A regular meeting of the City Council of the City of El Segundo, California, was held in the Council Chamber of the City Hall of said City on the above date, having been called to order at 7:00 o'clock P. M. by Peter E. Binder, Mayor. ROLL CALL. Councilmen Present: Gerow, Hesser, Love, Selby and Mayor Binder. Councilmen Absent: None. Other Officers Present: Clyde Woodworth - City Attorney. R. T. Hutchins - City Engineer. A. R. Gunn - Street Superintendent.. Bernard Lawler - Special City Attorney. Victor D. McCarthy - City* Clerk. READING OF MINUTES OF PREVIOUS ftEETING. The minutes of the regular meeting held on the 2nd day of October, 1940, were read. No errors or omissions appearing, it was moved by Councilman Love, seconded by Councilman Hesser, the minutes be approved as read. Carried. WRITTEN COTRITUNICATIONS. The following communications, which were read to the Council, were disposed of in the manner indicated, following the reference to each hereinafter: RICHFIELD OIL CORPORATION, dated October 7th, 1940, advising of the abandonment of its Elsie No. 2 Well, located on Lots 296 and 305, Block 1239 El Segundo. By general consent the matter was referred to the Building Inspector of the City of El Segundo for investigation and report to this Council as to whether or not such reported abandonment is in accordance with the provisions of the permit issued for the drilling, operation and maintenance of said well. THE PLANNING CONGRESS OF LOS ANGELES COUN'T'Y, undated, advising that its October meeting will be held in Long Beach, Saturday, October 19th, 1940, at which time a complete explanation and report of the "Master Plan of Airports— County of Los Angeles" and how it effects the cities and communities of the County will be given. Moved by Councilman Selby, seconded by Councilman Gerow, that any member of the City Council, finding it convenient to do so, is hereby authorized to attend the meeting of the Planning Congress of Los Angeles County, to be held in Long Beach, Saturday, October 19th, and to file his demand for his actual and necessary expenses in connection therewith, such demand to be audited and approved in the regular manner before payment. LOS ANGELES COUNTY DIVISION, LEAGUE OF CALIFORNIA CITIES, dated October 4th, 1940, announcing the holding of its 110th regular'meeting at El i:ionte, California, October 17th, 1940. Moved by Councilman Selby, seconded by Councilman Love, that Mayor Binder and Assistant City Engineer Frank Chilson be authorized to attend the meeting of the Los Angeles County Division, League of California Cities, at El.Monte, California, October 17th, 1940, and to file their demands for their actual and necessary expenses in connection therewith, such demands to be audited and approved in the usual manner before payment. GLADDING, dated October 4th, 1940, being an application for appointment to the office of City Judge of the City of El Segundo. Ordered filed. HERBERT STRIBLING, dated October 4th, 1940, an application for a permit to make a longitudinal excavation in East Walnut Avenue, for the purpose of installing an 8" vitrified pipe sewer line, for a distance of approximately 175 feet easterly of the westerly line of Sepulveda Boulevard. 1r. Stribling, who was present at the meeting, requested,Permission to with- draw said i�rritten application, and he verbally requested a permit to make a lateral cut in East 'alnut Avenue, adjacent to Sepulveda Boulevard, for the purpose of connecting a sewer line which he will construct on private property with the trunk line sewer in Sepulveda Boulevard, in accordance with a sketch thereof he exhibited to the Council. After discussion, it was moved by Councilman Hesser and seconded by Councilman Selby, that the following resolution be adopted: RESOLVED, that the sketch showing location and extent of the proposed excavation to be made in East Walnut Avenue by Mr. Herbert Stribling, for the purpose pf connecting a sewer lateral, to be located on private property, to the municipal sewage - system and which sketch shows the location and extent of the. said excavation_ by inked shading, be placed on file in the office of the City Clerk for purposes of identification and reference; . AND, BE I1T FURTHER RESOLVED, that permission be and the same is hereby granted to said Herbert Stribling to make said excavation and -to install therein a 6" vitrified clay sanitary sewer pipe and connect the same with the municipal sewage system of the City of El Segundo at .said location, all of such work to be done under the supervision and to the satisfaction of the City Engineer and Street Superintendent of said City; provided, however, that this permission is granted subject to the following terms or conditions, to -wit: First. That said permittee must procure, at his own cost and expense, any and all easements or rights of way for said private sewer lateral upon any private property effected; and . Second. That nothing herein contained shall operate or be considered as operating to relieve or exempt any property served or effected by such private sewer lateral from payment of its just, fair and proper share of any cost of any municipal sanitary sewer lateral which may be subsequently placed in said East Walnut Avenue. LOS ANGELES COUNTY HEALTH DEPARTMENT, entitled: "Release No. 86 ", undated, but stamped received October 7th, 1940, containing statements made by Dr. J. L. Pomeroy, County Health Officer, respecting the recommendation in the United States Public Health Service survey of Los Angeles City Health Department, that use be made in this Metropolitan District of the California Local Health District Law. Ordered filed. P 746 ORAL COMIaUNICATIONS. Mr. W. R. Hickman addressed the Council, requesting that the Street Superin- tendent be instructed to dispose of ice plant trimmings which he is cleaning from certain unimproved real property in.Loma Vista Street between Grand Avenue and Franklin Avenue. It appearing from the Council's questioning of Mr. Hickman and Street Superintendent Gunn that the quantity of ice plant trimmings to be disposed of is greatly in excess of that which the City could reasonably be expected to remove, the request was denied, except that the Street Superintendent was authorized and directed, by general consent, to dispose of such trimmings as already have been deposited in the public street. Mr. J. W. Pinkerton advised the Council that the private roadway heretofore utilized by him across the easterly half of Section 7, within the City of El Segundo, to afford ingress and egress to and from his home on Duley Road in sr_; Section, has been :Wade impassable by plowing and he inquired whether or not the Council could provide another inlet and outlet for his use during the cominE- winter months. It appearing from the discussion which followed that the roadway formerly used ran through the Arivate property of Dr. A. S. Gough, who had no objection to its use other than that it might be considered a public road after continued and uninterrupted use for a period of time, and it appearing also that the owner's rights would not be prejudic9d by such use if the same were properly sign posted, and Mr. Pinkerton having agreed to make and erect or pay the cost of making and erecting such signs as would protect the owner's interests provided the owner of said property will consent to the use of said private roadway and the erection of said signs, the City Clerk, by general consent, was requested to communicate with Dr. Gough respecting the matter and to report to this Council the result of such communication. REPORTS OF STANDING COMMITTEES. Councilman Love reported that he and Councilman Gerow and City Engineer Hutchins had this day made a survey of the City of'E1 Segundo can dump, which is rapidly filling up, and that as it is quite evident additional or new space for the disposal of cans must be provided in the near future. He stated, however, that the proposition will require some study and that he is not prepared to make a recommendation at this time. Councilman Love reported also that the same group had inv6stigated a condition in Northrop Street, which permits dust, developed when vehicles use the unimproved portion of said street, to blow into_the Interstate Engineering Corporation shops and which has been complained of by said Company. By general consent the Street Superintendent was requested to submit to this Council an estimate of the cost of.oiling that portion of said Northrop Street which is unimproved and which is the source of the complaint mentioned, and to file the same with this Council at its next meeting. REPORTS OF OFFICERS AND SPECIAL COMMITTEES. The City Clerk reported that Mr. Weber of National Youth Administration, had advised him of the appointment of Mr. A. J. Sullivan as Superintendent of construction of El Segundo Public Library and that the said Administration also has made arrangements for a crew of workmen to be on the job to open the project P onday, October 14th. The City Clerk stated also that there had•been delivered to him from the offices of John C. Austin, Architect, a set of plans and specifications covering the construction of E1 Segundo Public Library, whereupon it was moved by Councilman Selby, seconded by Councilman Gerow, that the following resolution be adopted: WHEREAS, the City of E1 Segundo has heretofore filed with National Youth Administration a project application for P` X4`7 the construction of a public library building in and for the City of E1 Segundo; AND, WHEREAS, said application has been approved by said National Youth Administration and this Council is presently in- formed that arrangements have been made for the commencement of said work October 14th, 1940; AND, WHEREAS, John C. Austin, the architect employed by the City of E1 Segundo to prepare plans and specifications for said El Segundo Public Library, which is to be constructed by National Youth Administration as aforesaid, has prepared said nlans and specifications and same are now presented to this Council for approval and acceptance; NOW, THEREFORE, BE.IT RESOLVED, that those certain plans prepared by John C. Austin and Frederick h4. Ashley, Architects of Los Angeles, California, designated "Foundation Plan and Details - El Segundo Public Library, E1 Segundo, California - Job No. 735 ", Sheets 1 to 11 inclusive and Sheets M 1, M 2 and M 3, and Specifica- tions entitled "Specifications for E1 Segundo Public Library ", be and the same are hereby approved and adopted.as the Plans and Specifications for the construction of El Segundo Public Library Building hereinbefore referred to. The City Attorney reported with respect to the present status of Douglas Avenue abandonment proceeding, stating that all procedures to date have the anproval of the Title Company and that at this time.if the Council cares to do so, it may introduce its ordinance ordering the abandonment, such ordinance having been prepared by him and delivered to the City Clerk for presentation at the proper time and at the Council's pleasure. Thereupon the City Clerk announced that no objections to the abandonment of Douglas Avenue have been made to or filed with him, either verbal or written. The Mayor then inquired whether there was any person in the Council Chamber who desired to make any objection to the abandonment of Douglas Avenue as proposed under Resolution of Intention No. 509. No person responding, Councilman Hesser introduced Ordinance No. 237, entitled: AN ORDINANCE OF THE CITY OF EL SEGUNDO, CALIFORNIA, DECLARING VACANT FOR PUBLIC STREET PURPOSES A CERTAIN PORTION OF DOUGLAS AVENUE WITHIN THE SAID CITY, AS CONTMIPLATED BY RESOLUTION OF INTENTION NO. 509, which was read. UNFINISHED BUSINESS. Moved by Councilman Selby, seconded by Councilman Hesser, that. Ordinance No. 236, entitled: AN ORDINANCE OF THE CITY OF EL SEGUNDO, CALIFORNIA, REGULATING THE ESTABLISHMENT AND OPERATION OF REST HOIv cS , E_QAP.DING HOK28 S , HOSPITALS, SANITARIUMS OR S NITORIU1JS IN SAID CI 7, AND_FIXING A PENALTY FOR Try VIOLATION =REOF , which was introduced and read at a regular meeting of this Council held October 2nd, 1940, and reread at this meeting, be adopted. It was thereupon moved by Councilman Selby, seconded by Councilman Love, that upon the taking effect of Ordinance No. 236, regulating the establishment and operation of rest homes, etc. within the City of El Segundo, that copies thereof be furnished Los Angeles County Health Department and that Department be directed to enforce the same in connection with its contract with the City of El Segundo respecting performance of the duties of Health Officer for said City. Carried by the following vote: Ayes: Councilmen Gerow, Hesser, Love, Selby and Mayor Binder. Noes: Councilmen None. Absent: Councilmen None. The City Engineer thereupon presented for the Council's examination, plans prepared by him for the improvement of Grand Avenue between Eucalyptus Drive and Sepulveda Boulevard. The plans appearing to be satisfactory to the Council, said Engineer was instructed to present them at the next meeting of the Council, together with specifications for doing the work of improvement, at which time the Council would consider adopting said plans and such specifications as are prepared as the plans and specifications for the improvement of Grand Avenue between Eucalyptus Drive and Sepulveda Boulevard. In connection with the proposed improvement of Grand Avenue, it appeared desirable that the City do certain preliminary work in the roadway thereof, whereupon it was moved by Councilman Selby, seconded by Councilman Gerow, that the Street Superintendent be authorized and directed to cause portions of Grand Avenue between Eucalyptus Drive and Sepulveda Boulevard to be planed at a cost of not to exceed $400.00, same to be charged against the Special Gas Tax Street Improvement Fund. Carried by the following vote: Ayes: Councilmen Gerow, Hesser, Love, Selby and Mayor Binder. Noes: Councilmen None. Absent: Councilmen None. It was then moved by Councilman Love, seconded by Councilman Selby, that the Street Superintendent be authorized and directed to condition the shoulders of Grand Avenue between Eucalyptus Drive and Sepulveda Boulevard, where.necessary, and to treat the soft spots which will appear after planing, all in preparation for surfacing the same, in accordance with plans and specifications therefor now in process of completion in the Engineering Department of the City of E1 Segundo, the cost in connection with this work to be a charge against the Special Gas Tax Street Improvement Fund. Cummings, Captain, El Segundo Police Department, be and he is hereby granted one week's leave of absence, without pay, beginning October 14th, 1940. Chief of Police Hutchins requested the appointment of Officer T. B. DeBerry as Acting Captain of Police during the absence of Captain Cummings, whereupon it was moved by Councilman Love, seconded by Councilman Selby, that the recommendation of the Chief of Police that T. B. DeBerry be designated Acting Captain of Police of the City of E1 Segundo during the 1940 vacation absence of.Captain Cummings be and the same is hereby approved and consented to. Chief of Police Hutchins requested permission to absent himself from the City of E1 Segundo during Saturday and Sunday, October 12th and 13th, 1940, and there appearing to be no objection thereto., such permission was granted by general1consent.. Special City Attorney Bernard Lawler addressed the Council, stating that he had received a request from the County E'ngineer's office that the City Council of the City of E1 Segundo adopt a resolution agreeing not to dispose of properties which it may acquire from the State of California, or such portions of such property as may be effected by the Master Plan of Los Angeles County highways. He exdlained that immediate adoption of such P; '750 a resolution is requested to enable the County Engineering Office to make a report to-the Board of Supervisors Tuesday next, which report will be incomplete unless such resolution is adopted by*this Council.
