A regular meeting of the City Council of the City of E1 Segundo, California,_
was called to order at 7:00 otclock P. M. on the above date, in the Council
Chamber of the City Hall of said City, by Peter E. Binder, Mayor.
ROLL CALL.
Councilmen Present: Gerow, Hesser, Love, Selby and Mayor Binder.
Councilmen Absent: None.
Other Officers Present:
Clyde Woodworth - City Attorney.
Frank Chilson - Asst. City Engineer.
Victor D. McCarthy - City Clerk.
READING OF ML=ES OF PREVIOUS FETING.
The minutes of the regular meeting held on the lst day of February, 1939,
were read. No errors or'omissions appearing, it was moved by Councilman
Love, seconded by Councilman Selby, the minutes be approved as read. Carried.
WRITTEN COP!JJNICATIONS.
The following comnunications, which were road to the Council, were
disposed of in the manner indicated following the reference to each hereinafter:
E. B. MORITZ FOUNDRY, dated February 7th, 1939, advertising its "School
Girl" traffic sign and quoting.prices thereon. Ordered filed.
SOUTH,3EST DISTRICT HIaEVAYS ASSOCIATION, dated February 3rd, 1939,
transmitting copy of a resolution adopted by said Body, endorsing William B.
Barclay, City Engineer of the City of Hawthorne, for appointment to membership
on the Highway Commission of the State of California, and requesting this
Council to add its endorsement to those already forwarded Governor Olson.
After discussing the matter, it was moved by Councilman Gerow, seconded
by Councilman Love, that the following resolution be adopted:
WHEREAS, there exists a vacancy in the Highway Commission
of the State of California, which Commission deals with technical
and practical problems of an important nature, which demand
training and experience in their impartial, intelligent and
economic solution;
AND,,WHEREAS, said Highway Commission is'a body exercising
jurisdiction throughout all portions of the State of California,
making it seem logical therefore that its membership be composed
of individuals chosen from various sections of the State of
California;
AMID, WHEREAS, it appears that Los Angeles County has not
had representation on said Commission' for a great many years and
that it is felt by some that the Southwest portion of Los Angeles
County has not been accorded the consideration it deserves in
the treatme'nt,of it's Highway problems during recent years and
that therefore an appointee from the Southwest region .of.Los
Angeles County seems desirable and reasonable at this time;
AND, WHEREAS, there resides in the City of Hawthorne in
Los Angeles County, one William R. Barclay, a licensed civil
engineer, with wide experience in highway construction work, who
is recommended by and has received the endorsement of numerous
individuals and civic groups for appointment by Governor Culbert
L. Olson to the office of member of the Highway Commission of
the State of California to fill the vacancy hereinbefore referred to;

AND, 4'tI-==, from information which has come to
it'and from the personal observation and knowledge of
several of its members, this Council believes Mr. William
B. Barclay to be qualified in all respects to fill the
office of member of the Highway Commission of the State of
California;
Nows =,REFORE, BE IT RESOLVED, that the City Council
of the City of El Segundo, in regular session assembled this
8th day of February, 1939, does hereby endorse the candidacy
of Mr. William. R. Barclay for appointment to the office of
Highway Commissioner of the State of California, does hereby
recommend such appointment to His Excellency Culbert L.
Olson, Governor of the said State and sincerely and respect-
fully urges Governor Olson to give favorable consideration
to this petition.
The foregoing resolution was adopted by the following voter
byes: Councilmen Gerow, Hesser, Love, Selby and Mayor Binder.

CITY OF SOUTHGATE, dated February 6th, 1939, elaborating upon
the arrangements which have been made for the holding of a meeting of the
Los Angeles County Division of the League of California Municipalities at
Southgate, February 20th, 1939, and urging that arrangements be made for
the attendance thereat of a full representation from the City of El
Segundo. By general consent action respecting the matter was taken under
consideration until the next regular meeting of the Council.
I"—q AGUE OF CALIFLRNIA MUNICIPALITIES, dated February 4th, 1939,
being its Legislative Bulletin No. 3, 1939 series, conveying information
respecting the status of certain bills pending before the Legislature
of the State of California which effect municipalities. Ordered filed.
DIVISION OF OIL AND GAS, dated February 3rd, 1939, disclosing
the record of said Division respecting the abandonment of that certain
oil well known and described as George R. Rider Well No. 1. Ordered filed.
GUY E. PEARSALL, dated February 7th, 1939, being an application
for employment by the City of El Segundo. Ordered filed.
SPECIAL ORDER OF BUSINESS.
The hour of 7:15 P. M. at this meeting, having heretofore been
fixed as the time, date and place for the reception of bids for furnishing
the City of El Segundo certain hydrated lime in accordance with notice
therefor published in time, form and manner provided by law, the Mayor
announced the arrival of the hour of 7:14 P. M. and asked if there were
any person or persons present who desired to file bids.
The hour of 7 :15 P. M. having arrived and all bids being in, the
Mayor declared the time for receiving bids for furnishing the City of E1
Segundo certain quantities of hydrated lime as advertised for, closed.
The City Clerk announced that six sealed bids had been received;
that he had-in his possession one unsealed bid received by ordinary mail
in the office of the Kater Department without proper identification being
endorsed upon the outside of the envelope containing said bid; that the
envelope was opened upon receipt and when the nature of its contents dis-
covered, the communication, together with the envelope which contained the
same, was delivered to the City Clerk by the Assistant City Engineer; that
the bid had been in the possession of the City Clerk prior to the hour of
7:15 P. M. and that he has not conveyed the contents of said communication
or bid to any other person.
The Council thereupon by general consent decided to consider said
communication as a regular bid, whereupon it was moved by Councilman Gerow,
seconded by Councilman Love, that this Council proceed to open, examine
and publicly declare all bids received this date for furnishing the City of
E1 Segundo a certain quantity of hydrated lime as advertised for. Carried.
The Council thereupon proceeded to and did open, examine and
publicly declare all of the bids received this date for furnishing the City
of E1 Segundo hydrated lime as advertised for, which said bids were found
by said Council to be as follows, to -wit: `

