting, and do hereby consent and agree that the same may be held at said place., beginning at said time, upon said date, and for said purposes.
