A regular meeting of the City Council of the City of El Segundo, California,
was called to order at 7 :00 o'clock P. M. on the above date, in the Council
Chamber of the City Hall of said City, by Peter E. Binder, Mayor,
ROLL CALL.

READING OF MINUTES OF PREVIOUS TZEETING.
The minutes of the regular meeting held on the 8th day of Lurch, 1939,
were read. No errors or omissions appearing, it was moved by Councilman Selby,
seconded by Councilman Love, the minutes be approved as read. Carried.
13RIT•TEN CO 11U14ICATIONS.
The following communications, which were read to the Council, were disposed
of in the manner indicated following the reference to each hereinafter:
ET.,!ILY G. S1?ILEY, dated March 13th, 1939, requesting the City to remove
-. from her premises at 503 niting Street, two large cypress trees. After
hearing a report respecting the trees from the Street Superintendent and dis-
•cussing the matter at some length, it was moved by Councilman Gerow, seconded
by Councilman Hesser, that the City Clerk be directed to address Mrs. Smiley,
advising her that the City cannot remove the trees from her property. Carried.
E. J. GROW, dated March 15th, 1939, requesting a six months' leave of absence
beginning March 20th, 1939. Moved by Councilman Selby, seconded by Councilman
Love, that effective March 20th, 1939, E. J. Grow, Municipal Mechanic, be granted
a leave of absence, without salary or compensation for a period of not.to
exceed six months. Carried by the following vote:
Ayes: Councilmen Gerow, Hesser, Love, Selby and Mayor Binder.

ELECTRICAL- PRODUCTS CORPORATION OF CALIFORNIA, dated March 13th, 19399
• requesting permission to install a neon sign and pipe standard for the Union
Oil Company of California at the southwest corner of Imperial Highway and
Sepulveda Boulevard, within the City of E1 Segundo and submitting therewith
a dravring showing the location of said sign and post.
After consideration, the City Clerk, by general consent, was instructed
to advise the Electrical Products Corporation that before acting in the matter,
the Council will require an application to be filed by the owner or lessee of
the premises.

ORAL COrAMNICATIONS.
A Mr. Reed, a Termo Company superintendent, requested the Council to
naive its recuirement that his Company be required to pay an annual oil well
ML9400.
license fee of $150.00, plus a penalty of $50.00, for the calendar year 1939,
because.the premises upon which it had drilled its Termo -Elsie No. 2 Well,
had not been completely cleaned up until the latter part of February. He
explained that most,of the work had been done in December, and that the removal
of broken concrete and the resurfacing of the ground had been delayed due to
wet weather, which made it impracticable to operate a tractor on the ground.
The Council explained that in viaw of the provisions of the permit issued
his Company and of the ordinance of the City of El Segundo respecting the drilling,
operation and maintenance of oil wells within said City, and of the further
fact that it has denied similar requests made by other companies, it would have
to deny the present request.
A 1.r. 'Whitehurst addressed the Council relative to making an aerial survey
of the City of El Segundo. He was directed to confer with the City Engineer
during the coming week to determine what scale of map would be desirable for
the City of El Segundo in event the Council authorized such a survey and
what the exact cost thereof would be to.the City. Upon recej.pt of this
information from the City Enginer, the Council would then give the,matter
further consideration.
REPORTS OF STANDING COTiVIITEES.
Councilman Gerow drew attention to the need of painting the exterior
trim of the City Hall. He also,expressed the belief that the interior should
be renovated to.some extent, whereupon by general consent he was instructed
to check the building with the City Clerk and to obtain an estimate for
presentation to the Council.
REPORTS OF OFFICERS AND SPECL4L CObiiv1ITTEES.
The City Clerk reported having heard from the Park Department of the City
of Pasadena respecting the planting of oleanders in public park$ and street
par-kings; that said City had experienced no difficulty therewith and recommended
their use. Thereafter by general consent, Foreman Charles McIlwaine was granted
permission to plant some oleanders in parkings within the City of El Segundo.
.The City Clerk, reporting with respect to the abandonment of a certain
oil well known as Mary No. 1, advised of receipt of a letter from Mr. E. M.
Hilton of the Howard Oil Company, vrnich drilled said well, to the.effect that
his Company had made a settlement with the land oymers,.relieving it of all
liability pertaining to the cleaning up of the premises and that he had.
this date forwarded to one of the owners of the property the letter he had
received from the City Clerk respecting the matter.
The City Clerk reported having received notification from the Health
Officer of Los Angeles County of the lifting,of the dog and cat quarantine;
also of receiving an oral request from a representative of Los Angeles County
Health Department requesting the adoption of an ordinance similar to Los Angeles
County.Ordinance No. 3266, respecting dogs running at large, copy of which
ordinance had been delivered to the City Clerk for presentation to the Council.
By general consent the ordinance was referred to the City Attorney for
examination and cormnent.
The City Engineer reported having conferred with Mr. Ralph Cornell,
Landscape Engineer, relative to t#e removal of tall palm trees from the parking
in the vicinity of 522 East Maple Avenue; that Mr. Cornell stated that in his
opinion the trees are too large to move and hold and that-tree growers would not
be interested unless they had a ready market for-the same. How@ver, he Gave
the Cit,'Enoineer the'names of three tree - growers, with whom the Engineer
stated he would communicate.
The City Attorney reported that the attorney, who had been checking
the ordinances and resolutions of the City of El Segundo under a W. P. A.
project recently completed, had submitted to him a few questions, which he
felt should be determined by the Council and had drawn attention to three
clerical errors in existing ordinances, which might be corrected by amendments.

