1939 MAR 22 CC MINEl Segundo, California. Larch' 22nd, 1939. A regular meeting of the City Council of the City of El Segundo, California, was called to order at 7:00 o'clock P. M. on the above date, in the Council Chamber of the City -;all of said City, by Peter E. Binder, mayor. ROLL CALL. Councilmen Present: Gerow, Hesser, Love and nayor Binder. Councilmen Absent: Selby. Other Officers Present: Clyde ,'doodworth - City Attorney. R. T. Hutchins - City Engineer. Victor D. McCarthy - City Clerk. C. E. M1,cConnell - Fire Chief. READING OF MINUTES OF PREVIOUS MEETING. The minutes of the regular meeting held March 15th, 1939, were read. It appearing that that portion of said minutes recorded at Page P -229, minutes of the proceedings of this Council, reading: "By general consent the City Attorney was instructed to prepare, for the consideration of this Council, an ordinance which would prohibit the sale and discharge of fireworks within the City of E1 Segundo" is in error, inasmuch as such instruction was not given or consented to by this Council at said meeting, it was moved by Councilman Love, seconded by Councilman Hesser, that that portion of the minutes of the proceedings of this Council at its March 15th, 1939 meeting, next above Quoted and referred to, be deleted from said minutes and that said minutes otherwise be approved as hereby corrected. Carried. SMITTEN COP=ICATIONS. The 'following communications, which were read to the Council, were disposed of in the - manner indicated following the reference to each herein- after: UNIOI1 OIL COIED.� Y OF CALIFORNIA, dated LSarch 20th, 1939, requesting Der-mission to install a neon 1176" sign and post therefor in a portion of the *est side of Sepulveda Boulevard approximately 5 feet South of Imperial Highway. The City Attorney stated that subsequent to the date shown upon the application of Union Oil Company for a permit to erect said Neon 1176" sign adjacent. to the Southwest corner of Imperial Highway and Sepulveda Boulevard, a representative of Electrical Products Corporation, the contractors who will erect such sign and lease the same to Union Oil Company, had discussed the matter at length with him and the conversation concluded with the under- standing that the-contractor would further confer with his principal with the idea of erecting the sign entirely upon private property. Therefore, by general consent, action upon the application of Union Oil' Company of California was deferred. URTITED STATES PUBLIC Hl ` TH SERVICE, dated March 16th, 1939, in response to the letter addressed to it March 10th, 19390 by the City Clerk, with reference to the distribution of certain folders relating to public health., expressing pleasure-as to the cooperative attitude of the Council, and sugSesting distribution technique vi :a reference to said folders. By general consent the City Clerk was instructed to confer with the County Health Department for the purpose of ascertaining whether or not it wouldundertake the distribution of the pamphlets referred to, the City Clerk to report his findings to this Council at a future date. LEAGUE OF CALIFORNIA T_MTICIPALItIES, dated February 18th, 1939, being its Legislative Bulletin No. 4, 1939 series, giving the status of certain bills no�i pending before the State Legislature, and requesting Councilmanic action upon certain of those referred to in said Bulletin. P :.234 Following discussion, it was moved by Councilman Gerow, seconded by Councilman Love, that the Mayor of the City of El Segundo be authorized and directed to send telegrams to the State Senator and to the Assemblyman representing this District in the State Legislature, indicating this Council's approval of AB 2059, SB 19 and SB 999 and its disapproval of SB 1089. Carried by the following vote: Ayes: Councilmen Gerow, Hesser, Love and Mayor Binder. Noes: Councilman None: Absent: Councilman Selby. BOARD OF SUPERVISORS OF LOS AIJGLLES COUN?'Y, CALIFORNIA, being a copy of that certain resolution adopted by said Body, Isarch 14th, 1939, establishing a policy with reference to the payment to cities of that portion of gas tax monies allocated to cities within Los Angeles County. Ordered filed. Try TER:,, O COI.:PANY, dated Idarch 18th, 1939, transmitting therewith its check for $200.00, in payment of its 1939 annual oil well license fee and penalty and requesting that the