A regular meeting of the City Council of the City of E1 Segundo, California, was held in the Council Chamber of the City Hall of said City on the above date, having been called to order at 7:00 P. M. by Peter E. Binder, Mayor. ROLL CALL. Councilmen Present: Gerow, Hesser, Love, Selby and Mayor Binder. Councilmen Absent: None. Other Officers Present: Clyde Woodworth - City Attorney. R. T. Hutchins - City Engineer. Victor D. McCarthy - City Clerk. READING OF MIN'UTE'S CF PREVIOUS MEETING. The minutes of the regular meeting held on the 10th day of December, 1941, having been read without error or omission being noted, it was moved by Councilman Love, seconded by Councilman Selby, the minutes be approved as recorded. Carried. 1 RITTEN CQM1TTNICATIONS. The following communications, which were read to the Council, were disposed of in the manner indicated, following reference to each hereinafter: .LOS ANGELES COUNTY DIVISION, LEAGUE OF CALIFORNIA CITIES, dated December 9th, 1941, advising of its regular monthly- meeting at Lynwood, December 18th, 1941, and requesting attendance thereat. Moved by Councilman Selby, seconded by Councilman Love, that any member of the City Council desiring so to do, the City Clerk and the City Engineer be and they are hereby authorized to attend the regular monthly meeting of Los Angeles County Division, League of California Cities, at Lynwood, Thursday, December 18th, 1941, as respresentatives of the City of El Segundo and to file their demand for their actual and necessary expenses in connection therewith, such demands to be audited and approved in the usual manner before payment. CONVERSE, dated December 15th, 1941, responding to the Clerk's letter of December 11th, 1941, with reference to electric wiring in that space in his building occupied by E1 Segundo Public Library, and stating that he would be glad to have the assistance of the Engineering and Building Departments of the City of E1 Segundo to correct the wiring faults mentioned in the Clerk's said letter. Ordered filed. CCLU11BLA VARNISH CC12ANY, dated December 11th, 1941, advising of the availability of black out paint for interioT'or exterior use. Ordered filed. SC'JT`r? CALIFORNIA GAS COMPANY, dated December 11th, 1941, requesting the City Council to adopt an ordinance releasing said Company from its obligation under existing ordinance of the City of El Segundo to maintain red lanterns around street excavations at night. It appearing that this matter will be treated later by the adoption of an ordinance relating to air raid precautions, the communication was ordered filed. P ` 1JL 9 JOIT C. AUSTIN, Architect, dated December 15th, 1941, submitting a report of costs segregation into labor and material for all items to make E1 Segundo Public Library Building usable for emergency purposes. It appearing that additional information is required for use of the Legal Department of the City* of El Segundo, the communication was ordered received and placed on Tile with the City Clerk and the subject matter thereof referred to the City Attorney of the City of El Segundo for further handling. LEAGiTE OF CALIFORNIA CITIES, dated December 15th, 1941, submitting a form of Air Raid Precautions Ordinance, which said League submits for consideration of the Council as one approved by State officials and to be uniformly adopted by cities of the State of California. The matter was discussed at length, at the conclusion of which Councilman Selby introduced Ordinance No. 252, entitled: AD; ORDINAP3CE OF THE CITY OF EL SE97NDO, CALIFORNIA, R::LATL`,G TO AIR RAID PRECAUTIONS,• which was read. CULBERT L. OLSON, Governor of the State of California, undated, being a ^roclamation declaring a state of- emergency to exist throughout the State of California and ddsignating duly constituted officers of the State and of each City and of each City and County and of each County of the State of California as the officer to take charge of this emergency in their respective jurisdictions and to carry into effect plans for civil protection adopted by the State Council of DPfPnse an-4 by local Councils of Defense. WRIGH & BEC R, dated December 17th, 1941, transmitting therewith Cashier's Check No. 306163, dated December 17th, 1941, in the sum of $1100.00, drawn payable to the order of the City of E1 Segundo, upon the 39th and '"Testern Branch of Security -1st National Bank of Los Angeles, together with receipted invoices aggregating•$6198.54, indicating the payment of that sum to Harvey-B. Adair, the contractor who installed