A regular meeting of the City Council of the City of E1 Segundo, California, was held in the Council Chamber of the City Hall of said City on the above date, having been called.to order at 7:00 P. M. by Peter E. Binder, Mayor. ROLL CALL. Councilmen Present: Hesser, Loves Selby and Mayor Binder. Councilmen Absent: Gerow. Other Officers Present:. Clyde Woodworth - City Attorney. Bernard Lawler - Special City Attorney. A. R. Gunn - Street Superintendent. Frank Chilson - Assistant City Engineer. Victor D. McCarthy - City Clerk. READING OF MINUTES OF PREVIOUS MEETING. The minutes of the regu ;ar meeting held on the 29th day of May, 1940, were read. No errors or omissions appearing, it was moved by Councilman Love, seconded by- Councilman Selby, the minutes be approved as read. Carried. WRITTEN COMMUNICATIONS. The following communications, which were read to the Council, were disposed.of in the manner indicated following the reference to each hereinafter: PLANNING CONGRESS OF LOS ANGELES COUNTY, undated, stamped "Received June 3, 1940 ", announcing a meeting of said Congress, June 8th, 1940, in the Hollywood Bowl dining room. Ordered filed. The Mayor announced receipt of a communication from Buron Fitts, District Attorney, dated May 31st, 1940, requesting the Council to adopt an ordinance prohibiting trespass upon private property, thereby providing an effective means of preventing unlawful trespass upon the property of airplane factories, airports, oil refineries, public utilities, etc. After discussion, Councilman Love, introduced Ordinance No. 231, entitled: AN ORDINANCE OF THE CITY OF EL SEGUNDO , CALIFORNIA, PROHIBITING TRESPASS UPON PRIVATE PROPERTY AND PROVIDING PENALTIES FOR THE VIOLATION THEREOF, which was read. ORAL COMMUNICATIONS. Mr. A. J. Sullivan addressed the Council, requesting additional time within which to remove from Lot 43, Tract 2667 in the City of E1 Segundo, that certain two story apartment house building recently purchased by him from said City,, stating that.he has definitely made arrangements for its remove; and that this extension, if granted, will be the last one requested. It was thereupon moved by Councilman Love, seconded by Councilman Selby, that A. J. Sullivan be and he is hereby granted an extension of time to and inclusive of June 19th, 1940, for removing from Lot 43, Tract 2667, in the City of E1 Segundo, that certain two story apartment house building purchased from said City by said A. J. Sullivan. Carried. None. REPORTS OF STANDING COMMITTEES. REPORTS OF OFFICERS AND SPECIAL COMMITTEES. Special City Attorney Bernard Lawler orally explained to the Council that in filing foreclosure actions against real properties within the City of E1 Segundo because of delinquent special.assessment payments, he finds that there were included a number of parcels of real property owned by persons who had, in good faith, agreed to pay delinquent taxes and special assessments under the so- called "10 Payment Plan "; that a number of these persons have approached him for the purpose of making settlement of unpaid balances of special assessments due and he feels that under the circumstances it will be inequitable to assess costs and fees in such cases where all installments have been paid to date. After discussion of the matter, it was moved by Councilman Love, seconded by Councilman Hesser, that the following resolution be adopted: WHEREAS, as a part of the program for the restoration of tax and special assessment delinquent properties to a tax paying basis, in the City of El Segundo, actions to for various special assessment liens on real properties located within said City ...were heretofore filed in the Superior Court of the State of California in and for the County of Los Angeles; AND, WHEREAS, settlements and adjustments of various claims involved in such foreclosure proceedings are being made from time to time; AND, WHEREAS, it appears that certain of the parcels of property involved in such foreclosure actions at the time such actions were filed were being redeemed by the owners thereof under the so- called "10 Payment Plan" for settlement of delinquent taxes and were not in default in the installments payable under such plan; AND, WHEREAS, this Council feels that in the settlement of claims relating to such properties so being adjusted under said "10 Payment Plan" and which are not in default thereunder, that it would be inequitable to require the payment of costs and fees incident to such foreclosure proceedings when settlements of such claims on such particular properties are made; NOW THEREFORE, BE IT RESOLVED that Special City Attorney Bernard Lawler,,in charge of such foreclosure proceedings, when.making settlements on any such properties, be and he is hereby authorized to waive the costs and fees incident to such foreclosure actions which would otherwise be applicable were such respective.properties not being so adjusted under said "10 Payment Plan ". The foregoing resolution was adopted by the following vote: Ayes: Councilmen Hesser, Love, Selby and Mayor Binder. Noes: Councilmen None. Absent: Councilman Gerow. Assistant City Engineer Frank Chilson reported as follows: That the.installation of the 6 ",cast iron water line in Imperial Highway east of Sepulveda Boulevard has been completed; That the stripe painting machine has been completed and except for a few minor adjustments is ready for service; That he had conferred with the orfice engineer of Pacific Electric Railway Company and has learned that said Engineering Department of said p : 634 -- Company has. prepared maps and sketches of the changes in its facilities adjacent to Eucalyptus Drive and Grand Avenue, which will be necessary by reason of its granting to the City of E1 Segundo an easement for street purposes over its right of way at said point and that probably before long said Company will have definite word for the Oity as to cost, etc.; That the Engineering Department of the City of El Segundo had received a communication from the Department of Public Works, Division of Highways of the State of California, stating that lAv gas tax revenue available for allocation to Streets of Major Importance within the City of E1 Segundo for the Fiscal Year 1941 is estimated at $3240.00; that this sum may be added to the unobligated balance of revenues at the end of the Fiscal Year June 30th, 1940, making a total of $9635.61 available for programming at this time; that Project