April 15th, 1940.
An adjourned regular meeting of the -City Council of the City of El
Segundo, California, was held in the Council Chamber of the City Hall of
said City on the above date, beginning at the hour of 4:15 o'clock P. M.,
having been tailed to order by Peter E. Binder, Mayor.
ROLL CALL.
Councilmen Present: Gerow, Hesser, Love, Selby and Mayor Binder.
Councilmen Absent: None.
Other Officers Present:
Clyde Woodworth - City Attorney.
Victor D. McCarthy - City Clerk.
By general consent the regular order of business was dispensed.with.
The City Clerk reported that the returns of the General Municipal
Election held on Tuesday, the 9th day of Apri1,,1940, in the City of El
Segundo, California, were then, and had been,,in his possession in the
envelopes containing them, in the same condition as when received, and that
he had also received and had ready to present to the Council four (4)
absent voters' ballots. Said Clerk then presented said returns and said.
absent voters' ballots to the City Council at this time at this meeting.
'It was thereupon moved by Councilman Selby,and seconded by Councilman
Love, that the City Council proceed forthwith to canvass said returns and
said absent voters' ballots. The said motion was carried and adopted by
the following vote:
Ayes: Councilmen derow, Hesser, Love „Selby and Mayor Binder;
Noes: Councilmen None;
Absent: Councilmen None.
Said motion having carried, the City Council then proceeded forthwith
to publicly examine and canvass the said returns and the said absent voters'
ballots, all.as provided by law, and upon the completion of said canvass by
said Council, it was moved by Councilman Hesser, and seconded by Couhcilman
Gerow, that the following resolution be adopted:
TEEREAS, there was held and conducted in the City•of El Segundo, County
of Los Angeles, State of California, on Tuesday, the 9th day of April, 1940,
a General Yunicipal.Election of the qualified electors of said City, under,
pursuant to and as required by, the provisions of the laws of the State of
California relating to cities of the sixth class, for the purpose of electing
the following officers of said City, to- Tait:
Three members of the City Council of said City for
the full term of four (4) years;
A City Clerk of said City for the full term of four .
(4) years; and
A City Treasurer of Said City for the full term of
four (4) years;
AND, VITTEREAS, there was also submitted to the electors of said election,
the following measures, to -wit:
"Shall each member of the City Council of the City of
E1 Se�7undo, California, hereafter receive the sum of
X35.00 per month ' as compensation for his services as
such member?"
"Do the people of the City of E1 Segundo wish the City
Council of said city to permit marble boards, pin ball
and similar games to be operated within said city ? ";
AND, MHEREAS, it appears that notice of said election was duly and
legally given; that there were seven (7) voting precincts established
within the said City for holding said election, consisting in all in-
stances of the regular election precincts established for holding general .
State and County elections, as established by the Board of Supervisors of
Los Angeles County, California; that election officers were appointed and
election supplies furnished; and that in all respects said election was
held and conducted and the votes cast thereat received and canvassed and
the returns thereof made and declared in time, form and manner as required
by the - ?rovisions of the laws of the State of California relating to cities
of the sixth class and pursuant to all laws of said State and of said City
in such case made and provided;
AND, IATHEREAS, the City Council of the said City of E1 Segundo, met at
the Council Chamber of the said Council in the City Hall of said City on Monday,
the 15th day of April, 1940, as provided by law, beginning at the hour of 4:15
o'clock p. m. of the said day, to canvass the returns of said election and said
absent voters' ballots, and declare the results thereof, whereupon the said
Council found that the number of votes cast; the names of the persons voted
for; the office to fill which each person was voted for; the measures voted
upon; the results of said election; and the other matters required by law, to
be as hereinafter stated:
THEREFORE, THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA,
D04.S HEREBY RESOLVE, DECLARE AND DETERMINE AS FOLLOWS:
. That said.General Municipal Election was held and conducted-in said City
of El Segundo, California, on Tuesday, the 9th day of April, 1940, in time,
form and manner as required by law;
That there were seven (7) voting precincts established within the said
City for the purpose of holding said election, consisting in all instances of
the regular voting precincts established by the Board of Supervisors of Los
Angeles County, California, for the holding of general State and County
elections, as follows:
Voting Precinct "A" comprising State and County Precinct,
El Segundo City Precinct No. 1, the polling place of which was
in the dwelling house located at 835 Loma Vista Street, in
said city;
Voting Precinct "B" comprising State and County Precinct,
E'1 Segundo City Precinct No. 2, the polling place of which was
in the dwelling house `located at 515 W. Walnut Avenue, in said
city;
Voting Precinct "C" comprising State and County Precinct,
El Segundo City Precinct No. 3, the polling place of which was
in the dwelling house located at 506 Arena Street, in sdLid city;
Voting Precinct "D" comprising State and County Precinct,
E1 Segundo.City.Precinct. No. 4, the polling place of which was
ir. the Council Chamber of the City Hall, 203 Richmond Street,
in said - city; .
Voting Precinct "E" comprising State and County Precinct,
H1 Segundo City Precinct No. 5, the polling place of which was
in the dwelling house located at 426 Whiting Street, in said
city;
Voting Precinct "F" comprising State and County Precinct,
E1 Segundo City Precinct No. 6, the polling place of which was
in the dwelling house located at 403 Whiting Street, in said
city; and
Voting Precinct "G" comprising State and County Precinct,
E1 Segundo City Precinct No. 7, the polling place of which was
in the dwelling house located at 822 brain Street, in said City.
That the whole number of votes (Ballots) cast in said City
of El Segundo at said election was 1412 votes (Ballots); and
That the whole number of absentee votes (Ballots), cast was
4 votes (Ballots) making a total of 1416 votes (Ballots) in all
cast at said election;
That the names of the persons voted for; the office to fill
which each person was voted for; the number of votes given at
each precinct to each of such persons; the total number of votes
given in the City to each of such persons; and the number of votes
giver_ in said respective precincts and in the whole City of El
Segundo, both for and against the said measures, are as follows:

First: That GEORGE LOVE is the candidate for the office of Member
of the City Council of the City of El Segundo, California, for the full
term of four (4) years, who received-the hilg-hast number ov votes for
said office and that therefore said GEORGE LOVE was elected and is
hereby declared elected to the office of Member of the City Council of
the City of El Segundo, California, for the full term of four (4) years;
Second: That JOHN A. GEROW is the candidate for the office of Member
of the City Council of the City of E1 Segundo, California, for the full
term of four (4) years, who received the second highest number of votes
for said office and that therefore said JOHN A— G ROW was elected and is
hereby declared elected to the office of Member of the City Council of the
City of E1 Segundo, California, for the full term of fcur (4) years; and
Third: That WILLIAL R. SELBY is the candidate for the office of
1�ember of the City Council of the City of E1 Segundo, California, for the
full term of four (4) years, who received the third highest number of
votes for said office and that therefore said WILLIAM R. SELBY was elected
and is hereby declared elected to the office of Member of the City Council

That also in the ballots furnished to absentee voters, hereinabove
referred to, the measure hereinabove quoted received 2 votes for said
measure and 2 votes against the same.
That each vote indicated as voting "Yes" upon said measures, shall
be counted in favor of or for said measures; and that each vote indicated
as voting "No" upon said measures, shall be considered as a vote not in
favor of, or against said measures.
AND, BE IT FURTHER RESOLVED, DECLARED AND DETERMINED that at the said
election, and as a result thereof, the following measure was rejected and
that the same was not carried or adopted, to -wit:
"Shall each member of the City Council of the City of
El Segundo, California; hereafter receive the sum of
$35.00 per month, as compensation for his services
as such member ?"
and that therefore no further proceedings shall be had or taken with reference
to the said proposed amendment as a result of said election;
AND, ALSO, BE IT FURTHER RESOLVED, DECLARED AND DETER1,1INED that at the
said election, and as a result thereof, a majority of the voters voting on
the following measure, to -wit:
"Do the people of the City of El-Ser-undo wish the City
Council of said City to permit marble boards, pin balls
and similar, games_to be operated within said City ?"
voted in the negative thereon and the City Council therefore hereby
accordingly finds that a majority of the people of said City do not wish
the City Council of said City to permit marble boards, pin balls and
similar games to be operated within said City.
AND SAID CITY COL'NCIL DOES HEREBY FURTHER RESOLVE, DECLARE AND DETERMINE
that the City Clerk of said City shall enter on the records of said City
Council a statement of the result of said election showing:
(1) The whole number of votes cast in said City of El Segundo;
(2) The number of votes cast by absentee voters;
(3) The total number of votes cast inclusive of both the votes
cast at the various precincts and the votes cast in absentee voters'
ballots;
(4) The propositions, measures, or questions voted upon;
(5) The number of votes given at each precinct for and
against such propositions, measures, or questions voted upon;
(6) The number of votes given in said City for and against
such propositions, measures, or questions voted upon;
(7) The number of votes given in absent voters' ballots for
and against such propositions, measures, or questions voted upon;
(8) The total number of votes given in said City and in
absent voters' ballots for and against such propositions, measures,
or questions voted upon;
(9) The names of the persons voted for and the measures
voted upon.
(10) The office to fill which each person was voted for;
(11) The number of votes given at each precinct to each of
such persons for each of such offices;
(12) The total number of votes given in said City of El
Segundo to each of such persons for each of such offices;
(13) The number of votes given in absent voters' ballots
to each of such persons for each of such offices; and
(14) The total number of votes given in said City and in
absent voters' ballots to each of such persons for each of such
offices;
AND SAID CITY COUNCIL DOES HEREBY FURTHER RESOLVE, DECLARE,
DETB3IY`1NE AND DIRECT:
(A) That the City Clerk shall immediately make and deliver to
each of such persons so elected a certificate of election signed by
him and duly authenticated, said certificates to certify respectively
as follows:

(a) That JOHN A. GEROW was elected as a member of
the City Council of the City of El! Segundo, California,
for the full term of four (4) years;-
(b) That GEORGE LOVE was elected as a member of the
City Council of the City of El Segundo, California, for
the full term of four (4) years; and
(c) That William R. Selby was' elected as a member of
the City Council of the City of El Segundo, California,
for the full term of four (4) years;
(d) That VICTOR D. McC_4RTHY was elected as City Clerk
of the City of El Segundo, California, for the full term of
four (4) years; a ^'
(e) That &PINTA =ZW.ILEB was elected as City Treasurer
of the City of El Segundo, California, for the full term of
four (4) years.
(B) That said City Clerk shall also impose the constitutional
oath of office upon the said JOHN A. GEROW, GEORGE LOVE and WILLLUI R.
SEI,BY, as members of the City Council of said City, and upon the said
Minta Curtzwiler, as City Treasurer of said City, and have them subscribe
thereto and file the same in his office; he shall also take and subscribe
the constitutional oath of office before some person authorized to take oaths
and shall file the same in the office of said City Clerk, as required by law.
(C) That thereupon each and all of said persons so elected to
said rPspective offices shall be inducted into the said respective offices
to which they have respectively been elected.
The motion to adopt the foregoing resolution was carried unanimously (and
by the Mayor declared carried) by the vote shown in the following certificate
of the City Clerk, to -wit:

I, the undersigned, VICTOR D. McCARTHY, City Clerk of the City of
El Segundo, California, do hereby certify that the foregoing resolution was
duly and legally introduced and adopted by the City Council of said City of
E1 Segundo, California, at a meeting of the said Council held on Monday, the
15th day of April, A. D., 1940, and that the same was adopted by the following
vote, to -wit:
Aves: Councilmen Gerow, Hesser, Love, Selby and Mayor Binder.
Noes: Councilmen None.

IN T'ITNESS TA —TREOF, I have hereunto set my hand and affixed the
Official seal of said City of E1 Segundo, California, this 15th day o£ April

The City Cler'_: then delivered a.-Certificate of Election to and
imposed the Constitutional Oath of Office upon John A. Gerow, George Love
and William R. Selby, Councilmen elect, and also upon Minta Curtzwiler,
Treasurer elect, and each subscribed to said oath, and announced that he
had taken and subscribed his constitutional oath bf office before an officer
authorized by law to impose oaths and had filed the same in the office of the
City Clerk.

At this time John A. Gerow, George Love and William R. Selby assumed
their respective offices and took their seats at the Council table, and the
Council as thus constituted, consisted of Councilmen John A. Gerow, George Love,
William R. Selby, Peter E. Binder and Orest 0. Hesser, all of whom were present.
The City Clerk thereupon announced that the official bond of the City
Clerk and the official bond of the City Treasurer had each been duly furnished
and filed as provided by law.
The City Attorney thereupon advised the Council that it would be in
order for the City Council at this time to hold its organization meeting and
proceed to organize by choosing a Mayor. He thereupon presented to the members
of the Council elect the following: "Consent and Waiver of Notice of Organ-
ization Meeting of the City Council of the City of E1 Segundo, California ",
which was subscribed by all of the members of the City Council as so constituted,
and which was thereupon filed with the City Clerk, to -wit:
"Consent and Waiver of Notice of Organization Meeting of the
City Council of the City of El Segundo, California.

KNOW ALL YEN BY Tr-ESE PRESENTS: That we, the undersigned,
constituting and being all of the members of the City Council
of the City of El Segundo, California, as presently constituted,
do hereby give our written consent to the holding of the organ-
ization meeting of the said Council following the regular general
municipal election of April 9, 19400 to be held in the Council
Chamber in the City Hall of said City, in said City, beginning at
this time, to -ait: the hour of 4:15 o'clock p. m. on Monday, the
15th day of April, 1940, for the purpose of organizing said Council
by choosing one of its members as, and to act as, Mayor of said
City, and for the purpose of transacting any other business that
may properly come before said Council, and we hereby, waive any and
all notice of the time and place of the holding of said meeting, and
do hereby consent and agree that the same may be held at said place,
beginning at said time, upon said date, and for said purposes.
IN WITNESS WHEREOF, we have hereunto subscribed our respective
names the 15th day of April, 1940, and file this Consent and Waiver
of Notice, in the office of the City Clerk, to the holding of said
meeting.

The City Council thereupon proceeded with the organization
meeting referred to in the foregoing Consent and Waiver of Notice, and
upon proceedings duly and regularly taken PETER E. BINDER was chosen
by said Council.as Mayor of said City to continue as such Mayor during
the pleasure of said Council and until its further order.
• No further business appearing to be transacted at this
meeting, it was moved by Councilman Hesser, seconded by Councilman
Gerow, the meeting adjourn. Carried.
