A regular meeting of the City Council of. the City of E1 Segundo,
California, was held in the Council Chamber of the City Hall of said City,
on the above date, having been called to order at 7:00 P. Y. by Peter E.
Binder, Mayor.

READING OF MINUTES OF PREVIOUS MEETINGS.
The minutes of the regular meeting held. on the 13th day of March, 1940,
were read. No errors or omissions appearing, it was moved by Councilman
Gerow, seconded by Councilman Selby, the minutes be approved as read. Carried.
The minutes of the adjourned regular meeting held on the 18th day of
Larch, 1940, were read, without error or omission being noted. It was moved
by Councilman Selby, seconded by Councilman Gerow, the minutes be approved
as read. Carried.
WRITTEN COMMUNICATICNS.
The following communications, which were read to the Council, were
disposed of in the manner indicated following the reference to each herein-
after:
SOUTH'NF._,ST CITIES FLOOD CONTROL ASSOCIATION, dated March 19th, 1940,
calling a meeting of said Association for Friday, March 22nd, 1940, at
6:30 P. M. at Daniels Cafe, Gardena, in connection with spliciting Federal
aid- in the flood control plan for Los Angeles County and the inclusion in
such plan of the Nigger Slough supplemental plan. Moved by Councilman
Gero?:, seconded by Councilman Hesser, that Mayor Binder and City Engineer
Hutchins be and they are hereby authorized and instructed to attend the
meeting of Southwest Cities Flood Control Association at Gardena, Friday,
March 22nd, 1940, and to file their demand against the City for their actual
and necessary expenses in connection therewith, such demand to be audited
and approved in the regular manner. Carried by the following vote:
Ayes: Councilmen Gerow, Hesser, Selby and Mayor Binder.

WAR DEPARTMENT, BOARD OF ENGINEERS FOR RIVERS AND HARBORS, dated
March 18, 1940, captioned "Public Notice relative to Playa Del Rey,
California ", inviting the submission of statements and arguments bearing upon
the necessity for improving the harbor at Pima Del Rey. Ordered filed.
SOUTHERN CALIFORNIA EDISON COMPANY, LTD., dated March 18th, 1940,
advising that said Company had on said date, filed revised street lighting
rate schedules with the Railroad Commission of the State of California
in accordance with said Commission's decision No. 32834, and transmitting with
said communication a copy of each of,the revised schedules for the classification

under which the City of E1 Segundo receives service, which said new
schedules become effective May lst, 1940. By general consent said
communication and accompanying data were ordered filed in the office of
the City Clerk.
In connection with the foregoing matter, the City Attorney advised
having received from the Railroad Commission of the State of California,
its First Supplementary Order, beinE7 Decision No. 32891, with reference
to Cases Nos. 4337 and 4464, being the street light rate reduction cases,
which SuDDlemental Order he handed the City Clerk, to enable that officer
to correct the original Order on file in his office, after which said
document is to be returned to-the City Attorney for his files.
UNITED AUTObIiOBILE WORKERS OF ;IM-RICA, dated March 15th, 1940,
requesting permission to use a sound equipment within the limits of the
Cite of E1 Segundo. The communication did not state the dates uron which
it is proposed to use said equipment, nor the specific hours of any day
upon which same shall be used, hence after discussion, it -was moved by
Councilman Gerow, seconded by Councilman Selby, that the communication of
United Automobile Workers of America, dated March 15th, 1940, over the
signature of Wyndham Mortimer, International Representative, requesting
permission to use sound equipment within the City of El Segundo, be
received and filed with the City Clerk, and that in view of traffic
conditions on portions of the public streets surrounding the airplane
factory within the City of El Segundo, that action with reference thereto
be deferred until the next.regular meeting of this Council, to enable the
City Clerk to obtain further data with reference to.the time and place
of the proposed use of said equipment. Carried.
. LOS ANGELES C OUN'TY COUNCIL, AFRICAN LEGION, DEPARTDIENT OF
CALIFORNIA, dated February 26th, 1940, making application for permission
to solicit and pick un discarded materials from individuals, firms, etc.
within the City of El Segundo, for its salvage industry, the revenues from
which are used in the operation of the American Legion Service Department,
which handles the welfare work of all World War veterans, their widows,
families and orphans, and in the promotion of its Americanism program,
which includes Child Welfare work and Youth work. By general consent
the communication was ordered received and filed and the City Clerk
instructed to advise the writer that the City of E1 Segundo has no ordinances
bearing upon the subject.
MRS. GEORGE MC;AUGHLIN, undated, acknowledging the Council's
expression of sympathy in the loss of her husband, a,former City employee.

