A regular meeting of the City Council of the City of E1 Segundo, California, was held in the Council Chamber of the City Hall of said City, having been called to order at 7:00 P. M. by Peter E. Binder, Mayor. ROLL CALL. Councilmen Present: Gerow, Hesser, Love, Selby and Mayor Binder. Councilmen Absent: None. Other Officers Present: Clyde Woodworth - City Attorney. R. T. Hutchins - City Engineer. A. R. Gunn - Street Superintendent. C. K. McConnell - Fire Chief. Victor D. McCarthy - City Clerk. REEADING OF MINUTES OF PREVIOUS MEETING. The minutes of the regular meeting held on the 6th day of September, 1939, were read. No errors or omissions appearing, it was moved by Councilman Love, seconded by Councilman Gerow, the minutes be approved as read. Carried. WRITTEN COMMUNICATICNS. The. following communications, which were read to the Council, were disposed of in the manner indicated, following the reference to each hereinafter: LEAGUE OF CALIFORNIA h1UNICIPALITIES, dated September 1st, 1939, advising of the transmittal to the City Clerk of copy of "Digest of 1939 Legislation Effecting Municipalities ". Ordered filed. CITY OF LONG BEACH, dated September 7th, 1939, soliciting the support and favorable consideration of said City's invitation to the League of California Municipalities to hold its 1940 Convention in Long Beach. Ordered filed. C. L. BROADWATER, Secretary, E1 Segundo High School, advising that the Board of Trustees of E1 Segundo Unified School District has adopted the necessary resolution to initiate legal proceedings in the matter of granting the City of E1 Segundo the right to construct a storm water drain across a certain portion of High School property, and that the proceedings should be completed within two to three weeks. Ordered filed. LLOYD ALDRICH, City Engineer of the City of Los Angeles, dated September 5th, 1939, advising, that pursuant to the letter of the City Engineer of the City of E1 Segundo, dated August 23rd, 1939, he is having the plan for the improvement of Coast Boulevard (Grand Avenue) changed, so that the widening of the existing twenty feet of pavement will be ten feet on each side thereof. Ordered filed. SOUTHERN CALIFORNIA TELEPHONE COMPANY, dated September 12th, 1939, being•an application for a permit to move a pole in the alley west of Virginia Street between Mariposa and Pine Avenues. Said application having received the approval of the Street Superintendent of the City of El Segundo, it was moved by Councilman Gerow, seconded by Councilman Love, that Southern California Telephone Company be and it is hereby granted permission to move one pole in the East side of the alley-westerly of Virginia Street, 171 feet south of Mariposa Avenue, �o a new location 27 feet north of the present one, such work to be prosecuted and completed to the satisfaction of the Street Superintendent of the City of E1 Segundo. Carried. EL SEGUNDO RECREATION COMMISSION, dated /September 13th, 1939, making inquiry with reference to expenditures for recreational purposes. The City Attorney advised that in his opinion it was perfectly competent for the City of E1 Segundo, upon recommendation and approval of the Commission and upon audit by the City Council, to pay demands for materials, supplies and services which were ordinarLy used in connection with recreational activities in the City. He stated that it was quite common practice for cities to provide tennis courts, croquet grounds, baseball fields, shuffleboard courts, etc. etc., and to provide equipment for the same and proper lighting facilities. These were legitimate expenditures in his opinion, as they involve not only recreational features on the part of those who participate in activities but also recreation on the part of that portion of the public which desire to attend the games or activities as spectators. He stated that the procedure which had been followed in the past, whereby the Commission, on behalf of the City, had made arrangements with various merchants for the furnishing of the usual and necessary accessories and services for such activities, all of which were used in connection with public events; the approval of the claims for the various items furnished. by the Commission; the auditing of the respective items of the various claims. presented by the office of the City Clerk by the City Council in the same manner as other claims against the City are audited and the subsequent approval of the various items as legitimate municipal expenditures, were, in his opinion, perfectly regular. He stated that if there were any