Council take such action as is necessary to release its bonding company from further liability under the bond for faithful performance heretofore filed in connection with the drilling'of its oil well known as Termo -Elsie No. 2. Loved by Councilman Love, seconded by Councilman Hesser, that the following resolution be adopted: The Termo Company, a corporation, on or about the 24th day of November, 1937, was granted a permit to drill an oil well in Lot 163, Block 123, within the City of El Segundo, said oil well being known and designated as Termo- Elsie i'Io. 2;' AND, = —I S, on or about the 18th day of January, 1938, said Termo Company riled with this Council Bond No. 4258086 in the penal sum of :- 5,000.00, with Fidelity and Deposit Company of I:Iaryland as Surety, guaranteeing the faithful nerformance'by said Termo Company of all of the provisions of the hermit hereinbefore referred to and of ordinances of the Oity of E1 Segundo respecting the drilling, operation and maintenance of oil wells; AND, .1- =ZEASI said Termo Company has advised this Council of its abandonment of said oil well on or about the 15th day of November, 1938; AND, MHERE S, on the 8th day of Iaiarch, 1939, the Building Inspector of the City of El Segundo advised this Council by written report now on file in the office of the City Clerk, that said well has been abandoned to his satisfaction; AND, ffHERFwS, since said date said Termo Company has procured its annual license for the calendar year 1939 and has thereby satisfied all of its indebtedness to the City of E1 Segundo; NO179 7- =FORE, BE IT RESOLVED, that the bond of The Termo Company, a corporation, with the Fidelity and Deposit Company of I1a,.:7 land as surety thereon, be and the same is hereby exonerated as to any liability on account of said Termo Company's well named and known as Termo -Elsie No. 2 accruing subsequent to Iuarch 22nd, 1939; AIQD, BE IT FURTHER RESOLVED, that the.City Clerk of the City of El Segundo, is directed to advise The Termo Company and said Fidelity and Deposit Company of Mar:�land of this action. P r APPLICATIONS for employment of Donald W. Balmer, dated March 22nd, 1939, and Kenneth Grunagle, dated March 18th, 1939. Ordered filed. None. ORAL COP,S.zUNICATIONS. REPORTS OF STANDING COlUJITTEES. Councilman Gerow reported that he and the.City Clerk had inspected the City Hall building with reference to painting and redecorating the same and he asked the City Clerk to enumerate the items, which, in their opinion, seemed in need of attention. The Clerk thereupon read a list of the work which appeared desirable to have done and by general consent Councilman Gerow and the City Clerk were recuested to obtain prices on the work and submit the same at their convenience. REPORTS OF OFFICERS ATM SPECIAL COL'IITTT�''S. The City Clerk read to the Council a letter he had received from the Department of ?arks of the City of Los Angeles with reference to the use of oleanders for ornamental tree planting, the writer of said letter reconmmendin; their use. The City Engineer reported that he could find no nursery or tree grower who was interested in purchasing the palm trees which it has been suggested be removed from the parking in a portion of East Idaple Avenue. He explained it would be expensive to remove the trees and that in his opinion they present no hazard at this time. It was therefore, by general consent, decided to do nothing about the matter until a more favorable time. A communication from Southern California Telephone Company, applying for a permit to place poles in the South side of Pine Avenue, one 50 feet easterly of Eucalyptus Drive and another 150 feet easterly of Arena Street, was read by the City Engineer. He stated that upon investigation he found that the poles already had been erected, that said Company had set the poles through the sidewalk in line with other poles which had previously been erected.there. He felt that these poles should have been placed in the parking outside - of the sidewalk area and the Council concurring, it was moved by Councilman Gerow, seconded by Councilman Hesser, that the application of Southern California Telephone Company, dated March 21st, 1939, requesting permission to excavate in the South side of Pine Avenue, 50 feet easterly of Eucalyptus Drive and 150 feet easterly of Arena Street, for the purpose of placing two