ASSOCIATION OF CITY PLANNERS OF LOS ANGELES COUNTY, dated March
20th, 1940, announcing its first 1940 meeting at Wistaria Vine Gardens,
Sierra Madre, March 30th, 1940, at 12:45 P. M. Ordered filed.
SPECIAL ORDER OF BUSINESS.
The hour of 7:15 o'clock P. M. at this meeting having heretofore
been fixed as the time and place for receiving bids for drainage excavating
as advertised for, the b"ayor announced the arrival of the hour of 7:14
o'clock P. I.T. and stated that any person or persons present desiring to file
bids for drainage excavating, should do so immediately.
, The hour of.7:15 o'clock P. M. having arrived and.all bids being
in, the Mayor announced the time for receiving bids for drainage excavating,
as advertised for, closed.
The Clerk announced that three bids had been received, whereupon
it was moved by Councilman Selby, seconded by Councilman Gerow, that the
Council Droceed.to open, examine and publicly ddelare all bids received
this date for furnishing all labor, machinery, tools, supplies and equipment
for the excavation of approximately 4300 feet of sewer drainage as advertised
for. Carried.

The Council thereupon proceeded to open, examine and publicly declare all
bids received this date for furnishing all labor, machinery, tools, supplies
and equipment necessary for drainage excavating as advertised for, which said
bids were found by said Council to be as follows, to -wit:

The bid of J. Kruly was accompanied by Bidder's Bond in amount of $200.00,
with J. L. Kruly as Principal and Maryland Casualty Company as Surety.
The bid of G. A. Reichert was accompanied by Certified Check No. 1366,
drawn on Citizens National Trust and Savings Bank, Lincoln Heights Branch, payable
to City of El Segundo in the sum of $370.00.
The bid 'of Vusich & Chutuk was not accompanied by a Bid Bond or deposit as
requested in the Notice to Bidders and Mr. N. J. Chutuck, representing the firmf
who was present in the.Council Chamber, was questioned with reference to the
omission. He stated. that he had procured a bond but that in hi's haste to reach
the meeting in time to present and file his bid, he had inadvertently neglected
to enclose the bond, which was at his home.
It appearing that Mr. Chutuck had previously done contract work for the
City of El Segundo and that such work had proven satisfactory in all respects
and the Council believing the firm of Vuksich & Chutuk to be a responsible
contracting firm, it was, by general consent, in view,of the explanation given,
decided to excuse the failure of the bidder Vuksich & Chutuk to enclose a bond
or check with its bid and to consider said bid along with others received.
Thereafter, it was moved by Councilman Gerow, seconded by Councilman Selby,
that all bids received this date for draininage excavating in and for the City
of El Segundo, be taken under advisement until later in this meeting and that
in the meantime, they be referred to the City Engineer for checking. Carried.
ORAL CO1201UNICATIONS.
Yessrs. William P. Goodman of 234 East 84th Street, Los Angeles, and
Elmer Freitag of 312 East Hazel Street, Inglewood, each addressed the Council,
stating they represented local Union No. 683 of the Amalgamated Aircraft Workers
and. they inquired whether or not the Council had received a•letter requesting
a permi_t.to operate sound, equipment adjacent to the airplane faptgries within
the City of El Segundo for the purpose of organizing the workers and advising
them with respect thereto.
The Mayor advised the gentlemen that such a letter had.been received
and that the Council had earlier in the meeting taken the matter under advise-
ment for one week due to the fact that the communication contained no information
as to location proposed to be used, or the date and time'of such use, which

information.the City Clerk had been instructed to endeavor to obtain from
the person who made the application for the permit.
The gentlemen then explained that they had authority to represent the
applicant; that the use of the sound equipment was intended for the benefit
of their particular union; that the equipment would be used one day per week
only and between the hour of 12:00 o'clock Noon and 12:30 o'clock P. M., and
between 8:00 o'clock P. M. and 8230 o'clock P. M.
Following a further discussion of the subject, it was moved by Councilman
frerow, seconded by Councilman Selby, that the action of this Council hereto-
fore taken at this meeting respecting the application of Wyndham Mortimer,
International Representative, United Automobile Workers of America, for a
permit to operate sound equipment within the City of E1 Segundo, be rescinded
and the matter reconsidered by this Council at this time. Carried.
Following such reconsideration, it Inas moved by Councilmah Gerow,
seconded by Councilman Selby, that the following resolution be adopted: '
RESOLVED, that a permit, under the provisions of
Or:;-inance No. 205 of the City of El'Segundo, and ordinances
amendatory thereof br supplementary thereto, be and the same
is hereby granted -to- United Automobile Workers of America',
-pursuant to its applicatioh dated March 15th, 1940, on file;
provided, however, that this permit is granted upon and subject
to each and all of the following terms and conditions', which
must be accepted, met and observed by the permittee, to -wit:
1. That this permit is temporary only and 'is revocable
at any time by the City Council of the City of E1 Segundo,
California, without notice, without cause and without
liability on the part of said City or any of its officers,
agents, servants or employees.
2.. That. the permission herein granted is for use of
the sound equipment referred to in the said application on
file and which is hereby referred to and made a part hereof
for the following periods, only: From 12:00 Noon to •12:30
P. M. and from 8:00 P. M. to 8:30 P. M. of each Thursday of
each week hereafter until the further order of this Council.
3. That permittee must conduct the activities referred
to in connection with said sound equipment and shall use such
sound equipment in such manner so as not to in any way con-
stitute the same'a nuisance or create any nuisance in connection
therewith.
4. That this permit.shall not become effective unless
and until the'permittee shall.have signed and filed a copy-
of this resolution with the City Clerk, accepting the same,
subject to the terms and conditions herein expressed and agreeing
to be bound thereby.
The foregoing resolution was adopted by the following vote:
Ayes: Councilmen Gerow, Hessdr, Selby and Mayor Binder,
Noes: Councilmen None.,

At this point, the hour being 8:10 P. M., the City Engineer reported
that he had completed his check of the bids received this date for furnishing
the City of E1 Segundo all labor, machinery, tools and equipment for drainage
excavating within the City of E1 Segundo as advertised for and that J. Kruly
is the lowest bidder. Thereupon, it was moved by Councilman Hesser, seconded
by Councilman Selby, that Resolution No. 492, entitled:

REPORTS OF STANDING COMMITTEES.
Councilman Gerow of the Public Works Committee, reported that he and
City Engineer Hutchins had investigated the traffic hazard and other matters
mentioned in a communication received by Mayor Binder from Mrs. Sarah
Federson at 913 East Grand Avenue, El Segundo, which letter the Mayor had
shown to members of the Council and he recommended the erection of a suitable
sign adjacent to Mrs. Federson's home for the purpose of attempting to
control motor vehicle speed in that vicinity.
Following such report, it was moved by Councilman Selby, seconded by
Councilman Hesser, that.the matter of alleviating the conditions mentioned
in a communication received by.Mayor Binder from Mrs. Sarah Federson, be
referred to Councilman Gerow of the Public Works Committee and to the
Chief of Police for such action as their discretion dictates. Carried.
Councilman Gerow of the Public Works Committee, reported that Mr.
C. E. Kenney had asked him to convey to the Council Mr. Kenney's desire
that a goose neck street light fixture at Walnut Avenue and Penn Street be
changed to a center suspension fixture. By general consent it was decided
that the Council, at its earliest convenience, will make a night inspection
of El Segundo street lighting and thereafter take action with reference to
hr. Kenney's request.
REPORTS OF OFFICERS AND SPECIAL COMMITTEES.
The Street Superintendent reported having received from Asphalt
Pavement Planing Company, its quotation, in writing, of 3 -3/4o per square
yard for planing Richmond Street, betT.een E1 Segundo Boulevard and Grand
Avenue and portions of Grand Avenue from Eucalyptus Drive to Lomita Street.
Following discussion of the matter, it was moved by Councilman
Selby, seconded by Councilman Gerow, that the Street Superintendent of
the City of E1 Segundo be and he is hereby authorized and directed to employ
Asphalt Pavement Planing Company to plane Richmond Street, between E1 Segundo
Boulevard and Grand Avenue, and portions of Grand Avenue from Eucalyptus
Drive to Lomita Street, at a total cost of not to exceed $450.00, it
being understood.that said Street Superintendent shall have authority to
stop the work of planing said streets at any time during the operation
in event he finds that the work is not being satisfactorily prosecuted
or that it will not satisfactorily accomplish the ends in view. Carried
by the following vote:
Ayes: Councilmen Gerow, Hesser, Selby and Mayor Binder.
Noes: Councilmen None.
Absent: Councilman Love.
The City Clerk reported that the City of Manhattan.Beach had requested
permission to dump non - combustible rubbish at the City of E1 Segundo can
dump on Friday, March 22nd, 1940, due to the fact that the City of Manhattan
Beach temporarily has'no disposal place for its non - combustible rubbish, and
this accomodation would give it sufficient time to seek and arrange for a
dumping ground.