items, either of materials or services, which appeared at any time;to be questionable, they undoubtedly would receive attention from the auditing officials in the same manner as the items of any other claim would receive such attention. Upon hearing the advice of the City Attorney, the City Clerk, on motion duly made, seconded and unanimously carried, was instructed to communicate with the Commission in response to its letter, advising it accordingly.. None. ORAL COMMUNICATIONS. REPORTS OF STANDING COMMITTEES. Councilman Hesser of the Public Works Committee, recommended con- sideration of•the matter of installing red reflectors on the northerly side of the alley north of Mariposa Avenue opposite the center of the intersections of Eucalyptus Drive and the alleys easterly and westerly thereof, as it appeared to him that a possible traffic hazard exists owing to the fact that there is a comparatively steep bank just beyond these dead end thorough- fares. By general consent the matter was referred to City Engineer Hutchins for an estimate as to the cost of installing the warning reflectors. Councilman Hesser reported that his attention has been called to the fact that frequently uninformed.motor vehicle operators drive to the extreme west end of Palm Avenue in anticipation of driving over the sand hills to the beach. This street being blinded at the sand hills necessitates returning over the same route and to facilitate turning, motorists enter the driveway of a dwelling in the vicinity, causing beams of the head lights of automobiles•to shine through the.windows, disturbing and annoying the tQnants of said dwelling. Following a discussion of the problem, the City Engineer, by general consent, was instructed to prepare a "No Through Street" sign, and erect the same advantageously on Palm Avenue near Hillcrest Street and at the same time to erect a similar sign on Walnut Avenue adjacent to Hillcrest Street. REPORTS OF OFFICERS AND SPECIAL COMMITTEES. P -'398 The City Clerk reported receipt of a Grant of Easement for sanitary sewer purposes from John F. Hussey and Beulah I. Hussey, husband and wife, effecting certain property in the East acreage adjacent to which the City contemplates the construction of a trunk line sewer. Moved by Councilman Love, seconded by Councilman Selby, the following resolution be adopted: RESOLVED, that that certain.Grant bf Easement for sewer trunk line purposes, made by John F. Hussey and Beulah I. Hussey, husband and wife., dated August 31st, 1939, granting to the City of E1 Segundo a perpetual easement and /or right of way, for the construction, reconstruction, inspection, maintenance, operation and repair of a sanitary sewer or sewers, in, over, upon, across and along the Southerly 72 feet of Lot 173, Block 123, as shown upon El Segundo Sheet No. 8, recorded .in Book No. 22, pages 106 and 107 of Maps, records of Los Angeles County, California, and on file in the office of the County Recorder of said County, be and the same is hereby accepted on behalf of the City of E1 Segundo; and BE IT FURTHER RESOLVED, that the City Clerk of the City of El Segundo be and he is hereby directed to cause the said instrument to be filed for record in the office of the County Recorder of Los Angeles County, California. The foregoing resolution was adopted by the following vote: Ayes: Councilmen Gerow, Hesser, Love, Selby and Mayor Binder. Noes: Councilmen None. Absent: Councilmen None. City Engineer Hutchins reported receipt of advice from the local 11% P. A. office that it has about completed its check of the plans of the City of El Segundo for constructing a trunk line sewer in the East acreage and that duplicates of the plans will be forwarded San Francisco and Washington for approval. City Engineer Hutchins reported having had a discussion with Inspector Bloom of the State Division of Oil and Gas with reference to the Rider Well; that Mr. Bloom had some knowledge of the work proposed to-be done on said well, having talked with Mr. Walter Roth, who is interested in the ownership thereof; that Inspector Bloom indicated the State has no control over capping said well or using the gas produced for commercial purposes; that any attempt to remove the drill stems must be undertaken under State supervision and that Mr. Roth has been informed as to such activities as he may pursue with reference to said ,.well without State permits and inspection. City Engineer Hutchins reported also having talked with Mr: Roth, who expressed his willingness to sell the property to the City of El Segundo. City