certain street improvements - in Tract 12812 within the City of El Segundo, and requesting that in view of the said payments to the said contractor, and the deposit at this time of $1100.00, that their original deposit of $7200.00 heretofore made, be released. Moved by Councilman Gerow, seconded by C ouncilman Hesser, that the communication of Wright and Becker, dated December 17th, 1941, asking for the return to them of a Cashier's Check in the sum of $7200.00 and the substitution therefor of a dashier's Check in the sum of $1100.00, together with the. Contractor's receipts showing payment of $6198.54 in connection with public improvements installed in Tract 12812, be received and placed on file in the office of the City Clerk for the purpose of identification and reference; that the City* Clerk be and he is hereby authorized and directed to return to "! -in-ht & Becker said firm's original deposit check of $7200.00 and that its check in the sur, of $1100.00 be held for the same purposes and on the same terms and conditions under , ^.hich the original $7200.00 deposit was made and retained by order of this Council. Argo addressed the Council, requesting employment by the City of E1 Segundo and he was advised by the Mayor that there are no vacancies in prospect. However, he was furnished an application for employment, which he was instructed to fill in and deliver to the City Clerk. -w p; 1180 None. REPORTS OF STANDING COMITTEFS. REPORTS OF OFFICERS AYD SPECL4L COMMITTEES. Councilman Gerow reported that the holiday street decorations are practically completed with the exception of decorating the front of the City Hall. Councilman Love of the Public Works Committee, to whom was referred the matter of investigating the.advisability of repairing the alley in that certain bloc: bounded by Grand Avenue, Richmond Street, Holly Avenue and Main Street, reported that it is possible to make a satisfactory improvement at a cost of X100.00. Discussion followed and it appearing therefrom that such an improvement :+:ould be contrary to the policy heretofore adopted.by this Council with respect to irrnroving public alleys, it was decided, by general consent, that the Street Superintendent be instructed to repair only the northerly portion of said alley ,,,here it intersects Holly Avenue. Councilman Hesser of the Public Sa`_'ety Committee, to whom was referred the matter of investigating the desirability of installing traffic stop signs at the interjection of Loma Vista Street with Palm Avenue, reported that, he and Chief of Police Hutchins had made such investigation, as a result of which they con- cluded that the proper trimming of a hedge situated at the Northeast corner of Palm Avenue and Loija Vista Street would improve visibility of motorists to such an extent that traffic accidents should not occur at said intersection, and that such trimming would eliminate the erection of stop signs at the location. He stated further that the Chief of Police is now endeavoring to induce the o7.ner of the property to cause the hedge referred to to be satisfactorily trimmed. .The Chief of Police thereupon announced the revocations,of the appointments of the appointments of the following named persons heretofore appointed Special Police Officers of the City of E1 Segundo, such revocations effective as of December 17th, 1941: H. 0. Hartley, i. Daniels, L. C. Hellman, P. J. Pennoyer, C. L. Green, R. L. Albrecht, E. E. Hancock, R. R. Stockburger and R. L. Barham. The Chief of Police announced the appointments of certain persons as Special ?olice Officers of the City of E1,Segundo and requested the Council's approval d' such appointments. Moved by Councilman Hesser, seconded by Councilman Love, that the appointments by the Chief of Police of the City of El Segundo of Francis E. Sturm, William Z. Tarrant, George Ernest Jordan, and Maxwell Norman Stabeck as Special Police Officers of said City, be and the same are hereby ratified, approved and confirmed. Carried. In the matter of the disposition of certain instruments of conveyance heretofore tendered the City by Santa Fe Land Improvement Company and by The Atchison, Topeka and Santa Fe Railway Company, the Council directed the City Clerk to inform these Companies that the City of El Segundo is continuing its negotiations with other Ccmpanies who have been asked to make grants to the City, so that the improvements contemplated at,the time Santa Fe Land Improvement Company and the Atchison, Tope'-ca and Santa Fe Railway Company made its tenders, may be