A regular meeting of the City Council-of the City of E1 Segundo, California,
was called to order at 7 :00 o'clock P. LYI. on the above date, in the Council
-Chamber of the City Hall of said Oity, by Peter E. Binder, Mayor,

The minutes of the regular meeting held on the 15th day of February,
1939, were read. No errors or omissions appearing, it was moved by
Councilman Love, seconded by Councilman Selby, the minutes be approved as
read. Carried.
WRITTEN COMI RM CAT IONS.
The following communications, which were read to the Council, were
disposed of in the manner indicated following the reference to each herein-
after:
B. B. LITTRELL, dated February 30th, 1939, making application for
employment as an auto mechanic. Ordered filed.
STATE COLiPENSATION INSURANCE FUND, dated February 17th, 1939, with
reference to Case No. Y- 733046, injured - C. Dinwiddiee Ordered filed.
HAROLD D. BRIL�'Y, Bishop, Church of Jesus Christ of Latter Day Saints,
dated February 17th, 1939, requesting permission to use additional facilities
at the City Hall 45 minutes each Sunday in connection with its religious
services. By general consent the Clerk was instructed to advise the
writer that by reason of the fact that his Church group is a regular tenant
of the City of El Segundo, said group may use the Council Chamber of the City
Hall each Sunday fora 45 minute period, by courtesy of the City Council
and until ibs further order; provided, however, that such use shall at all
times be subject to the prior right of.the public to use the same.

REPORTS OF STANDING C01,11ITTEIPS.
REPORTS OF OFFICERS AND SPECIAL COLUITTEES.
The City Clerk advised the Council that City Foreman Charles MoIlwaine
had inquired of him whether or not the Council had made a decision with
respect to the planting of oleander trees in certain parkings within the City
of El Segundo. It appearing that no decision has been reached due to the fact
that the Council has not had data before it respecting said trees, the City
Clerk•vras directed to address,communications to the Park Departments of the '
Cities of Los Angeles, Pasadena and San Bernardino, and to the Department of
Agriculture of the State of California, requesting that these agencies advise
with respect to their experience and knowledge of oleanders.
In connection with the abandonment of that certain oil well known as
Termo -Elsie No. 2, concerning which Fidelity and Deposit Company of Maryland,
as Surety, and The Termo Company, as permittees, each addressed communications
to the City of E1 Segundo under date of January 20th, 1939, which communications
were filed with this Council January 25th, 1939, at which time the Building
Inspector was instructed to ascertain whether or not said well had been abandoned
in accordance with the permit granted for the drilling thereof, and as provided

for in Ordinance No. 211 of the City of El Segundo, the Building Inspector
reported that the derrick has been removed but that the cement concrete
derrick footings and slab have been broken and piled upon'the property; that
a sump approximately 8 ft. x 30 ft. contains refuse and is only partially
filled and that other debris remains upon the property upon which said well
was drilled; whereupon it was moved by Councilman Love, seconded by Councilman
Gerow, that the following resolution be adopted:
1'E= S, on January 25th, 1939, there was presented and read
to this Council a communication from The Termo Company advising
of the abandonment of its ail well '_mown as Termo -Elsie No. 2;
also a communication from Fidelity and Deposit Company of Ialaryland,
requesting that it be given a release of its obligation under
its bond insuring the performance of The Terno Company in con-
nection with the permit issued to said Company for the drilling
of that certain oil well known as Termo -Elsie No. 2;
AND, V C, on said date, the Building Inspector of the
City of El Segundo was instructed to ascertain whether or not said
well had been abandoned in all particulars in accordance with the
permit granted by this Council for the drilling, operation and
maintenance of said well;
APdD, 1 r 5, said Building Inspector has reported this date
that said well has not been abandoned in accordance with said permit
and with ordinances of the City of El Segundo respecting the abandon-
ment of oil wells within said City in this - that the swJJhas not
been filled; that debris consisting of planks, dirt and broken
pieces of cement concrete remain upon the property and that the
surface of the ground adjacent to said well has not been restored
as nearly as possible to the same condition it was in prior to the
drilling of said well;
AND, ,El=,S, under the provisions of the permit issued for
the drilling of said well, said permittee is bound and agrees to
remove any and all structures and appurtenances and to restore the
premises as nearly as reasonably possible to the condition in which
same existed at the time the said permit was granted;
AND, IVEEMEAS, Fidelity and Deposit Company of Maryland, under
the bond given for the faithful performance of said permit and its
provisions, undertook to guarantee the performance of the acts
required on the part of said Termo Company in: connection with said
permit;
NOVI, UEFORE, the City Council of the City'of El Segundo,
California, does hereby resolve, determine, declare and order as
follows:
1. That said City Council hereby- finds that said well has
not been completely abandoned as contemplated under the provisions
of said permit in - this'- that there still remains'to be removed
from said premises the appurtenances and debris above referred to,
and the cleaning up of said premises must be further accomplished•,
that the sump must be filled and the ground restored to as nearly
as reasonably possible the same condition in which it existed at
the time of the issuance of said permit.
2. That said permittee named in said permit and Fidelity and
Deposit Company of Maryland, its bondsman under the bond given in
connection with'the said permit, be and they are hereby ordered and
required to immediately cause the remaining work of abandonment Above
referred to to be performed and completed in accordance with the
terms and requirements of said permit.
3. That said City-Council hereby finds and determines that
said permittee and its said surety are in default'under the terms
of said permit and bond in the particulars above stated and they are
hereby required and ordered to remedy such default as hereinabove
contemplated and to place their indebtedness to the City of E1 Segundo
in good order, said indebtedness to the City of El Segundo being
oil well license fee for the calendar year 1939, which is due and
payable under the provisions of Ordinance No. 211 of said City.

