A regular meeting of the City Council of the City of El Segundo, California,
was called to order at 7:00 o'clock P. M. on the above date, in the Council
Chamber of the City Hall of said City, by Peter E. Binder, Mayor.

REPXING OF MINUTES OF PREVIOUS =ING.
The minutes of the regular meeting held on the 26th day of October, 1938,
were read. No errors or omissions appearing, it was moved by Councilman
Selby, seconded by Councilman Gerow, the minutes be approved as read. Carried.
'WRIT'IEN COM 1UNICATIONS.
The following communications, which were read to the Council, were disposed
of in the manner indicated following the reference to each hereinafter:
RAY L. CHESEBRO, Member, California Committee, Council on State Defense,
undated, advising that at a meeting of the Los Angeles County League of
'Municipalities, held October 20th, 1938, said Body adopted a resolution on
the subject of Federal taxation of municipal securities and salaries, and
requesting this Council to adopt a similar resolution.
?Moved by Councilman Selby, seconded by Councilman Hesser, the following
resolution be adopted:
R&E REAS, concerted efforts are now being made to subject
to federal taxation the income from municipal bonds and the
salaries of municipal employees, and to give such taxation
retroactive effect; and
W11ERE_AS, the taxation of income from municipal bonds would
inevitably result in increasing the cost of local government
and, in so far as retroactive, would work a serious injustice
to persons who paid a higher price for such bonds, relying upon
their exemption from taxation than they otherwise would have
paid; and
VE EREAS, the retroactive taxation of the income of municipal
employees would be financially ruinous-and unfair to those
employees and injurious to the communities in which they reside;
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the
City of E1 Segundo
1. Condemns as unfair, oppressive and un- American the
imposition of retroactive taxes upon the income from municipal
bonds and municipal salaries;
2. Urges that if equitable and non - retroactive taxation
of the income from muzicipal.salaries hereafter be contemplated,
such taxation be authorized only on the condition that the State
be afforded the reciprocal right to tax income from federal salaries;
3. Is convinced that the radical change in relationship
between local and federal government that is iiiherent in current
efforts to tax municipal securities and salaries should be
accomplished only by sanction of the people as a whole, expressed
through well considered amendment of the Constitution, and not
by judicial law - making;

AND, BE IT FURTEER RESOLVED, that this Council does
hereby urge all candidates for election to Congress to care-
fully consider the views herein expressed, and to lend their
constant support to all proper legislative means for carrying
them into effect, and does hereby direct the City Clerk of
the City of E1 Segundo to transmit immediately a copy of
this resolution to every candidate for election to the Congress
from this District.
The motion carried, Councilman�Gerow not voting.
DOUGLAS AIRCRAFT CO. INC., dated October 29th, 1938, its File No.
30, in response to the City Clerk's letter of October 25th, 1938, advising
that said Company will endeavor to prevent, in the future, disturbances
created by its planes flying over the City of E1 Segundo. during testing
operations, as heretofore complained of by resi-dents of said City. Ordered
filed.
SOUTEERN CALIFORNIA GAS COMPANY, dated October 27th, 1938, being an
application for a permit to excavate at the Northeast corner of Lain Street
and Franklin Avenue for the purpose of installing a regulator vault.
Moved by Councilman Gerow, seconded by Councilman Hesser, that Southern
California Gas Company be'and it is hereby granted permission to excavate in
the pavement and in the sidewalk at the Northeast corner of Main Street and
Franklin Avenue within the City of E1 Segundo, for the purpose of installing
a gas regulator and a vault to house the same, provided the work is prosecuted
and completed in a good workmanlike and safe manner and to the satisfaction
of the Street Superintendent of the City of�El Segundo. Carried.
LOGAN R. COTTON, Accountant and-Auditor, dated November lst, 1938,
transmitting therewith his report of his audit of the accounts and records of
the various departments of the City of El Segundo for the quarter ended
September 30th, 1938; wherein he made nine comments respecting which the City
Clerk reported as follows:
That Comments 1 and 2 refer to erroneous credits of income in amount
of $3.00 each in the Court docket, the errors correcting each other by off -set;
That Comment 3 referred to a credit of $0.00 to Street Department Fund
in the Court Docket, whereas credit should have been to General Fund, this
was corrected by Journal entry;
That Comment 4 referred to a credit of $1.00 to Electrical Permits
Per Treasurer's Receipt No. 7469, whereas it should have been Plumbing Permits.
Adjusted by Journal entry;
That Comment 5 referred to at duplicate payment of $3.00 for postage.
Corrected by Clerk's Receipt No, 5002,
That Comments 6 and 8 referred to distribution of payments of $13.50
and $8.78 in the General Fund and Water Department respectively, the Auditor
suggesting that the items be charged to accounts others thaA those to which
they had been charged. The comments represented differences of opinion and
are only argumentative.
That Comments 7 and 9 refer to charges to wrong accounts in the Water
Department and have been corrected.
Moved by Mayor Binder, seconded by Councilman Gerow that the Quarterly
Report of Logan R. Cotton for the quarter year ended September 30th, 19389
be reneived and filed and that the City'Clerk's explanations as to the
disposal of the items'oi comments made in said report be approved.. Carried.
LOS ANGELES COUN'T'Y DIVISION LEAGUE OF CALIFORNIA MUNICIPALITIES,
dated October 24th, 1938, being a report of the meeting of-the Board of
Directors of said League held on said date. The document contained a state-
ment of budgeted revenue and expenses of the League of California Municipalities
for the current year and indicated that voluntary increase in membership dues
is necessary if the League is to continue to function in the efficient manner
that it has in the past. The report contained a resolution requesting the
cities of Los Angeles County to advise the State League office of their

