A regular meeting of the City Council of the City of E1 Segundo, California,
vras called to order at 7:00 o'clock P. M. on the above date, in the Council
Chanber of the City Hall of said City, by Peter E. Binder, Mayor.

The :minutes of the regular meeting held on the 17th day of August, 1938,
were read. No errors.or omissions appearing, it was moved by Councilman
Love, seconded by Councilman Hesser, the minutes be approved as read. Carried.

The following corm=ications, which were read to the Council, were
disposed of in the manner indicated following the reference to each hereinafter:
., LICATION OF =DON J. BEAT, for employment by the City of El Segundo.
Ordered filed.
RICHFIELD-OIL CORPORATION, dated August 18th, 1938, advising that it
has abandoned its E1 Segundo No. 4 17ell in-the South half of the Northeast
quarter of Section 8, Township 3 South, Range 14 ,lest, in accordance with
the rules and regulations of the Oil and Gas'Supaa-visor of the Division of
Natural Resources of the State of California, and has removed its derrick and
restored the surface of the ground. Ordered filed.
R. E. L 11 AN, dated August 14th, 1938, expressing appreciation for
the consideration shown him by giving him casual employment while hw was a
resident of the City of E1 Segundo. Ordered filed.
H. L. BYRAM, County Tax Collector, dated August 17th, 1938, making
demand upon the Council to provide funds for the payment of all delinquent
assessments for all 1915 Improvement Bond Act projects, for which current
assessments have terminated, but which have delinquent assessments for prior
years still outstanding. '
It appearing upon report of the City Clerk that sufficient monies
remain in the several 1915 Bond Act Interest and Redemption Funds to take
care of outstanding indebtedness, the communication was ordered filed.
ANGELO J. ROSSI, mayor, City of San Francisco, dated August 19th,
1938, inviting the support of the delegates of the City of El Segundo who
may. attend the 1938 Convention of. %the League of California Municipalities,
in San Francisco's endeavor to obtain the 1939 convention of said League.
Follo -ring discussion, it was -moved 'by Mayor Binder, seconded by Councilman
Gerow, that such representative or representatives of the City of E1 Segundo
who may attend the 1938 Convention of the League of California municipalities,
be privileged to use his or their judgment in voting upon the 1939 Convention
City of said League. Carried.'
STATE COP;I.'ENSATION INSDR X-IT, FUND, dated August 18th, 1938, referring
to Case No. 714482, advising that after careful consideration of the facts,
neither the City of E1 Segundo nor the State Compensation Insurance Fund
has any liability and that the injured has been advised of his right to
file an application for hearing with the Industrial Accident Commission

should he not be satisfied with the decision. Ordered filed. -
STATE COIEP14=5ATION INSTT92-NCE 17UND, dated August 20th, 1938, with
refArence to Case No. 714873, advising that thorough consideration of the
circumstances surrounding the condition of the man reported in this case,
has convinced said Fund that neither the City of El Segundo nor the State
Compensation Insurance Fund has any liability as the condition reported
did not arise out of the injurecd's employment; that the assured has been
advised of his right to apply to the Industrial Accident Commission for
a hearing if he does not agree with that decision. Ordered filed.
RICHFIELD OIL CORPORATION, dated August 19th, 1938, applying for a
permit to excavate in the :.public streets for the purpose of installing a
4" gas pipe line.
In connection therewith the City Engineer recommended that that portion
of the line to be laid in Grand Avenue and paralleling the Northerly line
thereof be laid in a line 17 feet Northerly of the center line'of Grand
Avenue instead of 25 feet Northerly thereof as requested in the application.
It*was moved by Councilman Gerow, seconded by Councilman Hesser, that
the following resolution be adopted:
RESOLVED, that the application of Richfield Oil Corporation, dated
August 19th, 1938, for permission to install one 4" gas pipe line
in Grand Avenue on a line 25' North of the center line thereof,
beginning at a point 9 feet Nesterly of the Center line of Oregon
Street, thence West and parallel with the Northerly line of
Grand Avenue a distance of 500 feet to a point, thence Northerly
to the Northerly property line of said Grand Avenue, be received
and placed on file;
AND BE IT FURTHER RESOLVED,'that permission to.so install
said line be and the same is hereby granted upon the following
terms and conditions, to -wit: -
1. "That said pipe line shall be laid in Grand
Avenue on a line 17 feet'North of the center line
thereof beginning'at a point 9 feet'Westerly of the
center line of Oregon Street, thence Vilest and parallel
with the Northerly line of Grand Avenue a distance
of 500 feet to a point; thence Northerly to the
Northerly property line of said Grand Avenue, instead
of at the vocation set forth in the application'
hereinabove referred to.
2. 'This permit is temporary only and may be revoked
at any time by the City Council of the City of E1
Segundo, without notice, without cause and withdut
liability and must be accepted by'the permittee
accordingly.
3, In the event this permit is revoked, then and
in that .event the said permittee; at its own expense,
shall cause any facilities installed hereunder to be
immediately removed from said streets and shall restore
the streets and the surface thereof to the same condition,
as nearly as the same cdn be done, in which the same
existed immediately prior to the making of any excavation
or'the doing of any work Hereunder.
4. That any work hereunder, excavations, trenches or
earth piles or other obstructions shall,be properly and
.adequately protected by,barriers, lights and /or other
protective means or devices` so as to prevent injury to
persons or property in the vicinity.
5. That the permittee, by accepting this permit or
doing any work thereunder, shall thereby automatically
agree to indemnify the Citt of E1 Segundo and each and
all of its officers, agents, servants and employees from
and against any and all damages and liabilities