prosecuted and completed, and to request that the Companies last named grant the City an extension of time to February lst, 194Q,.to complete such pending negotiations. In the matter of discussions and commune cations heretofore had with Interst-te Engineering and Aircraft Corporation with respect to its dedication to the City of El Segundo of a portion of.its frontage for the purpose of widening and improvi n€ Imperial Highway, between Sgpulveda Boulevard and Ingle::ood- Redondo Road, the Cit;; Attorney : -ras instructed to further confer with the officials of said Company in an endeavor to close the transaction at the earliest possible date and in a manner satisfactory to all parties concerned. City Attorney 'l+ood-uorth reported having referred to the Bureau of Power and Light of the Denartment of Public Works of the City of Los Angeles a copy of P list Ordinance No. 251 as the same was introduced ,by Council ari Gerow at the last regular meeting of this Council and that said Bureau of Power and Light had re- quested hin: to make a number of changes therein, which changes he thereupon explained to the Council. Councilman Gerow thereupon reintroduced Ordinance No. 251, as corrected, which said ordinance is entitled: AN ORDINANCE OF THE CITY OF EL SEGUNDO, CALIFORNIA, GIVING AND GRANTING THE CONSENT OF SAID CITY TO THE INSTALLATION-OF A CERTAIN WATER LINE WITHIN SAID CITY OF EL SEGUNDO BY THE DEPA.RT1ENT OF ;17ATER AND PO'.�JER OF THE CITY OF LOS ANGELES IN AND ACROSS CERTAIN OF THE PUBLIC STREETS ,TIT_ -= SAID CITY OF EL SEGUNDO, and which was read. City Attorney Woodworth reported having had a telephone conversation with Mr. McDonough, the owner of Lot 7, Block 105, El Segundo, a portion-of which the City of E1 Segundo proposes to purchase for storm water control purposes, and that as a result of such conversation he expects to have all documents in connection with the transaction prepared and ready for presentation to this Council at its next regular meeting. The City Attorney reported having had referred to him certain documents in connection with the sale and assignment by Caminol Company, Ltd. of certain of its oil wells within the City of El Segundo to 0 & B Oil Company, which documents are in satisfactory form and w1lich were necessary to complete the assignment and ,transfer in a manner satisfactory to the City of El.-Segundo and in conformity with its policies and practices respecting transfer and assignment of oil wells, and that he had :prepared and now presents to the Council for its consideration certain form of resolution respecting the transaction. Thereafter it was moved by Councilman Gerow, seconded by Councilman Iiesser, tht *the following resolution be adopted: P 1182 WHERE S, The Caminol Company, Ltd., did heretofore assign to J. Y. Owen and R. J. Berryman, all of the right, title and interest of said assignor in and to those certain oil wells known as "The Caminol Company, Ltd. El Segundo No. 1" and "The Caminol Ccmpan�,, Ltd. E1 Segundo No. 2 ", located upon real property in the City of E1 Segundo, County of Los Angeles, State of California, together with the respective permits for said respective wells issued by the City of El Segundo; AND "T.zLREAS, thereafter said J. Y. Owen and R. J. Berryman, sold, assigned and transferred to 0. & B. Oil Company, a co- partnership, consisting, of J. M. Owen and R. J. In the natter of the construction of ramps adjacent to curb returns at the corners -of Ric'imbnd Street and Franklin Avenue and Richmond Street and Grand Avenue, the Cit;; Engineer explained that the installation of pipes to carry storm_ waters wider the ramps instead of around them viould increase the cost considerably. In the matter of the extension'of'Douglas Avenue adross the right of way of Atcr.is�n, Topeka and Santa Fe Railway Company to Inglet } ood- Red -ndd Road, the City Engineer reported that Douglas Aircraft Corporation has requested that the City cf E1 Sesndc petition the Railroad Commission of the State of California to waive the requirements that automatic wig -A-a g signals be installed at such crossing. Thereafter, by general consent, the Council determined that such an application should be filed and the City Attorney was authorized and directed to prepare the appropriate documents� the proper officers of the City of E1 Segundo were authorized and directed ' to sign the same on behalf of the City of El Segundo and to cause the same to be filed' with the Railroad Commission. The City Engineer reported 'receipt of a communication from