4. That the City Clerk shall prepare certified copies
of this resolution and shall forward one such certified copy
to each of the following:
(a) The Termo Company, the permittee.
(b) Fidelity and Deposit Company of Maryland, the bonding
company.
(c) The owner of the property upon which said well was
drilled, when the City Clerk of the City of E1 Segundo
shall have ascertained the name of the owner of said
property.
The foregoing resolution was adopted by the following vote:
Ayes: Councilmen Gerow, Love, Selby and Mayor Binder.
Noes: Councilmen None.
Absent: Councilman Hesser.
In connection with the abandonment of Union Oil Company of California's
'!Jell No. 3, the Street Superintendent reported that that portion of the
curb on the East side of Sepulveda Boulevard, between El Segundo Boulevard
and Rosecrans Avenue, which had been removed to permit of ingress to- and
egress from said well in Section 18, has now been replaced in satisfactory
manner.
It appearing also that El Segundo Land and Improvement Company,
owners of the land upon which said well had been drilled, has heretofore
advised this Council that approximately 600 feet of oiled roadway need
not be removed therefrom in order to complete abandonment of said well,
and that therefore said well is now abandoned to the satisfaction of the
City of El Segundo, it was thereupon moved by Councilman Gerow, seconded
by Councilman Love, that the following resolution be adopted:
T1JHE"T2Er�.S, under date of July 21st, 1937, this Council granted
Union Oil Company of California a permit to erect one derrick
for the purpose of drilling for oil, gasand /or other hydrocarbon
substances.in a portion of Section 18, Township 3 South, Range
14 471est, S. B. B. & H. in the City of El Segundo, said well to
be known and designated as "El Segundo No. 3 ";
AND, Z=REAS, this Council has been advised of the abandon-
ment of said "El Segundo No. 8" well, and has received the
report of its Building Inspector to the effect that said well
has been abandoned in a manner satisfactory to the City of E1
Segundo;
NOW, THEREFORE, BE IT RESOLVED, that the bond of said
permittee, Union Oil Company of California, with Hartford
Accident and Indemnity Company as surety, covering the said
well, be and the same is hereby exonerated as to any liability
accruing thereon subsequent to this date;
AND, BE IT FURTHER RESOLVED, that the City Clerk be and
he is hereby authorized and instructed to forward a certified
copy of this resolution to Union Oil Company of California and
to Hartford -Accident and Indemnity Company.
The foregoing resolution was adopted by the following vote:
Ayes: Councilmer.'Gerow, Love, Selby and Mayor Binder.

name "M�bnicipally Sponsored Old Timers''Club" be lettered upon the front
of that certain building leased by the City of El Segundo and occupied
and used as a recreation room for elderly residents of the City of E1
Segundo, the total cost thereof not to exceed $5.00. Carried by the
following vote:
Ayes: Councilmen Gerow, Love, Selby and Mayor Binder.
Noes: Councilmen None.

No further business appearing to be transacted at this meeting, it
was moved by Councilman Gerow, seconded by Councilman Love, the meeting