Moved by Councilman Gerow, seconded by Councilman Hesser, that the
City of Manhattan Beach be and it is hereby granted permission to dump
non - combustible rubbish on the City of E1 Segundo can dump, on Friday,
March 22nd, 1940, such permission being granted to said City for this one
day only as an accomodation in an emergency now confronting said City.
Carried.
The City Clerk advised the Council that its boiler explosion policy
will expire April 15th, 1940, that the premium on a policy with $5,000.00
public liability limits will be 041.75 for a three year period and he
inquired whether or not the Council desired to renew said boiler
explosion policy.
Moved by Councilman Selby, seconded by Councilman Hesser, that the
City Clerk be and he is hereby authorized and directed to procure a public
liability policy in the limit of $5,000.00, indemnifying the City
against loss through bodily injuries as a result of boiler explosion,
respecting that certain boiler used in the heating system of the City
:-fall of the City of El Segundo, said policy to become effective at the
expiration of the existing policy, to -wit: April 15th, 1940, at 12 o'clock
Noon Standard Time, the premium for said policy not to exceed the sum of
$42.00. Carried by the following vote:
Ayes: Councilmen Gerow, Hesser, Selby and Mayor Binder.
Noes: Councilmen None.
Absent: Councilman Love.
The City Attorney reported that he has advised the Bank of America
at Inglewood respecting the Council's action at its last meeting with
reference to the dismissal of an action brought in the Superior Court
of Los Angeles County to foreclose a street assessment lien effecting
Lot 13, Block 105, E1 Segundo, and that he has deposited with said Bank
a dismissal for filing when said Bank may comply with the conditions set
forth in the Council's resolution.
The City.Engineer reported that the lots within the City to be mowed
this year to reduce fire hazards will aggregate 60 acres, after which he
was instructed by the Council to ascertain the cost of doing this work by
private contract.
The City Engineer reported having discussed with Mr. Jones of Work
Projects Administration the matter of a lateral sewer project in certain
areas of the City northerly of Palm Avenue, who stated that such a project
would be acceptable to WPA, as well as sidewalk and curb projects. The
City Engineer was thereupon directed to prepare an estimate of the cost of
materials for_the installation of certain lateral sewers as indicated upon
a certain map which he presented for the Council's examination.
The City Attorney reported that during the week Messrs. Overton
and Schroeder and others representing the owners of the acreage northerly
of the City of El Segundo and the persons who farmed said land, had had a
conference with members of the Council, which said City Attorney attended;
that the owners of said property and those interested in farming the same
had agreed to plant a cover crop on the high knolls and use other means to
prevent, so far as possible, the dust nuisance which occurs during high winds
and that under the circumstances the.file on the subject might now be closed
until the further order of the Council.
The City Engineer reported that his revised estimate of con-
structing toilets at tree Nursery site, using chemical toilets and galvanized
iron exterior for the building without any interior finish is $274.00.
Moved by Councilman Selby, seconded by Councilman Gerow, that the City
Engineer be and he is hereby authorized to cause a galvanized iron building
to be erected on city Nursery property and to install two chemical toilets
and two lavatories therein, the total cost not to exceed the sum of $275.00.
Carried by the following vote:
Ayes: Councilmen Gerow, Hesser, Selby and Mayor Binder.
Noes: Councilmen None.

The City Engineer submitted his estimate of $4834.00 for improving
Grand Avenue, between Lomita Street and Washington Street, by the construction
therein of a 2" asphaltic plant mix surface on existing pavement, and
X6728.00 for the improvement of the same thoroughfare between the same
points by tearing up a portion of existing pavement, the filling with
earth to bring the North side up to presentable grade and resurfacing of
the entire area of said street with a 2" asphaltic plant mix. No action
taken with respect to this matter.

Councilman John A. Gerow be and he is hereby authorized and instructed
to attend the Mayors' and Councilmen's conference of the League of California
Cities at Fresno, California, March 28th and 29th, 1940, and to file his
demand against the City for his actual and necessary expenses in connection
therewith, such demand to be audited and approved in the usual manner.
Carried by the following vote:

Noes: Councilmen None.

No further business appearing to be transacted at this meeting, it
was moved by Councilman Gerow, seconded by Councilman Selby, the meeting
