A regular meeting of the City Council of the City of El Segundo, California, was held in the Council Chamber of the City Hall of said City on the above date, having been called to order at 7:00 P. M. by Peter E. Binder, Mayor. ROLL CALL. Councilmen Present: Gerow, Hesser, Selby and Mayor Binder. Councilmen Absent: Love. Other Officers Present: Clyde `.'7oodworth - City Attorney. R. T. Hutchins - City Engineer. Victor D. McCarthy - City Clerk. A. R. Gunn. - Street Superintendent. READING OF MLJ[TI`ES OF PREVIOUS P,r�TINGS. The minutes of the regular meeting held on the 6th day of March, 1940, were read. No errors or omissions appearing, it was moved by Council- man Gerow, seconded by Councilman Hesser, the minutes be approved as read. Carried. 'WRITTEN COIL- MTICATIONS. The following communications, which were read, were disposed of in the manner indicated following the reference to each hereinafter: DONALD H. HEIZIAN, dated March 9th, 1940; ALBERT CLARK FREEMAN, dated March 9th, 1940; JOHN B. S14ITH, dated March 13th, 1940; and MARTIN BENSON, dated March 13th, 1940, each being an application for employment by the City of El Segundo. Ordered filed. LOS ANGELES COUNTY LEAGUE OF MUNICIPALITIES, stamped "RECEIVED March 133, 194011, advising of the holding of its 104th regular meeting at Culver City March 18th, 1940. Moved by Mayor Binder, seconded by Councilman Selby, that Councilmen Gerow, Hesser, Selby and Binder, City Engineer Hutchins, and City Clerk McCarthy each be authorized to attend the regular meeting of the Los Angeles County Division, League of California Punicipalities to be held at Culver City March 18th, 1940, and to file his demand for his actual and necessary expenses in connection therewith, the same to be audited and approved in the usual manner before payment. Carried by the following vote: Ayes: Councilmen Gerow, Hesser, Selby and mayor Binder. Noes: Councilmen None. Absent: Councilman Love. =ON'S LOT CL_E-1 I1TG SEWICE, dated March 4th, 1940, soliciting an opportunity to discuss lot cleaning problemens with the Council. It appearing that the City has no weed abatement ordinance and they therefore would have no occasion, to avail themselves of the service offered, the cor,Lmunication was ordered filed. ' TOI T DURING, dated March 7th, 1940, extending an invitation to the Council to attend a dinner meeting at the Elks Club, Redondo Beach, March 14th, 194u, with reference to matters of interest in the 46th Assembly District. Ordered filed. ORAL COMJUNICATIONS. MESSRS. TORN B. SMITH; and MARTIN BENSON, each addressed the Council relative to his application for employment heretofore filed with the Council, and each was instructed to confer with Lir. Hutchins -at a later date for the purpose of ascertaining the Council's decision in their respective cases. REPORTS OF STANDING COMMITTEES. Councilman Gerow of the Public Works Cormittee reported that complaint has been made to him concerning an unsightly and unpleasant situation existing on that certain unimproved lot situated at the northeast corner of Cedar Street and Walnut Avenue within the City of El Segundo, as a result of automobile wrecking operations and the deposit thereon of other debris. '_Ely general consent, the Chief of Police was directed to confer with Mr. L. L. Koyer and with E1 Segundo Co- operative Unit who, it is felt, may assist in eliminating the conditions complained of. REPORTS OF OFFICERS AND SPECIAL COWITTEES. Councilman. Selby reported concerning a conference had between Councilmen Gerow, Hesser, and himself, and Pair. Tohn C. Austin, architect, concerning the construction of an adobe library building. Mr. Austin stated that plans here- tofore drawn for the library will need only minor revision and that an estimate of the cost of construction with adobe may be furnished within approximately one week's time. Mr. Selby stated further that representatives of N.Y.A. also were present at said conference and that this organization is anxious to erect a library building and other structures for the City of El Segundo. These representatives stated also that N.Y.A. would make and paint the furn- iture required in said library building. R. T. Hutchins, Superintendent of Water Department, reported concerning the minor automobile accident which had occurred this date involving a motor vehicle of the Water Department, and he filed a copy of said report with the City Clerk. By general consent the City Clerk was directed to make a report thereof to the insurance carrier of the City of El Segundo. City Engineer Hutchins advised having started a check of the recent decision of the Railroad Commission of the State of California with reference to street lighting rates and that he will have a report in a short time as to the manner in which such new rates effect the City of E1 Segundo. The City Engineer reported having conferred with Mr. Holsworthy, Street Opening and Widening Engineer of the City of Los Angeles, with reference to the improvement of Imperial Highway as suggested in a communication received recently from the Imperial Highway Association, Mr. Holsworthy informed Mr. Hutchins that he is too busy to give the matter immediate attention but expects to be _able to do so within two weeks, at which time he will arrange for a meeting between the City Engineers of the several cities involved, and of the County, for the purpose of working out a method of procedure. The City Attorney reported that there had been submitted to him a Form of Notice to Bidders on welded steel pipe; that he approves the Notice as to form, with certain corrections which he has underlined, and that the Form, as corrected, may be used if it is the Council's desire to advertise for bids on said steel pipe. The City Attorney reported also that Mr. Schroeder and Mr. Overton, ' -representing the owners'of the unimproved acroage lying northerly of Imperial ' Highway, will meet the City Council at El Segundo at 4:15 P. M. Mar@h 18th, for the purpose of viewing the property and determining what, if anything, may be done to eliminate the dust nuisance complained of by the City of El Segundo. p _ZO The City Attorney reported that there was pending in the Escrow Department of the Inglewood Branch of the Bank of America National Trust and Savings Association, an escrow in which apparently Lot 13, of Block 105, El Segundo Sheet N0. 31 in the City of El Segundo, was being handled. He stated that some few days ago the City Clerk had contacted him with reference to the matter of this escrow, and with reference to an old suit which the City had filed for foreclosure of a 1915 Act Assessment covering said property, together with certain other properties in the City. The City Attorney stated that a search had been made and that he had been successful in locating the old foreclosure suit file, which was dated in 1925. He stated further that he.had prepared the necessary form of dismissal, providing for the dismissal of said old action against said particular parcel of land, but that he did not feel the same should be delivered without some evidence satisfactory to the City that the assessment for which the foreclosure action had been filed had been paid. The City Clerk stated that the records thus far received by the City Treasurer were not sufficient to indicate that such payment had been made. The City Clerk thereupon explained to the Council that when remittances are received from the tax collecting officials of Los Angeles County they are received in a lump -sum remittance and are apportioned to the respective districts to which they apply. He procured the municipal records and demonstrated to the Council the method employed by the County in making such remittances. After discussion, it appeared that the persons desiring the dismissal should cause a check to be made of the County records for the Year t0@ 1925 with reference to this matter if they claim that the assessment has been paid. After further discussion, it was moved by Councilman Gerow, seconded by Councilman Hesser, the following resolution be adopted: RESOLVED, that the City Attorney be and he is hereby authorized and instructed to place, with the Escrow Department of the Inglewood Branch of.the Bank of America National Trust and Savings Association, a dismissal of that certain action in the Superior Court of Los Angeles County, California, bearing No. 175029,.entitled: "City of E1 Segundo, a Municipal Corp- oration, vs.-Adella F. Paine, et al ", with prejudice as to Lot 13, Block 103, El Segundo Sheet No. 3, as per Map recorded in Book 20, Pages 22 and 23 of Maps, records of Los Angeles County, California, with instructions that said Bank be authorized to use said dismissal if and when the assessment, for the foreclosure of which said action was filed, is paid to said City, or evidence satisfactory to said City Attorney is produced, showing that such assessment has heretofore been paid. On roll call the said resolution was adopted by the following vote: Ayes: Councilmen Gerow, Hesser, Selby and Mayor Binder. Noes: Councilmen None. Absent: Councilman Love. UNFINISHED BUSINESS. Moved by Councilmau Gerow, seconded by Councilman Hesser, that the City Clerk of the City of E1 Segundo be and he is hereby authorized and directed to publish, in the manner required by law, a notice of sale of apartment house building, for the purpose of obtaining bids on the removal or demolition of that certain apartment house building standing on Lot 43, Tract 2667, recently purchased by the City of El Segundo in connection with the widening of. Grand Airenue between Concord Street and the westerly City Limits, said notice when published to be in substantially the same form as that presented °anti read to the Council this date. Carried by the following vote: Ayes: Councilmen Gerow, Hesser, Selby and Mayor Binder. Noes: Councilmen None. Absent: Councilman Love. FN The matter of the construction of toilet facilities at the City Nursery located on the Water Works property, at the southwest corner of California Street and Mariposa Avenue, was discussed and referred back to the City Engineer for further report. None. PAYING BILLS. NEW BUSDMSS. Moved by Councilman Hesser, seconded by Councilman Gerow, that the purchase of approximately 600 ft. of 8" 10 -gauge welded steel pipe, for use in connection with sewer construction in the east acreage of the City of El Segundo, be and the same is hereby authorized and directed, at a cost of not to exceed $372:00, plus California State Sales Tax. Carried by the following vote- :' :;yes: Councilmen Gerow, Hesser, Selby and Mayor Binder. Noes: Councilmen None. Absent: Councilman Love. moved by Councilman Selby, seconded by Councilman Hesser, that the City Clerk of the City of El Segundo be and he is hereby authorized and directed to advertise in the manner provided by law for bids on 1600 lineal feet of 8" 10 -gauge welded steel pipe, the same to be used in connection with the construction of sewers in the east acreage of the City of El Segundo. Carried by the following vote: MICI Ayes: Councilmen Gerow, Hesser, Selby and Mayor Binder. Noes: Councilmen None. Absent: Councilman Love, Ir. E. G. Lammiman addressed the Council relative to the installation of sewers and the construction of sidewalks and curbs in certain areas in the northeasterly portion of the residential district of the City of El Segundo. The matter was discussed at length, after which it was moved by Councilman Gerow, seconded by Councilman Selby, that the City Engineer of the City of El Segundo be and he is hereby authorized and directed to make a survey of the sewer, sidewalk, and curb needs in that portion of the City of E1 Segundo lying easterly of Main Street and northerly of Mariposa Avenue, and check with Work Projects =- - -ass Administration with respect to developing a project and providing these facilities. Carried by the following vote: Ayes: Councilmen Gerow, Hesser, Selby and Mayor Binder. Noes: Councilmen None. Absent: Councilman Love, Street Superintendent Gunn was authorized and directed to obtain bids for planing Richmond Street between Grand Avenue and El Segundo Boulevard, and portions of Grand Avenue between Main Street and Sepulveda Boulevard. I:Ioved by Councilman Gerow, seconded by Councilman Hesser that the City Engineer be and he is hereby authorized and directed to estimate the area of the lots within the City of E1 Segundo from which weeds and vegetable growth should be removed in order to minimize fire hazards and to obtain bids for mowing and raking the same.
