1939 MAY 31 CC MINEl Segundo, California. Iyay 31st, 1939. A regular meeting of the City Council of the City of E1 Segundo, California, was called to order at 7:OC o'clock P. Id, on the above date, in the Council Chamber of the City Hall of said City, by Peter E. Binder, Mayor. ROLL CALL. Councilmen Present: Gerow, Hesser, Love, Selby and i.:ayor Binder. R11`0ING OF ZIiv'UTES OF PREVIOUS I =TING. The minutes of the regular meeting held on the 24th day of May, 1939, were read. It appearing that through a misunderstanding, the i.'.inute Record of the action taken by the City Council with respect to painting the City Hall is in error, as the same was recorded at Page P -286 Minutes of the Proceedings of this Council, in that it was the Council's intention to paint the interior of the Council Chamber and the office of the City Judge only, it was moved by Councilman Love, seconded by Councilman Selby, that said minutes be approved as read with the exception that the record of the action taken by this Council with reference to painting; the City Hall as recorded under "Reports of Standing Committees ", at Page P -286, i;inutes of the Proceedings of this Council be changed to read as follows: "After discussion, it was moved by Councilman Gerow, seconded by Councilman Selb;,r, that the work of painting the interior of the Council Chamber in the City Hall and.the.office of the City Judge adjoining the same be done by force account; that I6r. Harry Dooms be employed as painter to prosecute said work and to be compensated for his services and for the furnishing of tarpaulins and other equipment necessary in the prosecution of said work at the rate of N1.25 per hour for such hours as he is actually em- ployed in the capacity of painter for this particular job and that Joseph F. Miner be employed as painter, to be compensated for all services rendered in connection with the painting of said Council Chamber and said City Judge's office at the rate of X1.00 per hour for such time as he is actually employed in the performance of the work hereby ordered and that the City Clerk, as Purchasing .gent, procure all of the necessary paint, brushes and /or other details and equipment which may be necessary in connection therewith. Absent: Councilmen 11one. :,RITTrN COWUNICATIONS.- The foregoing communications, which were read to the Council, were disposed of in the manner indicated following the reference to each hereinafter: P t ► X90 - t .t GRZATrE 2 LOS ANGELES RAPID TR�U,.SIT ASSOCIATION, INC., dated May 29th, 1939, calling attention to the present situation relative to pending Metropolitan Transportation District legislation as embodied in Senate Bill 1243 and Assembly Bill 2625, citing nine reasons why these bills should be defeated and requesting this Council to register with legislators at Sacramento representing this district a protest against the adoption of these bills and urging their support of Assembly Bill 693, which is an enabling act embracing.the same subject and contains .none of the undesirable features which appear in Senate Bill 1243 and Assembly Bill 2625. Relating to the same matter and containing a similar request, there was read to the Council a communication from Citizens Transportation Committee of Los lungeles County, dated Lay 27th, 1939, quoting a certain resolution adopted by said Body, opposing the passage of Senate Bill 1243 and Assembly Bill 2625 and another resolution bearing date the 27th day of May, 1939, recommending the passage of Assembly Bill 693. after consideration and discussion of the matters referred to in the communications of Greater Los Angeles Rapid Transit Association, Inc. and Citizens Transportation Committee of Los Angeles County, it was moved by Councilman Hesser, seconded by Councilman Love, that no action be taken-with reference thereto until after the League of California Municipalities shall have replied to a communication which the City Clerk is hereby directed to send said organization, asking for its comment and recommendations with respect to Assembly Bill 693, Senate Bill 1243 and Assembly Bill 2625. Carried. Shoreline Planning Association of California, Inc., dated May 27th,. 1939, and from the same Association, dated 'u:ay 29th, 1939, urging the defeat of Assanbly Bill 2622, which apparently would tend to deprive the State Park Commission of monies required for acquisition and laintenance of public beaches. It appearing that the Council has heretofore taken action respecting this matter, the communication was ordered filed without further action having been - taken at this time. i LEAGUE OF CALIFORI3IA MUNICIPALITIES, dated May 25th, 1939, its Legislative Bulletin No. 12, referring to Senate Bill 8009 the purpose of which is to fix the maximum schedule of wholesale license fees on vehicles, which maximu- in the judgment of directors of the League of California Y.unicipalities, which Body has given thought and study to the problem, is inadequate and urging that the Council take immediate action with reference thereto. The City Clerk reported that said communication was received May 29th, and contained.the statement that to be effective letters or telegrams concerning the matter would have to reach the