Statement forms accompanied said communication and that said forms have been completed by the Engineering Department of the City of E1 Segundo in the same manner as in former .years and are now ready for transmittal to the Division of Highways of the State of California. It was thereupon moved by Councilman Hesser, -seconded by Councilman Love, that Project Statement No. 6, dated June 5th, 1940, containing an estimate of the cost.of general maintenance of Streets of Major Importance within the City of E1 Segundo, for the Fiscal Year 1940 -1941, addressed to the Director of Public Works, Sacramento, California, prepared and submitted to this Council this date by the City Engineer of the City of El Segundo, be and the same is hereby approved and the City Engineer is hereby authorized and directed to cause the same to be forwarded to the Director of Public Works of the State of California, at Sacramento, California, through the District Engineer of the Division of Highways of said State at Los Angeles, California, and said City Engineer is further directed to cause one copy of said Project Statement to be placed on file in the office of the City Clerk of the City of E1 Segundo for identification and reference. Street Superintendent Gunn reported as follows: That all work he was requested to perform at the baseball park has been completed; That the work of removing the rail from atop the guard posts on the Coast Boulevard has not been started because-no S. R. A. men have appeared to perform the work. By general consent he was granted permission to delay the contemplated work until it is definitely known whether or not SRA proposes to send men to the project. At this point Assistant City Engineer Chilson reported having received from State Relief Administration a form to be signed, authorizing extension of the E1 Segundo SRA project from July 1st, 1940 to March 31st, 1941 inclusive. Action authorizing the execution and transmittal of the request for extension was deferred pending a conference between the Engineering Department and SRA officials to determine whether or not SRA will be able to furnish men to complete the projects set up. Street Superintendent Gunn inquired whether or not it was the Council's ,intention to.have him condition the baseball grounds during the current season and after discussion it was moved by Councilman Love, seconded by Councilman Hesser, that the following resolution be adopted: RESOLVED, that until the further order of this Council, E. L. Coddington be employed as Baseball Grounds Keeper of the City of E1 Segundo; such employment shall include control of the lighting system during night baseball games, marking p -` 133 the base lines when necessary, caring for the equipment of the City used at such ball games and doing such work as is necessary one day per week to maintain the baseball ' grounds in satisfactory cohdition; AND, BE IT FURTHER RESOLVED, that as compensation for services rendered'as such Baseball Grounds Keeper, said employee shall'be'compensa "ted at the rate of $1.00 for each occasion upon which he performs services in connection with officially scheduled 'games actually played upon said baseball grounds; and at.the rate of 70¢ per hour for such time as he is actually employed in conditioning said grounds, not to exceed, however, eight hours per week unless additional hours per week are authorized by this Council. The City Clerk reported that in view of the recent unfortunate airplane crash within the City of E1 Segundo, which endangered lives and property of residents of the City of El Segundo, he had received a number of requests that the Council take such action as it might deem appropriate in an endeavor to cailse the practibe of the testing of airplanes over the City of El Segundo be discontinued. The matter 4as discussed at length,- whereupon upon motion of douncilman Love, seconded by Councilman Hesser, which carried unanimously, the City Attorney of the City of E1 Segundo and the City Clerk'of said City were authorized and directed to address a communication to the Civil Aeronautics Authority, requesting that Body to adopt regulations which would minimize the hazards'of airplanes flying over the City of E1 Segundo. Moved by Councilman Love, seconded by Councilman Selby, that the employment of Nelle Sheldon as Relief Departmental Clerk, to perform P 63:7 services in the Water Department of the City of El Segundo, during the vacation period of Departmental Clerk Frances Lloyd, be and the same is -hereby ratified and approved; said temporary employee to be compensated at the rate of 600 per hour, as provided in the resolution of the City Council of the-City of E1 Segundo, fixing the rates of compensation for municipal employees. Carried by the following vote: Ayes: Councilmen Hesser, Love, Selby and Mayor Binder. Noes: Councilmen None. Absent: Councilman Gerow. Moved by Councilman Selby, seconded by Councilman Hesser, that the purchase of one Profeasional Transferable Membership Coupon Book for use in connection with the Twelfth Annual session of the Institute of Government at the University of Southern California, said Institute to be in session June 10th to 14th, Incl. 1940, be and the same is hereby authorized and directed, at a cost of not to exceed $25.00. Carried by the following vote: Ayes: Councilmen Hesser,-Love, Selby and Mayor Binder. Noes': Councilmen None. Absent: Councilman Gerow. At this point Mr. J. L. Kruly, the contractor who is renting a ditching machine to the City of E1 Segundo, for use in connection with the construction of a trunk line sewer within the City of E1 Segundo, addressed the Council, requesting settlement of his account. It appearing that the work contemplated in that certain Agreement between the City of E1 Segundo and J. L. Kruly, dated March 25th, 19400, has not been completed,•and it appearing also that the Council has no report or recommendation from the City Engineer of the City of E1 Segundo as to any additional compensation which might be due Mr. Kruly as alleged by him, consideration of his request was postponed until the neat meeting of this Council to enable said contractor and the City Engineer to discuss Mr. Kruly's claim and to enable said Engineer to file a recommendation with this Council. No further business appearing to be transacted at this meeting, it was moved by Councilman Love, seconded by Councilman Selby, the meeting adjourn. Carried. Approved: Mayor.