willingness to accept an increase in dues -on, a voluntary basis,, so that the
officers of said League may proceed with its program for 1939.
Following discussion, during which several members of the Council expressed
the belief that the benefits received by the cities through membership in said
League are well-worth-the cost of dues, it was moved by Councilman Gerow,
seconded by Councilman Selby, that the City Clerk be authorized and instructed
to advise the League of California Municipalities that this City is willing to
accept an increase in dues to said League on a voluntary basis for the current
dues year. . Carried by the following vote:
Ayes: Councilmen Gerow, Hesser, Selby and Mayor Binder,
Noes: Councilmen None.

SPECIAL ORDER OF BUSINESS.
The hour of 7:15 o'clock P. M. at this meeting, having heretofore been fixed
as the time for receiving bids for drilling, casing and completing a water well
for the City of El Segundo, as advertised for, the Mayor announced the arrival
of 7:14 o'clock P. M. and asked that any person or persons present who desired
to file bids, do so immediately.
The hour of 7 :15 P. M. having arrived and all bids being in, the 11ayor
announced the time closed for receiving bids for &i-lling, casing and completing
a water well for the City of El Segundo.
The City Clerk announced that four bids had been received.
Moved by Councilman Selby, seconded by Councilman Gerow, that the Council
proceed to open, examine and publicly declare all of the bids received for
drilling, casing and completing a water well in and for the City of El Segundo.

1. Following bid on a well to be dri4ed on site selected by the
City Council of the City of E1 Segando on Tract 10058,•
city of El Segundo, as per map recorded in Book 142, Page 17 of
Maps of the records of Los Angeles County, Los Angeles, California.
2. I will drill a sixteen (161 inch water well to an approximate
depth of 350 feet below the surface of the ground, or into strata
producing flow of water which the City Council of E1 Segundo,
California, considers sufficient, and will furnish all labor,
materials, machinery, tools, equipment and supplies for drilling,
and will paint the inside surface of the outer casing and the
outside surface of the inner casing with red lead and oil as the
casing is installed, and will furnish proper and acceptable
performance bonds, and will carry complete workman's compensation
and complete public liability insurance as a protection to the City
of El Segundo and the contractor as signed below, for a total
price of $6.18 per foot, or for a lump sum as set forth above,
350 feet .$2162.00.
3. I will furnish and set test pump and will run it for 48 hours for
a total additional cost of . . . 350.00
and should the City Council desire to run test beyond 48 hours
the cost will be $2.50 per hour after the first 48 hours, the
City of El Segundo to furnish power and deliver at switch board.
4. Should the well be drilled beyond 350 feet but not more than
500 feet, the price per foot beyond 350 feet becomes, per foot . $5.90.

5. Should the undersigned bidder receive the contract he will accept
full responsibility for the job and will not hold the City of
El Segundo or its officers in any way liable for anything which
may•happen during the course of the work on said Well No, 5.
Furthermore, no part of this contract will be sublet without
permission of the City Council of the City of El Segundo. Any
revision of the terms of this bid or the contract, if it is let to
this bidder, will be with the full knowledge and consent of the
contractor herein bidding and the City of E1 Segundo through its
properly authorized executive-body or person.
Should I be awarded the contract, I will start work within ten days
after execution of contract and will complete 350 feet of well
within thirty days thereafter. I will drill the well straight and
plumb 4nd will drive the casing straight and plumb.
Undersigned bidder will furnish accurate log of the strata of the
well upon completion of the well.,
Pef'forations will be accomplished in aonformance to instructions of
the City Engineer and the perforator will be equipped with a seam
finding devide to prevent perforations at the seams.

I will hire and put on the job an experienced driller perfectly
competent to take care of any eventualities which might arise,
and prevailing wages for this job will be in conformance to
paragraph in specifications pertaining to wages.

called your water well No. 5; and we beg to submit herewith
our proposal for "the drilling of your well in strict compliance
with the specifications.
We will furnish complete well drilling machinery with
competent men 'to operate same, together with
1 16" x 12" x 1" shoe,
121 16" #10 ga. three ply starter,
81 16" #10 ga. two ply starter,
330* 16" #10 ga. double well casing,
all oil and red lead for the painting of the casing as it is in
installed in the well, and drill, paint, case, perforate and sand -
pump well in good and workmanlike manner to the depth of 350 feet

of the well, with a capacity of 1,0001gallons per minute, together
with s4table motor and switchboard,tand operate this equipment with
neregy to be furnished by yourselves, and develop and test your well
for a period of 48 hours for $350.00. For such period of time as

type of openings is used exclusively by this company and enables us
to cut safely materials which would ordinarily have to be excluded
from'perforating.'