Attorney Woodworth also reported having discussed the matter with Mr. Roth, at which time the sale of the property to the City of E1 Segundo was referred to. City Engineer Hutchins reported that Street Superintendent Gunn had called his 4ttention to excavating which is being done on private property adjacent to Walnut Avenue on the west side of Sepulveda Boulevard; that an investigation discloses the passibility of damage to the public street if such excavating continues to approach the said thoroughfare. After discussion, it was moved by Councilman Hesser, seconded by-Councilman Selby, the following resolution be adopted: P 399 RESOLVED, that the City Engineer of the City of E1 Segundo be authorized and instructed to make a survey of the public street known as Walnut Avenue adjacent to its intersection with Sepulveda Boulevard and if such survey indicates the necessity therefor, the Street Superintendent is hereby authorized and directed to erect guide posts along the northerly line of said street and the City Clerk is authorized and directed to communicate with the owner of said property, calling his attention to the necessity of protecting the highway from damage and requesting said owner to take all precautions necessary to that end. The foregoing resolution was adopted by the following vote: Ayes: Councilmen Gerow, Hesser, Love, Selby and Mayor Binder. Noes: Councilmen None. Absent: Councilmen None. Fire Chief McConnell, through the City Clerk, reported that a State law, which becomes effective September 19th, 1939, makes mandatory the installation of windshields on all trucks, including public emergency vehicles, and that such vehicles include fire apparatus; that, therefore, he had authorized the installation of a windshield upon the fire engine of the City of El Segundo while the same is now undergoing repairs in Los Angeles; that the cost of said wii}dshield is $125.00, plus California State Sales Tax, and that the installation charge will be approximately $15.00. It was thereupon moved by Councilman Selby, seconded by Councilman Love, that the action of the fire chief of the City of E1 Segundo in authorizing the installation of a windshield on the fire engine of the City of E1 Segundo at a cost of not to exceed $140.00, plus California State -Sales Tax, be and the same is hereby ratified and approved. Carried by the following vote: Ayes: Councilmen Gerow, Hesser, Love, Selby and Mayor Binder. Noes: Councilmen None. Absent: Councilmen None. UNFINISHED BUSINESS. The Superintendent of the Water Department presented to the Council his completed plan for increasing the water pressure in that portion of the City of E1 Segundo.bounded by Main Street, Penn Street, Imperial Highway and Pine Avenue, which plan and method had received the approval of Councilman Love. The plan was examined by other members of the Council, who also approved the same. Thereafter it was moved by Councilman Gerow, seconded by Councilman Lgve, that the Superintendent of the Water Department be and he is hereby authorized and directed to purchase one centrifugal pump at a cost not to exceed $400.00, plus California State Sales Tax. Carried by the following vote: Ayes: Councilmen Gerow, Hesser, Love, Selby and Mayor Binder. Noes: Councilmen None. Absent. Councilmen None. Moved.by Councilman Hesser, seconded by Councilman Gerow, that the Superintendent of the Water Department_ be.and he i-s hereby authorrized to purchase a quantity of check valves of ,various sizes, for use in. -water lines of -said Department, all at a cost of not to exceed $350.00, plus California State Sales Tax. Carried by the following vote: Ayes: Councilmen Gerow, Hesser, Love, Selby and Mayor Binder. Noes: Councilmen None. Absent: Councilmen None. P 400 Moved by Mayor Binder, seconded by Councilman Love, that the Superin- tendent of the Water Department of the City of E1 Segundo be and he is hereby authorized and directed to cause to be installed by force account a centrifugal pump and certain check valves in portions of the water distribution system of the City of E1 Segundo, within the area bounded by Pine Avenue, Main Street, Imperial Highway and Penn Street, within the City.of E1 Segundo, for the purpose of increasing water pressure within said area. Carried..by the following vote: Ayes: Councilmen Gerow, Hesser, Love, "Selby and Mayor Binder. Noes: Councilmen None. Absent: Councilmen None. The Superintendent of the Water Department reported that because of mechanical difficulties encountered, which apparently cannot be overcome, he would