1938 APR 18 CC MIN0-241 El Segundo, California. April 18, 1938. An adjourned regular meeting of the City Council of the City of E1 Segundo, California, was called to order at 4 :30 otclock P. M.'on the above date, in the Council Chamber of the City Hall of said City, by Peter E. B inder, Mayor, ROLL CA.U. Councilmen Present: Gerow, Hesser, Love, Selby and Illayor Binder. Councilmen Absent: None. By general consent the regular order of business was dispensed with. WRITTEN C0IIINNICATIONS. The following communications, which were read to the Council, were disposed of in the manner indicated following the reference to each herein- after: LOS AWG=,2S COMITY LEAGUE OF MUNICIPALITIES, dated April 15th, 1938, being notification of the holding of the 84th annual meeting of the League, at Signal Hill, April 21st, at 6:30 P. Ii. Moved by Councilman Selby, seconded by Councilman Love, that Councilman Gerow and Mayor Binder be and they are hereby authorized to attend the meeting of the Los Angeles County League of Municipalities to be-held at Signal Hill, April 21st, and to file their demands for their actual and necessary expenses in connection with their attendance at said meeting. Carried by the following vote: Ayes: Councilmen Germi, Hesser, Love, Selby and Mayor Binder, Noes: Councilmen None, Absent: Councilmen None. CITY OF SIGIL -Z =11 , dated =_pril 16th, 1938, extending to the City Council and the heads of all City departments an invitation to attend the meeting of Los Angeles County League of Municipalities to be held in said City, April 21st, 1938. Ordered filed. T. G. PIMMY, dated April 18th, 1938, being an application to move a one story corrugated iron building from its present location within the City of E1 Segundo to a point outside of said City. Moved by Councilman Gerow, seconded by Councilman Hesser, that J. G. Pitney be and he is hereby granted permission to move a one story, corrugated iron building from its present location in a portion of Block 114 within the City of El Segundo to a point outside of said City, over and along the following route, to -wit: Easterly on L:ariposa Avenue to Sepulveda Boulevard, Southerly on Sepulveda Boulevard to El Segundo Boulevard, Easterly on E1 Segundo Boulevard to the Easterly City Limits; provided said building is moved upon dollies, with wheels having a tread conforming in all respects to the provisions of the Motor Vehicle Code; provided further, that said building is removed between the hours of 7:00 I.:. and 8:30 A. T' on the 19th day o April, •1938, anti that such removal in.•all respects i_s.conducted to the satisfaction of the,Street Superin- tendent of the City of El Segundo, and that the perruttee shall notify the Police Department of said City prior to the commencing of such removal, so that adequate police protection may be rrovided for vehicular traffic during the course of such removal. Carried by the following vote: Ayes: Councilmen Gerow, Hesser, Love, Selby and Mayor Binder, Noes: Councilmen None. Absent: Councilmen None. -�24Z The City Clerk reported that the returns of the General h'Ianicipal Election held on Tuesday, the 12th day of April, 1938, in the City of El Segundo, California, were then, and had been, in his possession in the envelopes containing then, in the same condition as when received. Said Clerk then presented said returns to the City Council at this time at this meeting. It was thereupon moved by Counci]r:an Selby, and seconded by Councilman Love, that the City Council proceed forthwith to canvass said 'returns. The said notion was carried and adopted by the following vote: Ayes: Councilmen Gerow, Hesser, Love, Selby and Mayor Binder; Noes: Councilmen None; Absent: Councilmen None. Said notion having carried, the City Council then proceeded forthwith to publicly examine and canvass the said returns, all as provided by law, and upon the completion of said canvass by said Council, it was moved by Councilman Hesser and seconded by Councilman Love, that the following resolution be adopted: there was held and conducted in the City of El Segundo,* County of Los Angeles, State of California, on Tuesday, the 12th day of April, 1938, a General Municipal Election of the qualified electors of said City, under, pursuant to and as required by, the provisions of the laws of the State of California relating to cities of the sixth class, for the purpose of electing the following officers of said City, to -wit: nvo members of the City Council of said City for the full term of four (4) years; AIM, IUMEREAS, there was also submitted to the electors at said election, the following proposition, to -twit: "Shall each member of the City Council of the City of El Segundo, California, hereafter receive the sum of $50.00 per month (instead of $25.00 per month as at present provided), as compensation for his services as such member ? "; AIM MIEREAS, it appears that notice of said election was duly and legally given; that there were six (6) voting precincts established within the said City for holding said election, consisting in all instances of the regular election precincts established for holding general State and County elections, as established by the Board of Supervisors of Los Angeles County, California; that election officers were appointed and election supplies furnished; and that in all respects said election was held and conducted and the votes cast thereat received and canvassed and the returns thereof made and declared in time, ford and manner as required by the provisions of the laws of the State of California relating to cities of the sixth class and pursuant to all lairs of said State and of said City in such case made and provided; AITD ;'EREAS, the City Council of the said City of El Segundo, met at the Council Chamber of the said Council in the City Hall of said City on T.?onday, the 18th day of April, 1938, as provided by law, beginning at the hour of 4:30 o'clock-P. M., of the said day, to canvass the returns o f said election and declare'the results thereof, whereupon the said Council: found that the number of votes cast; the names of the persons voted for; the office to fill which each person was voted for; the proposition voted upon; the results of said election; and the other natters required by law, to be as hereinafter stated; NOW, THr 23FORE, THE CITY COUNCIL OF THE CITY OF EL SSMTDO, CALIFORNIA, DOES Y RESOLVE, DEC LTA E «i:D DETEt Z—] AS FOLLOI -13: r C C 0-243 That said General Municipal Election Eras held and conducted in said City of El Segundo, California, on Tuesday, the 12th day of April, 1938, in time, for!