or claims of or for damages or liabilities which may
arise out of the doing of any work under this permit,
or as the result of any act or omission on the part
of said permittee, its officers, agents, servants or
employees or persons under contract with it.
6. That all work must be prosecuted to the satis-
faction of the City Engineer and Street Superintendent
of said City and all materials -must likewise be of `
character, dimension and material satisfactory to said
Engineer and must be located and installed in accordance
with the instructions of such City Engineer and Street
Superintendent.
7. Before commencing any work under this permit, the
permittee shall give to the City Engineer and Street Super-
intendent sufficient and adequate notice of the time when
such work is to commence ,`so as to permit said City
Engineer and Street Superintendent to be present or to
have some person delegated by him in attedance thereat,
for the purpose of inspecting the same and giving instruc-
tions with reference thereto. Such direction and in-
struction by said City Engineer and Street Superintendent
or on his behalf shall not be deemed in any sense as making
the permittee the agent off' the City or of any officer there-
of, nor shall such direction or control be construed in any
manner whatsoever to be such as to constitute said permittee
or any agent, servant or employee of said permittee an
employee of said City, within the meaning of the Workmen's
Compensation Insurance and Safety Act'of the State of
California.
8. That this permit is an interim permit only and the
City Council reserves the right to fix additional and
different conditions ana terms at anytime in the future
in connection with said installation or the maintenance or
use of the facilities installed hereunder.

The City Clerk reported that in February, 1938, a vehicle operated by
Johnson T'ran`sportation, Inc., Lain Office, B43 cl �- Yfornia; -hiod damaged
a city sign at the corner of ,Sepulveda BouYe'vgrd and El Segundo Boulawhrd;
that a bill for repairs amounting to $17.11 had been sent "to said Compete
correspondence exchanged on several occasions, but that the bill remains un46 -
It was thereupon moved by Councilman Hesser, seconded by Councilman
Love, that the matter . of collecting from Tohnson Transportation, Inc., Bakersfield,
California, the sum of $17.11, due the City of E1 Segundo for repairing a
traffic sign damaged on or about February 4th,.1938, be and the same is hereby
referred to the City Attorney of the City of E1 Segundo for collection. Carried.
The City Clerk reported that -three toilet flush valves in the City Hall
building are out of order and"that inasmuch as they"are an'old style valve,
difficult and expensive to repair, he reconmended that they be replaced with
a later type valve; that the cost of new installations would not exceed $36.00:
Moved by Councilman Gerorr, seconded by Councilman Hesser, that the
Street Superintendent be authorized and directed to purchase three toilet flush
valves for use in the City Hall and to cause the same to be installed, all
at a cost of not to exceed 36.00. Carried by the following vote:

SPECIAL ORDER OF BUSINESS.
The hour of 7:30 o'clock P. I:"_, at this meeting having heretofore been
fixed as the time and date for considering bids heretofore received by this
Council for purchasing garbage collected by the City of E1 Segundo, the Mayor
announced the arrival of said hour and stated that the Council would proceed
with the consideration of said bids.
Thereupon the Council proceeded to and did consider said bids,
following which it was moved.by Councilman Love, seconded by Councilman Gerow,
the following resolution be adopted:
ti4'��AS, the City Council of the City of El Segundo,
California, has received bids under that certain "Notice to
Bidders on Garbage ", dated the'22nd day of July, 1938;
AND SEAS, said Council has duly considered all
bids received and the locations of the disposal places
submitted in'said bids and all other factors entering into
such consideration, including a consideration of the public
peace, health and safety;
AND, ;00EAS, after such consideration said Council
deems that the Public interest and general welfare, health
and safety of the said City and its'inhabitants would be
best served by making the award as hereinafter set forth;
N077, THEREFORE,_ BE IT RESOLVED by the City Council
of the City of El`Segundo, California, as follows:
1. That all bids or proposals received under said
notice above referred to be and the same are hereby rejected
with the exception of the bid of Luther V9. Andrews, and that
the contract for purchasing garbage- bollected by the said
City of El Segundo, referred to in said Notice, be and the
same is hereby awarded to said Luther W. Andrews for a
period of three years c'ommencing'on the 1st day of September,
1938, and at the price I as stated in said bid of said
successful bidder, to wit: $10.00 per month;
AND BE IT FURTHER RESOLVED, that in making this award,
said Council finds and determines that the public peace,
health and safety of said City require and will be best
served by making the award to said successful bidder rather
than to the other bidders in view of all phases of the
matter, including place of disposal, availability of disposal

place in times of inclement weather, character of territory
adjacent to disposal places and mann6r and method of
disposal, etc., etc.;
AND BE IT FURTHER RESOLVED, that the City Clerk be and he
is hereby authorized and instructed to return the checks of
unsuccessful bidders.

The Mayor stated that !Jr. Gharles McIlwaine, Foreman in charge of
street trees, desired to make a tour of the County to ascertain the methods
used By such cities in maintdining and propagating street trees, and the
Mayor felt that the City should bear the expense of such an inspection
trip. -
It was thereupon moved by Councilman Hesser, seconded by Councilman
Love, that Charles L. LcIlwaine, Foreman, and Kayor Peter E. Binder be
and they are hereby authorized to make a tour of inspection of the cities
of Los Angeles County, ascertaining the best methods'of propagating and
caring for street trees and parkings.,. and that they be authorized and
directed to file their demands against the City for their actual and
'necessary expenses in connection thereiith. ' Carried by the following vote:
