May 15th, 1940.
A regular meeting of the City Council of the City of El Segundo, California,
was held in the Council Chamber of the City Hall of said City on the above date,
having been called to order at 7:00 P. M. by Peter E. Binder, Mayor.
ROLL CALL. .
Councilmen Present: Gerow, Hesser, Love, Selby and Mayor Binder.
Councilmen Absent: None.
Other Officers Present:

READING OF MINUTES OF PREVIOUS MEETING.
The minutes of the regular meeting held on the 8th day of May, 1940,
were read. No errors or omissions appearing, it was moved by Councilman Love,
seconded by Councilman Gerow, the minutes be approved as read. Carried.
WRITTEN COMMUNICATIONS.
The following communications, which were read to the Council, were
disposed of in the manner indicated, following the reference to each herein-
after:
LYLE W. PENN, dated May 14th, 1940, being an application for employment
by the City of E1 Segundo. Ordered filed.
LEAGUE OF CALIFORNIA CITIES, dated May 13th, 1940, acknowledging receipt
of a copy of the Council's resolution endorsing a proposed amendment to
Assembly Bill No. 47, having reference to procedure which will restore tax
deeded property to the tax rolls, stating-that the matter will be considered
by the Legislative Committee of the League-at a meeting of said Committee to
be held Wednesday, May 15th, 1940, and that thereafter the cities interested
in the proposed bill will be furnished a statement of the conclusions
reached-by said Committee. Ordered filed.
HONORABLE ROBERT W. KENNY, Senator for Los Angeles County, dated May
13th, 1940, acknowledging receipt of a copy of this Council's resolution
respecting an amendment to Assembly Bill No. 47, stating that the matter
will be taken under consideration by a committee of-which he is a member,
and that said proposed amendment will receive his careful consideration.

MR. 0. A. SMITH, President, Pacific Electric Railway Company, - advising
that he will meet City representatives at E1 Segundo, Friday, May 17th, for
the purpose of discussing the problem of improving Grand Avenue between Main
Street and Eucalyptus Drive, in the center of which said Company has its
right of way. By general consent it was understood that the members of
the City Council, the City Engineer and /or the Assistant City Engineer, the
City Attorney and the City Clerk would attend the conference and the communica-
tion was ordered filed.
ORAL COMMUNICATIONS.
Mr. Edward J. Olstyn of the University of Southern California,
addressed the Council with reference to the 12th annual Institute of Government,
which will be held on the campus of the University at Los Angeles, June
10th to 14th, 1940, and urging this City's usual cooperation and participation.
He was advised by the Mayor that the matter would be given the consideration
it deserves.

Mr. H. J. Collins of 2206 Overland Avenue, best Los Angeles, addressed the
Council, requesting that it amend its ordinance regulating certain kinds of
business on the West side of Sepulveda Boulevard, so that he might engage in
the business of selling live and dressed poultry at a location on said Boulevard
between Walnut Avenue and Mariposa Avenue.
Following a discussion, in which the gentleman was asked to estimate the
quantity he might expect to handle in any one day; his-experience in the
business; about the sanitary arrangement of the building he proposes to occupy;
how he proposes disposing of the offal so as not to create a nuisance, etc.,
it was moved by Mayor Binder, seconded by Councilman Selby, that the City Clerk
be instructed to communicate with the Health .Officer of the City of E1 Segundo,
requesting that officer to submit to this Council his recommendation with
respect to amending existing ordinances of the City of El Segundo, so as to
permit of the slaughter and sale of fowls and /or other small animals within
the City of E1 Segundo. Carried.

REPORTS OF STANDING COMMITTEES.
REPORTS OF OFFICERS AND SPECIAL COMMITTEES.
The Park Department and Street Department 1940.Vacation Schedules, as
recommended by C. L. McIlwaine and A. R. Gunn, Superintendents of the
Departments respectively, were presented to the Council for approval, where-
upon it was moved by Councilman Hesser, seconded by Councilman Love, that
the Vacation Schedules for the Year 1940, for employees of the Park and Street
Departments of the City of E1 Segundo, as prepared by the Park Superintendent
and Street Superintendent respectively, be and the same are hereby adopted
as the Vacation Schedule for employees of these Departments for the Year 1940;
provided, however, that such schedules may be altered by the heads of the
Departments effected to suit the interest and convenience of said Departments
and of the public, and provided further, that in event of deviation from the
schedules as filed this date, a memorandum thereof be filed with the City Clerk
for attachment to the Vacation.Schedules hereby adopted. Carried by the
following vote:

The Chief of Police announced the revocation, as of May 15th, 19409
of the appointment of Marcus L. Edwards as a Special Police Officer of the
City of E1 Segundo.
The Chief of Police announced the appointment of Frank J. Battaglia,
Edward P. Burns, Virgil B. Fields and Hugh C. Walters as Special Police
Officers and requested the Council's approval of said appointments. Moved
by Councilman Love, seconded by Councilman Hesser, that the appointment by
the Chief of Police of the City of E1 Segundo of Frank J. Battaglia, Edward
P. Burns, Virgil B. Fields and Hugh C. Walters as Special Police Officers of
the City of E1 Segundo be and the same are hereby ratified and approved.
Carried.
The City Attorney reported having prepared, pursuant to instruction
of the Council, a form of resolution for adopting specifications for the
widening and improvement of a portion of Grand Avenue within the City of
E1 Segundo, which he had delivered-to the-City Clerk for action thereon by
the Council �.t its pleasure.

which was introduced and read at a regular meeting of this Council held on the

The City Engineer thereupon presented Plans Nos. M- 390910 A and-M-399910 B,
being Plans for the widening and improvement of a portion of Grand Avenue within
the City of El Segundo. After the same had been examined by the Council, it
was moved by Councilman Selby, seconded by Councilman Love, that Plans Nos.
M- 390910 -A and M- 390910B, being plans for the widening and improvement of
Grand Avenue between Concord Street and the Westerly City Limits of the•City
of E1 Segundo, be and the same are hereby approved and ordered placed on file
in the office of the City Engineer of the City of E1 Segundo for identification
and reference. Carried by the following vote:

NEW BUSINESS.
Councilman Hesser expressed the.belief that at all of such times as
sidewalks and curbs are being constructed by- private contractors or private
individuals within the City of El Segundo, an inspector should be on the job
to make sure that the cement concrete mix and the location and dimensions of
the same are in conformity with City specifications with reference thereto. No
action taken.
Moved by Councilman Selby, seconded by Councilman Love, that Park Superin-
tendent C. L. McIlwaine and Foreman of the-Park Department J. G.. Schoening and
Mayor Binder be authorized and directed to attend meetings of the Western Shade
Tree Conference to be held in Los Angeles, May 23rd to 25th,.Inclusive, 1940,
and to file their demands for their actual and necessary expenses in connection
therewith, which demands shall be audited and approved in the regular manner
prior to payment. Carried by the following vote:

WHEREAS, on 4pril'3rd., *1940, ,, -the City Council ,of -the.-
City of El: Segundo sold. to A. -J.- Sullivan - that,.cestain. two
.story.apartment house building owned by the City of E1
Segunda,_,situated ,on Lot -43, Tract 2667, -- within .the City of
E1 Segundo, which said sale was.made pursuant to a.,notice
inviting bids on said apartment house received- on•said date,
at the opening of which bids said A. J. Sullivan-'was found
to be.the.highest bidder;
. -AND, WHEREAS, said resolution of award-- provided, among
other - .things, that the said A. J. Sullivan must have said
apartment house building removed from.the said .lot.within . a
period of thirty days after written notice of the award of
said.building to him;-
AND, WHEREAS,..said written notice was sent to said..A.
J. Sullivan, through the United States mails, April 18th, 1940;
AND, WHEREAS, the thirty day period required for removal
will expire May 18th, 1940 and the said building has not as
yet been removed;
NOW, THEREFORE, BE IT RESOLVED, that A. J. Sullivan be
and he is hereby granted an extension of time to and inclusive
of May 22nd, 1940,'within which`to remove said two story
apartment house building from said Lot -43, Tract 2667.

Moved by Councilman,.Gerow, seconded by Councilman Hesser, that the
following resolution be adopted:
WHEREAS, it has been customary in years past to have
an -open public "ceremony'inn` library Park on Memorial Day
of each year;
AND, WHEREAS, El Segundo 'Post No: 38 of -the Ampriaan
Legion proposes such a ceremony May 30th, 1940, and has
heretofore been granted permission to use Library Park for
such purpose;
AND, WHEREAS, it appears necessary to use a piano in
connection with said event;
NOW THEREFORE, in view of the patriotic nature of suck
ceremony, which all of the public may attend without charge,
BE IT RESOLVED that the Street Superintendent of the City
of E1 Segundo be and he is hereby directed to cause a piano
to be moved from one of the school buildings adjacent to
said Library Park to said Park for use on said date and to
return the same to its usual place of storage after the
conclusion of said ceremony.

The City Clerk reported that ha had just been advised of 'the '
death, on May 14th, 1940, of William C. Bryson, former Councilman and Mayor
of the City of E1 Segundo.
Moved by Councilman Selby, seconded by Councilman Hesser, that
the following resolution be adopted:

NOW, Tom' ORE, BE IT RESOLVED, that "the City Council
of the City of E1 Segundo, California, on behalf of the
individual members of said Council and on behalf of the
public of said City which it represents, does hereby express
regret upon learning of the demise of Mr. Bryson; does
hereby tender-its sincere sympathy to those bereaved; and
does hereby order chronicled upon the offical records of
said City this testimonial to him: He�was unselfish, able,
conscientious and earnest in all of his acts as an official_
of the City of El Segundo and performed them with honor to
himself and with resultant benefit to this City.
The foregoing resolution was adopted by the following vote:
