A regular meeting of the City Council of the City of El Segundo, California, was held in the Council Chamber of the City Hall of said City, on the above date, having been called to order at 7:00 P. M. by Peter E. Binder, Mayor. ROLL CALL. Councilmen Present: Gerow, Hesser, Selby and Mayor Binder. Councilmen Absent: Love. Other Officers Present: Clyde Woodworth - City Attorney. R. T. Hutchins - City Engineer. A. R. Gunn - Street Superintendent. Victor D. McCarthy - City Clerk. READING OF MINUTES OF PREVIOUS MEETINS. The minutes of the regular meeting held on the 14th day of February, 1940, were read. No errors or omissions appearing, it was moved by Councilman Selby, seconded by Councilman,Gerow, the minutes be approved as read. Carried. The minutes of the adjourned regular iAeeting held on February 19th, 1940, were read without error or omission being noted, and were approved •as read upon motion of Councilman Selby, seconded by Councilman Gerow, which carried unanimously. WRITTEN COMMUNICATIONS. The following communications, which were read to the Council, were disposed of in the manner indicated, following the reference to each hereinafter: BEULAH A. SAMSEL, being application to serve as Election Officer. Ordered filed. PACIFIC ELECTRIC RAILWAY COMPANY, dated February 16th, 1940, responding to the City Clerk's letter of February 15th, 1940, regarding the proposed improvement of the roadway.of Grand Avenue, between Sepulveda Boulevard and the Westerly City Limits, and advising that the matter of abandonment of its right of way and facilities between Eucalyptus Drive and Main Street will be looked into at once. Ordered filed. RAILROAD COMP:IISSION OF THE STATE OF CALIFORNIA, dated February 20th, 1940, advising of electrical rate reductions effective March 1st, 1940, to domestic and commercial users of electrical energy. Ordered filed. PETITION, in four sections, signed by A. J.•Sullivan and 142 others, requesting the Council to submit to the electors of the City of E1 Segundo, at the General-Municipal Election to be held April 2th,•1940, the proposition, to -wit:: "Shall Each Member of the.City.Council of the City of El Segundo, California, Hereafter Receive the Sum of $35.00 Per Month as Compensation For his Services as Such Member ?". Moved by Councilman Gerow, seconded by Councilman Hesser, that said petition be received and filed and the City Attorney instructed to prepare the necessary legal procedure to submit to the electors of the City of E1 Segundo at the General Municipal Election to be held April 9th, 19409 P 530 the proposition referred to in said petition. Carried by the following vote: Ayes: Councilmen Gerow, Hesser, Selby and Mayor Binder. Noes: Councilmen None. Absent: Councilman Love. B. A. BYRNE, as representative of the Knights of Columbus, dated February 21st, 1940, transmitting therewith a resolution for the Council's consideration. The purpose of the resolution was to recommend to the City Council and through it the Chamber of Commerce and business men and women of the community, that all gainful occupations cease, wherever possible, from 12:00 o'clock Noon until 3:00 P. M., Good Friday, March 22nd, 1940. Moved by Councilman Gerow, seconded by Councilman Hesser, that the communication and accompanying resolution be received and filed. Carried. SPECIAL ORDER OF BUSINESS. The hour of 7:15 P. M. at this meeting having heretofpre been fixed as the time and date for receiving bids on sewer manhole frames and covers and on vitrified clay sewer pipe, as advertised for, the Mayor announced the arrival of the hour of 7:14 P. M. and stated that any person or persons present desiring to file bids on the items named should do so immediately. The hour of 7:15 P. M. having arrived and all bids being in, the Mayor declared the hour for receiving bids for furnishing the City of El Segundo with certain sewer manhole frames and covers and vitrified clay sewer pipe closed. The City Clerk announced that three bids had been received. It was thereupon moved by Councilman Selby-, seconded by Councilman Gerow, that the Council proceed to open, examine and publicly declare all bids received this date for furnishing the City of E1 Segundo certain sewer manhole frames and covers and vitrified clay sewer pipe as advertised for. Carried. Thereupon the Council proceeded to and did open, examine and publicly declare all bids received this date for furnishing the City of E1 Segundo with certain sewer manhole frames and covers vitrified clay sewer pipe, as advertised for, which said bids were found by said Council to be as follows, to -wit: . Bid of Alhambra Foundry Co. Ltd., submitted on regular form provided therefor, as follows: Item No. 1: $16.00 Item No. 2: No Bid Item No. 3: No Bid Item No. 4: No Bid Said bid was accompanied by Cashier's Check No. 38- 47345, drawn on California Bank,•Alhambra, California, payable to City of El Segundo, in the sum of $50.00. Bid of Pacific Clay Products, submitted on regular form provided therefor, as follows: Item No. 1: No Bid Item No. 2: $.247 per ft. Item No. 3: $.309 per ft. Item No. 4: $.648 per ft. Said bid was accompanied by Certified Check No. 110024, drawn on The Farmers and Merchants National Bank of Los Angeles, California, payable to City of E1 Segundo in the sum of $400.00. Bid of Gladding, M.cBean 8 Co. submitted on regular form provided therefor, as follows: Item No. 1: No Bid Item No. 2: $.252 Item No. 3: $.307 Item No. 4: $.667 Said bid was accompanied by Cashiers Check No. 795754, drawn on Glendale Branch of Security -First National Bank of Los Angeles, payable to City of E1 Segundo in the surf of $405.00. Following the opening and declaration of said bids, it was moved by Councilman Selby, seconded by Councilman Hesser, that all bids received this date for furnishing the City of E1 Segundo with certain sewer manhole frames and covers and vitrified clay sewer pipe, be taken under advisement until the hour of 7:15 o'clock P. M., Wednesday, February 28th, 1940. Carried. ORAL COMMUNICATIONS. None. REPORTS OF STANDING COMMITTEES. None. REPORTS OF OFFICERS AND SPECIAL COMMITTEES. The City Clerk advised that he had received from Nannie L. Patterson, the owner of Lot 332, Block 123, E1 Segundo, a Grant of Easement for sanitary sewer purposes over the Southerly 72 feet of said lot, this easement for use in connection with the construction of a trunk ;ine sewer in the East acreage, the acceptance of said easement being desirable at this time, due to the fact that in a former Grant an error had been made in the description of the property. It was thereupon moved by Councilman Hesser, seconded by Councilman Selby, that the following resolution be adopted: RESOLVED, that that certain Grant of Easement for sewer trunk line purposes, made by Nannie L. Patterson, dated the 16th day of February, 1940, granting to the City of El Segundo a perpetual easement and /or right of way for the construction, reconstruction, inspection, maintenance, operation and repair of a sanitary sewer or sewers, in, over, upon, across and along the 13outherly 72 feet of Lot 332, Block 123, as shown upon E1 Segundo Sheet No. 8, recorded in Book No. 22, pages 106 and 107 of Maps, Records of Los Angeles County, California, and on file in the office of the County Recorder of said County, be and the same is hereby accepted on behalf of the City of E1 Segundo; AND, -BE IT FURTHER RESOLVED, that the-City Clerk of the City of•El Segundo be and he is hereby directed to cause the said instrument to be filed for record in "the office of the County Recorder of Los Angeles County, California. The foregoing resolution was adopted by the following vote: Ayes: Councilmen Gerow, Hesser, Selby and Mayor Binder. Noes: Councilmen None. Absent: Councilman Love. The City Clerk called the Council's attention to the fact that it has never requested Los Angeles County Health Department, which functions under contract with the City of E1'Segundo as the Health Department of said City, to enforce the provisions of Ordinance No. 223 of the City 'of El Segundo, regulating the sanitation and conduct 'of camp cars,' trailer camp.cars or trailers in the City of E1 Segundo. It.was thereupon moved by Councilman Gerow, 'seconded by Councilman Selby, that the following iVsolution be adopted: RESOLVED, that irf addition to the ordinances of the City of El Segundo, which the County Health Officer of Los Angeles County, California, has heretofore been requested to enforce, 'that said Health Officer be and he'-is hereby further instructed to enforce, within the City of El Segundo, the provisions of Ordinance No. 223 of said City, entitled: "AN ORDINANCE OF THE CITY OF EL SEGUNDO, CALIFORNIA, ' REGULATING = SANITATION AND CONDUCT OF CALT CARS, TRAILER CAMP CARS, OR TRAILERS IN THE CITY OF EL SEGUNDO, CALIFORNIA". The foregoing resolution was adopted by the following vote: Ayes: Councilmen Gerow, Hesser, Selby and Mayor Binder. Noes:' Councilmen None. Absent: Councilman Love. City Engineer Hutchins reported that on Thursday, February 15th, he and Councilman Gerow had attended a meeting of the Imperial Highway Association at Los Angeles; that it was an annual meeting attended by approximately 35 City and County officials. At said meeting they learned that the crossing of Imperial Highway at San Pedro Street, within the City of Los Angeles, should be completed about May of this year and that an attempt will be made to widen said Highway between San Pedrh Street and Alameda Street. The City Engineer reported also that the construction of a trunk line sewer in the East acreage was started February 20th and that March 5th, 1940, has been tentatively fixed as the date for the holding of public ceremonies in connection