At the conclusion-of the declaration of said bids, it was moved by
Councilman Hesser, seconded by Councilman Gerow, that all bids received this
date for furnishing the City of E1 Segundo a certain quantity of hydrated
lime be taken under advisement until the hour of 7:25 P. M. at the regular
meeting of this Council to be held Fobtu.ary 15th, 1939. Carried.
ORAL C OM= CATIONS .
A representative of Pacific Western Oil Corporation (name not obtained),
addressed the Council relative to waiving the annual license fee of $150.00
on its well known as Goodwin No. 1, abandonment of which had begun prior to
January lst, 1939, which said license fee had not been paid prior to January
15th, 1939, and therefore by reason of the penalty for delinquency which
accrued after said date, is now $200.00.
The-Council gave consideration to the request, but could not acquiesce
therein by reason of the existence of an ordinance of the City of El Segundo
making license fees for oil wells payable in full for each calendar year
durin such time as any oil well is not abandoned fully in compliance with
the permit granted for the drilling, operation and maintenance thereof, which
permits require that all appurtenances be removed from any premises upon which
an oil well is drilled and that sump holes be filled and the ground restored
as nearly as possible to the same condition-it was in prior to the drilling of
any well.

REPORTS OF STANDING COMbITTEES.
REPORTS OF OFFICERS AND SPECIAL COMNLITTEES.
Assistant City Engineer Frank Chilson reported having inspected the
derrick of that certain oil well named and known as "Van No. 1 ", located
on a portion of Lot 4 of J. H. Fisher's Subdivision of Section 12, Township
3 South, Range 15 West, S. B. B. & M., within the City of El Segundo; that
in his opinion the derrick is satisfactorily braced and in sound condition,
but is not suitably guyed, making it hazardous during wind storms; that the
sumps and pits on the premises have not been filled and that there is an
accumulation of trash on the property; that the derrick ladder is available
from the dery ck platform, thus creating an attractive nuisance and a
dangerous condition which should be remedied: -
It was thereupon moved by Councilman Gerow, seconded by Councilman Hesser,
the following resolution•be adopted:
'RESOLVED, that the City Clerk be and he is hereby authorized
and instructed to address a cor;munication to the permittee of that
certain oil well within the City of E1 Segundo, California,
designated and known as "Van No. 1" and to the owner or owners of
the real property upon which said well is locate-d,-calling their
attention to the fact that the derrick and appurtenances of said
well, in their present condition, constitute a nuisance which is
attractive to - minors, and v&.ieh under some conditions might be
dangerous to other persons and property as well, and requesting
that the said permittee and /or owners glace such property in proper
condition, so that it will not constitute any such nuisance.
The foregoing resolution was adopted by the following vote:

Assistant City Engineer Frank Chilson advised the Council that on February
3rd, 1939, in company with Councilman Gerow and City Clerk McCarthy, he had
attended the hearing before the Railroad Commission of the State of California
in the matter of the City of El Segundo, et al vs. Southern California Edison
Companyr, Ltd; that so far as the presentation of testimony of witnesses is
concerned, the case was concluded on said date, the Commission allowing each
party twenty days in'which to file concluding briefs, after which the Commission
will give its decision in the matter.
City Attorney Woodworth supplemented the report of the Assistant City
Engineer with reference to the Railroad Commission hearing of February 3rd,
information respecting which was given him by his associate, Mr. Lester 0. Luce,
who attended the said hearing in Mr, Woodworth's behalf, due to the necessity
of Mr. Woodworth appearing in another court on another matter on said date.
UNFINISHED BUSINESS.
In the matter of the request of El Segundo Post No: 38, American Legion,
for permission to use the Fire Department diaphone for giving an emergency
mobilization alarm, no decision having been reached, by general consent the
matter was taken under further advisement until the next regular meeting of
the Council.

The following demands, having had the approval of the Committee on
Finance and Records, were read:

transferred from the General Fund of the City of El Segundo to the Library Fund•
of said City the sum of $3000,00, and that the City Clerk and City Treasurer of
said City be authorized to make appropriate entries in their respective books
of record respecting said transfer. Carried by the following vote:

Moved by Councilman Gerow, seconded by Councilman Love, that the
following resolution be adopted:
WHEREAS, this Souncil deems it desirable to provide a
Recreation Room for elderly men of the community;
AND, WHEREAS, there is available for such purpose, suitable
quarters in that certain one story building No. 147 Richmond
Street, in the City of El Segundo, which said quarters may be
rented at a figure which this Council deems reasonable;
NOW, THEREFORE, BE IT RESOLVED, that that certain one
story frame building situated No. 147 Richmond Street in the
City of E1 Segundo, California, be rented from its owner, R. M.
Converse, for the sum of $37.50 for the period ending February
28th, 1939,iand thereafter, until the further order of this
Council, on a month to month basis at the monthly rental or
sum of $25.00, the City of El Segundo to pay all charges for
public utiiity services at said premises.