The first question had reference to whether or not the Qouncil's intention
is correctly expressed in Ordinance No. 208 of the City of E1 Segundo, which
limits the sale and discharge of fireworks to certain hours on certain dates.
The discussion which followed indicated that there is some agitation for a
complete prohibition of the sale and discharge of fireworks and it was brought
out that the State Legislature is now considering a bill, which would prohibit
the sale and use of fireworks throughout the State.
Councilman Gerow expressed the belief that the sale of fireworks to and
the discharge thereof by the public generally should be prohibited, but felt that
some public agency should haves- oad`_iarge fireworks display July 4th each year
under governmental supervision. By general consent the City Attorney was
instructed to prepare, for the consideration of this Council, gn ordinance
which would prohibit the sale and discharge of fireworks within the City of E1 ^t
Segundo.
The second question was with reference to a duplication of numbers
assigned to two ordinances of the City of E1 Segundo and it appearing that this
was a clerical error, which could be corrected by the adoption of an amendatory

The third matter was a clerical error in Ordinance No. 45, which may be
remedied by the adoption of an amendatory ordinance, whereupon Councilman Selby
introduced Ordinance No. 219, entitled:

The City Attorney reported that Southern California Telephone Company
had filed an action in Superior Court, naming the City of El Segundo as
Defendant, said action having reference to basin questions of law with
reference to the State Board of Equalization assessing property of said Company;
that said Company had filed a stipulation that the City will not have to do
anything about the matter until given ten days notice by the Company, whereupon
it was moved by Councilman Love,'seconded by Councilman Selby, that the
following resolution be adopted:
RESOLVED, that the City Attorney be and he is hereby
authorized and instructed to appear in that certain action in
the Superior Court of the State of California, in and for the
County of Los Angeles, entitled: "Southern California Telephone Company,
a Corporation, vs. City of El Segundo, a LTunicipal Corporation ",
and to make defense of said action on behalf of said defendant
City, filing such documents and pleadings and taking such pro-
ceedings and making such arguments as in his opinion will best
subserve the interests of said City and protect its position in
the matter; and
BE IT FURT: RESOLVED, that said City Attorney shall be
entitled to receive and there shall be paid to him an additional
compensation for his services with reference to the said action,
to be paid upon presentation of proper demand therefor to be
audited and approved in the usual manner.
The foregoing resolution was adopted by the following vote:

The City Clerk reported having received from Walter Ainsworth, Sr.
a quit claim deed executed by W. T. Mulcahy and Lucretia Mulcahy, his
wife; also a quit claim deed executed by L. C. Roberts and Evelyn L. Roberts,
his wife, -and what. purports to be -a certified copy of a judgment in a quiet
title action, all respecting Lots 1 to 6 inclusive, of Tract 10058, recently
purchased by the City of E1 Segundo for water development purposes. The
City Clerk stated that Mr. Ainsworth, one of the owners from whom the City
purchased said•property, felt that these two instruments would now clear
the record, so that the-grantors would be entitled to receive the money
which was held up by the City at the time it took over the property.
By general consent the instruments were referred to the City Attorney
for examination and report at the next meeting of the Council.

Moved by Councilman Selby, seconded by Councilman Hesser, the following
resolution be adopted:
WHEREAS, Wilshire Oil Company, Inc. did heretofore furnish
to the City of El Segundo its certain bond in the penal sum
of $25,000.00, with Fidelity and Deposit Company of Maryland
as surety, and which said bond bears date the 5th day of January,
A. D. 1938, relating to those certain oil dells within the City
of E1 Segundo, designated and Down as: Wilshire Oil Company, Inc.
Elsie9 -1; Wilshire Oil Company, Inc. Elsie 9 -2,; Wilshire Oil
Company, Inc. Elsie 2 -1; Wilshire Oil Company, Inc. E1 Segundo
Construction Company No. 1 and Wilshire Oil Company, Inc. Security
No, 2;
AND, YEEREAS, it appears that that particular well here -
inabove designated as Wilshire Oil Company, Inc. El Segundo
Construction Company No. 1 has been heretofore duly and properly
abandoned and that,-therefore, no bond is now required in
connection- with said well;

Oil Company, Inc. now desires to post individual bonds in

to in the principal sum of $5,000.00 each in lieu of the said

2. That this Council does hereby exonerate the said
bond for $25,000.00 given by said Wilshire Oil Company, Inc. with
said Fidelity and Deposit Company of Maryland as Surety, and
bearing date the 5th day of January, A. D. 1939, as to any and
all liability accruing thereon or thereunder on or subsequent

3. That the City Clerk be and he is hereby authorized
and instructed to forward a copy of this resolution to said
Wilshire Oil Company, Inc. and to said Fidelity and Deposit
Company of Maryland, surety, for their information in the premises.