therewith. The City Attorney reported having prepared the form of application to the State Employee's Retirement System, requesting it to furnish an estimate of the cost of making an investigation to enable it to advise the City the cost of said City becoming a part of the State Employees Retirement System, which form had been signed by the City Clerk and transmitted to the proper office at Sacramento, The'Ci'ty Attorney reported having prepared the several documents required in connection with the City's acquisition of Lot 8, Block 108, E1 Segundo Sheet No. 5, which has heretofore been sold to the State for delinquent taxes, all of which documents he delivered to the City Clerk for examination and signature of the officers of said City required to sign the. same. It was thereupon moved by Councilman Hesser, seconded by n Coucilman Gerow; the following resolution be adopted: WHEREAS, .the City Council 'of the City of El Segundo has heretofore, by Resolution No. 488, instituted pro- ceedings for the acquisition by said City, under the provisions of Sections 3897.3 and 3897d of the Political Codefbr the purposes of a water well site, of the following described property, to -wit: Lot 8, Block 108, El Segundo Sheet No. 3, in the City of E1 Segundo; P -1533. ` .. AND, WHEREAS, this Council feels that the manner and expense of the improvement to be made by said City upon said property, if and when same is so acquired, should be stated and determined; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of El Segundo, California, as follows: 1. That if and when said real property described in said Resolution, Lot 8, Block 108, El Segundo Sheet No. 5, is acquired by said City, that the same will b'e improved by the construction thereon of a water well, substantially the same as the other water wells now owned by sgid'City and used in connection with the municipal water works system thereof and by further constructing upon said property the necessary and usual pump house and appurtenances, including adequate protective fencing; and 2. That the City Council proposes to °construct and complete all of said above mentioned improvements within a,. period of not to exceed two years from the date of acquisition of such property by said City. The foregoing resolution was adopted by the following vote: Ayes: Councilmen Gerow, Hesser, Selby and Mayor Binder. noes: Councilmen None. Absent: Councilman Love. UNFINISHED BUSINESS. Moved by Councilman Gerow, seconded by Councilman Selby, that Ordinance No. 228, entitled: AN ORDINANCE OF TIC CITY OF EL SEGUNDO, CALIFORNIA, AMENDING ORDINANCE NO. 204 OF SAID CITY, ENTITLED: "AN ORDINANCE OF THE CITY OF EL SEGUNDO, CALIFORNIA, REGULATING TRAFFIC UPON THE PUBLIC STREETS, AVENUES, ALLEYS, THOROUGHFARES AND PLACES WITHIN SAID CITY, AND REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT THEREWITH. ", BY ADDING A NEW SUBDIVISION TO SECTION 79 OF SAID ORDINANCE, AND BY ADDING A NEW SECTION THERETO TO BE KNOWN AND DESIGNATED AS "SECTION 80.1 ", which was introduced and read at a regular meeting of this Council held on the 14th day of February, 1940, and reread at this meeting, be adopted. Carried by the following vote: Ayes: Councilmen Gerow, Hesser, Selby and Mayor Binder. Noes: Councilmen None. Absent: Councilman Love. NEW BUSINESS. An estimate of the cost of repairing that certain municipal dwelling house located at 803 East Grand Avenue, was submitted for the Council's consideration and following discussion;,it'was moved by Mayor Binder, seconded by Councilman- Selby, that action with respect to renovating the municipal dwelling house at 803 East Grand Avenue be takeh under advisement until the next regular meeting of this Council. Carried. Moved by Mayor Binder, seconded by Councilman Hesser, that the City Clerk be authorized and directed to ascertain ownership of the unimproved real property lying northerly of the northerly City limits of the City of El Segundo and when the same has been ascertained, to transmit the information forthwith to the City Attorney, who is hereby authorized and directed to P . 334 use his best offices in an endeavor to cause the owners to take such steps as they reasonably can to minimize the dust nuisance which effects the City of El Segundo during wind storms. By general consent the City Attorney was instructed to prepare a Notice to Bidders calling for bids for moving or wrecking that certain two -story apartment house building recently purchased by the City for the purpose of opening and widening Grand Avenue between Concord Street and the Westerly City Limits. By general consent Mayor Binder was authorized to notify Mr. Call, Director of N. Y. A. to'meet with the City Council for the purpose of discussing plans for a new City Hall for the City of E1 Segundo. No further business appearing to was moved by Councilman Gerow, seconded adjourn.