State Capitol not later than %ay 29th; that he thereupon conferred with Mayor Binder, who recommended that the State Senator and State Assemblyman representing this area, be sent telegrams requesting their opposition to the passage of said Bill; that accordingly telegrams were dispatched to Honorable Robert W. Kenny, Senator, and Honorable Jack B. Tenney, Assemblyman. It was thereupon moved by Councilman Selby, seconded by Councilman Hesser, that the communication of t3te League of California Municipalities dated May 25th, 1939, being its Legislative Bulletin No. 12 with reference to the wholesale license measure, be received and placed on file in the office of the City Clerk, and that the action of Iviayor Binder in directing the City Clerk td send telee ams to Senator Kenny and.Assemblyman Tenney, soliciting their opposition to the passage of said bill, be and the same is hereby ratified and approved. KEdVY, Senator, Los Angeles County, dated Ylay 24th, 19399 and addressed to Honorable Peter E. Binder, Mayor of the City of E1 Segundo, acknowledging receipt of his telegram of May 18th pertaining to the Council's action relative to the State budget. Ordered filed. ROBERT W. KMNY, Senator, Los Angeles County,, dated May 27th, 1939, addressed to the City Clerk, acknowledging receipt of a telegram dated .:ay 25th, 1939, containing an expression from this Council with reference to proposed legislation. BOARD OF SUPERVISORS OF LOS ANGELS COUNTY, CALIFORNIA, dated May 23rd, 1939, being copy of a resolution adopted by said Body on said date, establishing the policy of said Board of Supervisors with reference to the expenditure, for the purchase of road.materials, of monies allocated to cities out of gas tax fund by said Board of Supervisors. Ordered filed. ORAL COMITUNIC ".TIONS. Mr. L. H. Stewart, a Public Utilities Counsellor, addressed the Council relative to his engagement for preparing a report with reference to the position of the City of E1 Segundo in the matter of.the abandonment of certain freight and passenger rail lines by Pacific Electric Railway Company and the substitution therefor of motor transportation. ire stated he was unable to quote a definite fee for such services as he might render in that connection, due to the fact that he is not fully aware of the extent to which the Council desires him to go with reference to survey and report in said matter, but did quote.a tentative fee based upon the preparation of the material and court appearances he believed would be' required in connection-therewith. Following lengthy discussion, by general consent.the matter was taken under advisement with the understanding that the Council will inform xir. Stewart when it again desires him to appear for a further conference. Yr. 17. V,. Hancock addressed the Council.relative.to employment by the City of E1 Segundo and was told that his case would be given consideration. REPORTS OF ST.'A -DING CO?,ITTMS. None. REPORTS OF OFFICERS AND SPECIAL COMITITTEES. The Acting Water Superintendent reported to the Council that the pump in Vater Well No. 1 will not operate, indicating probable trouble in the lower part of the well;.also' that o,ater.Well No. 3 is caving at a more rapid rate than usual and pumping large quantities of sand,. indicating that its abandonment is imminent. It was thereupon moved by Councilman Selby, seconded by Councilman Love, that the Acting Water Superintendent be and he is hereby authorized and directed to cause the pump shaft and the bowls to be removed from Water `fell No. 3 and such repairs•as may be'found necessary made thereto, at a total cost, of not to exceed $500.00. Carried by the following vote: Ayes: Councilmen Gerow, Hesser, Love, Selby and Mayor Binder. Noes: Councilmen None. Absent: Councilmen None. The Assistant Water Superintendent, Frank Chilson, reported to the Council that an emer7ency had arisen with reference to tha City's sources of P .292 water supply, in this - that Well No. 3 had caved.in; that the pump is stuck in eater Well No. 1 and that considerable time would be needed in_order to repair the same and with the possittility that said ~jell might have suffered damage beyond repair. Discussion was `then had by the.Council and in view of the fact that the summer season is at hand and the maintenance of _an adequate supply of water for domestic consumption and for fire fighting purposes is essential, the Council deeming its action justified in the premises, it was moved by Councilman Hesser, seconded by.Councilman Love, that the following resolution be adopted: Z7IUMEAS, it appears to this Council that two of the hater wells upon which the City of El Segundo is immediately dependent for its sources of supply= of water for domestic and fire fighting purposes have, in the interval since last Council meeting, suffered damage to the extent that said wells are not at this time capable of being operated, nor will they be for sometime in the future, if at all; ,',1M, .t'EDMEAS, this Council feels that immediate steps should be ta?zen to remedy this situation; NO.7, TIMP=RE, .BE IT RESOLVED$ by the City Council of the City of El Segundo, as follows: 1. That an emergency effecting the.public.peace, health and safety of said City exists due to the facts above--recited. 