Hutchins, Superintendent of the Water Department, for report at said meeting.

ORAL COM1JUNICATIONS.
Mr. H. Zettlemoyer and Mr. A. Comstock each addressed the Council
seeking employment by the City and each was instructed to confer with the
Street Superintendent at a future date.
REPORTS OF STANDING COAR,4ITTEES.
Councilman Gerow reported that Mr-, Cecil Moore, residing at 212
Virginia Street, had requested removal of a tree from in front of said premises.
Moved by Mayor Binder, seconded by Councilman Selby, that the Street Superin-
tendent be and he is hereby instructed to remove said tree in accordance with
said request. Carried.
Councilman Gerow reported that Mike Roncevich had requested to be
furnished -a long handled fork for use in the performance of his work at the
can dump.
REPORTS OF OFFICERS AND SPECIAL CObiM,TITTEES.
The City Clerk reported that Mr. Coddington desired 150 feet of hose
for use in the prosecution of his work•at the baseball grounds. By general
consent the matter was referred to the Street Superintendent to see whether or
not a lesser number of feet would suffice if the locations -of hose connections
are changed.
The City Clerk inquired whether or not it was the Council's desire to
discontinue lighting service at the night baseball grounds and by general consent
was instructed to have the service discontinued.
. The City Clerk advised that Western Casualty and Surety Company, the
present insuror af.the motor vehicles-of the City of E1 Segundo, had requested
the acceptance by the'City of a certain endorsement annexed to the policy and,
that he had referred the matter*tb the Attorney foran opinion.
_.City Attorney Woodworth thereupon.advised that the effect of the
endorsement was to agree that in event of a motor vehicle accident involving
motor vehicles of the City of El Segundo, resulting is damage to the property
of another, the City would give immediate written notice to the-Company and
the City or its representative would not negotiate for settlement or settle
any claim involving such damage without the written consent of the Company.

It appearing that by an inadvertence in such matters the policy might
be voided and it appearing also that through the procurement of property
damage insurance on the vehicles involved, the endorsement referred to
would be eliminated from the policy, it was moved by Councilman Selby,
seconded by Councilman Hesser, that the City Clerk be and he is hereby
authorized and directed to procure property damage insurance on all of the
motor vehicles described in Policy PA 22621 of the Western Casualty and
Surety Company not now covered for property damage indemnity and to have
cancelled from said policy the public liability and property damage insurance
on that certain 1927 Dodge touring car, Motor No, D 971330 described in
said policy, the net cost of such additional insurance to the City not to
exceed the sum of $65.00. Carried by the following vote:
Ayes: Councilmen Gerow, Hesser, Selby and Mayor Binder.
Noes: Councilmen None.
Absent: Councilman Love.
The Water Superintendent reported that it is his desire to employ an
experienced water treatment plant operator for a period following the
beginning of operations at the water treatment plant and that Mr. Carl
Wilson, water technologist now employed by the City, had recommended a
man from the water treatment plant of the City of Coronado..
It was thereupon moved by Councilman Hesser, seconded by Councilman
Gerow, that the superintendent of the Water Department be and he is hereby
authorized to procure the services of an experienced water treatment plant
operator at the water treatment plant of the City of E1 Segundo, and to
report to this Council the name of the person so employed and other
conditions or matters effecting such employment. Carried by the following
vote:
Ayes: Councilmen Gerow, Hesser, Selby and Mayor Binder.
Noes: Councilmen None.

The Superintendent of the Water Department submitted to the Council
a form of letter he proposed mailing to consumers of the municipal Water
Department, advising of the commencement of operations of the water
treatment plant on November 7th, 1938.
Moved by Councilman Gerow, seconded by Councilman Selby, that the
Water Superintendent be authorized to mail notices of the commencement of
operations of the water treatment plant of the City of El Segundo on
November 7th, 1938, to the consumers of said Department. Carried by the
following vote:

The Mayor announced that on December 2nd, 1938, pursuant to his

The matter of the construction of a fence around the water treatment plant
of the City of El Segundo was discussed, terminating in the matter being referred
to the Water Superintendent for the purpose of obtaining prices for erecting same.
Councilman Gerow initiated discussion relative to providing a recreation
hall for the elderly unemployed people of the community; the other Councilmen
concurring in the recommendation, directed Councilman Gerow to investigate
possible locations, rental and other costs of initiating and maintaining a
recreation hall; after which it wqs moved by Mayor Binder, seconded by douncilman
Gerow, that the City Clerk be and he is hereby authorized and directed to write
El Segundo Recreation Commission, advising it that the City Council of the City
of El Segundo is considering sponsoring a recreation hall for JdJam= elderly.
persons of the City of El Segundo and asking said Commission to give the
matter some thought and submit such suggestions or recommendations as to it
seem appropriate. Carried. ,

moved by Councilman Gerow, seconded by Councilman Selby, the meeting adjourn.