reco=iend the official abandonment of Water Weld No. 3 of the Water Department of the City of El Segundo. Moved by Councilman Hesser, seconded by Councilman Love, that City of E1 Segundo Water Well No. 3, which was drilled in 1950, and has outlived its usefulness, be and the same is hereby declared officially abandoned. Carried by the following vote: Ayes: Councilmen Gerow, Hesser, Love, Selby and Mayor Binder. Noes: Councilmen None. Absent: Councilmen None. Moved by Councilman Gerow, seconded by Councilman Hesser, the following resolution be adopted: RESOLVED, that the City Clerk be and he is hereby authorized and instructed to Dublish a notice inviting bids for the drilling, casing and completing of a new water well for the City of E1 Segundo, under Specifications No. WW -3 -1938, provided, however, that-the said well shall be located at a point to be designated by the Water Superin- tendent on the following described property within and owned by said City, to -wit: On a portion of Block 34, in the City of El Segundo, California, as shown on E1 Segundo Sheet No. 7, as recorded in Book 22, pages 54 and 55 of Maps, records of Los Angeles County, California, instead of on the property referred to in said Specifications No. WW -3 -1938; such bids to be received up to the hour of 7:15 o'clock P. M. on Wednesday, the 4th day of October, 1939. Carried by the following vote: Ayes: Councilmen Gerow, Hesser, Love, Selby and Mayor Binder. Noes: Councilmen None. Absent: Councilmen None., Discussion was had relative to the proposed widening and improvement of Grand Avenue from Concord Street to the Westerly City Limits, terminating in a motion by Councilman Gerow, seconded by Councilman Love, that the City Attorney of the City of E1 Segundo be and he is hereby authorized and directed to interview the owners of such property as it may be necessary for the City of E1 Segundo to acquire in connection with the-proposed widening and improving of Grand Avenue Prom Concord Street to the Westerly City Limits, and to discuss with such owners of said property all phases of such acquisition and to report to this Council. Carried. None. PAYING BILLS. NEW BUSINESS. P, i. Mr. R. T. Hutchins informed the Council that Mr. C. L. Broadwater, Superintendent of E1 Segundo Schools, had inquired whether or not the City of E1 Segundo's transit might be bor370wed for the purpose of surveying the foundations for the new E1 Segundo Grgmmar School. It appearing that the City Of El Segundo has in gontemplation construction work which will necessitate much surveying and that the requirements of the City and of the School might be in conflict, Mr. Hutchins was directed to further discuss the matter with Mr. Broadwater to see if some other satisfactory arrangement might be made. The Chief of Police reported to the Council that the ammunition and loading machine, which the City purchased some years ago, is in need of repairs, but that there have been improvements made in the construction of reloading machines, which would appear to make the purchase of a new machine desirable; that a new machine may be purchased for $63.75 and a credit of $20.00 allowed on the City's old machine,_ making a net cost to the City for a new machine of $43.75. By general consent the matter was referred to the Public Safety Committee of the Council for investigation and report. Moved by Councilman Love, seconded by Councilman Hesser, that the purchase of twelve 8 -oz. cans of gun powder and 15,000 ninkled primers, be and the same is hereby authorized and directed at a cost of not to exceed $55.00. Carried by the following vote: • Ayes: Councilmen Gerow, He sser,.Love,,Selby and Mayor Binder. Noes: Councilmen None. Absent: Councilmen None. Moved by Councilman Hesser, seconded by Councilman Gerow, that the purchase of fertilizers and 100 magnolia trees, be and the same is hereby authorized and directed, at a cost of not to exceed $300.00, plus California State Sales Tax. Carried by the following vote: Ayes: Councilmen Gerow, Hesser, Love, Selby and Mayor Binder. • Noes: Councilmen None. Absent: Councilmen None. Moved by Councilman Selby, seconded by Councilman Hesser, that the sum of $650.00 be transferred from the General Fund of the City of E1 Segundo to the'Recreation Fund of said City, and that the sum of $4700.00 be transferred from said General Fund to the Library Fund of said City; and that the City Clerk and the City Treasurer of said•City be and they are hereby directed to make said transfers and the requisite entries in their respective books of record.