poles, be and the same is hereby denied; that the applicant be advised that the Council has learned that the poles for which permission to erect had been asked, have already been erected; that the same are placed in locations unsatisfactory to the City of El Segundo and that said Company be requested to remove said poles immediately and to restore the sidewalk; which had been broken to permit of the installation of said poles, to the condition in which the same existed prior to the installation herein referred to. Carried. The City Attorney at this time reported that he had examined the Quitclaim Deed of �'d. T. L;ulcahy and his wife, Lucrecia L. Mulcahy to Ethel Ainsworth and her husband Walter C. Ainsworth, and Quit Claim Deed of L. C. Poberts and his wife Evalyn L. Roberts, to Ethel Ainsworth and her husband 71alter C. Ainsworth, the former deed being dated the 23rd day of January, 1939, and the latter deed dated the 22nd day of November, 1938; also the certified copy of the Judgment.Qu.ieting Title as against Harold Van Cleevan, which had been previously referred to him; that he new felt that the-title to Lots 1 to 6 inclusive of Tract 10058 was notr vested.in the City of El Segundo and that it would be in order to honor the demand of Ethel V. Ainsworth and �Ialter C. Ainsworth, Jr. in regular form for the remainder, to -wit: $250.00, of the purchase price of said property, as per the understanding which the Council had previously had in the matter. His understanding, it was pointed out was that whereas, the purchase price of the property had been the sum of ;1,000.00 and whereas the sellers at the time of actual transfer of the property were unable to dispose of certain outstanding encumbrances and had consented to a reduction of the purchase price in the sum of $250.00 until such time as such encumbrances were removed, whereupon the remaining :250.00 would be payable by the City. It now appearing that the encumbrances P`_ "VJ had-been removed, the City Attorney rendered his opinion as aforesaid. The City Clerk announced that the demand of Ethel V. Ainsworth and TValter'C. Ainsworth, Sr. for the balance of the purchase price of said property mould be included among the demands to be presented later at this meeting. The City Engineer reported having requested three acoustical engineering companies to submit prices for sound proofing the City Hall; that a reply had been received from one only, the quotation indicating a cost of between $3500.00 and $5000.00;,that he expected to receive replies from the others before the next meeting. The City Attorney explained to the Council the provisions of a County ordinance respecting dogs, which the Health Department had requested this City to adopt. After consideration of the same, the matter was taken under advisement until the further order of the Council. The City Attorney reported receipt of a letter from Fergus L. Fairbanks, who is handling the affairs of the Howard Oil Company, to the effect that the'books and records of the Company had only recently been placed in -his hands; that he is not familiar with the claim of the City of El Segundo, but that the claim will be disposed of on a pro rata basis with other claims against the Company as rapidly as funds come into his possession will permit. The Fire Chief reported that d new screen should be mounted on the City Hall chimney, also that the cover of the manhole on the roof of the City Hall should be painted. Moved by Councilman Gerow, seconded by Councilman Love, that these matters be referred to the City Clerk for attention. Carried by the following vote: Ayes: Councilmen Gerow, Love, Hesser and Mayor Binder. Noes: Councilmen None. Absent: Councilman Selby. The Chief of Police reported having conferred with Pair. V1. E. Whiteman of Santa Ana with respect to a two -way radio system for the Police Department; that bir. Vdhiteman had recommended a certain manufacturer to construct the necessary apparatus; that he had written said manufacturer but had received no reply to date. The City Engineer reported that to procure an aerial map of the City, the subdivided area being shown on a scale of 100 feet to the inch, and the iinsubdivided area on a scale of 300 feetcto the inch, would cost $130.00. It appearing that the use for such a map would not justify this expenditure, consideration of the matter was dropped.