Wright & Becker, ;sated December 16th, 1941, requesting 'that street lights be installed in the intersections in Tract No. 12812,'wherevef the Engineering Department deems advisable. By general consent the matter was referred to Councilman Love and City Engineer Hutchins for investigation and report. The City Engineer advised that 9riglit & Becker had requested permits to install sidewalks in Bungalow Drive,'bet;veen Palm Avenue and +Mariposa Avenue, in accordance with a certain sketch said firm had filed with the City Engineer and which is dated December 16th, 1941. The matter was given consideration dnd the sketch submitted was examined, after which it was moved by Councilman Gerow,'seconded by Councilman Hesser, that "right w- Becker be granted permisdioii to install side�lalks on both sides of Bungalow Drive, between Palm Avenue and Maftpdsa Avenud, in the City of E1 Segundo, in accordance with sketch thereof dubmitted to this Council this date, provided, however, that* said sidewalks shall be installdd in accordance with specifications for side -• walks heretofore adopted by the City'Council dnd provided further, that any such installation shall be prosecuted and completed to the satisfaction of the Street Superintendent of the Cit,Y of El Segundo. The Chief of Police advised the Coun ^il that Pierson- DeLane, the firm which has Been servicing the radio equipment of the Police Department of the City of E1 Segundo, will be unable to service the same after December 31st, 1941; that investiga- ticns made by hir, discloses that the only radio service man in this vicinity equipped P 1185 to and capable of satisfactorily servicing the radio equipment of this City on a 24 -hour basis is Mill Zillgitt of Inglewood, who proposes to furnish all labor required in connection with any such servicing on a flat rate basis of $25.00 per month, plus material charges for such parts or equipment as may be necessary. Following discussion, it was moved by Councilman Love, seconded by Councilman Messer, that-the Chief of Police of the City of E1 Segundo be and he is hereby authorized and directed to make arrangements with Mill Zillgitt of Inglewood to service the police radio equipment.of the City of El Segundo on a month to month basis, at the cost of 425.00 per month for labor; parts, material and equipment needed in connection with such servicing to be paid for additionally. Carried by the following vote: Ayes: Councilmen Gerow, Hesser, Love, Selby* and Mayor Binder. Does: Councilmen None. Absent: Councilmen None. The Chief of Police reported to the Council that the telephone line into the police station has been seriously overburdened by reason of the increased number of calls due to the war emergency and defense work, and he recommended the installation of an additional telephone. Following discussion, during which the necessity for having an open line at- all times for emergency use was evidenced, it was moved by Councilman Gerow, seconded by Councilman Love, that the City Clerk be and he is hereby authorized and directed to place and order with Southern California Telephone Company for the installation_ of an additional business telephone for the use of the Police De- =tment of the City of E1 Segundo. Carried by the following vote: Ayes: Councilmen Gerow, Hesser, Love, Selby and Mayor Binder. Noes: Councilman None. Absent: Councilmen. None. The City Engineer advised the Council that he had had a conversation this date with Mr. Blum.of the Division of Oil and Gas of the Department of Natural Resources of the .State of California, during which.conversation Mr. Blum informed him that certain oil companies are disposing of salt water from their wells by wastinz the same into abandoned oil wells, presumably at a point below 1000 feet. It appearing that there could be no certainty that such salt water is actually filtering away at the stated depth below the surface of the ground and also that there could be no certainty that such disposal method might not in ti,:,e contaminate the fresh water supply of the City of E1 Segundo, and it appearing also that such practice is contrary to existing ordinances of the City of El Segundo, said City Engineer was instructed to so advise the Division of Oil and Gas and to request that permits heretofore granted by it for salt water disposal in the manner indicated; be cancelled. No further business appearing to be transacted at this meeting, it was moved by Councilman Gerow, seconded by Councilman Hesser, the meeting adjourn until the hour of 7:00 P.