2. That said emergency should be met at once. 3. That a new source of water supply should be provided at.the earliest possible moment. 4. That the Acting : "Dater Superintendent of the City of El Segundo be and he is hereby authorized and instructed to irnediately contact Roscoe Moss Company and arrange for the immediate drilling and casing of anew water well for the City of E1 Segundo, to be designated as Well No. 6 and to be located on property owned by the City of El Segundo on the Southwest corner of Palm Avenue.and California Street within said City, the exact location to be designated by said Acting Water Superin- tendent. 5. That the well heretofore authorized to be drilled, shall be drilled substantially in conformance with the same specifica- tions as were used in connection with the drilling and casing of Well No. 5 of said City. 6. That the Acting Water Superintendent shall report to this Council at its next meeting the arrangements which he has concluded with reference to the drilling of said well and procure the ratification of this Council to his intervening acts in that regard. . 7. That the City Council hereby finds. and determines that the prevailing rates of per diem wages in the City of E1 Segundo for each craft, vocation and calling needed in order to perform the work hereinabove contemplated, are the,same as heretofore established and fixed by this Councilmin connection with the contract for the drilling and casing of said Well No. 5 and such rates are hereby fixed and determined by this Council as being the minimum rates of per diem wages to be paid in connection with the execution of the work hereby ordered. 8. That the City Attorney is authorized and instructed to prepare and present to this Council a form of contract embodying the provisions for the drilling of'the well herein authorized upon receipt of the details ponRected therewith to be furnished him by said Acting '�5ater Superintendent. The foregoing resolution was adopted by the following vote Ayes: Councilmen Gerow, Noes: Councilmen None. Absent: Councilmen None. Hesser, Love, Selby and I +:ayor Binder. Fire Chief C. K. McConnell called attention to the fact that the casing, which protrudes above the ground from the old abandoned oil well at the Northeast corner of California Street and Mariposa Avenue, commonly referred to as the "Rider Odell" is releasing unusual quantities of gas recently and is full of fluid; that action looking toward the proper mechanical abandon- ment of said well should be taken, as he fears damage to fresh water strata and injury to persons unless the pipe in said well is proper117 capped. It was thereupon moved by Councilman Gerow, seconded by Councilman Love, that the matter of the satisfactory abandonment.of the Rider Well by the person, firm or corporation responsible therefor and the removal of the attractive nuisance which exists by reason of the present condition of said well, be referred to the City Attorney for such action as his discretion dictates in the premises. Carried. ..= p NOT , TILMEFORE B IT RESOLVED, that under the particular circumstances and in view of the pending bankruptcy proceedings that the City of El. Segundo will compromise and adjust its said claim, totaling 9'M00.00 against said Government Gasoline and Refining Corporation for the sum of "300.00,_being the amount of the current license fee for each well, less penalty, to -wit, the sum of w150.00 oh each well; ANTD, BE IT FUR= RESOLVED, that the City Attorney be and he is hereby authorized and instructed to execute any and all documents and take any and all steps.necessary in order to effect the compromise and adjustment hereinabove referred to." After discussion, it was moved by Councilman Selby, seconded by Councilman Hesser, that the following resolution be adopted: i'rr,S, the City of El Segundo, California, has a claim against Government Refining and Gasoline Corporation in the sum of "400.00, as follows: Current license fee_ on Guaranty- i'vallace No. 1 ?!yell, "150.00, plus penalty on above .fee, "50.00; and Current license fee on Copinger- 17allace No. 2 Well, '150.00, plus penalty on above fee, "50.00; .!JJD, Cr ,4S, it appears that it is possible to *adjust said claim against said Government. Refining and Gasoline ' Corporation, in the bankruptcy proceedings of said corporation, now pending in the Federal Court of the Southern District of California, for the sum of the original license fee for each well, in the event the penalty *is vraived; N0: 119 T.Hv_ , RE, BE IT ES OLVED, that under the particular circumstances and in view of the pending bankruptcy proceedings that the City of it Segundo will compromise and adjust its said claim, totaling "400.00 against said Government Gasoline and Refining Corporation for the sum'of "300.00, being the amount of the current license fee for each well, less penalty, to -wit, the sum of :- 150.00 on each well; ' AND, ME IT FURTr-.-R RESOLTED, that' the City Attorney be and he is hereby authorized and instructed to execute any and all documents and take any and all steps necessary in order to effect the compromise and adjustment hereinabave referred to.