- and manner as required by law; That there were six (6) voting precincts established within the said City for the purpose of holding said election, consisting in all instances of the regular voting precincts established by the Board of Supervisors of Los Angeles County, California, for the holding of general State and County elections, as follows: Voting Precinct "A" comprising State and County Precinct No. 1, the polling place of which was in the brick dwelling house located at No. 844 Loma Vista Street, in said City; Voting Precinct "B" comprising State and County Precinct No. 2, the polling place of which was in the frame dwelling house located at Ido. 826 I.iain Street, in said City; Votinc- Precinct "C" comprising State and County Precinct No. 3, the polling place of which ti•,ras in the frame dwelling house located at No. 540 Sheldon Street, in said City; Voting Precinct "D" comprising State and County Precinct Ido. 4, the polling place of which was in the Council Chamber of the City Hall of the City of E1 Segundo, located at No. 203 Rielunond Street in said City; Voting Precinct "E" comprising State and County Precinct ITO. 5, the polling place of which was in the frame dwelling house located at No. 230 Virginia Street, in said City; and Voting Precinct "F" comprising State and County Precinct Ido. 6, the polling place of which vras in the frame dwelling house located at No. 518 Loma Vista Street, in said City. HESSER eras elected to the office of Councilman of the City of E1 Segundo, California, for the full term of four years; ATTD BE IT FURTHER RESOLVED, MCLARED AM M=.M= that at the said election, and as a result thereof,* the following proposition was rejected and that the same was not carried or adopted, to wit: "Shall each member of the City Council of the City of El Segundo, California, hereafter receive the sum of $50.00 per month (instead of $25.00 per month as at present provided), as compensation for his services as such member ? ", and that therefore no further proceedings shall be had or taken with reference to the said proposed amendment as a result of said election; AND BE IT FURTHM RESOLVED that the City Clerk shall enter on the records of the City Council of said City, a statement of the result of the said election showing: (1) The whole number of votes cast in said City of E1 Segundo; (2) The number of votes cast by absentee voters; (3) The total number of votes cast inclusive of both the votes cast•at the various precincts and the votes cast in absentee voters' ballots; (4) The names of the persons voted for and the proposi- tion voted upon; (5) The office .to fill which each person eras voted for; (6) The number of votes given.at each precinct to each of such persons for each of such offices; (7) The total number of votes given in said City of E1 Segundo to -each of such persons for each of such offices; (8) The number of votes given in absent voters' ballots to each of such persons for each of such offices; and (9) The total number of votes given in said City and in absent voters' ballots to each of such persons for each of such offices; AND SAID CITY COUNCIL DOES HEREBY r URTfD;R RESOLVE, DECLARE, DETER ME AND DIRECT; (A) That the City Clerk shall immediately make and deliver to each of such persons so elected a certificate of election • signed by him-and-duly authenticated, said edrtificates,to certify respectively as follows: (a) That PEAR E. BITER was elected as a member of the City Council of the 61-4y of El Segundo, Calif- ornia, for the full term of four (4) years; and (b) That CREST 0. BESSER was elected as a member of the City Council of the City of El Segundo, Calif- ornia for the full term of four (4) years; JZ40 (B) That said City Clerk shall also impose the constitutional oath of office upon the said PETER E. BINDER and OREST 0. HESSER, so elected to said respective offices and have them subscribe thereto and file the same in his office; (C) That thereupon each and all of said persons so elected to said respective offices shall be inducted into the said respective offices to which they have respectively been elected. The City Clerk then delivered a Certificate of Election to and imposed the Constitutional Oath of Office upon Peter E. Binder and Orest 09 Hesser, Councilmen elect, and each subscribed to said oath. At this time Peter E. Binder, and Orest 0. Hesser assumed their respective offices and took their seats at the Council table, and the Council as thus constituted, consisted of: Councilman Peter E. Binder, Orest 0. Hesser, George Love, William R. Selby and John A. Gerovt, all of whom were present. Discussion was had with reference to the organization of the Council and it appearing that the Council desired to take up said matter at its next meeting, it was regularly moved, seconded and unanimously carried, that pending its re- organization, the Council as presently constituted continue to function until the next meeting of this Body. No further business appearing to be transacted at this meeting, it was noved by Councilman Selby, seconded by Councilman Love, the meeting adjourn. Carried.'
